Abstract

The Religious Court of Malang Regency decided to divide the inheritance equally between sons and daughters. This certainly deviates from the sound of Article 176 KHI and the Koran in Surah an-Nisa’ verse 11, which states that the male share is two to one female share. The judge’s decision was based on the hadith of the apostle, which reads equalize in giving to sons and daughters and refers to article 183, which contains peace in distribution. This research is analysis-based normative research that seeks to examine the decisions of the Religious Courts in terms of benefits and Islamic justice. This study concludes that the judge’s decision is weak. Because the basis of the argument for article 183 is final and binding. At the same time, this case did not find a consensus. In addition, there has been no elaboration regarding the share of each heir before the agreement as mandated by Article 183. The judge’s decision is classified as biased because it annulled the principle of balanced justice without being confirmed by social facts and family culture. Judges tend to beat the average regardless of the attributes of the family heirs. This further strengthens the judge’s decision which is easily broken if brought to the appeal table.

Abstract

This article aims to reveal learning management for State Islamic University students with dual roles, namely studying and managing the household. This study used a descriptive-quantitative method using a sample of eight female students pursuing undergraduate education at a State Islamic University in West Java through a convenience sampling technique. Data collection techniques are through observation, interviews, and documents. At the same time, the data analysis technique uses a technique popularized by Miles and Huberman, namely data condensation, data display, and concluding. The study results show that it is challenging to discipline female students with multiple roles in time management. However, following the flow, adapting, dividing the time, and trying to do each of these roles well. However, the achievement can not be felt optimally. Therefore, it is sporadic for female students to have multiple roles in determining the management of their study time. As for trying to continue to design good learning time management, it will be able to discipline in moving forward and achieving predetermined goals

Abstract

This research analyzes international trade through the Heckscher-Ohlin political model towards national economic interests from an Islamic economic law perspective. This research uses qualitative methods with a text analysis approach. The data used is secondary, regarding the relationship between international trade, economic policy and national economic welfare. The research results show that the Heckscher-Ohlin (HO) theory is the main basis for studying the economics of international trade. This theory emphasizes differences in the scarcity of production factors between countries as the main factor influencing trade patterns. The main production factors in this theory are labor and capital. This difference in the scarcity of production factors encourages specialization in production, which helps increase the efficiency of resource allocation. Comparative advantage is basic in HO theory, where countries focus on producing goods they are able to produce at lower costs. This analysis also carries the HO Theory with Islamic economic law, which emphasizes the fairness of wealth distribution, business ethics, integrity, social welfare, balance and social justice, as well as individual moral responsibility in international trade. By combining these two approaches, international trade can provide sustainable economic and social benefits and is in accordance with Islamic ethical values.

Abstract

This research aims to find out the transformation in the institutionalisation of Islamic education, especially in pesantren (Islamic boarding school) Salaf. The focus of this research is on the transformation of Islamic education institutions in Salaf Islamic boarding schools, as well as their strategic role in the era of globalisation. This research uses a qualitative research method approach. This research is located at Salaf Al-Manar Islamic Boarding School in Bener Village, Tengaran District, Semarang Regency. The primary data source of this research comes from observations and interviews with relevant parties involved in various activities at the Salaf Al-Manar Islamic Boarding School. While secondary data sources are taken from some library data discussing the object of research such as articles (journals), books and other literature sources that support this research. Data collection techniques include observation, interviews, and documentation. Furthermore, the data analysis technique consists of three stages, namely data condensation, presenting data, and drawing conclusions (verification). Finally, data validity was tested by triangulating sources and triangulating techniques. This study found that first, Al-Manar Foundation underwent institutional transformation starting from the initial lodging place or pesantren and turning into Al-Manar Foundation. Second, the awakening of the fighting spirit of santri is very visible with the beginning of many santri who are considered classical/ Salaf starting to transform today in the world of formal education, even many santri continue to college level both general and Islamic. Third, the strategic role of the managers of pesantren educational institutions in the Era of Globalisation is to guard the teachings of morals and become the front guard.

Abstract

This article discusses one of the Indonesian legal products used in the settlement of labor disputes, namely the industrial relations mechanism, which is part of the legal product to resolve disputes by legal protection measures. This article aims to find out the mechanism of Industrial Relations to provide legal protection in labor disputes. This article is normative juridical research that analyzes secondary data from legal studies literature in the form of books, journals, and other materials related to the research topic of this article. The data analysis technique used is content analysis. The results of the analysis show that legal protection in labor disputes with industrial relations mechanisms can be carried out through the Bipartite, Tripartite, and Industrial Relations Courts (PHI). The results of this court's decision do not only stop in writing on paper, but there must be a follow-up from the losing party to carry out their obligations based on the demands that have been set.

Abstract

This article uses a sociological approach to discuss consumer protection in the sales system through e-commerce during the covid-19 pandemic. This study aims to provide legal certainty to consumers by highlighting consumer protection laws and the role of the government in protecting people who make transactions in e-commerce. This article is juridical-normative research. This article uses qualitative data that is a literature study. In this case, two types of data are used: primary and secondary data. Primary data includes Law Number 8 of 1999 concerning Consumer Protection. At the same time, secondary data is obtained from library sources such as books, scientific articles, theses, dissertations, research reports, internet websites, and other data sources. Miles et al. used the qualitative data analysis technique, namely data condensation, data presentation, and concluding. The analysis results show that the consumer protection law does not only apply to consumers but to everyone who transacts in it. Consumer protection is very much needed to maintain security and provide convenience for sellers and buyers in carrying out economic transactions in the covid-19 pandemic. The role of law in consumer protection following the Consumer Protection Law Number 8 of 1999 provides efforts to ensure legal certainty to protect consumers.

Abstract

The aims of this research is to clarify the type of multi-contract used by National Sharia Council-Indonesian Ulama Council (DSN-MUI) in its product innovation, so that the multi-contract concept used is a multi-contract concept that is in accordance with sharia rules and principles. This research is sharia economic law research that uses descriptive literature research methods. This research uses a normative juridical approach. The primary data used in this research is the DSN-MUI Fatwa which is related to the concept of hybrid contracts in the innovation of sharia banking products. Meanwhile, Secondary data sources include various sources of literature such as laws, scientific articles, books, and others. The data analysis technique used was the cumulative data analysis technique of Miles et al., namely data condensation, data presentation, and drawing conclusions. This study found that so far, the DSN-MUI has used the type of multi-contract for similar contracts (a combination of muawadhat contracts) and also non-similar contracts (a combination of muawadhat contracts and tabarru’ contracts) provided that there is a separation of agreement documents to avoid usury schemes for the use of these contract combinations and income (both margins, ujrah, and profit sharing) is obtained from the use of muawadhat contracts. This non-similar contract combination scheme is confirmed in the Fatwa on the Income of Islamic Financial Institutions (LKS) During the Construction Period (Fatwa No. 142 of 2021), namely Al- Uqud al-Murakkabah al-Muta’addidah. Meanwhile, the hybrid contracts scheme for similar contracts uses the Al-Uqud al-Murakkabah al-Mutajanisah hybrid contracts scheme

Abstract

The rapid development of artificial intelligence technology has opened up new opportunities in the transformation of education, including Islamic education. This research aims to analyze the use of AI in personalizing Islamic learning in the era of Society 5.0, with a constructivism-based theoretical approach. The method used is a qualitative-descriptive analysis of the literature and phenomena related to the application of AI in Islamic education. The results show that AI has great potential in creating learning that is more adaptive and meets individual needs, especially through the use of personalization algorithms and in-depth data analysis. This article makes a novel contribution by offering a new perspective on the application of AI technology based on constructivism theory, which highlights the importance of the interaction between technology, learners and the social environment. The implication is that the application of AI can encourage innovation in curriculum design and teaching strategies, while ensuring alignment with Islamic values in the digital age.
