Abstract

AbstractThe corona pandemic has paralyzed the joints of the economy. Many state-owned companies suffered losses. The private business sector has gradually collapsed. The community screamed because many could not work for a living, while the necessities of life remained demanding. This paper describes how to look for the right business opportunity in the midst of the Large-Scale Social Limitation (PSBB) which aims to break the chain of the spread of the COVID-19 virus.Keywords: Business, Opportunities, Covid-19 AbstrakPandemi corona telah melumpuhkan sendi-sendi perekonomian. Abstract

People in the Old Order era were not fully familiar with the Democratic System. This is because during the old order the people were directly confronted with their participation in democracy through legislative elections. This study uses a qualitative research method with a normative juridical approach. The results of the study stated that for the first time in the Old Order period elections were held in 1955 to elect members of the legislature, while more than 25 political parties participated in the general election. In addition, the condition of the state during the old order was not yet stable politically, socially, and economically, due to pressure from outside and the new state gained independence.Keywords: Old Order; Democracy; Multiparty.

Abstract

The welfare state is an ideal country whose development is focused on improving welfare. This is can doing through giving a more important role to the state in providing universal and comprehensive social services to its citizens. The choice of such a country is also the same as what is thought by a Muslim philosopher named Al-Farabi. Al-Farabi's thought in politics such as the main state resembles the ideal state concept of Plato. The leader is the first mover of society to get happiness, as is the position of the heart in the body, while the other body members are helpers to produce the happiness that they aspire to. This paper presents the thoughts of an Islamic philosopher named Al-Farabi about the Prosperous State of Prosperity. This paper analyzes analytically and explores critically Al-Farabi's view of a State and the conception of a Prosperous State in Islam. The study uses qualitative research methods with a literary approach. The data obtained comes from several books and other sources about the conception of a Prosperous State.

Abstract

Leadership has a major influence on the political and state life of a nation. A leader will also determine the progress and retreat of a country. This paper provides an understanding of the criteria for candidate state leaders whose mechanisms have been determined in the laws and regulations of the Republic of Indonesia and the criteria for candidate state leaders in the view of fiqh siyasah. This study uses a qualitative method with a literature approach. The data in this study were obtained from binding legal materials consisting of legislation, court decisions, legal theory, books, scientific writings and legal journals. The results of this study state that the criteria for candidates for state leaders in the Republic of Indonesia as stated in the laws and regulations have several similarities with the criteria for candidate leaders according to Fiqih Siyasah, the presidential election of the Republic of Indonesia in the period before 2009 was carried out with the concept of Bay'at Ahl al-Hall wa al-'Aqd, the presidential election is carried out in the deliberations of the people's representatives who are in the People's Consultative Assembly (MPR), appointed by the assembly, and when the term of office ends, an accountability report will be asked to the assembly that appointed it. The presidential election of the Republic of Indonesia, in the period after 2009 was carried out by way of direct elections through elections, all levels of society who have the right to vote can make their choice directly, no longer through representatives by people's representatives. But the weakness is that the elected president is not asked to report an accountability report at the end of his term of office.Keywords: Criteria for prospective leaders, mechanisms, fiqh siyasah. AbstrakKepemimpinan berpangaruh besar terhadap kehidupan berpolitik dan bernegara suatu bangsa. Seorang pemimpin juga akan menentukan maju mundurnya sebuah negara. Tulisan ini memberikan pemahaman bagaimana kriteria calon pemimpin negara yang sudah ditetapkan mekanismenya dalam peraturan perundang-undangan Republik Indonesia dan kriteria calon pemimpin negara dalam pandangan fikih siyasah. Penelitian ini menggunakan metode kualitatif dengan pendekatan literatur. Data dalam penelitian ini diperoleh dari bahan-bahan hukum yang mengikat yang terdiri dari perundang-undangan, keputusan pengadilan, teori hukum, buku-buku, tulisan-tulisan ilmiah dan jurnal hukum. Hasil penelitian ini menyatakan bahwa kriteria calon pemimpin negara di Republik Indonesia yang tertuang dalam peraturan perundang-undangan memiliki beberapa persamaan dengan kriteria calon pemimpin menurut Fiqih Siyasah, Pemilihan presiden Republik Indonesia dalam kurun waktu sebelum tahun 2009 dilaksanakan dengan konsep Bay’at Ahl al-Hall wa al-‘Aqd, pemilihan presiden dilakukan di dalam musyawarah para wakil rakyat yang berada di dalam Majelis Permusyawaratan Rakyat (MPR), diangkat oleh majelis, dan ketika berakhir masa jabatan akan dimintai laporan pertanggung jawaban kepada majelis yang mengangkatnya. Pemilihan presiden Republik Indonesia, dalam kurun waktu sesudah tahun 2009 dilakukan dengan cara pemilihan langsung melalui pemilu, semua lapisan masyarakat yang mempunyai hak pilih bisa menentukan pilihannya secara langsung, tidak lagi melalui perwakilan oleh wakil rakyat. Tetapi kelemahannya  presiden terpilih tidak dimintai laporan pertanggung jawaban di akhir masa jabatan. Kata kunci : Kriteria calon pemimpin, mekanisme, fiqih siyasah.

Abstract

AbstractPancasila as the ideology of the Indonesian people should become a spirit. In fact, he only became a mere jargon. The phenomena that occur are evidence, Bisexual, and Transgender, Gay, Lesbians (LGBT), corruption is rampant and has become a culture. God is only present in houses of worship but not present in daily activities. In other words, the concept of the precepts of Godhead fails to become the spirit of the nation. Automatic, the other precepts cannot be applied correctly. Shaykh Al-Zaytun (Grand Chancellor) Dr. (HC. MSU) U.S. Panji Gumilang has the view that Pancasila is a divine teaching. Not just jargon, but Pancasila can be applied well at Ma'had Az-Zaytun. Researchers tried to explore Shaykh's Al-Zaytun views on the Pancasila ideology through the book Al-Zaytun Sources of Inspiration (ASI). Then the view is associated with Siyasah Fiqh. After investigation, there is a relationship between Pancasila and Siyasah Dauliyah (international relations). This proves that the values contained in Pancasila are universal.Keywords: Pancasila, Ideology, Siyasah Dauliyah AbstrakPancasila sebagai ideologi bangsa Indonesia seharusnya menjadi ruh.. Kenyataannya, ia hanya menjadi jargon belaka. Fenomena-fenomena yang terjadi merupakan bukti. Lesbian, Gay, Biseksual, dan Transgender (LGBT), korupsi yang merajalela dan menjadi budaya. Tuhan hanya hadir di rumah ibadah, namun tidak hadir dalam aktivitas keseharian. Dengan kata lain, konsep sila Ketuhanan Yang Maha Esa gagal menjadi ruh bangsa. Otomatis, sila yang lain tidak mampu diaplikasikan dengan benar. Syaykh Al-Zaytun (Grand Chancellor) Dr. (HC. MSU) A.S. Panji Gumilang memiliki pandangan bahwa Pancasila merupakan ajaran ilahi. Bukan hanya sekedar jargon, namun Pancasila mampu diaplikasikan dengan baik di Ma’had Al-Zaytun. Peneliti mencoba menggali pandangan Syaykh Al-Zaytun terhadap ideologi Pancasila melalui buku Al-Zaytun Sumber Inspirasi (ASI). Kemudian pandangan tersebut dikaitkan dengan Fiqih Siyasah. Setelah diteliti, ada relasi antara Pancasila dengan Siyasah Dauliyah (hubungan internasional). Hal ini membuktikan bahwa nilai-nilai yang terkandung dalam Pancasila bersifat universal.Kata Kunci: Pancasila, Ideologi, Siyasah Dauliyah

Abstract

The national vaccination program (Sinovac vaccine), which is intended for all Indonesian people, is one of the government's efforts to control the spread of the corona virus (covid-19). So to guarantee the rights of the people in receiving the vaccine, it is necessary to have an in-depth study of the program in terms of human rights and fiqh siyasa in order to prevent abuse of rights for all Indonesian people. This study aims to determine the right to receive and refuse the sinovac vaccine according to human rights and fiqh siyasah and to determine the implementation of the use of the right to receive and refuse the sinovac vaccine according to human rights and fiqh siyasah. The method used in this study is qualitative with a literature and empirical approach. The results of the study show that according to human rights, accepting and rejecting the Sinovac vaccine is flexible, people can still consciously choose whether they want to be vaccinated or not, because there are no criminal provisions that regulate sanctions for civil society if they do not get vaccinated. Meanwhile, according to siyasa fiqh, although the legal origin of vaccination is allowed, its legal status can change based on the reasons and conditions. The law can be mandatory, sunnah, haram and makruh according to the reasons and conditions.Keywords: Sinovac Vaccine; Human rights; Fiqh Siyasah AbstrakProgram vaksinasi nasional (vaksin Sinovac) yang ditunjukan untuk seluruh masyarakat Indonesia, menjadi salah satu upaya pemerintah dalam pengendalian penyebaran virus corona (covid-19). Maka untuk menjamin hak-hak masyarakat dalam penerimaan vaksin tersebut, perlu adanya kajian yang mendalam mengenai program tersebut dari segi hak asasi manusia serta fiqih siyasah guna mencegah terjadi penyelewengan hak bagi seluruh masyarakat Indonesia. Penelitian ini bertujuan untuk mengetahui hak menerima dan hak menolak vaksin sinovac menurut hak asasi manusia dan fiqih siyasah serta untuk mengetahui pelaksanaan penggunaan hak menerima dan hak menolak vaksin sinovac menurut hak asasi manusia dan fiqih siyasah. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan literatur dan empiris. Hasil penelitian menunjukan bahwa menurut hak asasi manusia, menerima dan menolak vaksin sinovac hukumnya fleksibel,  masyarakat masih bisa memilih secara sadar ingin divaksin atau tidak, karena belum ada ketentuan pidana yang mengatur sanksi bagi masyarakat sipil bila tidak vaksin. Adapun  menurut fiqih siyasah meski asal hukum vaksinasi diperbolehkan, status hukumnya bisa berubah berdasarkan alasan dan kondisinya. Hukumnya bisa menjadi wajib, sunah, haram dan makruh sesuai dengan alasan dan kondisinya.Kata Kunci: Vaksin Sinovac; Hak Asasi Manusia; Fiqih Siyasah

Abstract

Village officials play an important role in managing village assets because they are assets owned by the village, although in managing village assets still have certain limitations, especially in the organization of government. This paper provides an understanding of how village asset management is based on Permendagri Number 1 of 2016 and how the role of langonsari village apparatus, Pameungpeuk District, Bandung Regency in managing village assets. This research is a qualitative research. The data collection technique was carried out by means of field research, using observation methods, and interviews with the Village Head, Village Secretary and several representatives of village officials in Langonsari Village, Pameungpeuk District, Bandung Regency, totaling 5 informants. The results showed that the role of village officials in managing village assets has not gone well, so that the results are not optimal in managing the village's assets. In addition, there are also obstacles such as lack of HR competence and village officials who do not know the specifics of village asset management which greatly affects the implementation in the utilization or management process. Which causes the implementation of village asset management in Langonsari Village has not been in accordance with the regulation of permendagri Number 1 of 2016 concerning Village Asset Management.

Abstract

AbstractLeaders have a very significant role in efforts to prevent the spread of the corona pandemic in the surrounding environment. Both leaders on a national and regional scale. Included in this are the leaders of CSOs, universities, schools and Islamic boarding schools. This article describes the strategy of Shaykh Al-Zaytun in preventing the spread of the Corona Pandemic in Ma'had Al-Zaytun and Al-Zaytun's Contribution to the Surrounding Communities. The method used is a qualitative method with a literature approach. The data obtained comes from lectures and public lectures, apart from various books and scientific journals.Keywords: Leader, Covid-19, Preventive Action AbstrakPara pemimpin memiliki peranan yang sangat signifikan dalam upaya tindakan preventif penyebaran pandemi corona di lingkungan sekitarnya. Baik pemimpin dalam skala nasional maupun daerah. Termasuk dalam hal ini adalah para pimpinan ormas, perguruan tinggi, sekolah dan pondok pesantren. Abstract

Regardless of the size of a city, children living on the streets, the homeless, and begging have become typical aspects of city life. This issue appears to necessitate particular attention. The problems of unmanaged homelessness, street kids, and begging are also present in Tangerang. The purpose of this study was to determine the extent to which the fiqh siyasah has evaluated regional rule 5 of 2012 in Tangerang City. This inquiry utilizes library searches with a policy-centric focus. This study discovered that Law No. 11 of 2009 concerning Social Health and Law No. 13 of 2012 concerning Handling the Poor are used to implement the Tangerang City Regulation, which promotes the right to education, shelter, and work for street children, homeless persons, beggars, and buskers. Numerous aspects of Tangerang City Regulation Number 5 of 2012 are consistent with siyasa fiqh, including the obligation to protect all people regardless of race or religion, the protection of oneself, one's property, and one's family, and the emphasis on equality of rights and equality before the law. In accordance with the Siyasah fiqh principles espoused by Abdul Khalaf Wahhab and Abu A'la al-Maududi, Regional Regulation No. 5 of 2012 also seeks to preserve the human rights of each community, social justice, and legal protection for all.
