Abstract

The Constitutional Court Decision No. 62/PUU-XXII/2024, which annulled the presidential threshold in Article 222 of Law No. 7 of 2017, marks a crucial shift in Indonesia’s presidential electoral design by removing structural restrictions on citizens’ rights to vote and to be elected. This study analyses the decision’s implications for the quality of democracy in the 2029 presidential election, using a normative legal method with statutory, case, and comparative approaches, and drawing on democratic theory and the principle of popular sovereignty in the 1945 Constitution. The findings show that abolishing the presidential threshold can broaden political participation, diversify representation, and reduce the dominance of large coalitions, yet simultaneously increase the risks of political fragmentation, electoral management complexity, and governmental instability. The article argues that the decision must be followed by regulatory reforms to strengthen party verification, deepen internal party democracy, and ensure transparent and accountable candidacy procedures, so that the post‑threshold electoral system becomes more inclusive and fair while maintaining effective governance.

Abstract

The phenomenon of online gambling reflects a clash between morality, digital technology, and law, which has not yet fully adapted. Morally, gambling practices are rejected from the perspective of religion and Pancasila, yet the digital reality makes gambling increasingly accessible, cross-border, and difficult to control. From a global perspective, various countries have developed three legal approaches to regulating online gambling: the prohibitive model, the legal-restrictive model, and the legal-liberal model. Indonesia still adheres to the prohibitive model based on the Criminal Code (KUHP) and the Electronic Information and Transactions Law (ITE Law), but faces serious challenges in implementation due to its transnational and technological nature. The analysis shows the need for a hybrid approach that combines prohibition rooted in moral norms with adaptive regulation that leverages technology, international cooperation, and public protection. Within a responsive legal framework, law enforcement against online gambling should not only emphasize repressive measures but also educational, collaborative, and preventive aspects, making it more effective in addressing the dynamics of the digital era.

Abstract

Transformasi pendidikan Islam modern merupakan sebuah keniscayaan di tengah dinamika perkembangan ilmu pengetahuan, teknologi, dan perubahan sosial yang semakin kompleks. Pemikiran Haji Abdul Malik Karim Amrullah menjadi salah satu rujukan penting dalam merumuskan arah pendidikan Islam yang tidak hanya berorientasi pada aspek kognitif, tetapi juga menekankan keseimbangan antara iman, akal, dan akhlak. Artikel ini bertujuan untuk mengkaji secara mendalam konsep transformasi pendidikan Islam modern dalam perspektif Buya Hamka serta relevansinya dalam konteks pendidikan kontemporer. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian kepustakaan (library research). Sumber data diperoleh dari karya-karya utama Buya Hamka, seperti Tafsir Al-Azhar, Lembaga Budi, serta tulisan-tulisan lain yang berkaitan dengan pemikiran pendidikan Islam. Hasil penelitian menunjukkan bahwa transformasi pendidikan Islam menurut Buya Hamka menekankan integrasi antara pendidikan spiritual, intelektual, dan moral sebagai satu kesatuan yang utuh. Pendidikan tidak hanya berfungsi sebagai sarana transfer ilmu, tetapi juga sebagai proses pembentukan karakter dan kesadaran tauhid yang mendalam. Konsep pendidikan Islam modern dalam perspektif Buya Hamka relevan untuk dijadikan landasan dalam mengembangkan sistem pendidikan yang adaptif, humanis, dan berorientasi pada pembentukan insan kamil di era globalisasi.
