Abstract

The aim of the research is The Validity of Marriage Using Telecommunication Media (Teleconferencing) Based on Law Number 1 of 1974 concerning Marriage. In this legal research, the author uses a legal research approach, namely a statutory (statue) approach approach), case approach (case approach), conceptual approach ( conceptual approach ). Legislative approach ( statue approach ) is carried out by reviewing the laws and regulations relating to issues that are in accordance with the legal issues in the case related to this research. In this thesis, the researcher takes a case study of marriage via teleconference media in Kalimantan west. The result of From the description of the discussion in chapters I to chapter IV above, the researchers draw the following conclusions the validity of Marriage Using Telecommunication Media (teleconference) as stated in Article 2 paragraph (1) that "Marriage is valid if it is carried out according to the laws of each religion and belief". Marriages using telecommunications media specifically in Indonesia are not yet regulated, therefore marriages or marriage contracts via teleconference are considered valid if they meet the requirements and harmony. Marriage via teleconference is basically the same as the implementation of marriage contracts and marriages in general, but the difference is that the implementation of marriage contracts and marriages via telecommunications is in a different assembly (long distance) or the marriage ceremony is carried out via telecommunications equipment which can be seen in pictures and can be heard. his voice. And then Obstacles faced during marriages using telecommunications or teleconference media include the bride and groom not being in a place or assembly, thus hampering the process of signing the marriage certificate, implementation towards the parties recording marriage nor KUA office. Abstract

Sistem hukum Republik Indonesia dalam proses penegakan mengenai asas yang tidak boleh dilangggar atau dikesampingkan, yang artinya pada dasarnya setiap orang yang melanggar hukum pasti akan diberikan sanksi yang telah dibuat. Penyimpangan terhadap kaidah hukum dibagi menjadi dua yaitu, penyimpangan terhadap kaidah hukum atas dasar yang sah yang maksudnya berupa ‘Pengecualian’ artinya kaidah hukum yang dapat disimpangi karena terdapat pengaturan hukumnya. Tindak pidana di bidang perpajakan adalah pelanggaran terhadap aturan undang-undang perpajakan yang menimbulkan kerugian keuangan negara dan orang yang melakukan tindak pidana dapat dituntut secara pidana. Pelanggaran perpajakan yang paling banyak terjadi di Indonesia adalah kasus faktur pajak pertambahan nilai (PPN) yang tidak valid. Di Indonesia, masih banyak penghindar pajak yang menggunakan faktur pajak tidak berdasarkan nilai transaksi sebenarnya. Hal ini berpotensi menyebabkan hilangnya pendapatan negara, bahkan mungkin hingga trilliun rupiah. Ketentuan mengenai tindak pidana terhadap faktur pajak tidak sah di dasarkan pada Pasal 39A Undang-Undang Nomor 28 Tahun 2007 tentang Perubahan Ketiga atas Undang-Undang Nomor 6 Tahun 1983 tentang Ketentuan Umum dan Tata Cara Perpajakan. Problem hukum yang perlu menjadi perhatian di masa datang adalah pengaturan dan penegakan hukum mengenai penyelesaian sengketa pajak yang berpotensi merugikan terhadap pendapatan negara dan tindak pidana di bidang perpajakan khusunya tentang tindak pidana faktur pajak yang tidak sah

Abstract

The purpose of this article is to make a positive contribution in promoting justice, understanding, and innovative solutions in the context of inheritance and testamentary divisions, particularly in situations involving children from first marriages and wives from second marriages. An in-depth article on the complexities of the division of inheritances and wills, in particular involving children from first marriages and wives from second marriages, qualitative research methods can be used. Qualitative research methods aim to understand phenomena in depth, exploring individual perspectives, values, and experiences related to the topic under study. Literature reviews of related scientific articles to provide reinforcement and ultimately the article offers a conceptual framework model of research results. The division of inheritances and wills is a complex topic, involving various aspects of law and social practice. In diverse societies, the process of inheritance sharing often reflects different cultural and religious values. However, in the context of globalization and modernization, there are challenges in harmonizing traditional practices with more inclusive modern laws. It is important to understand that the division of inheritances and wills is not only a legal issue, but also reflects complex social dynamics. Factors such as cultural norms, religious beliefs, and family structure can influence how inheritances are divided and wills are made.

Abstract

The existence of Law of the Republic of Indonesia Number 5 of 2014 concerning State Civil Apparatus is different from previous civil service laws. Therefore, it is very interesting and important to study further regarding what legal ratios regulate Government Employees with Work Agreements (PPPK) to replace the existence of non-permanent employees in the Indonesian civil service system in Law Number 20 of 2023 concerning State Civil Apparatus? and how to implement the protection of the rights, obligations and responsibilities of Government Employees with a Work Agreement (PPPK) within Government agencies within Indonesian civil service law. To answer these problems, normative juridical legal research methods are used with statutory and conceptual regulatory approaches. Data obtained from primary, secondary and tertiary legal material sources were collected and then analyzed using qualitative data analysis techniques. From the research results, it was found that when the law came into force on October 31 2023, Law Number 5 of 2014 concerning State Civil Apparatus was revoked and declared invalid. What's new is what you need to know about the provisions of Law Number 20 of 2023: a) The 2023 ASN Law provides the same rights for civil servants and PPPK; b) there are no longer the terms Central Civil Servants and Regional Civil Servants; c) Certain ASN positions can be filled by TNI soldiers and members of the Republic of Indonesia Police; d) ASN Employee Rights; e) ASN employees can be dismissed if they do not perform; f) Honorary honorary appointments are not permitted; and g) Non-ASN employees or other names must have their arrangements completed no later than December 2024 and from the time this Law comes into force. The facts on the ground are that there is still a lot of discriminatory treatment for PPPK ASN.

Abstract

The development of prostitution with social media intermediaries (online prostitution) is becoming lively, the percentage is increasing and the development is rapid. Prostitution activities have never experienced a degradation in the number of activities, but have always increased in number every year and this is a criminal act with old cases wrapped in a new way due to sophisticated technology. This research is a normative legal research method (Yuridis Normatif). The researcher examines how the regulation of the criminal act of online minor prostitution in Indonesian criminal law and what considerations the Panel of Judges in the Serang District Court Decision Number 563/Pid.Sus/2023/PN.SRG imposed punishment on the defendant. It can be concluded that the regulation of online child prostitution cases in Indonesia gives rise to a vague norm, namely the vagueness of norms because there are laws and regulations whose meaning is unclear and there is no detailed explanation of the existing articles so that they are prone to multiple interpretations. The judge's consideration used in resolving the case was correct because the defendant's actions fulfilled the elements in the indictment. However, the judge overruled several regulations, especially the ITE Law regarding the crime of prostitution through electronic media. It is necessary to systematically re-regulate online prostitution of children, especially in the Criminal Code. This regulation needs to involve good cooperation between the Attorney General, Police, State Cyber and Crypto Agency (BSSN), Communication and Information, Indonesian Child Protection Commission (KPAI), National Human Rights Commission, Ministry of PPA, Ministry of Social Affairs through a memorandum of understanding between these institutions to ensure legal certainty in Indonesia.

Abstract

In disclosing narcotics crimes, the police can act according to their own judgment as long as it is within their authority. The disguised purchasing technique is one of the police's ways of uncovering narcotics crimes. Therefore, it is very interesting and important to study further about how undercover buying techniques are regulated in uncovering narcotics crimes by the National Police of the Republic of Indonesia based on Law Number 35 of 2009 concerning Narcotics? and how are undercover buy techniques implemented in uncovering narcotics crimes by the National Police of the Republic of Indonesia? To answer these problems, normative juridical legal research methods are used with statutory and conceptual regulatory approaches. Data obtained from primary, secondary and tertiary legal material sources were collected and then analyzed using qualitative data analysis techniques. From the research results it was found that Article 79 of the Narcotics Law no. 35 of 2009. Protection for the implementation of covert purchasing techniques is also basically protected by the Criminal Procedure Code and the Police Law. undercover purchase method (Undercover Buy) by investigators, namely the role of covert purchase techniques in disclosing narcotics crimes is in the process of investigating narcotics crimes which is justified by law, namely Law no. 35 of 2009 concerning Narcotics.

Abstract

Kegiatan Pengabdian Kepada Masyarakat (PKM) yang dilaksanakan oleh Program Studi Strata Satu (S1) Ilmu Hukum Fakultas Hukum Universitas Dirgantara Marsekal Suryadarma menggunakan model penyuluhan hukum dalam bentuk sosialiasasi hukum. Tujuan PKM adalah meningkatkan pengetahuan dan pemahaman hukum warga masyarakat tentang Kekerasan Dalam Rumah Tangga (KDRT). Sosialisasi dilaksanakan di Rukun Warga (RW) 08, Kelurahan Halim Perdana Kusuma, Kecamatan Makasar, Jakarta Timur pada tanggal 15 Juli 2024. Sosialisasi dilakukan dengan metode ceramah dan tanya jawab disertai kuisioner pretest dan postest. Dari kegiatan disimpulkan pertama warga antusias memberikan pertanyaan dan juga Pernyataan berkaitan dengan KDRT, dan kedua dari lembar kusioner yang dibagikan dapat diketahui warga memperoleh tambahan pengetahuan hukum tentang pengertian, jenis atau bentuk, upaya pencegahan dan penanganan KDRT, serta ketiga warga juga menyampaikan harapan agar kegiatan ini dapat dilakukan berkelanjutan setiap tiga atau enam bulan sekali, agar warga memperoleh pengetahuan dan pemahaman hukum akan persoalan-persoalan yang timbul dalam kehidupan sehari-hari. Namun demikian masih perlu perbaikan agar alokasi waktu untuk setiap materi sosialisasi dan tanya jawab materi sosialisasi antara narasumber dengan peserta cukup, agar warga dapat merasakan adanya pemahaman akan semua jenis materi sosialisasi.   Community Service Activities (PKM) carried out by the Undergraduate Program (S1) of Law, Faculty of Law, Universitas Dirgantara Marshal Suryadarma used a legal counseling model in the form of legal socialization. The purpose of PKM is to increase residents' knowledge and legal understanding regarding Domestic Violence (KDRT). The socialization was conducted at the Community Association (RW) 08, Halim Perdana Kusuma Village, Makasar District, East Jakarta on July 15, 2024. The socialization was carried out using lecture and question-and-answer methods accompanied by pretest and posttest questionnaires. From the activity, it was concluded that first, residents were enthusiastic about providing questions and statements related to domestic violence, and second, from the questionnaire sheets that were distributed, it can be seen that residents gained additional legal knowledge about the definition, types or forms, efforts to prevent and handle domestic violence, and third, residents also expressed their hope that this activity can be carried out continuously every three or six months so that residents gain legal knowledge and understanding of the problems that arise in everyday life. However, improvements still need to be made so that the time allocation for each socialization material and questions and answers for socialization material between resource persons and participants is sufficient so that residents can feel that they understand all types of socialization material.

Abstract

The transfer of land rights to purchase and sell land must be conducted under the supervision of an authorized official, commonly known as a Land Deed Official (PPAT) in this context. The authority to execute a legally binding land deed is vested in a Notary. Nevertheless, in this instance, notaries are prohibited from drafting deeds pertaining to land unless they have successfully completed the requisite examination to become a Land Deed Official (PPAT). Furthermore, deeds may be made by the subdistrict head, who acts as a temporary PPAT. The methodology employed by the author is normative legal research (doctrinal legal research). Normative legal research is a form of pure normative legal research, in which the problem under study is a legal scientific one, such as those pertaining to justice, order, and the agreement of will, among others. This research does not concern itself with the legal facts that exist in society. The findings of this research indicate that the role of a notary in the process of making a land sale and purchase deed is limited to the pre-sale of land or the making of an agreement between the seller and the buyer. It can be concluded that only a PPAT (land deed official) is authorized to prepare and execute a land sale and purchase deed.

Abstract

The National Police plays a very important role in overcoming and enforcing the law related to narcotics crime cases. Investigators are members of the police who have duties and responsibilities in carrying out investigations into criminal acts. Investigators are responsible for gathering strong evidence to determine whether a criminal act has occurred and who is responsible for the act. In this research, we will discuss the Regulation of Narcotics Crimes and Their Investigations by Police Investigators in Indonesian Criminal Law and the Obstacles to Investigating Narcotics Crimes by Police Investigators in the Legal Area of Polda Metro Jaya for the Period 1 January 2023 to 31 December 2023. The legal research method used is normative juridical legal research methods supported by empirical data. Using a statutory approach and a conceptual approach obtained from primary, secondary and tertiary legal material sources. Regulation of Narcotics Crimes and Investigations by National Police Investigators in the Indonesian Criminal Law which is currently in force is regulated by Law Number 35 of 2009 concerning Narcotics and Investigation of Human Trafficking Crimes Based on the Indonesian Criminal Law which is currently in force is regulated in the Republic of Indonesia State Police Regulations Number 6 of 2019 concerning Criminal Investigations and on January 2 2026 regulated in Articles 609, 610 and 611 of Law Number 1 of 2023 concerning the Criminal Code. /d 31 December 2023 namely Limited Facilities and Infrastructure, Limited Human Resources for Investigators, Overlapping Authority with Other Institutions, Risks and Threats and Community Attitudes.

Abstract

Nowadays, several non-governmental organizations or NGOs have deviated and are no longer guided by the rules as they should be. These NGOs carry out their goals and functions, a handful of NGOs carry out illegal services billing and extortion carried out in the area of the NGO itself. Therefore, it is very interesting and important to study further how the criminal act of extortion by non-governmental organizations (NGOs) is regulated in Indonesian criminal law? and What were the considerations of the Panel of Judges in the North Jakarta District Court Decision Number 276/Pid.B/2020/PN Jkt.Utr in convicting the Defendant of a Non-Governmental Organization (NGO) as the perpetrator of the crime of extortion. To answer these problems, normative juridical legal research methods are used with statutory and conceptual regulatory approaches. Data obtained from primary, secondary and tertiary legal material sources were collected and then analyzed using qualitative data analysis techniques. From the research results, it was found that the criminal act of extortion with violence is regulated in Article 368 of the old Criminal Code which is still in effect at this time and the new Criminal Code, namely Article 482 of Law 1/2023 which comes into effect from the date of promulgation, namely 2026. Analysis of Decision Number 276/Pid .B/2020/PN Jkt.Utr for the criminal act of extortion committed by a Non-Governmental Organization (NGO) against Slamet Riyanto, the defendant was sentenced to 6 (six) months in prison. The things that mitigate the defendant include that the defendant has never been punished, admits and regrets his actions.
