Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui karakteristik tindakan kekerasan di sekolah yang dilakukan oleh anak dibawah 17 tahun dan untuk mengetahui apakah mediasi dapat digunakan dalam penyelesaian atas tindak kekerasan yang dilakukan oleh anak dibawah 17 tahun di sekolah. Metode penelitian yang digunakan yaitu penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual hukum. Hasil penelitian menunjukkan bahwa karakteristik tindakan kekerasan di sekolah yang dilakukan oleh anak dibawah 17 tahun dikelompokkan menjadi tiga jenis utama: hukuman fisik, pelecehan seksual dan intimidasi yang dimanifestasikan dalam berbagai cara, mulai dari kekerasan verbal atau pelecehan secara sporadis hingga kekerasan fisik dalam bentuk pemerkosaan atau pemukulan. Mediasi dapat digunakan dalam penyelesaian atas tindak kekerasan yang dilakukan oleh anak dibawah 17 tahun di sekolah karena dinilai dapat menyelamatkan masa depan anak yang masih panjang dan sebagai upaya perlindungan hukum bagi anak yang melakukan tindaskan kriminal di sekolah, sehingga anak akan terhindar dari pengaruh buruk yang sangat tidak baik bagi kehidupannya yang masih panjang. Kata Kunci: Mediasi, Anak, Tindak Kekerasan di Sekolah. ABSTRACT The purpose of this study was to determine the characteristics of acts of violence in schools committed by children under 17 years of age and to determine whether mediation can be used in the resolution of acts of violence committed by children under 17 years in schools. The research method used is normative legal research with a statutory approach and a legal conceptual approach. The results showed that the characteristics of acts of violence in schools committed by children under 17 years of age were grouped into three main types: corporal punishment, sexual harassment and intimidation which manifested in various ways, ranging from verbal violence or sporadic harassment to physical violence in the form of rape or harassment. beating. Mediation can be used in resolving acts of violence committed by children under 17 years old at school because it is considered to be able to save a child's long future and as an effort to protect the law for children who commit criminal acts at school, so that children will be protected from bad influences that are very bad. not good for his long life. Abstract

Jurnal ilmiah ini dibuat dengan tujuan untuk memahami bentuk pertangunggjawaban pidana korporasi yang menyebarkan berita hoax dalam hukum positif di Indonesia dan mengetahui pengaturan hukum pidana yang dicita-citakan berkaitan dengan korporasi sebagai pelaku penyebar berita hoax. Berita bohong atau (hoax) merupakan kabar yang tidak sesuai dengan fakta tetapi dibuat seperti benar adanya. Akhir-akhir ini mengenai tindakan penyebaran berita bohong (hoax) seringkali terjadi di dalam dunia maya. Tak hanya perorangan, media online yang dibentuk oleh korporasi juga ikut dalam menyebarkan berita bohong. Isu hukum yang akan dibahas pada karya tulis jurnal ini yaitu bagaimana pertanggungjawaban korporasi terhadap penyiaran berita palsu (hoax) dan bagaimanakah pengaturan hukum pidana yang dicita-citakan (ius constituendum) berkaitan dengan korporasi sebagai pelaku penyebar berita hoax?. Jurnal ini menggunakan metode peneltiain hukum normatif dengan jenis penelitian deskriptif. Sebab menggunakan metode penelitian hukum normatif karena menggunakan produk-produk hukum yang berlaku saat ini dan dijadikan sebagai sumber utama, tujuan dari jenis penelitian deskriptif yaitu mendeskripsikan peristiwa-peristiwa secara sistematis, factual, akurat terhadap suatu objek yang diteliti. Pengaturan mengenai penyebaran hoax di dunia maya atau online yang dimana pelakunya merupakan korporasi belum diatur dan pengaturan hukum pidana yang dicita – citakan berkaitan dengan korporasi sebagai pelaku penyebaran berita bohong masih jauh dari yang dicita – citakan Bangsa Indonesia. ABSTRACT This scientific journal was created with the aim of understanding the form of corporate criminal responsibility that spreads hoax news in positive law in Indonesia and knowing the desired criminal law arrangements related to corporations as perpetrators of hoax news spread. Fake news or (hoax) is news that is not in accordance with the facts but is made to appear to be true. Lately, the act of spreading fake news (hoaxes) often occurs in cyberspace. Not only individuals, online media formed by corporations also participate in spreading fake news. The legal issues that will be discussed in this journal paper are how is corporate responsibility for broadcasting fake news (hoax) and how is the desired criminal law arrangement (ius constituendum) related to corporations as perpetrators of spreading hoax news?. This journal uses a normative legal research method with a descriptive research type. Because it uses normative legal research methods because it uses current legal products and is used as the main source, the purpose of this type of descriptive research is to describe events in a systematic, factual, accurate manner towards an object under study. Arrangements regarding the spread of hoaxes in cyberspace or online where the perpetrators are corporations have not been regulated and the criminal law arrangements that aspire to be related to corporations as perpetrators of spreading fake news are still far from what the Indonesian people aspire to.

Abstract

Penelitian ini bertujuan untuk memahami dan mengkaji terkait urgensi penerapan asas keseimbangan dalam penyusunan perjanjian kerja pada hubungan industrial kontraktualis. Model hubungan industrial yang terdiri dari model hubungan industrial korporatis dan kontraktualis muncul pasca Undang-Undang No. 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang No. 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang. Pada hubungan industrial kontraktualis terdapat keleluasaan pengusaha dan buruh dalam membuat perjanjian tetapi terjadi masalah tidak dijalankannya asas keseimbangan dalam penyusunan perjanjian kerja. Metode penelitian yang digunakan dalam penulisan ini yaitu metode penelitian normative yang mana menggunakan data primer dan sekunder dengan teknik pengumpulan data melalui studi kepustakaan data. Hasil pengumpulan studi kepustakaan data menunjukkan bahwa, Sistem serikat buruh saat ini yang menerapkan sistem Multi Union masih belum dapat memberikan keleluasaan bagi pengusaha dan serikat buruh. Pada saat ini, sistem Multi Union dapat berjejer dengan model kontraktualis demi keleluasaan buruh serta pengusaha dalam menyusun perjanjian. Namun, penyusunan perjanjian model kontraktualis tidak jarang terjadi dominasi kepentingan pengusaha dibanding buruh. Hal itu terjadi karena tidak diterapkannya asas keseimbangan dalam pembuatan perjanjian kerja. Pengusaha dan buruh perlu memahami pentingnya penerapan asas keseimbangan dalam penyusunan perjanjian kerja dalam hubungan industrial kontraktualis. ABSTRACT The purpose of this research is to understand and examine the urgency of implementing the principle of balance in drafting work agreements in contractualist industrial relations. The industrial relations model consisting of a corporatist and contractualist industrial relations model emerged after Law Number 6 of 2023 concerning the Stipulation of Law Number 2 of 2022 concerning Job Creation. In contractual industrial relations, there is flexibility for employers and workers to make agreements, but problems occur when the principle of balance is not implemented in the preparation of work agreements. The research method used in this paper is an empirical research method which uses primary and secondary data and also collects data through the analysis of data literature study. Based on the results of the data literature study, it shows that the current trade union system that implements the Multi Union system is still unable to provide flexibility for employers and labor unions. At this time, the Multi Union system can be aligned with the contractualist model for the freedom of workers and employers in drafting agreements. However, it is not uncommon for contractualist model agreements to be dominated by the interests of employers over wokers. This happened because the principle of balance was not applied in making work agreements. Employers and workers need to understand the importance of applying the principle of balance in drafting work agreements in contractual industrial relations.

Abstract

Penelitian ini bertujuan untuk memahami bentuk pemberdayaan Industri Kecil dan Menengah melalui program One Village One Product (Satu Desa Satu Produk) serta memahami bentuk regulasi dari program One Village One Product. Studi ini menggunakan metode penelitian yuridis empiris dengan pendekatan perundang-undangan dan pendekatan fakta. Penelitian ini menggunakan pendekatan perundang-undangan dan pendekatan fakta karena pada penelitian ini mengkaji peristiwa (fakta) lapangan dengan ketentuan hukum yang berlaku. Hasil studi ini menunjukan bahwa Peraturan Menteri Perindustrian Nomor 14 Tahun 2021 merupakan dasar hukum pemberlakuan program One Village One Product sebagai konsep pemberdayaan Industri Kecil dan Menengah di Indonesia. Selain itu pula, menunjukan pemanfaatan kearifan lokal daerah khususnya di Kabupaten Badung yang dapat dikembangkan melalui program OVOP sesuai dengan Peraturan Menteri Perindustrian Nomor 14 Tahun 2021. Program One Village One Product (OVOP) merupakan suatu konsep yang dilakukan sebagai suatu gerakan sosial dalam upaya mengembangkan suatu wilayah dengan tujuan untuk mengurangi masalah perekonomian dengan cara memanfaatkan potensi lokal daerah sebagai produk yang memiliki nilai jual tinggi. ABSTRACT This study aims to understand the form of empowerment of Small and Medium Industries through the One Village One Product program and understand the regulatory form of the One Village One Product program. This study uses empirical juridical research methods with a statutory approach and a fact approach. This research uses a statutory approach and a fact approach because this study examines field events (facts) with applicable legal provisions. The results of this study show that the Regulation of the Minister of Industry Number 14 of 2021 is the legal basis for the implementation of the One Village One Product program as a concept of empowering Small and Medium Industries in Indonesia. In addition, it also shows the use of regional local wisdom, especially in Badung Regency, which can be developed through the OVOP program in accordance with the Regulation of the Minister of Industry Number 14 of 2021. The One Village One Product (OVOP) program is a concept carried out as a social movement in an effort to develop an area with the aim of reducing economic problems by utilizing the local potential of the region as a product that has a high selling value.

Abstract

Penulisan jurnal ini memikiki tujuan untuk memahami undang-undang yang mengatur penyelesaian pemberhentian pekerjapeke hotel karena pengalihan bisnis atau pengalihan kepemilikan. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan hukum yang relevan dengan hukum ketenagakerjaan dan peraturan lainnya yang relevan dengan tujuan surat ini. Kajian menemukan bahwa sudah banyak regulasi yang mengatur masalah ini, seperti Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, Peraturan Pemerintah Nomor 45 Tahun 2015 tentang Pemutusan Hubungan Kerja dan Tunjangan Pensiun, dan Putusan Mahkamah Agung Nomor 175K menjadi jelas. /pdt.Sus-PHI/2019, Keputusan No. 24 Tahun 1984 Tentang Penyederhanaan Tata Cara Penyelesaian Perselisihan Hubungan Perburuhan, Surat Edaran Menteri Tenaga Kerja Republik Indonesia No. 01/SE/MEN/1988 Tentang Pemberian Manfaat Pensiun , 2004 UU Penyelesaian Perselisihan Hubungan Perburuhan No.2. Dari aturan tersebut, sekalipun terjadi kelebihan pegawai sebagai akibat pengalihan kepemilikan bentuk usaha tetap, perusahaan wajib membayar uang pesangon sesuai dengan aturan yang berlaku dan pekerja dapat sepenuhnya melaksanakan hak-haknya ABSTRACT This article aims to understand the laws governing the settlement of dismissal of employees at hotels due to transfer of business or transfer of ownership. The method used is a normative legal research method with a legal approach that is relevant to labor law and other regulations that are relevant to the purpose of this letter. The study found that there are already many regulations governing this issue, such as Law Number 13 of 2003 concerning Manpower, Government Regulation Number 45 of 2015 concerning Termination of Employment and Retirement Allowances, and Supreme Court Decision Number 175K becomes clear. /pdt.Sus-PHI/2019, Decree No. 24 of 1984 concerning Simplification of Procedures for Settlement of Labor Relations Disputes, Circular Letter of the Minister of Manpower of the Republic of Indonesia No. 01/SE/MEN/1988 Concerning Retirement Benefits, 2004 Labor Relations Dispute Settlement Law No.2. From these rules, even if there is an excess of employees as a result of the transfer of ownership of a permanent establishment, the company is obliged to pay severance pay in accordance with applicable regulations and workers can fully exercise their rights.

Abstract

This study aims to examine whether the current industrial relations court procedural law system is sufficiently ideal as a reference for the settlement of industrial relations disputes in Indonesia and to test the urgency of regulating independent procedural law in the Court of Indonesian Industrial Relations. This is a normative legal research with a statutory approach, a conceptual approach and comparative approach. The result shows that the industrial relation court procedural law system is not ideal enough to accommodate the development and complexity of disputes that occur in Indonesian labor today. Simple, quick and inexpensive way of settling dispute is difficult to occur when the procedural law that is enforced still adopts or is unable to escape from HIR, RBg, RV as civil procedural law (colonial product), which has a general character. The Industrial Relations Court as one of the Special Courts must be able to show its independent character, including in regulating procedural law. Comparative studies with the state of Thailand, Malaysia and Japan are used in this paper in order to illustrate the importance of the regulation concerning the Industrial Relations Court procedures. Changes to the procedural law of the Industrial Relation Court are urgent to do in order to provide an effective and efficient means of dispute resolution that is able to represent simple, quick and inexpensive principles according to the needs or demands of workers and employers today

Abstract

After the enactment of the Law of Government Administration, had implied to shifting paradigm concerning the regime of Administrative Decision from negative fictive became positive fictive. However, the regulation into Law of Government Administration contains several obstacles on pratical scope towards Administrative Court Judges. Meanwhile enactment of Supreme Court regulation however Adiministrative Court Judges searching the suitable method after implication of positive fictive regime in the Administrative Procedural Law System. This study aims to analyze and discuss concerning obstacles and method by the Administrative Court Judges solving the practical obstacles after enactment of the Law of Government Administration. This study results is presented in a descriptive analysis paper.

Abstract

This research has a goal in terms of knowing the arrangements for Fiduciary Guarantees as a national legal instrument, to find out the procedures for executing fiduciary guarantee objects, as well as those disclosed as a result of the issuance of the Constitutional Court Decision Number: 18/PUU-XVII/2019. This study uses a normative legal research method with a statutory approach and an analytic and conceptual approach. The results of this study indicate that fiduciary guarantees as national guarantee legal instruments have been regulated through the Fiduciary Guarantee Act as a legal umbrella in the procedure for implementing fiduciary guarantees. Regarding the procedure for executing fiduciary guarantees, it is specifically regulated in the Fiduciary Guarantee Law by using executorial titles, through public auctions, and also underhand or private sales. However, after the Decision of the Constitutional Court Number: 18/PUU-XVII/2019 raises a legal implication for the execution procedure in terms of buying a default based on an agreement with the debtor who voluntarily surrenders the object and the execution procedure must be based on an agreement and there is already legal remedies against fraudulent breach of contract actually imposed on the creditor's position.

Abstract

The Procedures and Requirements for Payment of Old Age Security stated that the benefits of Old Age Security at the Institution of Social Security Employment can only be taken when workers enter retirement or at the age of 56 years, which elicits opposition reactions from various parties. The focus of this research was conducted to examine and criticize whether the Old Age Security (OAS) and Job Loss Guarantee (JLG) policies for workers who have been terminated have reflected the conception of an Indonesian welfare state that is socially just for all Indonesians, as well as to find out how the future concept (Ius Constituendum) of OAS and JLG for workers reflects the welfare state for social justice. A statutory and conceptual approach are used to support the type of normative legal research in this research. The results of the study indicate that the OAS and JLG policies have not described the concept of an Indonesian welfare state with social justice. To describe the OAS and JLG policies that reflect the welfare state, future policies must still provide convenience for workers to receive OAS benefits and continue to carry out OAS benefits.

Abstract

Mengenai artikel ini bertujuan dalam memberikan pengetahuan mengenai pengaturan Hak Tanggungan atas tanah berdasarkan Hukum Positif di Indonesia serta untuk mempelajari kekuatan hukum Akta Pemberian Hak Tanggungan yang dibuat oleh Pejabat Pembuat Akta Tanah di Indonesia. Metode pada artikel ini adalah penelitian hukum bersifat normatif yang bersifat deskriptif (menggambarkan). Hasil yang didapatkan dari pembahasan dibawah adalah Pengaturan tentang hak tanggungan di Indonesia diatur dalam Undang-undang Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah dan pasal 51 Undang-Undang No. 5 Tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria serta Undang-Undang Dasar (UUD) 1945, Pasal 33 ayat (3). Pengaruh hukum dari Hak Tanggungan yang dibuat dihadapan PPAT memiliki sifat eksekutorial, kekuatan hukum ini didapat dengan cara pemenuhan yang ditentukan seperti tata cara pembuatan Akta Pemberian Hak Tanggungan, syarat keotentikan Akta Pemberian Hak Tanggungan, syarat selanjutnya adalah syarat spesialitas dan publisitas Akta Pemberian Hak Tanggungan dan syarat pencantuman title eksekutorial pada Akta Pemberian Hak Tanggungan yang diterbitkan oleh Badan Pertanahan Nasional (BPN) dan harus memenuhi bentuk yang ditentukan yang diatur dalam ketentuan Pasal 224 HIR. Setelah pada proses Pembebanan Hak Tanggungan sudah terpenuhi syarat serta bentuk diatas, dapat diartikan Akta Pemberian Hak Tanggungan mendapatkan kekuatan hukum yang dimana kekuatan hukum ini bisa melindungi kreditur, debitur, serta pihak ketiga didalamnnya. Kekuatan hukum Akta Pemberian Hak Tanggungan memiliki sifat eksekutorial, dalam artian dapat dieksekusi langsung, tanpa adanya putusan pengadilan. ABSTRACT This article aims to provide knowledge regarding the regulation of Mortgage Rights on land based on Positive Law in Indonesia and to study the legal force of the Deed of Granting Mortgage Rights made by the Official Land Deed Maker in Indonesia. The method in this article is normative legal research that is descriptive. The results obtained from the discussion below are that regulations regarding mortgage rights in Indonesia are regulated in Law Number 4 of 1996 concerning Mortgage Rights over Land and Objects Related to Land and Article 51 of Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles and the 1945 Constitution, Article 33 paragraph (3). The legal effect of the Mortgage Rights made before the Land Titles Registrar has an executorial nature, this legal force is obtained by fulfilling the specified procedures such as the procedures for making the Deed of Granting Mortgage Rights, the conditions for the authenticity of the Deed of Granting Mortgage Rights, the next conditions are the conditions for specialization and publicity of the Deed of Granting Mortgage Rights and requirements for including the executorial title in the Deed of Granting Mortgage Rights issued by the National Land Agency and must comply with the specified form as regulated in the provisions of Article 224 HIR. After the process of Assigning Mortgage Rights has fulfilled the conditions and form above, it can be interpreted that the Deed of Granting Mortgage Rights has legal force, where this legal force can protect creditors, debtors and third parties therein.
