Abstract

Abstrak Pariwisata merupakan faktor penting dalam pembangunan ekonomi suatu Negara, karena mendorong perkembangan beberapa sektor perekonomian nasional. Mengingat begitu pentingnya pariwisata bagi perekonomian suatu Negara, maka pariwisata itu harus dikelola dengan sebaik-baiknya agar betul-betul dapat mendatangkan kesejahteraan bagi rnasyarakat. Jadi pengelolaan tersebut dapat diartikan sebagai suatu proses perencanaan, kebijaksanaan penyelenggaraan, serta pemanfaatan umber daya alam yang terkandung didalamnya secara berkelanjutan. Terkait dengan pengelolaan pariwisata, terkait dengan sejumlah prinsip-prinsip pengelolaan yang pada dasarnya menekankan pada nilai-nilai kelestarian lingkungan alarn komunitas, dan nilai-nilai sosial yang memungkinkan wisatawan menikmati kegiatan wisatanya secara bermanfaat bagi kesejahteraan komunitas lokal. Pengelolaan kepariwisataan melibatkan berbagai pihak, seperti pemerintah daerah, pihak swasta (pelaku usaha pariwisata) dan masyarakat yang diharapkan ikut berpartisipasi. Dalam penelitian ini dibahas dua permasalahan. Pertama, Bagaimana prinsip~prinsip penyelenggaraan kepariwisataan menurut Undang-Undang Nomor 10 Tahun 2009 Tentang Kepariwisataan dan Bagaimana hak prioritas masyarakat dalam pengelolaan menurut Undang-Undang Nomor 10 Tahun 2009 Tentang Kepariwisataan Penelitian jenis ini merupakan penelitian hukum normatif karena mempfokuskan analisa terhadap norma hukum yang muncul. Pendekatan yang digunakan ialah pendekatan perundang-undangan dan pendekatan analisa konsep hukum. Mengenai prinsip-prinsip penyelenggaraan kepariwisataan diatur berdasarkan ketentuan Pasal 5 Undang-Undang Nomor 10 Tahun 2009 tentang Kepariwisataan. Mengenai hak-hak prioritas masyarakat dalam pengelolaan yaitu setiap masyarakat mempunyai hak prioritas menjadi pekerja/buruh, konsinyasi, dan pengelolaan dalam bidang usaha pariwisata. Dalam konteks pengelola ini, setiap masyarakat diberikan hak untuk mengusahakan sumber daya yang dimilikinya dalam bidang usaha pariwisata. Konstruksi ini menjadikan masyarakat sekitar tidak lagi menjadi komunitas marginal, tetapi memiliki daya tawar (bargaining position) yang lebih dalam menentukan sendiri dan menikmati keuntungan pariwisata yang terdapat di wilayahnya. Abstract Tourism is an important factor in the economic development of a country, because it encourages the development of several sectors of the national economy. Given the importance of tourism for the economy of a country, tourism must be managed as well as possible so that it can truly bring prosperity to the community. So management can be interpreted as a planning process, implementation policy, as well as sustainable use of natural resources contained in it. Related to tourism management, it is related to a number of management principles which basically emphasize the values of environmental conservation, community values and social values that enable tourists to enjoy their tourism activities in a way that is beneficial to the welfare of the local community. Tourism management involves various parties, such as the regional government, the private sector (tourism business actors) and the people who are expected to participate. In this research has two issues were discussed. first, how the principles of tourism management according to Law Number 10 of 2009 concerning Tourism and How are community priority rights in management according to Law Number 10 of 2009 concerning Tourism This type of research is normative legal research because it focuses on analysis against legal norms that arise. The approach used is the legal approach and legal concept analysis approach. Regarding the principles of the implementation of tourism are regulated based on the provisions of Article 5 of Law Number 10 of 2009 concerning Tourism. Regarding community priority rights in management, each community has priority rights to be workers / laborers, consignment, and management in the field of tourism business. In the context of this manager, every community is given the right to seek the resources it has in the field of tourism business. This construction makes the surrounding community no longer a marginal community, but has a bargaining position that is more in its own right and enjoys the tourism benefits found in its territory.

Abstract

Nowadays in community life there are often conflicts or disputes. Including land disputes that are rife in indigenous communities, especially indigenous peoples in Bali. Various ways have been used by the community to resolve land disputes that occur. Either through court institutions (litigation) or institutions outside the court (non litigation). Many community members have taken alternative dispute resolution because they are considered more effective and do not take more time and money. One alternative dispute resolution that is often taken is through Mediation or peace. Especially in resolving customary land disputes in Bali. Alternative resolution of customary land disputes in Bali is often pursued through a mediation process because it is considered more effective, does not take long and is high cost. In this study, two issues are discussed, namely how the urgency of mediation as an alternative to resolving customary land disputes in Bali and how the mediation process is in alternative settlement of customary land disputes in Bali. This research uses a type of normative legal research because it focuses on the analysis of legal norms that emerge using a statutory approach and a legal concept analysis approach. Due to the complexity of the issue of customary land in Bali and the lack of written rules regarding it, Mediation as an alternative to resolving customary land disputes in Bali is very urgent because disputes can be resolved effectively and efficiently. And the mediation process is not regulated in statutory regulations, so the mediation process tends to be carried out according to the needs of the disputing parties in accordance with the directions and directions of the mediator.

Abstract

This study aims to determine the legal arrangements for predatory pricing in e-commerce transactions in Indonesia, as well as to determine the supervision of predatory pricing in e-commerce transactions in Indonesia. The method used in this research is to use a review of the literature study known as the normative legal research method. The approach used is the case approach, the statutory approach and the legal concept approach which aims to provide a legal view of the vacuum of norm issue due to the lack of affordability of regulations that strictly regulate the eradication of predatory pricing in e-commerce transactions. The analysis technique used is descriptive technique. The predatory pricing method is getting more complex with the presence of e-commerce which is classified as part of business actors who run their business subject to the Anti-Monopoly Law. Predatory pricing in Article 20 of the Anti-Monopoly Law focuses on the intention of eliminating competition which should support the nation's economic development, so that it is contrary to the objective of protecting business competition activities. Supervision of predatory pricing action refers to the basis of the regulation contained in the Anti-Monopoly Law, so based on Article 30 and Article 31 of the law, it shows that there is attributive authority to KPPU as an independent institution to supervise and maintain the business competition climate in Indonesia. The KPPU's efforts to supervise predatory pricing in e-commerce transactions can only be carried out when it is clear that the e-commerce with the benefits is carried out in the jurisdiction of the Republic of Indonesia. If predatory pricing occurs, KPPU has the authority to take actions as outlined in Article 36 of the Anti-Monopoly Law.

Abstract

This research aims to investigate the validity of digital signatures and their evidential value. This study adopts a normative juridical approach, utilizing a statutory method. The findings of this study reveal that: (1) Digital signatures have evidential strength as they are recognized by Article 5 of the ITE Law and are legally binding in civil cases in accordance with the relevant procedural laws of Indonesia. (2) In terms of legality under Indonesian positive law, digital signatures contained in electronic documents are considered valid in civil law, in accordance with the provisions of Article 1320 of the Civil Code and the enactment of Law Number 19 of 2016 Amendment to Law Number 11 of 2008, as well as Government Regulation No.71 of 2019, which deals with the Implementation of Electronic Systems and Transactions.
