Abstract

After the enactment of the Law of Government Administration implied the regulation concerning the execution of the Administrative Court Judgment. Some pro-cons academic and practice discourses, arguing that the enactment of the Law of Government Administration is the culminating point from the limited role of the Administrative Court on enforcing the administrative law and the argument that the regulation of the Law of Government Administration contains various ambiguities norms in concern with implementation in the Administrative Procedural Law System. This study aims to analyze and discuss concerning the regulation of the provisions of the Administrative Court Ruling execution, constrains in judgment execution and the legal certainty for the justice seekers in the provisions of the Administrative Court Ruling execution after the enactment of the Law of Government Administration. This paper is using a normative and empirical method. The data that using consisted of primary and secondary data, were analyzed using qualitative methods. This study result is presented in a descriptive analysis paper.

Abstract

This research aims to identify the regulation and dispute resolution regarding constructive termination of employment by a company in the perspective of Indonesian Labor Law. This research also compares the constructive termination of employment by companies based on International Law and Japan Labor Law. This is normative legal research with a statutory approach, conceptual approach, and also comparative law approach. The result shows that the constructive termination of employment has not been specifically regulated in the Indonesian Labor Law system, hence it becomes an exploitation gap that is used by companies to be able to terminate employment relations without protecting the worker’s right. The dispute resolution mechanism in terms of constructive termination of employments still refers to the provisions of the Industrial Relations Dispute Settlement Law, namely through bipartite negotiations, tripartite, and industrial relations courts. The constructive termination of employment has been substantively regulated in the ILO Convention C-158 concerning the Termination of Employment, which regulated in Article 4 to Article 6. Further in Japan, the constructive termination of employment is regulated in the Japan Labor Union Act, Act Number 174 of 1949 in Article 7 paragraph (i), (iii), and (iv) with its national enforcement.

Abstract

ABSTRACT This paper specifically examines the concept of law in a sociological study to find out how the law develops and how the law implemented or enforced as a unity in the legal system. This paper-based on the normative juridical method, using legal materials collected and analyzed using qualitative methods. The results show that the sociological of law studies as part of the activities of drafting legal products and the preparation of legal products is not just a juridical process. The processes of transformation from social desires into laws and regulations both in political and sociological contexts do not only occur during the formation of a regulation, continue and continually correct the legal products that produced. Law enforcement related to the sociology of law that observes the reality of how the law is working on different social structures, this scientific approach is expected to not only provide advice related to the development of legal science alone, but also must be applied, but unfortunately in the development of this science itself is not able to develop dynamically because observations that are not equally displayed in providing input to the development of legal protection in Indonesia.

Abstract

The emergence of the Covid-19 pandemic on global economic development has an impact not only on the world economy and investment, but also correlates with aspects of legal development, especially business economy law. One of the areas of business economy law that has also undergone changes in an effort to accommodate the development of modern business transaction practices is bankruptcy law. The purpose of this research is to examine the preventive efforts made by Debtors at Bankrupt Companies to reduce bankruptcy caused by Covid-19 and solutions to protect debtors in companies experiencing bankruptcy. The research method used is juridical normative, primary and secondary legal materials with a statutory approach and a conceptual approach. The results showed that the regulations regarding bankruptcy law in various countries, including Indonesia, tended to change. For example in Europe, in the last few decades European countries have argued that the existing insolvency legal framework has not been able to provide a better economic legal scheme compared to liquidation schemes, so that changes in the substance of bankruptcy have occurred in almost all aspects of the country including the Union. Europe, the American continent, the Asian continent, the African continent, and the Australian continent.

Abstract

The enactment of Law Number 24 of 2011 concerning the Social Security Organizing Body (BPJS Law) has legal implications especially for employers and workers before the enactment of the BPJS Law, the Parties had already agreed that Private Health Insurance as an organizer of workers' health insurance on Collective Labor Agreement (CLA). This condition provides a possibility for the emergence of conflicts of interest. The problem raised in this legal research is how is the regulation concerning the employers' obligations in the health insurance of workers after the enactment of the BPJS Law; what are the legal implications if the CLA in the company before the enactment of BPJS Law has implemented the scheme of Health Insurance for Workers through Private Insurance; and how the legal steps that can be taken in resolving disputes arising related to this matter. This study uses normative legal research methods with a statute approach and a case approach. The result of this research shows that after the enactment of BPJS law, the Employer is obliged to register all of the Workers to BPJS membership as the national provider of health care security system. In terms of double coverage of Workers’ health insurance which impacted the company, the parties could negotiate to amend the CLA based on mutual agreement and good faith. In terms of an interest dispute in implementing the CLA about workers’ health insurance is happening in the future, legal actions that can be taken accordance with the provisions of the Industrial Relations Disputes Settlement Law are bipartite, tripartite disputes settlement through mediation, conciliation, arbitration, and submit a lawsuit to Industrial Relations Court

Abstract

This research is aimed identifying the position of banking institutions as a choice of mediation dispute resolution between bank and customers banking of Indonesia as well as to find out the factors restricting and the cause of the weak level of the banking dispute resolution through mediation is associated with the introduction of PBI No. 8/5/PBI 2006 and PBI No. 10/1/PBI in 2008 about banking mediation.Types of research used in this paper included the normative legal research which put the law as a norm building system. This research uses secondary data where all of these data are analyzed using the qualitative methods. The report of this study is presented in a descriptive analysis. The results of the research indicated position of the institution of mediation as a form of banking is a real double protection for customers of banking Indonesia. As for restricting  factors and causes of weak levels of dispute resolution through banking mediation include:  yet the formation of independent banking mediation agencies banking,  filing a dispute settlement arrangements are still concentrated in Bank Indonesia Jakarta, related publication duty setting the existence of institutions banking mediation without provisions supported sanctions, weak setting regarding the appointment and terms of the mediator, weak implementation arrangements and the peace agreement as well as the results of the pouring is not strictly speaking arrangements regarding sanctions against parties that do not comply with the mediation agreement banking.Keywords: Banking, Alternative Dispute Resolution, Bank Indonesia Regulation on Banking Mediation.

Abstract

Tujuan penelitian ini adalah untuk menemukan dan mengidentifikasi faktor-faktor yang menyebabkan perusahaan belum dan atau tidak menerapkan UMSK Badung sesuai dengan ketentuan Pergub Nomor 76 Tahun 2017, untuk mengklasifikasikan dan merumuskan implikasi-implikasi hukum yang  ditimbulkan dari pengaturan UMSK Badung dalam Pergub Nomor 76 Tahun 2017 terhadap pelaku usaha pada sektor kepariwisataan di Kabupaten Badung dan untuk menemukan mekanisme yang dapat ditempuhdan akibat hukum bila pelaku usaha belum dan atau tidak melaksanakan ketentuan UMSK Badung sesuai dengan ketentuan Pergub Nomor 76 Tahun 2017.Penelitian dilaksanakan dengan menggunakan metode normatif empiris.Data yang digunakan dalam penelitian ini terdiri dari data primer dan data sekunder. Seluruh data yang terkumpul dianalisis dengan menggunakan metode kualitatif.Hasil penelitian menunjukkan pengaturan UMSK Badung masih menghadapi berbagai kendala dalam pelaksanaannya yakni kendala yang timbul  dari aspek penormaan maupun pada tahapan pelaksanaan di lapangan.Adapun implikasi hukum yang potensial timbul dalam pelaksanaan Pergub ini adalah berupa perusahaan kemudian mengajukan penangguhan pembayaran UMSK karena ketidakmampuan membayar dan atau perusahaan berusaha melakukan penundaan pembayaran UMSK dengan komitmen membayar.Sementara adapun mekanisme penyelesaian perselisihan terkait UMSK berdasarkan UU PPHI yaitu diawali dengan perundingan bipartit, tripartit (mediasi, konsiliasi, arbitrase), Pengadilan Hubungan Industrial dan Kasasi ke Mahkamah Agung.Kata Kunci :   Implikasi, Upah Minimum Sektoral Kabupaten, Pelaku Usaha The purpose of this study was to find and identify the factors that caused the company not and or not to implement the Badung UMSK in accordance with the provisions of Governor Regulation Number 76 of 2017, to classify and formulate the legal implications arising from the regulation of UMSK Badung in the Governor Regulation Number 76 of 2017 to business actors in the tourism sector in Badung Regency and to find mechanisms that can be taken and legal consequences if the business actor has not and or has not implemented the provisions of the Badung UMSK in accordance with the provisions of the Governor Regulation Number 76 of 2017. The study was carried out using empirical normative methods. The data used in this study consisted of primary data and secondary data. All collected data were analyzed using qualitative methods. The results of the research indicated the regulation of the Badung UMSK still faces various constraints in its implementation, such as the constraints arising from the normative aspects and the implementation stages in the field. The legal implications that have the potential to arise in the implementation of this Governor Regulation are in the form of a company then submits a payment delay of UMSK due to inability to pay and or the company tries to postpone payment of the UMSK with a commitment to pay. While the dispute resolution mechanism related to UMSK is based on the PPHI Law, which begins with bipartite, tripartite, (mediation, conciliation, arbitration), Industrial relations court and cassation to the Supreme Court.Keywords: Implications, District Sectoral Minimum Wages, Business Actors, Governor Regulation Number 76 of 2017

Abstract

Tujuan dalam penelitian ini adalah untuk mengetahui apakah vaksin Covid-19 dilindungi atau tidak dalam pengaturan hak kekayaan intelektual di Indonesia dan untuk mengetahui kelemahan dan keunggulan pengaturan perlindungan vaksin Covid-19 dalam perspektif hukum kekayaan intelektual di Indonesia. Metode penelitian yang digunakan dalam tulisan ini ialah penelitian hukum normatif yaitu dengan mengkaji Peraturan Perundang-undangan dan pendekatan konseptual hukum yaitu. Hasil Penelitian menunjukkan bahwa vaksin Covid-19 mempunyai sisi hukum yang wajib diberikan perhatian dikarenakan vaksin Covid-19 adalah hasil olah pikir manusia yang dalam ilmu hukum bisa mendapatkan perlindungan hak eksklusif melalui Hak Kekayaan Intelektual yaitu dengan rezim paten ataupun rahasia dagang. Berdasarkan salah satu hal itu masing- masing mempunyai kelemahan serta kelebihan, sehingga perlunya pertimbangan secara matang oleh inventor. Eksklusivitas vaksin Covid-19 dalam hak kekayaan intelektual bukan merupakan suatu hal yang bisa dieksploitasi tanpa batas, tetapi Negara bisa hadir sebagai bentuk tanggung jawabnya melalui penerapan lisensi wajib serta pengungkapan informasi yang memilki sifat rahasia. The purpose of this research is to find out whether the Covid-19 vaccine is protected or not in regulation of intellectual property rights in Indonesia and to find out the weeknesses and advantages of regulating the Covid-19 vaccine protection in the perspective of intellectual property law in Indonesia. The research method used in this paper is normative legal research, namely by reviewing legislation and used method legal concepts. The results of the article show that the Covid-19 vaccine has legal aspects that must to be considered because the Covid-19 vaccine is the result of human thought which in law can get exclusive rights protection through Intellectual Property Rights, namely through the patent regime or trade secrets. Based on that, each of these options has disadvantages and advantages, so it needs to be considered carefully by the iventor. The exclusivity of the Covid-19 vaccine in Intellectual property right, a thing that can be exploited without limits, but the state can be present as a form of responsibility that is implemented through the application of obligations and confidential information.

Abstract

Tujuan studi ini adalah untuk mengetahui bagaimanakah legalitas Saham Dengan Hak Suara Mulitpel, bentuk dan penerapanya pada Emiten serta mengetahui perlindungan hukum terhadap invetor ritel pasca berlakunya Saham Dengan Hak Suara Multipel dan Perubahan Peraturan BEI I-A. Metode yang digunakan dalam penulisan studi jurnal ini yaitu metode penelitian hukum normatif dengan pendekatan perundang – undangan (the statuae approach). Hasil penelitian menunjukan bahwa legalitas dari Saham Dengan Hak Suara Multipel diatur Peraturan Otoritas Jasa Keuangan Republik Indonesia No. 22/POJK.04/2021 tentang Penerapan Klasifikasi Saham Dengan Hak Suara Multipel Oleh Emiten Dengan Inovasi Dan Tingkat Pertumbuhan Tinggi Yang Melakukan Penawaran Umum Efek Bersifat Ekuitas Berupa Saham bentuk dan penerapannya sebagaimana diimplementasikan dalam IPO Emiten GOTO dengan Saham Seri B. sebagai perlindungan preventif kepada investor ritel telah diterapkan Notasi Khusus pada Emiten dengan klasifikasi tertentu. The purposes of this study is to know legality of Multi Voting Shares, form and it’s implementation in listed company and also to know legal protection for retail investors after implementation of Muti Voting Shares and Amandement of BEI Rules I-A. In writing this scientific journal using normative law research with the statue approach was used. The result of this study showed legality for Multi Voting Shares ruled in Indonesia Financial Services Authority (OJK)’s regulations No. 22/POJK.04/2021 concerning of Implementation multi voting shares by company have innovation and high growth rate who listed in BEI then Multi voting shares has implemented in PT Gojek Tokopedia Tbk’s IPO by B Series Stcok. Others result of this study showed prevent legal protection for retail investor has implemented Special Notations policy for listed company with particular classification.

Abstract

Clinical Legal Education is an interesting subject to be developed at the Faculty of Legal, Universitas Udayana. Unlike other subjects, clinical legal education participants get an education in the classroom and go directly to the field (community) to increase students' knowledge and practical abilities in solving problems in society. The purpose of writing this journal is to find out how the form of clinical education-based learning, especially in the form of Street Legal Clinic at the Faculty of Law, Universitas Udayana, and to find a model for developing learning methods based on clinical legal education in the form of street legal clinic that can answer legal problems that develop in society. More optimally, the author uses normative legal research methods with the statutory approach and conceptual approach. The results showed that the form of the clinical legal education which is implemented at the Faculty of Law of Universitas Udayana consisted of three stages of the process, namely the planning component, the experiential component, and the reflection component with the learning models that had been used so far, namely In House Clinic, Out House Clinic, Combination and Street Legal Clinic. The development model suggested in implementing the Street Legal Clinic is to be more optimal in answering problems in the community, namely by accommodating several stages in its implementation, namely the pre-implementation, implementation, and evaluation stages into a single unit that is packaged creatively and comprehensively in collaboration with Clinical Partners.
