Abstract

Kebijakan Dana Desa merupakan instrumen strategis negara dalam mendorong pemerataan pembangunan dan pengurangan kesenjangan antarwilayah, khususnya antara desa dan perkotaan. Secara normatif, Dana Desa dihadirkan sebagai perwujudan politik hukum pembangunan yang berorientasi pada prinsip desentralisasi, keadilan sosial, serta penguatan otonomi desa sebagaimana diamanatkan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Namun dalam praktiknya, implementasi Dana Desa masih menghadapi berbagai persoalan struktural, regulatif, dan kelembagaan yang berpotensi menghambat terwujudnya pemerataan pembangunan secara substantif. Penelitian ini bertujuan untuk menganalisis politik hukum Dana Desa dalam mewujudkan pemerataan pembangunan di Indonesia, dengan menelaah arah kebijakan, desain regulasi, serta implementasi Dana Desa dalam kerangka negara kesejahteraan. Fokus penelitian diarahkan pada kesesuaian antara tujuan normatif kebijakan Dana Desa dengan realitas pelaksanaannya di tingkat desa, serta implikasinya terhadap keadilan pembangunan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan historis. Data penelitian bersumber dari bahan hukum primer berupa peraturan perundang-undangan terkait Dana Desa, bahan hukum sekunder berupa literatur, jurnal ilmiah, dan hasil penelitian terdahulu, serta bahan hukum tersier sebagai penunjang analisis. Analisis dilakukan secara kualitatif dengan menekankan penafsiran hukum dan konstruksi argumentasi normatif. Hasil penelitian diharapkan mampu merumuskan model politik hukum Dana Desa yang lebih responsif dan berkeadilan, serta memberikan rekomendasi normatif bagi perbaikan kebijakan Dana Desa agar benar-benar berfungsi sebagai instrumen pemerataan pembangunan dan peningkatan kesejahteraan masyarakat desa secara berkelanjutan.

Abstract

Abstract: The reconstruction of Indonesian legal theory, which is dominated by positivism and legal formalism, creates a gap between legal certainty and substantive justice. This dominance ignores the moral and social dynamics of society and presents the law as a tool for legitimizing power. This study uses doctrinal law research methods to analyze the synthesis of rationalism, empiricism, and pragmatism within the framework of national legal theory. The findings show that rationalism provides a structural foundation through Joseph Raz’s conception of legal authority; empiricism catalyzes harmony among Indigenous law, Islam, and the West, grounded in social realities; and pragmatism encourages flexible reforms, such as the Omnibus Law, but risks reducing democratic principles in Indonesia. New Legal Realism (NLR) is proposed as an integrative framework that combines normative, empirical, and realist analysis to produce responsive legal findings. This paper is expected to contribute to the development of dynamic legal theory through a double movement: the extraction of the universal meaning of norms, accompanied by empirical contextualization, and the emphasis on the need for interdisciplinary legal education reform and the strengthening of democratic institutions.

Abstract

This paper examines in depth the dynamics of default in the Peer-to-Peer (P2P) Lending fintech industry in Indonesia and Malaysia, with a review from the perspective of Islamic Economic Law. Fintech has become a crucial tool for financial inclusion, but it also increases default risk, especially among young people. The research used is normative legal research with a comparative approach. This study describes how the two countries respond to these challenges through the harmonization of positive law and Sharia principles. Key findings show a glaring regulatory gap between the two countries. In Indonesia, legal protection for the parties remains weak because the DSN-MUI fatwa has not been fully integrated into binding positive law, and there is no efficient dispute-resolution mechanism. The phenomenon often leads to unethical billing practices and privacy violations, which are contrary to the principles of maslahah and muamalah ethics. In contrast, Malaysia features a more mature ecosystem, with strict personal data protection under the Personal Data Protection Act (PDPA) and effective financial dispute mediation institutions. Within the framework of sharia, this study highlights the relevance of the principle of justice as enshrined in QS. Al-Baqarah: 282. The study concludes that to mitigate the impact of defaults and ensure profitability, Indonesia needs to reform its regulations by adopting aspects of Malaysia’s fintech laws, enforcing digital ethics, and providing cheap, fast online dispute resolution to balance rights between creditors and debtors.
