Abstract

The development of online commerce provides opportunities for Micro, Small, and Medium Enterprises (MSMEs) to expand their markets, increase sales, and reach consumers without geographical boundaries. However, the increase in digital commerce activity is also accompanied by various risks of digital fraud, such as phishing, payment manipulation, fake accounts, malicious links, and data theft. MSMEs play a crucial role in the digital commerce ecosystem because they not only act as sellers but also as managers of accounts, customer data, transaction communications, and payments. This Community Service (PkM) activity aims to increase the knowledge and awareness of MSMEs in Batam City in recognizing and preventing digital fraud in online commerce activities. The activity was carried out through lectures, discussions, and simulations of digital fraud cases involving 30 MSMEs. Evaluation was carried out using pre-test and post-test questionnaires consisting of 20 multiple-choice questions. The results showed an increase in participants' knowledge after being provided with education. The average score increased from 58.4 ± 12.6 in the pre-test to 84.7 ± 9.3 in the post-test, or an increase of 26.3 points. The proportion of participants with good knowledge increased from 13.3% to 63.3%, while the proportion with poor knowledge decreased from 46.7% to 6.7%. The Wilcoxon Signed Rank test showed p < 0.001, indicating a statistically significant increase in knowledge after the education. Satisfaction evaluation also showed a positive response with an average score of 4.0–4.7. This activity demonstrates that education combined with discussions and case simulations can be an effective strategy to improve digital fraud prevention literacy for MSMEs.

Abstract

Sejarah menunjukkan bahwa perempuan pada masa awal Islâm mendapat penghargaan tinggi. Islâm mengangkat harkat dan martabat perempuan dari posisi yang kurang beruntung pada zaman jahiliyah. Di dalam al-Qur’ân, persoalan kesetaraan laki-laki dan perempuan ditegaskan secara eksplisit. Meskipun demikian, masyarakat muslim secara umum tidak memandang laki-laki dan perempuan sebagai setara. Akar mendalam yang mendasari penolakan dalam masyarakat muslim adalah keyakinan bahwa perempuan adalah makhluk Allâh yang lebih rendah karena diciptakan dari tulang rusuk yang bengkok. Selain itu, perempuan dianggap sebagai makhluk yang kurang akalnya sehingga harus selalu berada dalam bimbingan laki-laki. Akibatnya, produk-produk pemikiran Islâm sering memosisikan perempuan sebagai subordinat. Kenyataan ini tentu sangat memprihatinkan, karena Islâm pada prinsipnya menjunjung tinggi kesetaraan dan tidak membedakan manusia berdasarkan jenis kelamin. Oleh karena itu, doktrin maupun pandangan yang mengatasnamakan agama yang sarat dengan praktik diskriminatif sudah selayaknya dikaji ulang, jika ingin Islâm tetap menjadi rahmat bagi seluruh alam.History proves that woman had been highly respected in the early of Islamic period. Islam promoted the woman’s dignity and prestige from being uncivilzed in the time of jahiliyah. Al-Qur’an has explicitly stated that man and woman equity. However, Muslim community does not apply the same view of man-woman equity as stated in the holy scipture. The community believes that Allah creates women differently from men; women are considered weaker since they are created from the rib of the men. Hence, men think that most women are illogical then they must be under the guidance of men.  As a result, the products of Islamic studies place women as the sub-ordianated creation. This is quite apprehensive. On the other hand, Islamic teaching actually holds up the gender equality, it does not differ people from its gender. Consequently, there must be a restudied-discourse on a view or doctrin that answering to the name of religion practicing descriminative act on woman. It is about to purify the Islamic vision of being a rahmat (mercy) for the rest of mankind.

Abstract

The refusal of entry of foreign nationals constitutes a preventive immigration instrument that plays a strategic role in safeguarding the sovereignty, security, and public order of the Unitary State of the Republic of Indonesia. This study aims to analyze the legal framework, implementation, obstacles, and solutions concerning the effectiveness of the policy on the refusal of entry of foreign nationals as an instrument for safeguarding state sovereignty at the Sea Immigration Checkpoint in Batam City, particularly at Batam Center International Port. This research employs an empirical legal research method using statutory, conceptual, and empirical approaches. Data were collected through observation, interviews, documentation, and examination of primary and secondary legal materials. The findings indicate that, normatively, the refusal-of-entry policy has a legal foundation under Law Number 6 of 2011 on Immigration and Minister of Law and Human Rights Regulation Number 9 of 2024. However, its implementation remains not fully effective due to interpretive gaps concerning several grounds for refusal, particularly the clarity of the purpose of visit and the sufficiency of living expenses, which are not yet supported by uniform technical indicators and evidentiary parameters. Effectiveness is also affected by limited secondary inspection facilities, dependence on the reliability of immigration information systems and network connectivity, suboptimal integration of passenger manifest data, and the need to strengthen the competence and consistency of immigration officers. Therefore, regulatory and procedural improvements are required through measurable evidentiary indicators, strengthened infrastructure and immigration information systems, digitalization of refusal documentation, enhanced competence and integrity of immigration officers, and stronger inter-agency coordination. Ultimately, an effective refusal-of-entry policy must balance the facilitation of international mobility with firm law enforcement, thereby ensuring that state sovereignty is protected in an objective, accountable, and sustainable manner.

Abstract

Motor Vehicle Tax (MVT) is one of the primary sources of Regional Original Revenue (Pendapatan Asli Daerah/PAD) that plays a crucial role in financing regional governance and development. However, the high rate of late Motor Vehicle Tax payments by taxpayers has negatively affected regional revenue collection and reduced the effectiveness of law enforcement in regional taxation. This study aims to examine the legal framework governing Motor Vehicle Tax, analyze the implementation of law enforcement against late tax payments, and identify the obstacles and potential solutions at the Bintan Samsat Office. This research employed an empirical legal research method using both a statutory approach and a sociological approach. Primary data were collected through interviews with officers of the Bintan Samsat Office and taxpayers, while secondary data were obtained through a review of relevant legislation, legal literature, and official documents concerning Motor Vehicle Tax. The collected data were analyzed qualitatively to evaluate the effectiveness of law enforcement in addressing late Motor Vehicle Tax payments. The findings reveal that law enforcement against late Motor Vehicle Tax payments at the Bintan Samsat Office has been implemented in accordance with Law Number 1 of 2022 on Financial Relations between the Central Government and Regional Governments, as well as the applicable regional regulations and implementing provisions on regional taxation. Enforcement measures include the imposition of administrative sanctions in the form of fines, public awareness and education programs, the provision of digital tax payment services, and joint vehicle inspection operations conducted with relevant government agencies. Nevertheless, these measures have not yet achieved optimal effectiveness due to several challenges, including taxpayers' low level of legal awareness, economic constraints, limited public understanding of tax obligations, and inadequate supervision and monitoring. In conclusion, although the enforcement of laws governing late Motor Vehicle Tax payments at the Bintan Samsat Office has been carried out in accordance with the prevailing legal framework, it has not been fully effective in improving taxpayer compliance. Therefore, greater efforts are required to strengthen public education and awareness programs, enhance supervision and the consistent enforcement of administrative sanctions, and optimize digital-based tax services to improve taxpayer compliance and maximize regional revenue from Motor Vehicle Tax.

Abstract

Tujuan penelitian ini adalah bagaimana penyelesaian kewajiban PT. Asuransi Jiwa Bakrie kepada pemegang polis produk asuransi diamond investa dan eksistensi Otoritas Jasa Keuangan (OJK) dalam memberikan perlindungan hukum terhadap pemegang polis produk asuransi diamond investa.  Penelitian ini bersifat yuridis normatif dan empiris Otoritas Jasa Keuangan sebagai lembaga independen dalam pengawasan dan pengaturan usaha perasuransian di Indonesia yang memiliki kewenangan sangat besar, namun dalam penyelesaian kasus gagal bayar perusahaan asuransi terkendala karena tidak adanya itikad baik dari PT. Asuransi Jiwa Bakrie dalam memenuhi kewajiban-kewajibannya kepada para pemegang polis produk asuransi diamond investa. Masih berlarutnya penyelesaainan nasabah polis asuransi Bakri Life terutama produk asuransi diamond fiesta karena OJK tidak dapat bertindak secara tegas.  OJK tidak menjalankan fungsi, tugas, tanggung jawab dan kewenangannya dalam memberikan perlindungan hukum kepada pemegang polis sebagaimana mestinya berdasarkan peraturan perundang-undangan yang berlaku.
