Abstract

This study aims to analyze and examine the meaning of unlawful acts by government officials and the authority of state administrative courts in dealing with cases related to unlawful acts by government officials. This study was normative legal research using a statutory approach and a conceptual approach. The primary legal materials uses in this study including Indonesian Civil Code (Burgerlijk Wetboek), Supreme Court Regulation (hereinafter PERMA) Number 2 of 2019 concerning Guidelines For Dispute Settlement Of Government Actions and Authority to Hearing Unlawful Acts By A Government Board And Government Officer (onrechtmatige overheidsdaad) and Law No. 51 of 2009 concerning the second amendment to Law Number 5 of 1986 concerning State Administrative Court to analyses substance related to the meaning of unlawful acts by government officials and the authority of state administrative courts in dealing with cases related to unlawful acts by government officials in accordance with prevailing law. The conceptual approach taken from the meaning of onrechmatigedaad in Burgerlijk Wetboek. This study indicated that the dispute settlement on the unlawful act by the government official mentioned on the Supreme Court regulation (hereinafter PERMA) number 2 of 2019 including dispute settlement process, which shall be file through state administrative court. which stipulates that the authority to hearing the disputes of unlawful acts by the government board or the government officials can be resolved through the state administrative judiciary.

Abstract

The failure to produce a peace agreement as an implementation of the bipartite process open up opportunity for the parties to resolve their disputes by the tripartite stage. At this stage, although the parties are given the opportunity to choose the settlement model used either through arbitration, conciliation or mediation, in general, the parties have a tendency to choose the settlement model through mediation facilitated by the Manpower Office based on process efficiency. The purpose of this study is to identify and determine the characteristics of industrial relations disputes that occur in the tourism sector during the Covid-19 pandemic, to identify and find out the obstacles that occur in the implementation of industrial relations dispute mediation in the tourism sector during the Covid-19 pandemic, to measure and analyze how effective mediation is in resolving industrial relations disputes in the tourism sector during the Covid-19 pandemic besides to find and formulate efforts that can be made to strengthen the position of mediation as an alternative dispute resolution in industrial relations. The method used in this study is an empirical legal research method with a conceptual approach and a case approach.

Abstract

The Procedures and Requirements for Payment of Old Age Security stated that the benefits of Old Age Security at the Institution of Social Security Employment can only be taken when workers enter retirement or at the age of 56 years, which elicits opposition reactions from various parties. The focus of this research was conducted to examine and criticize whether the Old Age Security (OAS) and Job Loss Guarantee (JLG) policies for workers who have been terminated have reflected the conception of an Indonesian welfare state that is socially just for all Indonesians, as well as to find out how the future concept (Ius Constituendum) of OAS and JLG for workers reflects the welfare state for social justice. A statutory and conceptual approach are used to support the type of normative legal research in this research. The results of the study indicate that the OAS and JLG policies have not described the concept of an Indonesian welfare state with social justice. To describe the OAS and JLG policies that reflect the welfare state, future policies must still provide convenience for workers to receive OAS benefits and continue to carry out OAS benefits.

Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui karakteristik tindakan kekerasan di sekolah yang dilakukan oleh anak dibawah 17 tahun dan untuk mengetahui apakah mediasi dapat digunakan dalam penyelesaian atas tindak kekerasan yang dilakukan oleh anak dibawah 17 tahun di sekolah. Metode penelitian yang digunakan yaitu penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual hukum. Hasil penelitian menunjukkan bahwa karakteristik tindakan kekerasan di sekolah yang dilakukan oleh anak dibawah 17 tahun dikelompokkan menjadi tiga jenis utama: hukuman fisik, pelecehan seksual dan intimidasi yang dimanifestasikan dalam berbagai cara, mulai dari kekerasan verbal atau pelecehan secara sporadis hingga kekerasan fisik dalam bentuk pemerkosaan atau pemukulan. Mediasi dapat digunakan dalam penyelesaian atas tindak kekerasan yang dilakukan oleh anak dibawah 17 tahun di sekolah karena dinilai dapat menyelamatkan masa depan anak yang masih panjang dan sebagai upaya perlindungan hukum bagi anak yang melakukan tindaskan kriminal di sekolah, sehingga anak akan terhindar dari pengaruh buruk yang sangat tidak baik bagi kehidupannya yang masih panjang. Kata Kunci: Mediasi, Anak, Tindak Kekerasan di Sekolah. ABSTRACT The purpose of this study was to determine the characteristics of acts of violence in schools committed by children under 17 years of age and to determine whether mediation can be used in the resolution of acts of violence committed by children under 17 years in schools. The research method used is normative legal research with a statutory approach and a legal conceptual approach. The results showed that the characteristics of acts of violence in schools committed by children under 17 years of age were grouped into three main types: corporal punishment, sexual harassment and intimidation which manifested in various ways, ranging from verbal violence or sporadic harassment to physical violence in the form of rape or harassment. beating. Mediation can be used in resolving acts of violence committed by children under 17 years old at school because it is considered to be able to save a child's long future and as an effort to protect the law for children who commit criminal acts at school, so that children will be protected from bad influences that are very bad. not good for his long life. Abstract

This study aims to examine whether the current industrial relations court procedural law system is sufficiently ideal as a reference for the settlement of industrial relations disputes in Indonesia and to test the urgency of regulating independent procedural law in the Court of Indonesian Industrial Relations. This is a normative legal research with a statutory approach, a conceptual approach and comparative approach. The result shows that the industrial relation court procedural law system is not ideal enough to accommodate the development and complexity of disputes that occur in Indonesian labor today. Simple, quick and inexpensive way of settling dispute is difficult to occur when the procedural law that is enforced still adopts or is unable to escape from HIR, RBg, RV as civil procedural law (colonial product), which has a general character. The Industrial Relations Court as one of the Special Courts must be able to show its independent character, including in regulating procedural law. Comparative studies with the state of Thailand, Malaysia and Japan are used in this paper in order to illustrate the importance of the regulation concerning the Industrial Relations Court procedures. Changes to the procedural law of the Industrial Relation Court are urgent to do in order to provide an effective and efficient means of dispute resolution that is able to represent simple, quick and inexpensive principles according to the needs or demands of workers and employers today

Abstract

After the enactment of the Law of Government Administration, had implied to shifting paradigm concerning the regime of Administrative Decision from negative fictive became positive fictive. However, the regulation into Law of Government Administration contains several obstacles on pratical scope towards Administrative Court Judges. Meanwhile enactment of Supreme Court regulation however Adiministrative Court Judges searching the suitable method after implication of positive fictive regime in the Administrative Procedural Law System. This study aims to analyze and discuss concerning obstacles and method by the Administrative Court Judges solving the practical obstacles after enactment of the Law of Government Administration. This study results is presented in a descriptive analysis paper.

Abstract

This research has a goal in terms of knowing the arrangements for Fiduciary Guarantees as a national legal instrument, to find out the procedures for executing fiduciary guarantee objects, as well as those disclosed as a result of the issuance of the Constitutional Court Decision Number: 18/PUU-XVII/2019. This study uses a normative legal research method with a statutory approach and an analytic and conceptual approach. The results of this study indicate that fiduciary guarantees as national guarantee legal instruments have been regulated through the Fiduciary Guarantee Act as a legal umbrella in the procedure for implementing fiduciary guarantees. Regarding the procedure for executing fiduciary guarantees, it is specifically regulated in the Fiduciary Guarantee Law by using executorial titles, through public auctions, and also underhand or private sales. However, after the Decision of the Constitutional Court Number: 18/PUU-XVII/2019 raises a legal implication for the execution procedure in terms of buying a default based on an agreement with the debtor who voluntarily surrenders the object and the execution procedure must be based on an agreement and there is already legal remedies against fraudulent breach of contract actually imposed on the creditor's position.

Abstract

The problem of outsourcing workers extends to the tourism industry. The unique challenge of 'seasonality' makes it more difficult to protect the outsourcing workers' legal rights in the said sector. The research examines the outsourcing regulation in Indonesia by referring to the Job Creation Law, by questioning whether the existing regulations provide prominent legal protection for outsourcing workers, especially in tourism sectors, and how the future law allows for improved protection. The research method used is normative legal research with statutory and legal conceptual approaches. The results of the study show that the amendment of the Manpower Law incorporated into the Job Creation Law and its implementing legal instruments significantly changed outsourcing regulation. As the Job Creation Law has abolished Article 64 of the Manpower Law, the scheme established by the Constitutional Court to prevent companies from exploiting workers in their decisions has become vague in the Job Creation Law. Following global practices, the country can implement a flexible workers policy while simultaneously protecting their rights which Indonesia must adopt.Keywords: Outsourcing, Rights Protection, Tourism Business.

Abstract

This study aimed to analyze the legal system and the attitude of judges to resolve intermarriage divorce cases. This study used a normative juridical method with a statutory and conceptual approach. The study results showed that the judge determines the legal system in intermarriage divorce cases by evaluating the link points and collecting facts to find a relationship between the case and the possible legal system used based on the principles of international civil law. The attitude of judges in efforts to resolve mixed marriage divorce cases should not necessarily apply to Indonesian law. Judges should pay attention to foreign national parties' personal and national legal status based on Article 16 Algemeene Bepalingen van Wetgeving Voor Nederlands Indie.
