Abstract

The purpose of this study was to determine the pattern of character education in the learning community at Islamic boarding schools in improving the oral skills of students. The type of research used is descriptive qualitative. The method of data collection and data processing uses literature studies and qualitative analysis, researchers look for data collections from scientific articles in various journals and then analyze them. The results of the study show that learning communities in Indonesia generally use a religious education model to create students' characters who are ready to use, especially in speaking in a pluralistic society, both in terms of language, culture, and religion. Therefore, this learning community is needed to realize a character, religious, and nationalist education. Because with the existence of a learning community, students can find their identity and ability to express themselvesbetter.

Abstract

This article uses a sociological approach to discuss consumer protection in the sales system through e-commerce during the covid-19 pandemic. This study aims to provide legal certainty to consumers by highlighting consumer protection laws and the role of the government in protecting people who make transactions in e-commerce. This article is juridical-normative research. This article uses qualitative data that is a literature study. In this case, two types of data are used: primary and secondary data. Primary data includes Law Number 8 of 1999 concerning Consumer Protection. At the same time, secondary data is obtained from library sources such as books, scientific articles, theses, dissertations, research reports, internet websites, and other data sources. Miles et al. used the qualitative data analysis technique, namely data condensation, data presentation, and concluding. The analysis results show that the consumer protection law does not only apply to consumers but to everyone who transacts in it. Consumer protection is very much needed to maintain security and provide convenience for sellers and buyers in carrying out economic transactions in the covid-19 pandemic. The role of law in consumer protection following the Consumer Protection Law Number 8 of 1999 provides efforts to ensure legal certainty to protect consumers.

Abstract

The Nahdlatul Ulama Party is one of the Islamic parties that became a loyalist party to President Soekarno during the implementation of guided democracy. This is because the political strategy used by the NU Party is a realistic political strategy and tends to be accommodating and cooperative in dealing with President Soekarno’s new political situation, namely guided democracy. So that after the NU Party decided to accept guided democracy, the return of the 1945 Constitution, and the Nasakom and Manipol-Usdek, the NU party supported the leadership of President Soekarno, one of its supports was the awarding of a charter with the title waliyul amri adh-dharuri bi syaukah from Nahdlatul Ulama to President Soekarno. This paper aims to reveal the waliyul amri adh-dharuri bi syaukah title charter as moral support from the Nahdlatul Ulama Party to the leadership of President Soekarno during the guided democracy. The method used in this study is the historical method, while the approach used is the hermeneutic theory of Paul Ricoeur. The results of the study show that the waliyul amri adh-dharuri bi syaukah charter is a form of moral support from the Nahdlatul Ulama Party for the leadership of President Soekarno, so it has legitimized that the government led by President Soekarno himself is a legitimate government according to the eyes of fiqh law. This charter is also the basis for acceptance and support from the NU Party for President Soekarno and his guided democracy.

Abstract

This article aims to describe the interconnection integration of Quranic Tafsir and Anthropology as an analysis of the value of Islamic education in the Nyadran tradition that developed in Semedo Village, Pekuncen District, Banyumas Regency. Nyadran by the Javanese is carried out to welcome the month of Ramadan. At first, Nyadran was a ritual of worship of ancestral spirits carried out by Hindu-Buddhist. However, as Islam came to the archipelago, this tradition was transformed so that it became a tradition containing local wisdom that synergized with Islamic values. This article uses a qualitative method of field research. Data was obtained by conducting observations, interviews and literature review. Data analysis techniques are condensation, data presentation, and concluding. This study found that the Nyadran tradition conveys many values and messages of Islamic education following the Quran and hadith in its implementation. The educational values are the values of aqidah, shari'ah values and moral values. While the messages conveyed through the Nyadran tradition include invitations to maintain cleanliness, remember death, and be devoted to parents and others.

Abstract

Nahdlatul Ulama is the only major political party representing Muslims in national politics during the implementation of guided democracy. NU's accommodative and flexible political practices have made Nahdlatul Ulama able to live and continue to survive in difficult times. This is inseparable from NU's religious political strategy, which is its guideline. The theological basis based on the theory of fiqh and ushul fiqh can be seen in NU's acceptance of the guided democracy concept. This paper aims to reveal NU's theological foundation in accepting the concept of guided democracy. Data was collected through the study of texts and manuscripts and literature studies. The data analysis technique uses hermeneutic theory to capture symbols in the form of texts originating from Islamic law, namely fiqh, and ushul fiqh, as the basis and foundation of NU accepting guided democracy. The results showed that there were several theories of fiqh and ushul fiqh used by NU, including the concepts of maslahah and mudarat, dar’ul mafasid muqoddamun ala jalbil mashalih, amar ma’ruf nahyil mungkar, ma la yudraku kulluh la yutraku kulluh, al-muhafadthu ala qodim al-shahih wa al-akhdzu bi al-jadid al-ashlah, and the concept of syuro presented by KH Idham Chalid.

Abstract

This article aims to formulate a strategy for preventing anti-religious radicalism at PTKIN's Ma'had al-Jami'ah in Indonesia, which is synergized with the Ma'had al-Jami'ah curriculum for the development of Ma'had al-Jami'ah. This study utilized qualitative research methods and a case study approach. This study's population was Ma'had al-Jamiah at PTKIN in Indonesia. Observation of non-participants and interviews were utilized for data collecting, with condensation, presentation, and conclusion approaches for data analysis. The findings indicated that the strategic procedures implemented by Ma'had al-Jamiah PTKIN in Indonesia involved teachers' appointments. In preventing religious extremism from Ma'had al-Jami'ah PTKIN in Indonesia, one of the most effective measures is to adjust the Ma'had management system's curriculum. In addition, the model for avoiding religious extremism in Ma'had al-Jami'ah was implemented using the teaching model based on the Islamic Yellow Book (Kitab Kuning). Furthermore, this study argued that those responsible for selecting Ma'had al-Jami'ah teachers should comprehensively understand Islam.

Abstract

This article describes the actualization of tasamuh values to be applied among religious people in Indonesia. Tasamuh is one of the attitudes that teach humans to be tolerant and fair, respect each other, and respect differences. However, it should be highlighted that the principle of tasamuh in Islam does not touch the field of faith but is actualized in the frame of brotherhood among human beings. In line with that, to meet the religious moderation program campaigned by the government, it is even stated in the National Medium-Term Development Plan (RPJMN) for 2020-2024. Thus, this article offers the concept of Kampung Tasamuh. The concept of Kampung Tasamuh mainstreams the principle of inter-religious openness. Everyone who lives in a village respects and respects each other regardless of differences. Everyone has the same opportunity to voice freedom of opinion and belief using dialogue in humanitarian matters. The findings of this article The concept of Kampung Tasamuh can be applied in tandem with several principles, namely intellectual humility, cultural empathy (caring for others), and open-mindedness (thinking inclusively).

Abstract

Polarisasi poligami dewasa ini menyeruak di permukaan. Hal ini ditengarai oleh pihak-pihak yang mengkampanyekan poligami dengan massif. Secara tidak sehat, Al-Quran dan Hadis dijadikan alat guna membungkus kampanye tersebut seolah poligami itu ‘Islami’. Akibatnya timbul paradoks, di mana sebagian orang berasumsi bahwa Islam agama yang pro dan mendukung poligami. Fakta demikian perlu diluruskan mengingat secara prinsip, agama Islam menjunjung tinggi penghormatan dan keadilan atas sesama makhluk Tuhan. Tidak boleh ada superioritas atas satu pihak yang berakibat memarginalkan pihak lain. Oleh karena itu, penelitian ini berusaha membedah fikih poligami dalam Islam bagaimana sesungguhnya konteks poligami berlaku dan apakah benar Islam mendukung hal tersebut. Penelitian ini menggunakan kajian normatif dengan pendekatan komprehensif guna menghasilkan konklusi yang akurat dan valid. Hipotesa kajian ini hendak membangun pemahaman bahwa poligami adalah pernikahan yang layak dipakai sebagai alternatif dengan berbagai fakta di antaranya secara prinsip fikih tidak menganjurkan poligami. Ayat poligami tidak bermakna wajib namun kebolehan, poligami Rasulullah s.a.w. bukan karena hasrat, hikmah pernikahan kontradiksi dengan poligami serta pendapat dari beberapa cendikiawan Muslim menyangkut persoalan poligami. Sejurus dengan temuan tersebut, poligami layak diperbincangkan pada ranah ‘abnormal’ dimana tidak semua kondisi praktik demikian patut dilakukan.[The polarization of polygamy is currently on the surface. This is suspected by those who are campaigning for polygamy. Unhealthily, Al-Quran and Hadith are used as tools to wrap the campaign as if polygamy is “Islamic” Polygamy, Sharia, Alternative. The result is a paradox, where some people assume that Islam is a pro and supports polygamy. This fact needs to be straightened out considering that the Islamic religion upholds respect and justice for fellow divine beings in principle. There must be no superiority over one party, which results in the marginalization of the other. Therefore, this study seeks to dissect the polygamy sharia in Islam, how the context of polygamy applies and whether Islam supports it. This study uses a normative study with a comprehensive approach to producing accurate and valid conclusions. This study’s hypothesis is to understand that polygamy is alternative fikih with various facts, including in principle that jurisprudence does not advocate polygamy. The verse polygamy does not mean obligatory but permissible, polygamy the Prophet s.a.w. not because of the passion, wisdom of marriage and polygamy, and some Muslim scholars’ opinions. In line with these findings, polygamy deserves to be discussed in the realm of ‘abnormal’ where not all practice conditions are appropriate.]

Abstract

This article aims to highlight Islamic exclusivism in the form of popular Islamic novelS for children’s reading books in Indonesia after the reform of 1998. Building on the media theory of Gill Branston and Roy Stafford, this study explains Islamic pop novels as Islamic educational materials from a semiotic approach, structuralism, and critical discourse analysis. In particular, this study uses qualitative research methods by descriptively analyzing the reading of Islamic pop novels spreading in the Qur’anic Education Centre in Central Java. The results showed that since the Reformation, the movement used books, newsletters, magazines, and children’s readings of Islamic pop novels to shape the religious thoughts of urban Muslim children and youth in Indonesia. There is hardly a story related to diversity, the value of tolerance, and mutual respect between religious people in those materials. The awareness of religious comprehension in children's reading seems exclusive. It must be realized by various parties that the media utilizing Islamic literature is very influential on the growth and development of children's religious thinking in the educational space in the metropolis.

Abstract

Artikel ini membahas pemikiran Ibnu Taimiyah tentang upah yang setara dan relevansinya terhadap Undang-Undang Nomor 13 Tahun 2003. Ibnu Taimiyah berpendapat bahwa dalam transaksi ekonomi harus adanya keadilan, semua akad harus didasari pada kesanggupan dari semua pihak untuk sepakat, termasuk dalam hal upah pekerja. Konsep upah yang setara menurut pandangan Ibnu Taimiyah adalah ketika upah antara pekerja dan pemberi kerja ditentukan dari tawar menawar antara kedua belah pihak. Dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan ketentuan mengenai upah dibahas dalam pasal 88 dan pasal 89 dan disebutkan bahwa setiap pekerja berhak mendapat upah bagi kehidupan yang layak. Penelitian ini memaparkan pemikiran ekonomi Islam menurut Ibnu Taimiyah tentang upah yang setara serta bagaimana relevansinya dengan upah dalam ketetapan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Metode yang digunakan adalah metode penelitian kualitatif. Data yang diperoleh dipaparkan serta dideskripsikan menjadi suatu analisis yang relevan sehingga menjadi suatu kesimpulan dari pemaparan kedua konsep tersebut. Hasil analisis menunjukkan antara konsep upah yang setara dan upah pada Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan keduanya sama-sama menentukan upah bagi para pekerja. Dalam konsep upah yang setara, jika upah tidak ditentukan dalam akad, maka upah yang dialokasikan adalah sepadan melalui standar upah yang sudah jelas atau upah biasanya pada pekerjaan tersebut. Masuk ke dalam Undang-Undang Nomor 13 Tahun 2003, upah yang telah ada dapat disamakan dengan upah minimum yang diatur dalam pasal 88.
