Abstract

This article aims to discuss the religious dimension in political conflict and violence in Indonesia Indonesian society is heterogeneous, especially in religious affiliation. A series of cases of violence in Indonesia involving religion, such as the events in Pekalongan (1995), Situbondo (1996), Poso (1998), Ambon (1999), Tasikmalaya (1996), Sukabumi (2008), and also other violence in several parts of Indonesia . This incident caused various kinds of losses both in terms of community facilities and the many casualties that fell. This is based on an excessive commitment to the religious aspects of Indonesian society... The method used in this article is a qualitative research method that consists of library research. Thus, the data obtained comes from literary sources such as books, scientific articles, research reports, and so on. The data analysis technique is a qualitative data analysis technique of Miles et al. The results of the study show that the religious dimension is the main factor in the various events of political conflict and violence in Indonesia. These religious-based conflicts are used by political elites to gain political power. The various religious and political conflicts and violence is due to hyper commitment in most religious societies and the factor of religious differentiation.

Abstract

The Religious Court of Malang Regency decided to divide the inheritance equally between sons and daughters. This certainly deviates from the sound of Article 176 KHI and the Koran in Surah an-Nisa’ verse 11, which states that the male share is two to one female share. The judge’s decision was based on the hadith of the apostle, which reads equalize in giving to sons and daughters and refers to article 183, which contains peace in distribution. This research is analysis-based normative research that seeks to examine the decisions of the Religious Courts in terms of benefits and Islamic justice. This study concludes that the judge’s decision is weak. Because the basis of the argument for article 183 is final and binding. At the same time, this case did not find a consensus. In addition, there has been no elaboration regarding the share of each heir before the agreement as mandated by Article 183. The judge’s decision is classified as biased because it annulled the principle of balanced justice without being confirmed by social facts and family culture. Judges tend to beat the average regardless of the attributes of the family heirs. This further strengthens the judge’s decision which is easily broken if brought to the appeal table.

Abstract

Since entering the beginning of 2020, the Covid-19 outbreak has rapidly spread to various parts of the world, including Indonesia. Therefore, everyone must keep their distance from each other to avoid transmission and break the chain of the virus. This situation requires the government to impose restrictions on community activities on a large scale, including in this case the restrictions on interaction in the education sector at the Tahfidz House of SMP Ma'arif NU 1 Wanareja. All learning activities must be transferred to the online system (online) or online, as well as the student's tahfidz program. Deposits for memorizing Al-Qur'an which are usually done in talaqqi in front of ustadz/ustadzah are now made through Zoom and Whatsapp media. This study aims to provide an overview of how an effort to learn Al-Qur'an must always run even in very difficult conditions. The results of this study indicate that Zoom is used for interpretation learning which requires delivering presentations (video calls), while Whatsapp is used for memorizing deposits through voice notes.

Abstract

Throughout the course of Islamic civilization, Muslims have experienced various kinds of dynamics of life. Islam once stood at the pinnacle of civilization before the Islamic world finally realized its backwardness from the Western world. In the golden age of Islam, the progress of Islamic scholarship was much enlivened by the thoughts of Muslim scholars. Likewise, when the Islamic world began to recede, Islamic thinkers always flowed their thoughts in various fields and contributed and greatly influenced the life and intellectuality of Muslims to this day. So, it is important to mention who are the Muslim scholars who have stuck their fangs and brought influence even to all corners of the world. These are 10 of the many Muslim intellectuals whose influence is very large for intellectual progress and the lives of Muslims. The ten figures include Al-Kindi, Al-Asy’ari, Al-Farabi, Ibn Sina, Al-Ghazali, Ibn Rushd, Ibn Taimiyah, Ibn Khaldun, Al-Afghani and Muhammad Abduh. The thoughts and contributions of these 10 figures are summarized in Nurcholish Madjid’s work entitled Khazanah Intelektual Islam. Thus, this paper aims to reveal and analyze critically and analytically what is contained in the book relating to the figures of Muslim intellectuals mentioned above. From the process of reviewing this book, it was found that Cak Nur’s work is quite comprehensive in conveying the intellectual journey of the Islamic world in a coherent manner, especially in the preamble which he compiled with a solid and neat content telling the development of critical thinking of Muslims from the friend of Umar bin Khatab to the modernist figure Muhammad. Abduh. In the following chapters, the main ideas of the ten figures are presented. This work makes it very easy for the reader to grasp the developments and differences of thought among the great figures of Islam.

Abstract

This article discusses one of the court products focused on the verdict. The presentation of the decision is divided into three sub-discussions, namely the understanding of court decisions, types and developments of court decisions in sharia economic cases, and legal remedies against sharia economic decisions. This article aims to find out how the decisions of Religious Courts regarding sharia economic disputes are used. The method used in this article is normative juridical, which is carried out qualitatively. The materials in this article come from laws, decisions of the Constitutional Court, decisions of the Supreme Court, books, scientific articles from journals, internet websites and so on related to the theme being studied, namely Religious Court decisions on sharia economics disputes. The data analysis technique used content analysis techniques. The results of the analysis show that the court’s decision is the final result or conclusion in written form, which is decided by a state official (judge) who is given the authority to end or settle a lawsuit because there is contention between the disputing parties in court which must be submitted in a hearing.

Abstract

This article aims to reveal learning management for State Islamic University students with dual roles, namely studying and managing the household. This study used a descriptive-quantitative method using a sample of eight female students pursuing undergraduate education at a State Islamic University in West Java through a convenience sampling technique. Data collection techniques are through observation, interviews, and documents. At the same time, the data analysis technique uses a technique popularized by Miles and Huberman, namely data condensation, data display, and concluding. The study results show that it is challenging to discipline female students with multiple roles in time management. However, following the flow, adapting, dividing the time, and trying to do each of these roles well. However, the achievement can not be felt optimally. Therefore, it is sporadic for female students to have multiple roles in determining the management of their study time. As for trying to continue to design good learning time management, it will be able to discipline in moving forward and achieving predetermined goals

Abstract

One of the thinkers in Islam who has contributed to the contemporary era is Muhammad Syahrur. It offers a contemporary methodology in explaining Islamic law. He further stated that in understanding the texts, one should not always be fixated on the interpretation of traditional ulama because religious texts should be interpreted according to their era. In explaining the renewal of Islamic law, Syahrul introduced a theory called the limit theory. This paper discusses the limit theory, which Muhammad Syahrur popularized. This paper aims to explain ijtihad in other languages ​​extracting Islamic law using the limit theory introduced by Syahrur. This article uses a library research method. The data in this article were analyzed qualitatively, namely data reduction, data presentation, and conclusion drawing. The analysis results show that the hudud theory or limit theory as a tool for criticism of the established methodology of Islamic law (ushul fiqh) is a good thing. However, to rely on the hudud theory or limit theory as the main method in extracting Islamic law as a substitute for the ushul fiqh method that mujtahids have used in extracting Islamic law, the hudud theory or limit theory is still not well established.

Abstract

This research analyzes international trade through the Heckscher-Ohlin political model towards national economic interests from an Islamic economic law perspective. This research uses qualitative methods with a text analysis approach. The data used is secondary, regarding the relationship between international trade, economic policy and national economic welfare. The research results show that the Heckscher-Ohlin (HO) theory is the main basis for studying the economics of international trade. This theory emphasizes differences in the scarcity of production factors between countries as the main factor influencing trade patterns. The main production factors in this theory are labor and capital. This difference in the scarcity of production factors encourages specialization in production, which helps increase the efficiency of resource allocation. Comparative advantage is basic in HO theory, where countries focus on producing goods they are able to produce at lower costs. This analysis also carries the HO Theory with Islamic economic law, which emphasizes the fairness of wealth distribution, business ethics, integrity, social welfare, balance and social justice, as well as individual moral responsibility in international trade. By combining these two approaches, international trade can provide sustainable economic and social benefits and is in accordance with Islamic ethical values.

Abstract

Tulisan ini membahas hadis yang berkenaan dengan hukum gadai. Pembahasan dalam tulisan ini dikhususkan dalam sebuah hadis yang ditetapkan sebagai hadis utama. Kemudian hadis akan diuraikan dari teks, artinya, tafsir, hal-hal penting yang terdapat dalam hadis, perbedaan pendapat para ulama, kandungan hadis, dan faedah yang terdapat dalam hadis tersebut. Dalam pemaparan hadis tersebut ditambah juga dengan hadis-hadis lain yang menjelaskan tentang gadai sebagai penguat. Tulisan ini bertujuan menjelaskan hukum barang gadai yang dimanfaatkan oleh penerima gadai. Artikel ini menggunakan penelitian kualitatif yang bersifat pustaka. Bahan-bahan dalam penelitian ini diambil dari bahan pustaka seperti buku dan artikel ilmiah yang diterbitkan di jurnal yang berkaitan dengan permasalahan yang dibahas yaitu tentang hukum gadai. Teknik analisis yang digunakan yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Analisis menunjukkan barang (jaminan) yang digadai kepada seorang penerima gadai boleh dimanfaatkan selama dia membayar sewa dari manfaat yang diambilnya. Hadith About Pawn: Legal Analysis of the Use of Animals as Collateral by Murtahin AbstractThis paper discusses the hadiths relating to the law of pawning, especially the use of pawning items by mu. The discussion in this paper is devoted to a hadith, which is designated as the main hadith. Then the hadith will be elaborated from the text, its meaning, interpretation, important matters contained in the hadith, differences in opinion of the scholars, the content of the hadith, and the benefits contained in the hadith. In the explanation of the hadith, other traditions that explain pawning as reinforcement are also added. This paper aims to explain the law of pawn items used by pawn recipients (murtahin). This article uses qualitative research that is the library in nature. The materials in this study were taken from library materials such as books and scientific articles published in journals related to the issues discussed, namely the law of using pawn items by murtahin. The analysis technique used is data reduction, data presentation, and conclusion drawing. The results of the analysis show that the goods (collateral) that are pawned to a pledge recipient can be used as long as he pays the rent from the benefits he takes.
