Abstract

This study examines refugee protection in Indonesia, a country that has not ratified the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol. The research focuses on the legal mechanisms applied in the jurisdiction of the North Sumatra Regional Office of the Ministry of Immigration and Corrections. It aims to explore (a) how international instruments govern refugee protection, (b) how Indonesia’s domestic legal framework functions despite non-ratification, and (c) what strategic measures are required to strengthen national and regional protection systems.Using both normative and empirical legal methods, the study analyzes relevant statutes, international conventions, and interviews with government officers. The findings reveal that, although Indonesia is not formally bound by the 1951 Convention, the moral and constitutional principles of refugee protection apply through its human-rights commitments. Presidential Regulation No. 125 of 2016 on the Handling of Refugees from Abroad provides administrative recognition but lacks comprehensive legal certainty and long-term solutions such as integration, education, and employment access. Strengthening domestic legislation, empowering local governments, and promoting inter-sectoral collaboration are essential for ensuring humane and sustainable refugee protection in Indonesia

Abstract

Penelitian ini mengkaji pengujian formil Undang-Undang Cipta Kerja sebagai instrumen untuk menilai legalitas prosedural pembentukan undang-undang dalam sistem hukum Indonesia. Fokus utama penelitian ini adalah analisis terhadap partisipasi publik dan legitimasi hukum dari perspektif konstitusi dan fiqh siyasah (politik Islam). Penelitian menggunakan pendekatan normatif dengan analisis terhadap Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020 dan Putusan No. 40, 41, 46, dan 50/PUU-XXI/2023, serta mengintegrasikan prinsip-prinsip musyawarah (syura), transparansi, dan keadilan prosedural (al- ‘adalah al-ijra’iyah) dalam etika politik Islam. Hasil kajian menunjukkan bahwa proses legislasi UU Cipta Kerja mengalami cacat formil karena kurangnya partisipasi publik yang bermakna dan minimnya keterbukaan informasi. Dari perspektif fiqh siyasah, proses tersebut tidak mencerminkan nilai-nilai syura dan keadilan prosedural yang menjadi prasyarat legitimasi suatu kebijakan dalam Islam. Oleh karena itu, pengujian formil berperan penting tidak hanya dalam menegakkan konstitusionalitas formal, tetapi juga dalam memastikan bahwa setiap produk hukum lahir dari proses yang adil, partisipatif, dan bermartabat secara moral dan religius.   Kata Kunci: Pengujian Formil, Undang-Undang Cipta Kerja; Partisipasi Publik; Fiqh Siyasah; Syura; Keadilan Prosedural.

Abstract

Pancasila sebagai sumber dari segala sumber hukum di Indonesia. Penelitian ini mengetahui hubungan dasar negara dengan konstitusi negara dan kesepakatan dasar serta fungsi perubahan dalam konstitusi. Metode Penelitian normatif dengan pendekatan perundang-undangan, konseptual, dan sejarah membuktikan suatu negara berdiri karena adanya pondasi dasar negara dan pilar konstitusi yang dapat melindungi serta menjamin tujuan negara. Keduanya mempunyai keterkaitan dan tidak dapat dipisahkan. Pancasila sebagai dasar negara di pembukaan UUD 1945 yakni hubungan formal dan UUD 1945 sebagai kaidah hukum negara yang seluruh unsur bersumber pancasila yakni hubungan material. UUD 1945 mengalami 4 (empat) kali perubahan amandemen pada tahun 1999-2002 oleh MPR (Majelis Permusyawaratan Rakyat) periode UUD 1945, UUD RIS, UUDS 1950, kembali ke UUD 1945, dan kemudian UUD 1945 yang diamandemen I, II, III, dan IV. Sebagai wujud demokrasi suatu negara maksud perubahan konstitusi ialah mengubah pasal yang tidak jelas dan tidak tegas dalam memberikan aturan, mengubah dan menambah aturan yang singkat, tidak lengkap, terlalu banyak mendelegasikan aturan terhadap Undang-Undang dan suatu ketetapan lain, memperbaiki kesenjangan dasar, dan memperbarui ketentuan yang tidak sesuai dengan ketentuan politik dan ketatanegaraan. Sehingga pembentuk konstitusi dihadapkan dengan mengubah konstitusi tanpa harus mengubah identitasnya Pancasila.

Abstract

General elections are the cornerstone of a democratic system. However, in Indonesia, the practice of money politics poses a serious threat to the integrity of elections and political justice. This article aims to analyze the importance of strengthening electoral regulations to combat money politics and provide steps that can be taken to safeguard democracy from such practices. The research methodology employed in this study focuses on analyzing existing legislation, government regulations, electoral institution decisions, and court rulings related to elections and money politics. The results and discussion of this article include concrete measures that can be taken to strengthen electoral regulations and combat money politics in Indonesia. These measures encompass increasing transparency and financial reporting, limiting campaign expenditures, enforcing strict legal measures, educating and raising awareness among the public, monitoring media and campaigns, fostering active public participation, and improving the political financing system. By strengthening electoral regulations, democracy in Indonesia can be protected from the threat of money politics. These steps will create a fair, transparent, and just political environment where the public interest is prioritized. Active participation of the public in elections and strict law enforcement against violations related to money politics are also crucial in preventing such practices. In conclusion, this article highlights the importance of strengthening electoral regulations in safeguarding democracy from the threat of money politics in Indonesia. By enhancing transparency, imposing limits on campaign expenditures, enforcing strict legal measures, educating the public, monitoring the media, encouraging public participation, and reforming the political financing system, Indonesia can build a more fair, transparent, and democratic electoral system.

Abstract

Indonesian courts play an important role in determining the legality of detaining vessels as evidence and ensuring the rights of the parties are protected. The court has the authority to determine the legality of the detention and release the ship if there is insufficient evidence to prosecute or if it turns out that the detention is illegal. This research uses descriptive analytical research methods and a normative legal approach. This research uses the 1982 UNLCOS theory and expert opinions from Cornelis von Bynkershoek, Galliani and Azumi. This research focuses more on discussing ship detention procedures in general justice and ship detention as a form of collateral confiscation. Meanwhile, previous studies focused more on implementing regulations, conformity with civil regulations, the readiness of the courts to implement them, the benefits of implementing P and I in transportation contracts in Indonesian maritime areas and what forms of responsibility apply to carriers in Indonesian Sea Transportation. This research found that every ship will be detained if it does not have a Fishing Permit (SIPI) as intended in Article 27 paragraph (1) to catch fish in Indonesia. Ships that do not have SIPI will be subject to Articles of Law no. 31 of 2004 and Law no. 45 of 2009 so that the ship will be detained by the authorities. The anchoring of the ship is in accordance with Article 93 paragraph (3) of Law No. 45 of 2009 and has a legal basis in Article 1134 of the Civil Code, Article 1878 of the Civil Code, and Article 214 of the HIR/RBG. Based on these results, it can be explained that the process of detaining ships in Indonesia is handled through the courts, and the courts have the authority to issue orders for detaining ships in civil cases involving maritime lawsuits.

Abstract

The importance of brands as a differentiator to avoid imitation is growing as a result of the increasing number of imitations that occur as a result of increasingly advanced trade and wider marketing reach, so that legal protection for brands is increasing. The analytical method uses a literature study. The discussion of the findings of this study is based on the opinions of legal experts and relevant academic journals. This study shows that in a declarative system, the priority of brand rights is determined based on the date of first use. Consequently, the system provides protection even to those who do not officially register their trademarks, allowing them to claim the first use at any time. As stated in its previous ruling, the Tribunal concluded that the two marks have disconcerting similarities in form, composition, combination, elements, sound, sound and appearance. Because PT Surabaya Top and Teh conveyed identical visual, phonetic and conceptual impressions, the group decided that the two were basically identical. The conclusion of this study is that the judge's a quo decision was based on the fact that all elements of similarity exist in the principal and the entire JAGUAR brand which causes harm to the plaintiff, even though his business processes and work are in conflict with the company he named himself which cannot be taken carelessly by others.

Abstract

This journal entitled "Effectiveness of the Principle of Getting to Know Consumers from Banks in Preventing the Crime of Money Laundering" focuses on research to determine policy arrangements for implementing the principle of getting to know consumers in the series of preventing criminal acts of money laundering through banking transactions. The problem in this writing is how to apply the principles regarding consumers in banking transactions and the obstacles encountered by banks in implementing the principles regarding consumers in banking transactions. Based on the problems that have been prepared, it can be concluded that in implementing the principles regarding consumers from banks in order to avoid criminal acts of money laundering, banks are obliged to implement principles regarding consumers continuously and significantly by implementing five basic elements, namely organizational policies, clear policies and procedures regarding consumer acceptance, provisions for ongoing updates and surveys on customer accounts and transactions, provisions for documenting files and reports of suspicious financial transactions, as well as risk management policies and internal regulations. Then, in implementing the principle provisions regarding consumers, all parties must be active in their implementation, both from the banking sector and the people who use banking services.

Abstract

This research was prepared with the aim of providing information related to working time and wages, as well as legal protection for part-time workers based on labor law. This research is studied using a qualitative research method using a juridical-normative approach. The juridical-normative approach in this research is carried out by tracing legal documents and laws and regulations related to the title discussed by the researcher. The results of this research show that the Government of the Republic of Indonesia provides legal protection for part-time workers so that employers cannot be arbitrary in terms of division of working time and work wages for part-time workers.

Abstract

The development of information technology has led to the rise of online gambling, which has become a serious threat in Indonesia. Although prohibited in the Criminal Code and the Electronic Information and Transaction Law, the practice continues to grow due to high accessibility and weak law enforcement. This study aims to analyze the effectiveness of regulations and strategies for handling online gambling to protect the public and maintain socio-economic stability. This study uses a qualitative method with a descriptive-analytical approach. Data was collected through a literature study as well as an analysis of government policies related to the prevention and enforcement of online gambling. The results show that law enforcement still faces technical challenges and regulatory weaknesses. There should be legal reform, strengthening of monitoring technology, and cross-border cooperation. In conclusion, a comprehensive approach is needed to address the negative impacts of online gambling.
