Abstract

Government Employees with Employment Agreements (PPPK) are required to comply with regulations relating to employment and are required to have good behavior such as being loyal and obedient to the stateIn siyasa fiqh it is referred to as tabi'in (followers). Where tabi'in are required to obey and obey the orders and rules made by ulil amri (Leader). The purpose of this study is to find out the application of government employee discipline with work agreements (PPPK) according to PP no. 49 of 2018 concerning Management of Government Employees with Work Agreements (PPPK). Knowing the Application of Discipline for Government Employees with Employment Agreements (PPPK) According to Fiqh Siyasah. The results of the study show that the application of disciplinary regulations for Government Employees with Employment Agreements (PPPK) is confirmed in Government Regulation No. 49 of 2018 article 51 and article 52 but in these articles, it is explained that the imposition of disciplinary sanctions is carried out by government agencies that have the authority to impose sanctions on employees. In adhering to the Siyasah Fiqh principles in the application of employee discipline, employees must have the principles of sovereignty, the principles of justice, the principles of deliberation and Ijma', the principles of equality, the principles of the obligations of the state and the people and the principle of amar ma'ruf nahi munkar. Dalam fiqh siyasah disebut sebagai tabi’in (pengikut). Dimana tabi’in diwajibkan untuk patuh dan taat terhadap perintah dan aturan yang dibuat oleh ulil amri (Pemimpin). Tujuan dari penelitian ini adalah Untuk Mengetahui Penerapan Disiplin Pegawai Pemerintah Dengan Perjanjian Kerja (PPPK) Menurut PP No. 49 Tahun 2018 tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja (PPPK). Mengetahui Penerapan Disiplin Pegawai Pemerintah Dengan Perjanjian Kerja (PPPK) Menurut Fiqih Siyasah. Hasil penelitian menunjukkan bahwa Penerapan peraturan disiplin bagi Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) ditegaskan pada Peraturan Pemerintah No. 49 Tahun 2018 pasal 51 maupun pasal 52 namun didalam pasal tersebut dijelaskan bahwa pemberian sanksi disiplin dilakukan oleh instansi pemerintah yang memiliki kewenangan untuk memberikan sanksi kepada Pegawai Pemerintah. Dalam menegakan prinsip Fiqih Siyasah pada penerapan disiplin pegawai harus memiliki prinsip kedaulatan, prinsip keadilan, prinsip musyawarah dan Ijma’, prinsip persamaan, prinsip hak kewajiban negara dan rakyat serta prinsip amar ma’ruf nahi munkar. Abstract

Juridically Indonesia has owned a set of law regulations to guarantee children’s rights and decrease the impact of working from children, one of which is law Number 13 Year 2003 about Employment. In Islam, children are a blessing from Allah God Almighty for parents to take care of and nurture well. This paper provides an understanding of the legal protection find out the legal protection towards minor workers according to Law Number 13 Year 2003 and find out the legal protection towards minor workers according to Islamic law. The author employed a library research type with a normative juridical approach. The data sources used in this research were primary data amely The Law Number 13 the Year 2003 and the book entitled Al-Qur’an and Social Prosperity. The secondary data were books, journals, documents, law regulations, and so on. The research results showed that the regulation in Article 68 until Article 75 Law Number 13 the Year 2003 gives the guarantee of legal protection to minor workers to gain their rights and obligation facility as workers. Islamic law gives legal protection to minor workers. Islamic law gives protection for underage child workers from a maslahah perspective. Legal protection for working children seen from their interests is included in the maslahah al-dharuriyah category because it concerns the basic needs of humanity in this world and the hereafter, namely maintaining religion, soul, mind, lineage, and property.Keywords: Legal protection, Worker, Minor, Islamic Law AbstrakSecara yuridis Indonesia telah mempunyai seperangkat peraturan perundang-undangan untuk menjamin hak-hak anak dan mengurangi dampak bekerja dari anak, salah satunya yaitu UU nomor 13 tahun 2003 tentang Ketenagakerjaan. Sedangkan dalam Islam, anak adalah sebuah titipan Allah SWT kepada orang tua untuk merawat, menjaga, dan memeliharanya dengan baik. Tulisan ini memberikan pemahaman mengenai perlindungan hukum terhadap pekerja anak di bawah umur menurut Undang-Undang nomor 13 tahun 2003 dan untuk mengetahui perlindungan hukum terhadap pekerja anak di bawah umur menurut hukum Islam. Penelitian ini merupakan penelitian kualitatif kepustakaan (Library Research) dengan pendekatan yuridis normatif. Sumber data yang digunakan adalah sumber data primer yaitu Undang-Undang nomor 13 tahun 2003 dan buku yang berjudul Al-Qur’an dan kesejahteraan sosial. Sumber data sekunder yaitu, buku, jurnal, dokumen, peraturan perundangan, dan sebagainya. Hasil penelitian ini  menunjukkan melalui peraturan pada Pasal 68 sampai dengan Pasal 75 Undang-Undang Nomor 13 Tahun 2003 memberikan jaminan perlindungan hukum bagi pekerja anak di bawah umur untuk mendapatkan fasilitas hak-hak dan kewajibannya sebagai pekerja. Hukum Islam memberikan perlindungan terhadap pekerja anak di bawah umur dalam perspektif maslahah. Perlindungan hukum bagi anak yang bekerja dilihat dari kepentingannya termasuk kategori maslahah al-dharuriyah, karena menyangkut kebutuhan pokok umat manusia di dunia dan di akhirat, yakni memelihara agama, jiwa, akal, keturunan, dan harta.Kata Kunci: Perlindungan Hukum Pekerja, Anak di Bawah Umur, Hukum Islam

Abstract

The high number of narcotics abuse in Indonesia cannot be denied because of the minimum assistance or report from the community related to the presence of narcotics crime existing around them. In the perspective of Islamic Law, narcotics is like khamr in which if it is consumed then it will cause mind lost. Therefore, khamr is forbidden in Islam. This paper provides an understanding of legal protection towards the informant of narcotics crime allegation according to The Law Number 35 Year 2009 and to find out the legal protection towards the informant of narcotics crime allegation according to Islamic law. The author employed library research type with normative juridical approach. The research results showed that The Law Number 35 Year 2009 about narcotics gives legal protection towards the informant of narcotics crime allegation systematically. Started from the protection aspect towards the physique, protection towards the psychic, and legal assistance during the process of justice and right reinforcement, and obtain an award. Islamic law gives legal protection to the informant of khamr drinker. Islamic law gives the opportunity by giving the protection towards the informant of khamr drinker not to be punished and the khamr drinker must be punished to implement the punishment and had in line with Islamic teaching namely the execution of whiplash for 40 times.Keywords: Informant Legal Protection, Narcotics, Islamic Law.  AbstrakTingginya angka penyalahgunaan narkotika di Indonesia tidak bisa di pungkiri, karena minimnya bantuan atau laporan dari masyarakat terkait adanya tindak pidana narkotika yang ada di sekitar mereka. Dalam perspektif hukum Islam, narkotika diqiyaskan dengan khamr, yang apabila diminum akan mengakibatkan hilangnya akal. Oleh karena itu khamr diharamkan dalam Islam. Tulisan ini memberikan pemahaman mengenai perlindungan hukum terhadap pelapor dugaan tindak pidana narkotika menurut Undang-Undang nomor 35 tahun 2009 dan perlindungan hukum terhadap pelapor dugaan tindak pidana narkotika menurut hukum Islam. Hasil penelitian menunjukkan Undang-Undang Nomor 35 tahun 2009 tentang narkotika memberikan perlindungan hukum terhadap pelapor dugaan tindak pidana narkotika secara sistematik. Mulai dari aspek Perlindungan terhadap fisik, perlindungan terhadap psikis, dan pendampingan hukum selama proses penegakkan hak dan keadilan, serta mendapatkan penghargaan. Hukum Islam memberikan perlindungan hukum terhadap pelapor peminum khamr. Hukum Islam memberikan kesempatan dengan memberikan perlindungan terhadap pelapor peminum khamr agar tidak dihukum dan wajib bagi seorang peminum khamr untuk melaksanakan hukuman atau had sesuai ajaran Islam, yaitu dengan terlaksananya dera sebanyak 40 kali.Kata Kunci: Perlindungan Hukum Pelapor, Narkotika, Hukum Islam

Abstract

Child murder cases are a topic that the Indonesian people are widely discussing. The increase in this crime has raised significant concern for victims of child murder, either through violence or abuse. However, there are still children who are victims of murder by their biological parents, either intentionally or unintentionally. Children who are victims of murder need legal protection and fulfilment of their rights so that they can grow and develop according to their age and potential. The purpose of this study was to determine the legal protection for victims of child murder according to Law Number 17 of 2016 and Islamic Law. This study uses a qualitative method with a normative juridical approach. The results of the survey indicate that legal protection for victims of child murder according to Law Number 17 of 2016, regulates acts of violence against child murder committed by parents. In Islam, parents who kill their children are not subject to qisas (retribution for murder), but are replaced with diyat (fines).Keywords: Protection; Child Murder; Law; Islamic Law AbstrakKasus pembunuhan anak menjadi topik yang sedang banyak dibahas oleh masyarakat Indonesia. Peningkatan tindak kejahatan ini telah menimbulkan keprihatinan yang besar terhadap korban pembunuhan anak, baik melalui kekerasan maupun penganiayaan. Meskipun demikian, masih ada anak-anak yang menjadi korban pembunuhan oleh orang tua kandungnya sendiri, baik dengan sengaja maupun tidak sengaja. Anak-anak yang menjadi korban pembunuhan membutuhkan perlindungan hukum dan pemenuhan hak-hak mereka agar dapat tumbuh dan berkembang sesuai dengan usia dan potensi yang dimiliki. Tujuan dari penelitian ini adalah untuk mengetahui perlindungan hukum terhadap korban pembunuhan anak menurut Undang-Undang nomor 17 tahun 2016 dan Hukum Islam. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa Perlindungan hukum terhadap korban pembunuhan anak menurut Undang-undang Nomor 17 Tahun 2016 adalah mengatur tindak kekerasan terhadap pembunuhan anak yang dilakukan oleh orang tua. Dalam Islam, Orang tua yang membunuh anaknya tidak dikenai qisas (balasan pembunuhan), melainkan diganti dengan diyat (denda).Kata Kunci: Perlindungan; Pembunuhan Anak; Undang-Undang; Hukum Islam

Abstract

The Village Head Election aims to elect a leader from the village community. There are winners and losers in this process, but not all defeats can be accepted sincerely, with an open heart, and make the village head election a normal process in every leadership change. Few participants or supporters accepted defeat in the village head election, with various reasons or excuses, including feeling disadvantaged by the results obtained, cheating, or even money politics. The rejection of the results of the village head election must lead to a conflict between supporters that has not been resolved, and even the losing party in the village head election filed an objection or dispute over the results of the village head election according to existing procedures according to laws and regulations. The method used in this study is qualitative with a conceptual approach. The study results show that the mechanism for electing the village head in Sukaslamet Village is voting, and several TPSs receive direct monitoring from the Ministry of Home Affairs, even the deputy governor of West Java. In the process of resolving disputes over the results of the Village Head election in Sukaslamet Village, the provisions according to Law Number 6 of 2014 concerning Villages, Article 37 paragraph (6) are that in the event of a dispute over the results of the Village Head election, the Regent or Mayor is required to resolve the dispute within 30 days from the receipt of the lawsuit report.Keywords: Dispute Resolution; Village Head Election; Fiqh Siyasah AbstrakPemilihan Kepala Desa bertujuan untuk memilih pemimpin yang berasal dari masyarakat desa. Dalam proses ini pun tentu ada yang menang dan ada pula yang kalah, akan tetapi tak semua kekalahan itu bisa diterima dengan ikhlas, dengan hati lapang dada, dan menjadikan pilkades adalah proses yang biasa dalam setiap pergantian kepemimpinan. Tidak sedikit pula peserta atau pendukung yang tidak menerima akan kekalahan dalam pilkades, dengan berbagai sebab atau alasan diantaranya adalah merasa dirugikan dengan hasil yang diperolehnya, ada kecurangan atau bahkan ada politik uang. Ketidakterimaan atas hasil pilkades tersebut harus berujung pada konflik antar pendukung yang tak kunjung selesai, dan bahkan terhadap pihak yang kalah dalam pilkades mengajukan keberatan atau sengketa hasil pilkades sesuai prosedur yang ada menurut peraturan perundang-undangan. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan konseptual. Hasil penelitian menunjukkan bahwa mekanisme pemilihan Kepala Desa di Desa Sukaslamet adalah dengan pemungutan suara, beberapa TPS mendapat monitoring langsung dari Kemendagri, bahkan juga Wakil Gubernur Jawa Barat.Kata Kunci: Penyelesaian Sengketa; Pemilihan Kepala Desa; Fiqih Siyasah

Abstract

The Indonesian state with its various cultures has millions of endemic characteristics in every corner. Starting from the diversity of languages, cultures, to religions and beliefs, Indonesia is an example of the unity of all diversity in unity. At least that's the dream contained in "Bhinneka Tunggal Ika" which is tied to the Garuda's legs. The purpose of this research is to find out the urgency of the value of tolerance and peace in the scope of education in Ma'had Al-Zaytun. This research method is a literature study research, which is a research method that collects, analyzes, and studies written sources that are relevant to the research topic or problem. The process of conducting an overview of previously published literature works related to various topics. The result of this study is that the urgency of the values of tolerance and peace in the scope of education in Ma'had Al-Zaytun is very important and these values of tolerance have been applied through education.Keywords: Urgency; Tolerance; Education

Abstract

This study explores the contextual interpretation of Islamic law within the framework of Arab countries and Indonesia, emphasizing the historical, social, and political factors that influence their legal systems. It highlights the complexities of implementing Islamic law, particularly concerning human rights and international legal standards. The research critiques the role of monarchies in Arab countries, where legal systems often reflect a blend of traditional Islamic principles and modern secular influences. The study also discusses the challenges these legal systems face in balancing religious mandates with contemporary human rights issues, as highlighted by various international organizations. The findings indicate that while Islamic law provides a fundamental legal framework, its application is significantly shaped by the socio-political context of each Arab country, leading to diverse interpretations and implementations of justice. Abstract

The stoning punishment, despite having a legal basis in Islam, sometimes sparks controversy as it clashes with modern values such as human rights and national constitutions. This study analyses the dynamics of implementing stoning as a criminal punishment from an Islamic perspective, particularly in Indonesia. It compares it with other Muslim-majority countries such as Saudi Arabia, Pakistan, and Malaysia. This research employs a qualitative method, examining literature in the form of scholarly articles, legal documents, and relevant books. The findings indicate that the enforcement of stoning as a criminal punishment, both in Indonesia and in other Muslim countries, has sparked significant debate and even international condemnation for allegedly violating human rights. At first glance, stoning may appear cruel, but behind this punishment lies a crucial lesson for society—it serves as a deterrent to prevent others from committing adultery. In different countries, the implementation of stoning laws varies depending on the legal system, social acceptance, and interpretations of Islamic law. In Indonesia, the stoning punishment is only enforced in the province of Aceh. The position of Islamic criminal law in Indonesia is influenced by the principle of Bhinneka Tunggal Ika (Unity in Diversity), which emphasises the nation's cultural and religious diversity. Abstract

Education is one of the strategic ways to shape the character of young people who love harmony and peace, especially in a diverse society. Ma'had Al-Zaytun, as an Islamic educational institution, places tolerance and peace as the core of its curriculum. This research aims to analyze the role of Ma'had Al-Zaytun in instilling the values of tolerance and peace in grade 5 students of Madrasah Ibtidaiyah Ma'had Al-Zaytun. This research uses a qualitative approach with a descriptive method. We obtained data from journals, articles, and other sources. The results showed that Ma'had Al-Zaytun has a learning program integrated with tolerance values, such as respect for differences, cooperation between individuals, and interfaith dialogue. These values are instilled through formal classroom activities, daily habituation, and extracurricular activities that encourage student interaction in a peaceful atmosphere. This research concludes that Ma'had Al-Zaytun has succeeded in creating an educational environment that supports the development of tolerance and peace. The findings contribute to the development of relevant educational models in building a harmonious multicultural society.Keywords: Tolerance; Peace; Character Education; Mahad Al-Zaytun

AbstractInformation and communication technology is developing very rapidly. The community is directed to use communication channels that are personal, effective and efficient. This condition leads to the allure of communication via the internet. The allure of internet communication is because the internet frees information and users to move without restrictions. Ignorance of internet users to access news from healthy sources, and spontaneity to share news without checking and rechecking, resulting in hoaks easily spread in the community.Keyword: Hoaks, Internet, Social Media AbstrakTeknologi informasi dan komunikasi berkembang sangat pesat. Masyarakat terarah untuk menggunakan saluran komunikasi yang bersifat pribadi, efektif dan efisien. Kondisi ini mengarah kepada daya pikat komunikasi melalui internet. Daya pikat komunikasi internet disebabkan karena internet membebaskan informasi dan penggunanya untuk bergerak tanpa batasan.
