Abstract

Iron sand mining in the Dedalpak Block began in 2009 where the authority to grant mining permits ranging from mining business permits (IUP) exploration to mining business permits (IUP) for production operations was issued by the Regent of East Lombok by adhering to article 37 of Law Number 4 of 2009. However, with the enactment of Law Number 32 of 2014 Challenging Regional Governments, the authority of the iron sand mining permit was taken by the NTB Provincial Government, then with the presence of Law Number 3 of 2020 the authority for iron sand mining business licenses by PT. AMG was taken over by the Centre. In its implementation, iron sand mining by PT. AMG with the enactment of Law Number 3 of 2020 has a significant impact on the mining licensing process for iron sand production in the Dedalpak block of East Lombok, where the central government through the Director General of Energy and Mineral Resources requires thirteen conditions so that the IUP for production operations can be obtained by PT. AMG. The company, however, has not been able to meet five requirements, so its license was suspended. Another impact, the community in the Dedalpak block circle resisted by going to race through a series of protests for the mining to be closed, because it caused a large environmental impact.

Abstract

Cases of violations of child protection. Of the reports received, 837 cases occurred within the education unit, including: Children who were victims of bullying or harassment: 87 cases, Children victims of educational policies: 27 cases, Children victims of physical and/or psychological violence: 236 cases and Children victims of sexual violence: 487 cases. From data collected by the Indonesian Child Protection Commission (KPAI) and the Federation of Indonesian Teachers' Unions (FSGI), bullying cases are still a terror for children in the school environment. Meanwhile, the types of bullying that victims often experience are physical bullying (55.5%), verbal bullying (29.3%), and psychological bullying (15.2%). Meanwhile, regarding educational level, elementary school students were the most victims of bullying (26%), followed by middle school students (25%), and high school students (18.75%). The aim of this service is to provide education to participants in community service activities so that bullying does not occur at school. The method used is a socialization method carried out face to face. The results are 50%. Orphaned children do not understand the limits of bullying itself, and their rights as children and citizens, despite the social and economic disparities they have. Some of the orphanage children are still insecure about their condition of not having parents, or having incomplete parents. So they tend to tolerate what happens to them, because they are not aware of these rights and also their own condition.

Abstract

Penelitian tentang analisis disparitas pemidanaan terhadap penyuapan dalam perkara tindak pidana korupsi. Penelitian ini dibuat untuk menganalisis akibat hukum adanya disparitas pemidanaan terhadap penyuapan dalam tindak pidana korupsi. Menganalisis bagaimana upaya menimalisir terjadinya disparitas pemidanaan terhadap penyuapan dalam tindak pidana korupsi. Analisis konsep disparitas pemidanaan terhadap penyuapan dalam tindak pidana korupsi di masa depan. Pendekatan yang digunakan adalah pendekatan hukum yuridis normatif, yang bersifat deskriptif analisis. Dari data diatas maka disparitas pemidanaan dalam tindak pidana korupsi dibutuhkan komitmen semua lembaga Negara yang memiliki kewenangan dalam penanganan dan penindakan kejahatan extra ordinary crime. Tindak pidana penyuapan dalam tindak pidana korupsi merupakan pekerjaan rumah bagi penegakan hukum di dalam pemberantasan korupsi, meskipun di beberapa sektor tingkat korupsi mengalami penurunan tapi di sektor politik mengalami peningkatan. Penyebab tingkat korupsi di sektor politik mengalami peningkatan mungkin salah satu penyebabnya adalah disparitas pemidanaan dalam pidana korupsi, mengingat dengan pengenaan pasal yang sama dan kerugian yang hampir sama ketika sebuah kasus korupsi melibatkan politisi maka vonis berbeda akan dialami politisi tersebut dimana kecenderungan yang ada vonis yang dijatuhkan lebih ringan dibandingkan dengan pelaku pidana korupsi dari non politisi. Hakim ujung tombak terdepan dalam memberikan putusan yang tegas dan memberikan efek jera, maka adanya pedoman pemidanaan yang dikeluarkan dalam bentuk Peraturan Mahkmah Agung dalam pemidanaan khusus terkait dengan Pasal 2 dan Pasal 3, maka PERMA No 1 tahun 2020 tidak banyak memberikan pengaruh dalam mengurangi dampak dari Disparitas Pemidanaan yang diujung tombaknya ada pada Hakim, sehingga regulasi yang ada saling kontradisi dimana undang-undang pemberantasan tindak pidana korupsi saling Tarik ulur dengan peraturan yang ada pada KPK, Kejaksaan, Pengadilan Tipikor (Hakim), sehingga masih belum dapat menciptakan suatu peradilan yang menlahirkan keadilan dan kesetaraan hukum pemberian pidana, yang memberikan kemungkinan bagi Hakim untuk memperhitungkan berat ringannya delik. Pendekatan diatas dapat dipergunakan dalam memperkecil dampak, menimalisir disparitas pemidanaan terhadap penyuapan dalam pidana korupsi di masa depan.

Abstract

ABSTRACT Purpose of the Study: This paper aims to analyze the judicial consideration of judges in Decision No. 273/Pdt.g/2021/PA.Bkt from the perspective of benefit and justice for all parties in the murabahah and its legal consequences.  Methodology: This research used the literature review method. It used the descriptive qualitative analysis, which was conducted by profoundly reading the decision, analyzing the case, examining the appropriateness of the legal basis, and how to define them. Results: The legal considerations of judges in Decision No. 273/Pdt.g/2021/PA.Bkt are: (1) the resolution of disputes on sharia economy is the absolute authority of the Religious Court; (2) the judge assembly must maintain the legal interests and rights of the plaintiff from the actions of the defendant to undergo an auction, as well as avoiding the losses and harm that may befall the plaintiff; (3) there was an emphasis on good intentions, benefit, and justice for all parties but the judges punished the defendant to undergo rescheduling, restructuring, and reconditioning. Applications of this study: It can inspire judges to create legal reasoning that supports the aspect of legal certainty. It can inspire banks and customers to emphasize the aspects of good intention, benefit, and justice in implementing contracts. Novelty/ Originality of this study: It explained the legal consideration of judges that emphasized the aspect of mediation through contract renegotiation based on the positive law and relevant sharia principles. Keywords: Judicial consideration, murabahah contracts, banks, good intention, benefit, justice.  ABSTRAK  Tujuan: Tulisan ini bertujuan untuk menganalisis pertimbangan yuridis hakim dalam Putusan No. 273/Pdt.g/2021/PA.Bkt dari perspektif kemanfaatan dan keadilan bagi semua pihak dalam murabahah dan akibat hukumnya.  Metodologi: Penelitian ini menggunakan metode literature review. Analisis yang digunakan adalah deskriptif kualitatif, yang dilakukan dengan membaca putusan secara mendalam, menganalisis kasus, memeriksa kesesuaian dasar hukum, dan bagaimana mendefinisikannya.  Hasil: Pertimbangan hukum hakim dalam Putusan Nomor 273/Pdt.g/2021/PA.Bkt adalah: (1) penyelesaian sengketa ekonomi syariah merupakan kewenangan mutlak Peradilan Agama; (2) majelis hakim harus menjaga kepentingan hukum dan hak penggugat dari tindakan tergugat untuk menjalani lelang, serta menghindari kerugian dan kerugian yang mungkin menimpa penggugat; (3) ada penekanan pada itikad baik, kemanfaatan, dan keadilan bagi semua pihak tetapi hakim menghukum terdakwa dengan penjadwalan ulang, penataan ulang, dan rekondisi.   Aplikasi penelitian ini: Dapat menginspirasi hakim untuk menciptakan penalaran hukum yang mendukung aspek kepastian hukum. Hal tersebut dapat menggugah bank dan nasabah untuk mengedepankan aspek itikad baik, manfaat, dan keadilan dalam pelaksanaan kontrak.  Kebaruan/Orisinalitas: Dijelaskan pertimbangan hukum hakim yang menekankan aspek mediasi melalui renegosiasi kontrak berdasarkan hukum positif dan prinsip syariah yang relevan.  Kata kunci: akad murabahah, bank, itikad baik, kemanfaatan, keadilan

Abstract

This research aims to analyze the process of law enforcement and prevention of money laundering crimes originating from corruption based on Law Number 8 of 2010 on the Prevention and Eradication of Money Laundering Crimes and the efforts made by third parties acting in good faith to recover their assets if the money laundering crime is not proven in the corruption offense. The research method used in this study is a normative legal research method. From the analysis conducted, the legal enforcement mechanism for money laundering crimes originating from corruption as the underlying offense is essentially bound by the Criminal Procedure Code (KUHAP), the Money Laundering Act, and the Corruption Criminal Act. In the law enforcement process for money laundering crimes, there are still obstacles, both in terms of substantive law (substantive law) and procedural law (formal law). Additionally, the efforts that can be made by third parties to recover their assets are not sufficiently regulated in Law Number 8 of 2010, which means that it may not fully satisfy the principles of justice and legal certainty. To combat and prevent money laundering crimes, especially those derived from corruption, it is not only necessary to have law enforcement agencies with competent human resources for investigation and prosecution, but it is also essential to build synergy among stakeholders to prevent and combat money laundering crimes. Given that combating money laundering crimes involves multiple institutions such as financial institutions, law enforcement agencies, the Financial Transaction Reports and Analysis Center (PPATK), and other relevant agencies as subsystems, including Bank Indonesia, financial service providers, goods and services providers, the Capital Market Supervisory Agency (BAPEPAM-LK), the Ministry of Communication and Information Technology, the Directorate General of Customs and Excise (DJBC), and law enforcement authorities.

Abstract

Tujuan penelitian adalah untuk mengetahui dan memahami Kebijakan Hukum Pidana terhadap Proses Merariq dalam Perspektif KUHP 2023. Bagaimana Aspek kepastian hukum proses merariq berdasarkan KUHP 2023 dan bagaimana proses merariq pada Masyarakat sasak dan kaitannnya dengan perbuatan pidana, Penelitian dilakukan denganm pendekatan yuridis normatif. Kesimpulan dari penelitian ini adalah: 1 Di dalam hukum pidana ada 2 (dua) hukum yang berbeda yang digunakan oleh masyarakat yaitu hukum pidana yang bersumber pada peraturan tidak tertulis (hukum pidana adat) dan hukum yang bersumber pada KUHP dan peraturan undang-undang yang tertulis lainnya. 2 Hukum pidana adat mengatur tindakan yang melanggar keadilan dan keamanan di tengah masyarakat sehingga menyebabkan terganggunya ketentraman serta keseimbangan masyarakat untuk memulihkan ketentraman dan keseimbangan tersebut maka dibutuhkan suatu aturan yang mengatur tentang delik adat. Hukum pidana adat adalah hukum yang hidup (living law) dan akan terus hidup selama ada manusia dan budaya dan tidak akan dapat dihapus dengan peraturan parundang-undangan yang tertulis. Andaikata ada undang-undang yang menghapus peraturan hukum pidana adat maka hukum pidana perundang-undangan akan kehilangan sumber kekayaannya oleh karena hukum pidana adat lebih erat hubungannya dengan antropologi dan sosiologi daripada perundang-undangan.

Abstract

This research aims to: 1) understand the judicial process for juvenile offenders with disabilities; and 2) examine and analyze the concept of resolving criminal cases committed by juvenile offenders with disabilities in the future. This study is categorized as normative research using a statutory and conceptual approach. The type of data used is secondary data, consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection techniques used include literature study and gathering data through electronic media related to the issues being studied. The data analysis technique applied is deductive reasoning, which involves drawing conclusions from general to specific, formulating facts, identifying causes and effects, and reasoning based on case studies. This study concludes that Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (JCJS) serves as a crucial legal foundation for protecting the rights of children in conflict with the law. The JCJS Law provides room for diversion for juvenile offenders with exceptions, namely if the offender is not a repeat offender and the offense is punishable by less than seven years of imprisonment. From a material perspective, the provisions in the JCJS Law do not rigidly explain the rights of children with disabilities when facing the law. The regulations in the JCJS Law still predominantly focus on children with normal physical conditions. From a formal perspective, there is a legal vacuum specifically regulating the rights of children with disabilities in conflict with the law, akin to the regulations for children in conflict with the law under the JCJS Law and for women in conflict with the law under Supreme Court Regulation No. 13 of 2017 on Guidelines for Adjudicating Women in Conflict with the Law. Thus, the judicial process for juvenile offenders with disabilities still applies the normal judicial system as used for other children without disabilities. In the future, if diversion is pursued for resolving criminal cases involving juvenile offenders with disabilities, another alternative for handling such cases is that judges may apply judicial pardon when making decisions. Judicial pardon is regulated under the new Criminal Code in Article 54(2), which provides a normative basis for judges in their decision-making.

Abstract

Penelitian ini bertujuan untuk menganalisis optimalisasi Sistem Penilaian Pembinaan Narapidana (SPPN) sebagai indikator pemberian remisi serta mengidentifikasi kendala penerapan prinsip keadilan distributif di Lapas Perempuan Kelas III Mataram. Metode yang digunakan adalah normatif empiris, dengan pendekatan konseptual, perundang-undangan, kasus, dan sosiologis untuk mengkaji efektivitas hukum dan kebijakan pemasyarakatan dalam praktik lapangan.SPPN merupakan instrumen strategis dalam menilai kemajuan pembinaan narapidana secara objektif, sejalan dengan pergeseran paradigma pemasyarakatan dari pendekatan retributif ke rehabilitatif. Diterapkan berdasarkan Keputusan Dirjen Pemasyarakatan No. PAS-10.OT.02.02 Tahun 2021, SPPN di Lapas Perempuan Kelas III Mataram dijalankan oleh tim Wali Pemasyarakatan dan Asesor melalui penilaian berbasis data dan bukti. Penilaian ini mencakup observasi perilaku, wawancara, telaah dokumen, serta tes, dengan pendekatan yang terindividualisasi sesuai karakteristik masing-masing narapidana.Optimalisasi SPPN telah menunjukkan dampak positif, seperti meningkatnya transparansi, motivasi narapidana, serta efektivitas dalam pemberian remisi dan hak-hak lainnya. Namun demikian, penelitian ini menemukan sejumlah kendala signifikan yang menghambat prinsip keadilan distributif. Kendala tersebut meliputi subjektivitas petugas, keterbatasan data yang akurat dan lengkap, belum optimalnya digitalisasi, serta rendahnya kapasitas SDM. Selain itu, inkonsistensi antarunit, resistensi terhadap sistem baru, dan tantangan integrasi data dengan Balai Pemasyarakatan (Bapas) turut memperparah ketimpangan dalam penilaian.Oleh karena itu, diperlukan upaya pembenahan menyeluruh melalui penguatan infrastruktur, pelatihan petugas, standardisasi teknis, serta percepatan digitalisasi. Langkah ini penting agar SPPN dapat benar-benar menjadi alat evaluasi yang adil dan efektif dalam mendukung pemasyarakatan yang humanis dan berkeadilan.

Abstract

Press freedom for journalists has become increasingly restricted following the enactment of the National Criminal Code, Law No. 1 of 2023, by the government, raising concerns about the potential criminalization of journalists performing their duties. Several articles in the National Criminal Code (New Criminal Code) have been noted by the Press Council, one of which pertains to the broadcasting or dissemination of false news or information. The term 'any person' in the relevant article can apply to anyone, including journalists. Meanwhile, responsible and proper press freedom has already been accommodated through a specific law, namely Law No. 40 of 1999. The problem addressed in this study is how press freedom, based on Law No. 40 of 1999, relates to press offenses as regulated by Law No. 1 of 2023. The method used in this study is normative juridical, supported by empirical juridical analysis. The research findings indicate that even before the National Criminal Code was enacted, several journalists, including in the case of Asrul, were criminalized for allegedly spreading false news under the Electronic Information and Transactions Law (ITE Law). There is concern that the National Criminal Code could also be used by law enforcement to target journalists engaged in their journalistic profession. Therefore, revisions to certain articles in the National Criminal Code are necessary to provide exemptions for the journalistic profession, which is protected by the press law, and to establish a specific mechanism to be prioritized in the event of a press dispute.

Abstract

Penelitian ini bertujuan untuk menganalisis Bagaimana Tipologi Pemidanaan Tindak Pidana Korupsi Di Sektor Agraria dalam penerbitan sertifikat hak atas tanah nelayan Perspektif Kepastian Hukum Dan Keadilan dan Bagaimana penegakan hukum terhadap tindak pidana korupsi dalam penerbitan sertifikat tanah bagi nelayan di Indonesia dapat mewujudkan kepastian hukum yang berkeadilan, Metode yang digunakan adalah Penelitian hukum normatif yang mengkaji putusan pengadilan serta norma-norma hukum yang berlaku. Hasil penelitian menunjukkan bahwa korupsi dalam sektor agraria, terutama dalam penerbitan sertifikat tanah untuk nelayan, berdampak besar terhadap kepastian hukum dan keadilan. Berdasarkan analisis beberapa putusan Pengadilan Tindak Pidana Korupsi (Tipikor), penerapan kepastian hukum dan keadilan sangat penting untuk membangun kepercayaan publik terhadap sistem pertanahan di Indonesia. Penegakan hukum yang tegas terhadap pelaku korupsi dan pengembalian hak tanah yang diambil secara ilegal merupakan langkah penting untuk memastikan program pemerintah berjalan sesuai prinsip hukum yang berlaku. Penegakan hukum yang konsisten akan meningkatkan transparansi, akuntabilitas, serta kepercayaan publik terhadap sistem hukum, sekaligus memastikan perlindungan hak-hak nelayan dan meningkatkan keadilan sosial serta ekonomi. Oleh karena itu, penegakan hukum yang efektif tidak hanya menguntungkan pihak yang dirugikan langsung, tetapi juga memperkuat integritas sistem hukum dan menciptakan pemerintahan yang lebih akuntabel dan transparan.Kata kunci: Tindak pidana; korupsi; agraria; kepastian hukum; keadilan.
