Abstract

This study aims to examine the application of the distribution of marital property after divorce through an analysis of Decision Number 1301/Pdt.G/2023/PA.Smn. The research focuses on the division of marital property and the extent to which theories of justice are applied in the adjudication process. This study is significant as the distribution of marital property constitutes a sensitive issue within society, where justice plays a crucial role in shaping judicial decisions. Accordingly, it is necessary to analyze the factors considered by the panel of judges in adjudicating disputes concerning the division of marital property. This research employs a normative legal research method by examining applicable laws and regulations, supported by primary, secondary, and tertiary legal materials. The findings indicate that existing statutory provisions governing the distribution of marital property have not fully fulfilled the criteria of justice for wives who bear a double burden within marriage. In this context, judges are permitted to depart from positive law by applying the principle of contra legem in order to achieve substantive justice for all parties to the marriage.

Abstract

In the face of globalisation and complex socioeconomic concerns, democracy emerges as a critical factor in determining Indonesian public policy. This study dives into the dynamic interaction of democracy within the field of public policy, analysing its implications for Indonesia's legal environment. The major emphasis is on illuminating the difficulties that the legal system has in balancing multiple public opinions and goals during the governing process. This research takes a multidisciplinary approach, incorporating elements from legal political theory, legal sociology, and public policy theory, to reveal a nuanced understanding of democratic processes, institutional roles, and the intricate interplay between policy formulation and the legal framework. The findings highlight the considerable stresses that the dynamic character of democracy places on Indonesia's legal system. The difficult balance between protecting individual rights, fulfilling public interests, and maintaining societal stability is one of the challenges. These problems present possibilities to increase public engagement in policymaking, improve the operation of legal institutions, and design responsive legal enforcement mechanisms that are sensitive to the dynamic aspects of democracy. This research provides important insights into Indonesia's symbiotic link between democracy, public policy, and the legal system. The consequences guide targeted policy and legislative improvements that not only strengthen democratic foundations but also provide justice and legal security for every Indonesian person.

Abstract

Land tenure and ownership in Indonesia are marked by two interrelated structural problems: limited land availability to meet development needs and the concentration of land ownership in the hands of a small group of individuals or business entities. This concentration restricts access to land for much of the population, particularly marginal farming communities whose livelihoods depend on land cultivation. Accordingly, agrarian reform is necessary to restructure land tenure, ownership, use, and utilisation in a more equitable and sustainable manner. West Java Province, as Indonesia’s most densely populated region, faces acute challenges due to limited state land availability and a high proportion of low-income residents. In this context, agrarian reform must be treated as a development priority. This article examines agrarian reform as a regulatory and social engineering instrument aimed at achieving national development objectives, particularly food self-sufficiency and poverty alleviation, using West Java Province as a case study. The findings demonstrate that although agrarian reform in West Java has been relatively well planned and implemented, its effectiveness is constrained by insufficient budgetary support and limited involvement of Regional Government Agencies (Organisasi Perangkat Daerah/OPD), especially in the execution of access reform programmes such as economic empowerment initiatives for agrarian reform beneficiaries. The study argues that stronger institutional coordination and enhanced collaboration among OPD are essential to improve access reform and to realise food security as a central objective of agrarian reform.

Abstract

The Right to Build Certificate (Hak Guna Bangunan/HGB), as evidence of land rights intended to provide legal certainty for right holders, may in practice be revoked through decisions of the State Administrative Court. Such revocation creates legal uncertainty regarding the legal status of the land and the position of the right holder, particularly where the certificate holder is not a party to the proceedings. This research aims to analyze the legal status of land following the revocation of an HGB certificate and to examine the legal remedies available to right holders in order to obtain legal certainty. The research employs a normative juridical approach through a literature review of statutory regulations and court decisions. The findings indicate that following the revocation of HGB Certificate Number B 222 in the name of PT Pertamina (Persero), the land reverts to state land, with Pertamina holding priority rights pursuant to Article 37 paragraph (4) of Government Regulation Number 18 of 2021. However, legal remedies through the priority rights mechanism do not provide absolute legal certainty, as the use of the term “may” reflects governmental discretion rather than a legal obligation. Consequently, legal certainty for PT Pertamina remains conditional and dependent upon administrative discretion, rather than constituting final legal certainty.

Abstract

This study examines the validity of land lease agreements with very long terms, even exceeding 80 years, between foreign nationals and Indonesian citizens as reflected in Supreme Court Decision Number 2785 K/Pdt/2011. The analysis focuses on how the principles of freedom of contract, the principle of justice, and the principle of legal certainty are applied when the structure of the lease clause substantively shifts the nature of the lease into long-term land ownership that resembles a disguised transfer of ownership rights. The study uses a normative juridical method with a statutory regulatory approach and a conceptual approach to the Civil Code, the Basic Agrarian Law, and the doctrine of contract law, which are then linked to the legal considerations of the Supreme Court in the case. The results of the study indicate that unreasonable lease terms, disproportionate rental prices, and unequal bargaining positions give rise to violations of the social function of land and the limits of legal propriety, while also emphasizing the importance of the role of notaries in preventing the emergence of exploitative contract clauses.

Abstract

Land ownership conflicts in Indonesia frequently emerge in plantation regions when local communities cultivate land in fact while corporations assert formal legal control over the same land. This situation generates agrarian disputes that expose structural tensions between the formal land certification regime and long-established patterns of community land use. This study examines the philosophical orientation underlying judicial reasoning in adjudicating disputes concerning Land Use Rights held by PT Perkebunan Nusantara Persero and evaluates the degree of legal protection granted to communities that cultivate land without formal certificates. The research applies a normative legal method through statutory and case approaches. The study relies on primary and secondary legal materials gathered through systematic literature review and analyzes them using deductive reasoning and interpretative analysis. The findings demonstrate that judicial panels in five cases placed primary emphasis on formal legal certainty by prioritizing documentary evidence of title and by disregarding factual realities related to community cultivation. This approach directs adjudication toward procedural compliance and limits consideration of substantive justice and social utility. The analysis further shows that the legal system has not provided adequate protection for affected communities. Effective preventive protection requires clearer regulatory arrangements governing land control by communities and state-owned enterprises. Effective repressive protection requires judges to assess both formal documentation and material evidence in a balanced manner. The study concludes that current judicial practice has not achieved equitable legal protection for communities engaged in cultivated land use.

Abstract

This study aims to analyze the application of administrative sanctions in law enforcement against violations of the prohibition on giving money and goods to homeless people and beggars in the Special Region of Yogyakarta from the perspective of state administrative law. This study uses a normative legal research method (juridical normative) with a statutory approach and a conceptual approach. The results of the study indicate that the application of administrative sanctions against violations of the prohibition on giving money and goods is an instrument of social control that falls under the authority of the regional government as a form of government coercion (bestuursdwang). The applied administrative sanctions, such as verbal warnings, written warnings, and other administrative actions, aim to foster public legal compliance and support the effectiveness of social development and rehabilitation programs. However, the effectiveness of the implementation of these sanctions still faces various obstacles, including low public legal awareness, strong social empathy values ​​that encourage violations, limited apparatus resources, and weak coordination between related agencies. In addition, the validity of administrative actions is highly dependent on the apparatus' compliance with the General Principles of Good Governance (AUPB), especially the principles of legal certainty, proportionality, and accuracy.
