Abstract

Penelitian ini membahas urgensi pembentukan regulasi daerah melalui Rancangan Peraturan Daerah (Raperda) tentang Fasilitasi Penyelenggaraan Pesantren di Kota Bandar Lampung. Hingga saat ini, pemerintah kota belum memiliki dasar hukum khusus yang mengatur dukungan dan fasilitasi terhadap pesantren, padahal Undang-Undang Nomor 18 Tahun 2019 tentang Pesantren secara tegas mengamanatkan peran pemerintah daerah dalam pemberdayaan pesantren. Penelitian ini bertujuan untuk mekonstruksi aspek hukum pembentukan Raperda sebagai upaya penguatan kelembagaan dan peningkatan kemandirian pesantren di tingkat daerah. Metode penelitian yang digunakan ialah yuridis normatif dengan pendekatan konseptual dan perundang-undangan, didukung data empiris dari hasil wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa ketiadaan Perda menyebabkan dukungan pemerintah kota masih bersifat administratif dan belum menyentuh aspek substansial seperti pendanaan berkelanjutan, penguatan kurikulum, serta kolaborasi ekonomi pesantren. Oleh karena itu, konstruksi hukum diperlukan dengan menyesuaikan prinsip hierarki norma (Stufenbau Theory) dan asas desentralisasi fiskal untuk menjamin sinkronisasi kebijakan pusat dan daerah. Kesimpulannya, pembentukan Raperda tentang Fasilitasi Penyelenggaraan Pesantren merupakan langkah strategis menuju kepastian hukum, pemerataan dukungan, dan pemberdayaan pesantren yang berkelanjutan, agar mencerminkan fokus pada pembangunan konsep regulasi baru.

Abstract

The amendment to Law Number 39 of 2008 concerning State Ministries has sparked controversy in society, particularly regarding the flexibility of the number of ministries, which is no longer limited. When a legal norm undergoes regulatory changes, there is certainly a background. Law Number 61 of 2024, issued amidst the government's “efficiency” agenda, is an interesting anomaly to study. This study aims to identify and analyze the legal politics of the flexibility of the formation of state ministries in relation to government administration. This research employs a normative, utilizing a statutory, philosophical, conceptual, and case-based approach, framework to examine laws and legal phenomena. The results of this study, namely the legal politics of the flexibility of the formation of state ministries, which was originally limited to a maximum of 34 (thirty-four) ministries, then changed to "unlimited", indicate an attempt to actualize the strengthening of the President's prerogative, which does not require restrictions on ministerial institutional organs. The change in legal norms does not lead to a reduction in the number of ministries, but to an increase in the number of ministries. Law Number 61 of 2024 does not regulate substantive criteria for the formation of the number of ministerial organs, through the clause “needs for the administration of government by the President”, thus giving the President great discretion to determine how many ministerial organs are needed in the administration of government affairs.

Abstract

Forgery of diplomas is a criminal offense that not only damages the integrity of the education system, but also threatens public trust in educational institutions and government. Although diploma forgery has been regulated, the practice of forgery still occurs frequently due to the lack of synchronization between the two regulations. This research aims to analyze the relevance and synchronization between the Criminal Code and the National Education System Law in handling the criminal act of diploma forgery so as to provide a comprehensive understanding of more effective law enforcement. The method used is normative- juridical research with statute approach and conceptual approach. Data is sourced from primary legal materials in the form of provisions in the Criminal Code and the National Education System Law, as well as secondary legal materials such as journals, legal literature, and related court decisions, namely district court decision Number 43/Pid.B/2021/Pn. Liw and the analysis is done descriptively-qualitatively. The results show that the regulation of diploma forgery in the Criminal Code is still general in nature through Article 263 on forgery of letters, while the National Education System Law only emphasizes administrative aspects without clear regulation of criminal sanctions. This has led to dualism in the application of the law and the potential for a legal vacuum in practice

Abstract

The polemic regarding interfaith marriage in indonesia reflects the tension between positive law, religious values and the principles of human rights (HAM) the marriage law explains that a marriage is valid if it is carried out in accordance with each religion, making it difficult for interfaith couples to legally marry. If we look at the universal declaration of human rights (DUHAM), it gives everyone the freedom to marry regardless og religion. In indonesia, religious views on interfaith marriage also vary, some religious prohibit it, while others allow it with certain conditions. These diffrences in rule and views cause confusion and legal uncertainty. Therefore, clearer and fairer rules are needed so that everyone’s right to marry can still be respected without ignoring existing religious values.

Abstract

Di Indonesia sistem transaksi digital dalam lingkup perbankan syariah sudah sejak lama berkembang. Namun di era transformasi, sektor perbankan termasuk perbankan syariah menghadapi tantangan besar terkait keamanan data, perlindungan identitas pribadi, dan risiko siber, yang berdampak pada kepercayaan publik dan stabilitas ekonomi nasional. Pendekatan yang dilakukan menggunakan undang-undang dan konsep, serta menganalisis peraturan yang relevan seperti UU No. 21 Tahun 2008 tentang Perbankan Syariah, UU No. 27 Tahun 2022 tentang Perlindungan Data Pribadi, serta kebijakan OJK dan Bank Indonesia. Implementasi kedaulatan digital dilakukan melalui penguatan layanan sistem elektronik, regulasi, dan pengelolaan data nasional, namun perlindungan hukum bagi nasabah perbankan syaraiah digital masih bersifat umum dan belum diatur secara spesifik. Oleh karena itu diperlukan lembaga khusus untuk melakukan peningkatan pengawasan, dan memperkuat kerja sama dengan OJK dalam melakukan pemantauan penegakan hukum terhadap segala aspek pelanggaran di ruang digital, serta membuat standar operasional yang transparan dan akuntabel agar selaras dengan prinsip kehati-hatian, kepatuhan syariah, dan perlindungan konsumen. Dengan keadaan tersebut, pemerintah baik OJK dan Bank Indonesia patut segera merumuskan regulasi perlindungan hukum perbankan syariah digital yang sesuai prinsip syariah dan menyediakan mekanisme pengaduan yang berbasis digital dan terintegrasi.

Abstract

Infrastructure development has resulted in a decline in rice paddy area, rice production, and rice yields. The harvested rice area in 2024 decreased by 167.57 thousand hectares compared to 2023. This resulted in a decline in rice production in 2024, which amounted to 838.27 thousand tons compared to 2023. This shrinking agricultural land requires model protection of sustainable food agricultural land within the legal framework of land acquisition for public interest. This paper aims to offer a model protection of sustainable food agricultural land in land acquisition law for public interestso it is hoped that it will be able to guarantee protection sustainable food agricultural land and supports the achievement of food security and sovereignty. Using the doctrinal writing method with a conceptual approach and statutory regulations, it was found that: model Protection of sustainable food agricultural land in land acquisition law for public interest is composed of two important aspects, namely planning and institutional coordination. Where these two aspects are things that must be accommodated in change of Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest.
