Abstract

Electronic commerce is aproduct of the growth in the field of information and communication technology (ICT)has revolutionized the way in which commercial transactions being conductedworldwide. Distributors have realized the potential to utilize social media in terms ofcreating brand awareness, generate revenue, get feedback from consumers. But thereare also distributors who cheat and run away from the responsibility of making theconsumer loses. Consumer protection should receive more attention, because it hasbecome part of the economic development of Indonesia.

Abstract

Effect of bankruptcy on property with marital viewed from the perspectivehukum kepailitan. The problems that arise are related to how the concept of communityproperty in the legislation of law? and how the legal consequences of bankruptcyjudgment against the marital property of husband and wife?. The method of writingusing descriptive normative methods. The results of research related to the concept ofmarital property contained in Article 119 KUHPerdata and Article 35 paragraph (1)Undang Undang Perkawinan and in the event bankruptcy of the marital property ofhusband and wife, it will betreated as joint bankruptcy. So the conclusion of conceptmarital property in the KUHPerdata and Undang Undang Perkawinan havedifferences, both views of common property resources, the extent of union property, theexistence of private property after the marriage, the maintenance of marital property, aswell as the existence and function of mating in marital property agreement and the legaleffect of the decision bankruptcy of the marital property with husband and wife will betreated as joint bankruptcy case in accordance with Article 64 paragraph(1) of UndangUndang Kepailitan.

Abstract

Kajian ini bertujuan untuk mengetahui tentang pengaturan upah minimum bagi pekerja berdasarkan peraturan dibidang ketenagakerjaan serta upaya hukum pekerja terhadap adanya pemberian upah oleh pengusaha dibawah upah minimum. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan pendekatan perundangan serta pendekatan konsep. Hasil penelitian ini menunjukan bahwa pengaturan tentang upah minimum telah diatur dalam Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, namun masih banyak pekerja yang upahnya dibayarkan dibawah upah minimum, pekerja yang hak atas upahnya tida terpenuhi dapat melakukan upaya hukum dengan mediasi atau sengketa kepada pihak pengusaha sesuai dengan tata acara penyelesaian perselisihan hak yang terdapat pada undang-undang No. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial. Kata Kunci: Upah Minimum, Pekerja, pengusaha, penyelesaian. ABSTRACT The aim of this study is to find out about the regulation of minimum wages for workers based on regulations in the field of manpower and workers legal remedies against the existence of wages by employers below the minimum wage. The research method used is normative legal research with a statutory approach and a concept approach. The results of this study indicate that the regulation of minimum wages is regulated in Law no. 13 of 2003 concerning employment, but there are still many workers whose wages are paid below the minimum wage, if their wage rights are not fulfilled then workers can take legal action by mediation or dispute to the employer in accordance with the procedure for resolving rights disputes as regulated in Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes.

Abstract

Penelitian ini bertujuan untuk mengetahui legalitas penggunaan asuransi kredit dalam Peer To Peer Lending (P2P Lending) sebagai perlindungan dana lender dalam maraknya gagal bayar oleh borrower akibat pandemi COVID-19. Metode penelitian hukum normatif digunakan dalam penelitian ini Berdasarkan hasil analisis yang dilakukan penggunaan asuransi kredit dalam P2P Lending belum memiliki regulasi khusus terkait, namun penggunaan asuransi kredit sendiri telah dinyatakan legal dengan adanya perluasan produk asuransi umum yang dijelasakan lebih lanjut dengan dibentuknya ketentuan POJK No. 69/2016, kemudian bentuk perlindungan hukum yang dapat dijamin dengan penggunaan asuransi kredit terhadap dana kreditur berupa pemberian ganti rugi dari perusahaan asuransi umum yang menawarkan produk asuransi kredit tersebut kepada kreditur terhadap ketidakmampuan debitur dalam memenuhi kewajibannya dalam perjanjian pokok. Dimana sebelum memasarkan produk asuransi kredit tersebut, perusahaan asuransi umum harus memenuhi persyaratan yang tertera dalam Pasal 2 Permenkeu No. 124/2008, apabila perusahaan asuransi umum tidak memenuhi persyaratan tersebut maka produk asuransi kredit tidak dapat diedarkan. Dan juga perusahaan asuransi umum yang menawarkan produk asuransi kredit tidak diperkenankan menunda maupun tidak memenuhi kewajibannya dalan pemberian ganti rugi dalam keadaan apapun. Kata Kunci: Peer To Peer Lending, Asuransi Kredit, Perlindungan Hukum ABSTRACT This reasearch aims is to find out the legality of the use of credit insurance in Peer To Peer Lending (P2P Lending) as a protection for lender funds in the rampant defaults by borrowers due to the COVID-19 pandemic. The normative legal research method used in this research. Based on analysis P2P Lending doesn’t have a specific regulation yet, but the use of online money lending service such as peer to peer lending is legal and because of it’s extention of general insurance that’s been explained in the POJK No.69/PJOK.05/2016. Futhermore the type of protection from this law is guaranteed by using credit insurance to the credit fund in giving compensation from the general insurance company that offered the credit insurance products to the creditors to the debtor who can’t keep their contract. Before marketing their products companies should comply with the law that’s stated in Pasal 2 Permenkeu No. 124/2008, if a general insurance company cannot fulfill the requirements then their product will not be sold and these companies are not allowed to postpone and deny giving the proper compensation under any circumstances. Abstract

Tulisan ini bertujuan untuk mengetahui akibat hukum dan upaya penyelesaian perjanjian kredit yang obyek jaminanya bukan atas nama debitur. Penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan undang-undangan. Sifat penelitian dalam penulisan ini adalah analisisi bahan hukum kepustakaan dengan mengkaji literatur berupa jurnal, skripsi, serta buku-buku hukum lainnya sehingga bisa digunakan sebagai dasar dalam menarik kesimpulan permasalahan hukum terkait. Dalam undang-undang Nomor 4 tahun 1996 tentang Hak Tanggungan menjelaskan keterlibatan pihak ketiga dalam memberikan jaminan hak tanggungan yang dimana pengaturannya adalah sama dengan jaminan yang diberikan oleh debitur sendiri. Pemberian kredit oleh bank dilakukan dengan pemberian jaminan oleh pihak debitur sebagai wujud prinsip kehati-hatian. Perjanjian kredit dengan jaminan bukan atas nama debitur dikatakan sah karena tidak melanggar ketentuan hukum serta dalam melakukan perjanjian sudah sesuai dengan syarat sahnya perjanjian dalam Pasal 1320 KUHPerdata. Akibat hukum dalam hal 11 adalah jaminan dapat dieksekusi karena jaminan tersebut sudah mengikat dan berdasarkan kepada UU Hak Tanggungan serta terdapatnya kuasa jaminan oleh pihak ketiga dalam perjanjian kredit tersebut. Penyelesaian sengketa melalui Alternatif Penyelesaian Sengketa merupakan cara untuk mengikat kedudukan jaminan yang tidak bisa dijual sehingga tercapainya win win solution agar salah satu pihak tidak merasa dirugikan. Selain itu terdapat juga upaya penyelesaian secara musyawarah antara kreditur, debitur dan pihak ketiga agar memberikan jaminan secara sukarela untuk pemenuhan kewajiban debitur ketika debitur wanprestasi. Kata Kunci: Perjanjian Kredit, Hak tanggungan, Jaminan milik Pihak Ketiga, Akibat Hukum, Upaya Penyelesaian. ABSTRACT This paper aims to determine the legal consequences and efforts to settle credit agreements that the object of guarantee is not on behalf of the debtor.This paper aims to determine the legal consequences and efforts to settle credit agreements that the object of guarantee is not on behalf of the debtor.This research is a normative legal research using a statutory approach. The nature of the study of the writing is the analysis of the content of literature of literature in journals, scripts, and other legal books and thus can be used asa basis for drawing conclusions on related legal matters. In law number 4 of 1996 on Mortgage Rights describes the involvement of a third party in providing guarantees of mortgage where the arrangement is the same as the guarantee provided by the debtor himself. Lending by banks is carried out by providing guarantees by the debtor as a form of prudential principles. A credit agreement with a guarantee not in the name of the debtor is said to be valid because it does not violate legal provisions and in making the agreement it is in accordance with the valid terms of the agreement in Article 1320 of the Civil Code. The legal consequence in this case is that the guarantee can be executed because the guarantee is binding and based on the Mortgage Law and the presence of a proxy by a third party in the credit agreement. Dispute resolution through Alternative Dispute Resolution is a way to bind a collateral position that cannot be sold so as to achieve a win win solution so that one of the parties does not feel disadvantaged. In addition, there are also deliberative settlement efforts between creditors, debtors and third parties to provide voluntary guarantees for the fulfillment of debtors' obligations when the debtor defaults. Abstract

Tujuan studi ini ialah memberikan pemahaman kepada masyarakat terkait pengaturan hukum dalam penyelenggaraan transportasi online di Indonesia dan untuk memberikan pengetahuan kepada masyarakat khususnya penyedia aplikasi jasa transportasi online, driver dan pengguna jasa terkait pertanggungjawaban perusahaan penyedia aplikasi transportasi online atas kerugian yang diderita pengguna jasa akibat ketidaksesuaian data aplikasi driver dan kendaraan yang dipesan. Penelitian hukum normatif ini menelaah permasalahan norma berupa kekaburan norma. Penelitian ini memuat tiga sumber hukum bahan hukum primer, sekunder dan tersier. Pendekatan dalam penelitian dilakukan melalui pendekatan konseptual. Teknik studi dokumen digunakan teknik pengumpulan bahan hukum. Kemudian terkait proses analisis atas permasalahan hukum akan dilakukan dengan logika deduktif. Hasil penelitian menunjukan bahwa penyelenggaraan transportasi online diatur melalui UU Lalu Lintas dan Angkutan Jalan dan Peraturan Mentri Perhubungan No. 118 Tahun 2018 sebagai suatu penyelenggaraan angkutan sewa khusus. Kemudian berkaitan dengan permasalahan ketidaksesuaian antara data pada aplikasi transportasi online yang memuat identitas driver dan kendaraan yang digunakan dengan identitas driver dan kendaraan yang datang seusai dipesan oleh konsumen, merupakan tanggungjawab dari perusahaan transportasi online selaku penyedia aplikasi jasa transportasi online dalam menyelenggarakan sistem elektronik. Kata Kunci: Ketidaksesuaian, Tanggungjawab, Perusahaan transportasi Online. ABSTRACT The purpose of this study is to provide understanding to the public regarding legal arrangements in the implementation of online transportation in Indonesia and to provide knowledge to the public, especially online transportation service application providers, drivers and service users related to the accountability of online transportation application providers for losses suffered by service users due to incompatibility of driver and vehicle application data ordered. This normative legal research examines the problem of norms in the form of blurring norms in the regulation of accountability of online transportation application providers for losses suffered by consumers from the discrepancy of driver order application data. This study contains three legal sources of primary, secondary and tertiary legal materials. The approach in research is done through conceptual approach. Document study techniques are used legal material collection techniques. Then related to the process of analysis of legal problems will be done with deductive logic. The results showed that the implementation of online transportation is regulated through the Traffic and Road Transport Law and the Minister of Transportation Regulation No. 118 of 2018 as a special rental transportation. Then related to the problem of discrepancies between data on online transportation applications that contain the identity of drivers and vehicles used with the identity of drivers and vehicles that come after ordered by consumers, is the responsibility of online transportation companies as providers of online transportation service applications in organizing electronic systems. Abstract

Penelitian dari karya ilmiah ini mempunyai tujuan agar dapat mengetahui bentuk kerugian konsumen akibat adanya wanprestasi dalam perjanjian jual beli online di masa pandemi covid-19 serta perlindungan hukum terhadap konsumen yang dirugikan akibat adanya wanprestasi dalam perjanjian jual beli online di masa pandemi covid-19. Penelitian ini tergolong kedalam penelitian hukum normatif dengan menggunakan jenis pendekatan perundang-undangan dan pendekatan konseptual. Adapun hasil dari penelitian karya ilmiah ini adalah bentuk kerugian konsumen atau pembeli akibat adanya wanprestasi didalam perjanjian bertransaksi jual beli online di masa pandemi covid-19 yaitu yaitu produk atau barang yang diterima konsumen tidak sesuai dengan kesepakatan, produk atau barang yang diterima konsumen terlambat datang, barang yang diterima konsumen palsu, dan barang yang diterima konsumen cacat. Adapun perlindungan hukum bagi konsumen yang mendapatkan kerugian akibat wanprestasi di masa pandemi covid-19 diatur dalam Undang-Undang No. 11 Tahun 2008 atau UU ITE, Undang-Undang No. 8 Tahun 1999, dan Kitab Undang-Undang Hukum Perdata. Menyelesaikan sengketa jual beli online bisa melewati beberapa cara yaitu melalui peradilan umum atau bisa juga di luar pengadilan. Kata Kunci: Konsumen Wanprestasi, Jual Beli Online, Covid-19 ABSTRACT Research from this scientific paper was aimed to examine the form of consumer losses due to default in online buying and selling agreements during the covid-19 pandemic and legal protection for consumers who are harmed due to default in online buying and selling agreements during the covid-19 pandemic. This research normative legal research using a statutory approach and a conceptual approach. As for the results of this scientific research, it is a form of consumer or buyer loss due to a default in the online buying and selling transaction agreement during the covid-19 pandemic, namely the product or item received by the consumer is not in accordance with the agreement, the product or item received by the consumer is late, goods received by consumers are counterfeit, and goods received by consumers are defective. The legal protection for consumers who suffer losses due to default during the COVID-19 pandemic is regulated in Law No. 11 of 2008 or UU ITE, Law no. 8 of 1999, and the Civil Code. Resolving online buying and selling disputes can be done in several ways, namely through the general court or out of court. Abstract

Collateral requirements and loan resolution in practice at Village Credit Institutions (LPD) Desa Adat Kuta has the goal to find out the condition - what conditions must exist in the granting or lending and how the shape of loan resolution in practice in LPD Desa Adat Kuta. In this study approaches the problem in use in this paper is an empirical juridical approach, by reading literature books Legislation associated with the existing problems in the field. LPD Desa Adat Kuta require collateral in obtaining loans above Rp. 2000.000,00 is to guarantee: Guarantee of Moving Object, Ownership Certificate, and Deposits LPD Desa Adat Kuta. While below Rp. 2000.000,00 the LPD Desa Adat Kuta does not require the existence of a guarantee, only just a letter of recommendation from the Kelian Adat concerned. Form of loan resolution, LPD Desa Adat Kuta in two ways, namely by way of: Non-Litigation and Litigation.
