Abstract

Indonesia’s diversity is a valuable asset that must be wisely managed to prevent potential conflicts. Article 29 Paragraph 2 of the 1945 Constitution guarantees freedom of religion, in line with Islamic teachings on tolerance. Ma’had Al-Zaytun serves as an example of an Islamic educational institution that instills Islamic and national values in a moderate and inclusive manner, shaping students to live harmoniously within a pluralistic society. This study aims to determine the role of Ma’had Al-Zaytun in shaping attitudes of tolerance based on Article 29 Paragraph 2 of the 1945 Constitution and Islamic Law. The research employs a descriptive approach with a library research method. Primary data were obtained from Article 29 Paragraph 2 of the 1945 Constitution and Hukum Islam by Sofyan Hasan, while secondary data were derived from journals, theses, dissertations, documents, and previous relevant studies. The results show that Ma’had Al-Zaytun plays an important role in fostering tolerance through two perspectives. Based on Article 29 Paragraph 2 of the 1945 Constitution, Al-Zaytun creates an educational environment that values diversity through curriculum design, exemplary teachers, social activities, and intercultural dialogue. From the perspective of Islamic Law, tolerance is reflected through the preservation of religion and intellect, emphasizing peace, respect for other religions, and freedom of thought and dialogue. The combination of these perspectives produces students who are religious, open-minded, and socially responsible in a pluralistic national life.

Abstract

This thesis discusses the influence of the use of e-Court and its administrative effectiveness in the context of cultural transition from conventional to virtual trials. This change caused two reactions in the community that was previously used to conventional hearings , so it was necessary to adapt to the online system. These two reactions are used as the basis for the author's analysis of the e-Court mechanism from the perspective of siyasah dusturiyah. The purpose of this study is to find out the Analysis of the Use of E-Court and administrative arrangements in the North Jakarta District Court for the 2022-2023 Period Based on Supreme Court Regulation Number 7 of 2022. As well as analyzing the Use of E-Court in the North Jakarta District Court for the 2022-2023 Period Based on Siyasah Dusturiyah. This research uses a library research method with a normative-conceptual approach. Data collection was carried out through a systematic literature search of legal materials and academic studies. The data sources in the research were obtained from PERMA, Islamic legal literature, books, journals, and relevant articles. This study found that the use of e-Court in the North Jakarta District Court was in accordance with Perma No. 7 of 2022, starting from account registration, payment of case fees through virtual accounts, to setting trial schedules. For optimization, the North Jakarta District Court developed Sidilantara, Sigesittapus, and PASTI which accelerate administration, although system improvements, training, and digital security are still needed. From the perspective of siyasah dusturiyah, the implementation of e-Court (2022–2023) reflects the modernization of the judiciary that is in line with Islamic values and Pancasila, supporting justice, transparency, and public benefit in accordance with maqashid al-shariah, but still requires increasing digital literacy, data protection, and adaptation of legal culture

Abstract

This study aims to describe the quality of service provided by barbershops in Ma'had Al Zaytun according to customer perceptions, analyze the effect of service quality on customer loyalty, and explain the relationship between service quality and customer loyalty in the perspective of Sharia Economic Law. The research applied an explanatory sequential mixed method design, in which researchers first conducted a quantitative approach by distributing questionnaires by simple random sampling to 180 12th grade Rijal students from a total population of 328, based on the Slovin formula (5% margin error). After the quantitative analysis was deemed inadequate, the qualitative phase continued in the form of in-depth interviews with managers and barberman to deepen the understanding of quantitative data. Simple linear regression statistical analysis showed that service quality contributed 89.5% to customer loyalty (R² = 0.895), with a very strong correlation of 94.6% (r = 0.946). In addition, most respondents expressed satisfaction with the aspects of cleanliness, comfort of the place, and friendliness of the barberman, although there were complaints related to the discrepancy of the cut results and the lack of professional barberman training. From the perspective of Sharia Economic Law, the service practices at Ma'had Al Zaytun Barbershop reflect the principles of trustworthiness, justice, and maslahah, but professionalism still needs to be improved as part of the service contract (Ijarah bil 'amal). The results of this study make an important contribution to the development of Islamic services that are aligned with sharia principles, oriented towards customer satisfaction, and have the potential to build sustainable loyalty. Abstract

Semakin berkembangnya zaman, banyak inovasi yang muncul dalam kehidupan kita untuk memudahkan kegiatan kita sehari-hari. Diantara inovasi tersebut, yang paling berkembang adalah dalam bidang teknologi dan perekonomian. Salah satu contohnya adalah jual beli model dropshipping. Sehingga tujuan dari penelitian ini adalah untuk mengetahui bagaimana sistem jual beli dengan metode dropshipping dan juga untuk mengetahui sistem jual beli dengan metode dropshipping menurut hukum Islam. Dalam penelitian ini menggunakan metode Studi Pustaka dengan pendekatan deskriptif. Hasil dari analisis literatur ini mengungkapkan bahwa pertama, sistem jual beli dengan metode dropshipping adalah jual beli yang dilakukan dengan meminta izin menjualkan barang kepada supplier yang kemudian dijual dengan menggunakan alamat identitas dan terkadang toko milik dropshipper dan kedua bahwa praktik dropshipping halal dalam Islam jika memenuhi syarat seperti izin dari supplier dan penjelasan yang jelas mengenai barang. Akad yang digunakan adalah akad samsarah (makelar), yang sah selama tidak mengandung gharar atau penipuan. Mazhab Hanafi dan Syafi'i memperbolehkan dropshipping, namun dengan batasan. Barang yang tidak mudah berubah dan mudah dikenali. Sementara barang yang mudah berubah, seperti bahan pangan atau fashion, tidak diperbolehkan. Oleh karena itu, dropshipping harus dilakukan dengan hati-hati dan sesuai prinsip syariah.

This essay seeks to examine the terminology of justice found in the Quran and its potential application within constitutional Law. Amidst the growing trend of globalization, it is crucial to comprehensively comprehend how the principles of justice outlined in the Quran can be effectively incorporated into constitutional legislation. This essay emphasizes the significance of incorporating Islamic principles into constitutional Law to establish a fair and enduring society.

Abstract

This essay examines the terminology of democracy as mentioned in the Quran and evaluates its significance within the framework of contemporary constitutional law. While the term "democracy" is not directly stated in the Quran, essential democratic elements can be recognised in terms such as discussion (shura), fairness ('adl), and public welfare (maslahah). The objective of the debate is to explore the applicability of the democratic rhetoric found in the Koran within the framework of contemporary constitutional legislation. Furthermore, it is vital to analyse the ramifications of these principles on policy development, governmental procedures, and community engagement in the political sphere. By examining the verses of the Quran that pertain to contemplation, fairness, and the well-being of society, it may be inferred that these ideas hold great importance in establishing a democratic and inclusive governmental framework. The incorporation of democratic language in the Koran can offer moral and ethical direction to policymakers in guaranteeing the engaged involvement of citizens and the safeguarding of their rights in contemporary constitutional legislation.

Abstract

As the primary reservoir of Islamic doctrines, the Koran offers spiritual counsel and examines diverse facets of human existence, encompassing constitutional law. An essential aspect emphasised in the Koran is the vocabulary about the state or governance. This essay aims to elucidate the state language found in the Al-Quran and its significance in constitutional law. Additionally, it seeks to comprehend the ideas delineated in the Al-Quran concerning the organisation and operation of the state within the context of Islam. A profound comprehension of the specific vocabulary used in the Al-Quran about governance is crucial in establishing a solid conceptual basis for advancing Islamic constitutional law. This is particularly applicable in contemporary Muslim communities that require direction in establishing a government that aligns with Islamic ideals. The conclusion of the study indicates that the Al-Quran use the terms "Dawlah", "Daulah", and "Imarah" to emphasise the notion of state or leadership within the context of Islam. These two phrases highlight the significance of God's supremacy and fairness in governance. Through a comprehensive comprehension of this concept, Muslim communities can construct a nation founded upon authentic Islamic principles.

Abstract

This essay discusses the terminology of "welfare state" in the Quran from the constitutional law perspective. As the primary source of Islamic teachings, the Quran offers a deep and comprehensive concept of a welfare state that includes social justice, environmental sustainability, and a balance between individual rights and social obligations. This research explores three main aspects: fair law enforcement, infrastructure development that supports welfare, and community empowerment. In the Quran, the government has a significant responsibility to ensure the welfare of all society through transparency, justice and accountability in the management of state affairs. This essay concludes that the Quran provides moral and spiritual guidance and a comprehensive framework for creating a just and sustainable welfare state. Implementing these principles in constitutional law can form the basis for a government capable of bringing prosperity to all the people.

Abstract

Leadership is a vital aspect of a country's social and political structure. Without effective leadership, a country is prone to experiencing chaos and instability. The Quran, as the sacred scripture of the Islamic community, provides comprehensive guidance on the concept of leadership. Terminologi seperti khalifah, imam, dan uli al-amr tidak hanya memberikan petunjuk spiritual tetapi juga memiliki relevansi praktis dalam konteks hukum tata negara. This article explores and explains how leadership terminology in the Quran might be applied in constitutional law, focusing on implementing principles of justice, responsibility, and community participation. The leadership terminology in the Quran provides a solid moral and ethical foundation for building a just, transparent, and effective governance. Concepts such as Khalifah, imam, and uli al-amr offer guidelines that can be used to ensure that leadership in governance reflects the values of justice, integrity, and the well-being of the people. Thus, the Quran serves as a spiritual guide and a crucial source of ethics and morals in forming a just state law.
