Abstract

From the early 1920s to the late 20th century, there were at least 25 financial crises globally. In 2018, the Global Islamic Finance Report reported that Indonesia has tremendous potential to develop Islamic finance. Some of the Islamic financial products that can be developed in Indonesia are bonds and sukuk. Bonds are a product of the capital market. In its development, bonds have undergone relatively rapid innovation, which provides room for issuing Islamic bonds known as sukuk. This paper discusses the difference between sukuk and bonds. This paper aims to look at the differences between sukuk and bonds and the opportunities for issuance, application, and development of sukuk in Indonesia. This research is qualitative research that is literature. As for obtaining comprehensive results, this study uses two approaches consisting of a socio-historical approach and content analysis. The analysis results show that sukuk are in principle the same as bonds, with the main differences, among others, in the use of the concept of return and profit-sharing as a substitute for interest. Keywords: Sukuk; Bond; Sharia Bonds; Capital market; Indonesia

Abstract

This study aims to determine the anthropocentric concept in the perspective of the Quran and the efforts/tips to build anthropocentric Muslims in the midst of a pandemic. The research question in this article is how is the anthropocentric concept in the Qur'an? And how to build an anthropocentric people in the midst of a pandemic? This article is library research. The research method used is a research method that uses qualitative data. The research materials come from books, scientific articles, research reports, internet websites, and so on related to the research theme, namely anthropocentric people and pandemics. Data collection techniques are by reading and understanding library materials that have been collected. Data analysis techniques used in data condensation, data presentation, and drawing conclusions. The results show that anthropocentric Islam is pro to humanity (humanist) without abandoning divine values ​​(theology). The idea of ​​building a pro-humanitarian community during the pandemic is an elaboration of the partnership between the government and local religious leaders, the collaboration of the Rukun Tetangga (RT) with residents, empowering crowdfunding applications, and fortifying themselves with healthy readings during social restrictions.

Abstract

This article discusses applying the hybrid contract concept in multiservice ijarah financing as an alternative to financing health services. This is important to study because health services are one of the most urgent things in the current Covid-19 pandemic. This article aims to determine the form of contracts contained in multiservice ijarah financing as an alternative to financing health services in the Covid-19 pandemic. This type of research is normative legal research. The data were obtained from library materials such as books, journals, etc. The analysis results show that health financing can be carried out in two ways: the ijarah contract, which begins with the bank through investors doing the health institution after making the contract, and the wakalah contract through the customer himself. People who have financial problems paying for health costs with multiservice ijarah transactions can apply for health financing to Islamic Financial Institutions for their families to minimize deaths before treatment in the Covid-19 pandemic.

Abstract

Purpose: The aims of this study is to describe and analyze what happened to nature and forest tourism on the island of Sumatra in general during the covid-19 pandemic. Methods: This study uses a qualitative method with a literature research design. Data analysis techniques used are data reduction, data presentation, and drawing conclusions. Results: The results show that the nature and forest tourism sectors in North Sumatra, West Sumatra and Aceh have not been able to boost tourism back to its normal level. The social distancing policy is the main cause of the sluggish tourism activity on the island of Sumatra. Contribution: This research is expected to be able to provide a solution to the sluggish tourism sector during the COVID-19 pandemic.

Abstract

Information technology has changed the ways of transacting and opened up new opportunities in conducting business transactions. An online sale and purchase agreement via the internet is considered valid if it meets subjective and objective conditions. Trading business activities via the internet are known as electronic commerce (e-commerce). It has become a necessity that society always experiences changes which are often followed by changes in mindset and values. On the other hand, the legal anthropology approach in research on Islamic law, both the study of normative laws (in the Qur’an) and empirical ones (in the practice of Muslims), has not been fully used. This article describes the anthropological approach of Islamic law in viewing the phenomenon of online buying and selling practices in Indonesia. This article aims to highlight the practice of buying and selling online using an anthropological approach to Islamic law. This article is qualitative research with library research. This article uses a Normative-Anthropological approach. The data in this study were obtained from library materials such as books, journals, and others related to the problems studied, namely the anthropology of Islamic law and online buying and selling. Data analysis techniques used are data condensation, data presentation, and drawing conclusions. The analysis results show that economic activity, including buying and selling online, relies heavily on language as a symbol of interaction. In other words, humans and the economy always prioritize symbolic interactionism in negotiating the desires and expectations of sellers and buyers, that is where anthropology and economics meet.

Abstract

Dalam usaha untuk mendapatkan keuntungan dan mempercepat perputaran modal, perusahaan atau pelaku bisnis memperlancar produksi suatu barang yang tujuan akhirnya dapat meningkat pertumbuhan ekonomi masyarakat. Ketika pelaku bisnis atau perusahaan tidak mampu membayar secara keseluruhan dari harga transaksi yang telah disepakati, maka tidak jarang alternatif lain yang digunakan adalah hutang. Dalam utang piutang ada yang dikenal dengan istilah hiwalah. Artikel ini akan membahas beberapa kaidah fiqih, terkhusus kaidah furu’ fi al-hiwalah. Tulisan ini bertujuan untuk melihat lebih lanjut kaidah-kaidah yang terdapat dalam ranah hiwalah. Dengan diketahui ketentuan-ketentuan tersebut diharapkan dapat memberikansumbangsih praktek hiwalah pada perekonomian masyarakat. Artikel ini menggunakan pendekatan kualitatif yang bersifat pustaka. Data-data dalam penelitian ini berasal dari bukubuku dan jurnal-jurnal yang berkaitan dengan topik yang dibahas yaitu kaidah furu’ fi alhiwalah. Data dalam artikel ini disajikan dengan deskriptif. Teknis analisis data yang digunakan yaitu reduksi data, penyajian data, penarikan kesimpulan. Hasil analisa menunjukkan hiwalah adalah pemindahan hutang yang dilakukan oleh seseorang kepada orang lain yang berhutang kepadanya atas dasar saling ridha dan suka sama suka. In an effort to gain profits and accelerate the turnover of capital, companies or business actors facilitate the production of a good whose ultimate goal is to increase the economic growth of society. When a business actor or company cannot pay in full of the agreed transaction price, it is not uncommon for another alternative to be used is debt. In accounts payable, there is what is known as hiwalah. This article will discuss some of the fiqh principles, especially the rules of furu’ fi al-hiwalah. This paper aims to look further at the rules contained in the realm of hiwalah. With these provisions in mind, it is hoped that they can contribute to the practice of hiwalah in the community’s economy. This article uses a qualitative approach that is the library in nature. The data in this study come from books and journals related to the topics discussed, namely the rules of furu’ fi al-hiwalah. The data in this article are presented descriptively. The data analysis technique used was data reduction, data presentation, and conclusion drawing. The results of the analysis show that hiwalah is a debt transfer made by one person to another who owes him based on mutual approval and acceptance.

Abstract

The outbreak of COVID-19 has caused the government to implement the PPKM (Public Activity Limitation) policy. The PPKM context set by the government aims to reduce and reduce the number of deaths caused by COVID-19 as explained in the maqashid pillar, namely hifz an-nafs. The determination of PPKM has had a considerable impact in the economic field, one of which is on Micro, Small and Medium Enterprises (MSMEs). This article is qualitative research that is library research. The data analysis technique used is qualitative data analysis technical Miles et al. namely data condensation, data presentation, and concluding. The study results indicate that the determination of PPKM policies, including for MSMEs actors, is a form of maqashid sharia, namely hifz an-nafs. Therefore, MSMEs must comply with these regulations because they are related to the protection of life which has a higher position than the protection of assets in maqashid sharia. However, one must still see the slight difference between the two.Mewabahnya covid-19 menyebabkan pemerintah menerapkan kebijakan PPKM (Penetapan Pembatasan Kegitan Masyarakat). Konteks PPKM yang ditetapkan pemerintah bertujuan untuk mengurangi dan menurunkan jumlah kematian yang disebabkan oleh covid-19 sebagaimana yang dijelaskana pada pilar maqashid yaitu hifz an-nafs. Penetapan PPKM memberikan dampak yang cukup besar dalam bidang ekonomi, salah satunya pada Usaha Mikro Kecil Menegah (UMKM). Artikel ini merupakan penelitian kualitatif yang bersifat studi pustaka (library research). Teknik analisis data yang digunakan adalah teknis analisis data kualitatif Miles dkk. yaitu kondensasi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa penetapan kebijakan PPKM termasuk bagi pelaku UMKM merupakan bentuk maqashid syariah yaitu hifz an-nafs. Oleh karena itu, UMKM harus mematuhi peraturan tersebut karena terkait dengan penjagaan nyawa yang mana kedudukannya lebih tinggi dari penjagaan harta dalam maqashid syariah. Namun harus tetap melihat kemafsadatan yang sedikit di antara keduanya.

Abstract

Political economy is understood as a scientific discipline that discusses political and economic problems and their very complex nature related to thinking about the application of politics and economics. This article uses qualitative research methods. Data collection is done by the library research method. These data are sourced from scientific papers, authoritative books, internet websites, and those related to research topics. The data analysis technique used is a qualitative data engineering model, Miles et al., namely data condensation, data presentation, and drawing conclusions. The study results show that the state's welfare refers to the government's active role in managing the economy. Therefore, the source of state finances is the driving force for the welfare of the state and society. In Indonesia, the government has detailed regulated how state financial resources are obtained and issued for the public benefit. Judging from the history of Islamic economic politics that has been carried out during the time of the Prophet until now, financial sources such as business, taxes, and public debt have become significant contributions to the Indonesian government in running the economy.

Abstract

The birth and formation of laws and regulations related to sharia economic law are based on the growing development of sharia financial institutions (LKS). The operation of Islamic financial institutions must, of course, be following Islamic principles, namely those based on the Qur'an and hadith. Then the formation of laws and regulations of sharia economic law is rooted in fiqh muamalah. The research method used in this study is library research using library data from books, scientific articles, and others. Data analysis techniques are condensation, data presentation, and concluding. The study results show that the legislation related to Islamic economics, especially in Islamic banking, is widely absorbed from the fatwa of the Indonesian Ulema Council (MUI). Almost all MUI fatwas were absorbed as the basis for forming the Sharia Banking Law. There are several characteristics of the Act, namely universal, maslahah, varied, fairness in transactions, and transparency.

Abstract

In general, in leasing goods (ijarah ala al-a'yan) the object of the contract is the benefit that comes from tangible objects. However, it is different from renting a Zoom Meeting Premium account whose position is as application software. So that its position will have benefits if its use is collaborated with hardware as hardware. Meanwhile, if it is only the software that is being leased, how can the software have benefits as the object of an ijarah contract which is the benefit of an object. Therefore, this study will discuss the practice of renting a Zoom Meeting Premium account according to the perspective of sharia economic law. This research is a research that uses a descriptive case study method with an empirical juridical approach. The data analysis technique was carried out through three stages, namely data reduction, data presentation and conclusions. The results of this study find the fact that the position of Zoom Meeting is premium as an application software that is part of a computer program. While the computer program is part of the copyright in the form of intangible movable objects. So that there is the development of the object of the ijarah contract which is generally in the form of benefits derived from tangible objects which can also come from the benefits of intangible objects.
