Abstract

Land ownership conflicts in Indonesia frequently emerge in plantation regions when local communities cultivate land in fact while corporations assert formal legal control over the same land. This situation generates agrarian disputes that expose structural tensions between the formal land certification regime and long-established patterns of community land use. This study examines the philosophical orientation underlying judicial reasoning in adjudicating disputes concerning Land Use Rights held by PT Perkebunan Nusantara Persero and evaluates the degree of legal protection granted to communities that cultivate land without formal certificates. The research applies a normative legal method through statutory and case approaches. The study relies on primary and secondary legal materials gathered through systematic literature review and analyzes them using deductive reasoning and interpretative analysis. The findings demonstrate that judicial panels in five cases placed primary emphasis on formal legal certainty by prioritizing documentary evidence of title and by disregarding factual realities related to community cultivation. This approach directs adjudication toward procedural compliance and limits consideration of substantive justice and social utility. The analysis further shows that the legal system has not provided adequate protection for affected communities. Effective preventive protection requires clearer regulatory arrangements governing land control by communities and state-owned enterprises. Effective repressive protection requires judges to assess both formal documentation and material evidence in a balanced manner. The study concludes that current judicial practice has not achieved equitable legal protection for communities engaged in cultivated land use.

Abstract

This study aims to analyze the application of administrative sanctions in law enforcement against violations of the prohibition on giving money and goods to homeless people and beggars in the Special Region of Yogyakarta from the perspective of state administrative law. This study uses a normative legal research method (juridical normative) with a statutory approach and a conceptual approach. The results of the study indicate that the application of administrative sanctions against violations of the prohibition on giving money and goods is an instrument of social control that falls under the authority of the regional government as a form of government coercion (bestuursdwang). The applied administrative sanctions, such as verbal warnings, written warnings, and other administrative actions, aim to foster public legal compliance and support the effectiveness of social development and rehabilitation programs. However, the effectiveness of the implementation of these sanctions still faces various obstacles, including low public legal awareness, strong social empathy values ​​that encourage violations, limited apparatus resources, and weak coordination between related agencies. In addition, the validity of administrative actions is highly dependent on the apparatus' compliance with the General Principles of Good Governance (AUPB), especially the principles of legal certainty, proportionality, and accuracy.

Abstract

This research examines the urgency of reconstructing land policy in the context of digital transformation of the land registration system, focusing on the expansion of notary authority. Using a normative juridical research method with conceptual and statutory approaches, this study analyzes the transformation from conventional to electronic land registration systems. The results indicate that optimizing the electronic land registration system requires three main pillars: adequate technological infrastructure, a comprehensive legal framework, and human resource capacity development. The implementation of electronic systems has proven to increase time efficiency by 60% and reduce operational costs by 40%. The role of notaries has undergone significant expansion, including authority for electronic document verification and digital signature validation. The optimization model developed includes land database integration, digital verification systems, and artificial intelligence-based monitoring mechanisms. The implications of this research provide theoretical and practical foundations for land policy reform that is adaptive to digital technology developments.

Abstract

"Land Information Letter" once played an important role in land registration, but their issuance often caused problems such as overlapping and lack of understanding by village heads regarding the legal basis for their issuance. The government continues to strive to improve the land registration system, one of which is by revising Government Regulation Number 24 of 1997 to Government Regulation Number 18 of 2021.This research is a Doctrinal/normative research that adopts a statutory approach to analyze Land Information Letter. The data used are secondary data in the form of primary legal materials, secondary legal materials, and non-legal materials. Based on an in-depth analysis of the position of the “Land Information Letter” as proof of land ownership in the context of land registration in Indonesia, it can be concluded that the “Land Information Letter” does not provide a strong guarantee of legal certainty regarding land ownership. Government Regulation Number 18 of 2021, which changes the function of the “Land Certificate” to merely instructions in the land registration process, is expected to encourage the public to immediately take care of land registration and obtain stronger land title certificates. However, the implementation of this regulation needs to be carried out carefully and pay attention to the rights of vulnerable communities, as well as ensuring that they get sufficient understanding and information regarding changes in land registration regulations.

Abstract

AbstractThe objective of research was to find out the existing condition of spatial layout the Kutai Kartanegara Regency’s Government used and to find out the policy of Kutai Kartanegara Regency’s Government in spatial layout. In this research, Empirical research on Law (ELr) was used. ELr seeks to understand and explain how law works in the real world. This study was a descriptive developmental one providing a systematical description on the object to be studied, and then a model was developed to address the problems in the field. The research approach used was qualitative approach. The research was taken place in Kutai Kartanegara regency. From the result of research and discussion, two conclusions could be drawn. Firstly, the existing condition of land use in Kutai Kartanegara regency showed the land use for various activities such as: mining, forestry, gardening, and farming. The shift of land function increased over years. Secondly, the government of Kutai Kartanegara regency had developed draft Local regulation of regency about rTrW or Zoning for Kutai Kartanegara regency, but it had not been proposed to the Local Legislative Assembly’s (dprd’s) discussion because there had been no provincial regulation about rTrW or Zoning of East Kalimantan provinceKey words : policy, Special layout, ValorisationAbstrakTujuan penelitian adalah untuk mengetahui existing condition tata ruang yang digunakan Kabupaten Kutai Kartanegara, untuk mengetahui kebijakan Pemerintah Kabupaten Kutai Negara dalam penataan ruang. Pendekatan penelitian menggunakan pendekatan kualitatif. Lokasi penelitian meliputi Kabupaten Kutai Kartanegara. Dari Hasil penelitian dan pembahasan dihasilkan dua kesimpulan, yaitu : pertama, Kondisi existing Penggunaan tanah di Kabupaten Kutai Kartanegara untuk bermacam – macam kegiatan diantaranya yaitu : . Kegiatan  pertambangan  , Kegiatan Kehutanan , Kegiatan Perkebunan, kegiatan pertanian. Terjadi pengalihan fungsi lahan yang meningkat dari tahun ketahun Kedua, Pemerintah Kabupaten Kutai Kartanegara telah membuat Draft Rancangan Peraturan Daerah Kabupaten Tentang RTRW maupun Zonasi Kabupaten Kutai Kertanegara, hanya saja belum bisa diajukan dalam pembahasan dengan DPRD karena Peraturan Daerah Propinsi tentang RTRW maupun zonasi Provinsi Kalimantan Timur belum ada.Kata kunci : Kebijakan, tata ruang, valorisasi

Abstract

Important resources Management rights over customary landnare a resource for human life and community welfare. Human life and community welfare are management rights over customary land. This study looks atnthe role of the state innland management, relevant laws, and land management rights, over land and natural resources. relevant laws, and constitutional rights to landnand natural resources. The aim is to evaluate how well the current laws in place and support the interests ofnthe community. Protect andnrealize the interestsnof the community. Collected through literature studies and using a socio-legal research approach along with a conceptual and legal framework. The results of the study emphasize then need for the government to establish a complete and clear legislative framework for land management, as well as the recognition and defense of 'indigenous peoples' land rights. To address land inequality and ensure equitable and sustainable use and distribution of land resources, this study suggests agrarian reform.
