Abstract

The purpose of this study is to examine and analyze the application of criminal sanctions against children as perpetrators of restorative justice-based persecution in Semarang District Court Decision Number 5/Pid.Sus/Anak/2018/PN Smg. The method of approach in this writing is normative juridical. The specification of this research uses analytical descriptive. The data source uses secondary data. Data collection techniques using document studies. To analyze the data, researchers used qualitative analysis methods. The judge in deciding the case of maltreatment committed by a child against a child resulting in serious injury with a restorative justice approach in the Semarang District Court Decision Number 5/Pid.Sus/Anak/ 2018/PN Smg which states that the Defendant ARNES POLINUS SILALAHI alias ARPOL BIN J. SILALAHI is legally and convincingly proven guilty of committing the crime of "Participating in violence against children resulting in injury" as regulated and punishable in Article 80 paragraph (2) of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection is correct. This is in accordance with the charges of the Public Prosecutor and has been based on the facts in the trial, as well as the evidence submitted by the Public Prosecutor in the form of testimony from witnesses that are in accordance with the results of the Visum Et Repertum. And the defendant is considered physically and mentally healthy so that he is considered capable of taking responsibility for his actions. In addition, the legal considerations of the Judge in imposing punishment against the defendant of the crime of violence against children which resulted in serious injury were also appropriate. The judge sentenced the defendant ARNES POLINUS SILALAHI alias ARPOL BIN J. SILALAHI to 5 (five) months imprisonment. The judge has considered both from a juridical point of view, the facts in the trial, the testimony of witnesses, existing evidence, and based on the conviction of the judge.

Abstract

Klitih is a form of street violence committed by teenagers in Yogyakarta and is a serious concern. This research aims to analyze the application of restorative justice in the settlement of juvenile crime in klitih cases. The research approach used is normative juridical and empirical juridical, with primary data in the form of interviews and observations, as well as secondary data which includes legal documents and case reports. The results showed that the application of restorative justice can provide rehabilitation for the perpetrator and facilitate social reintegration, while restoring the victim's condition through the mediation and negotiation process. This process increases the offender's understanding of the impact of their actions, fosters responsibility, and builds empathy. However, the implementation of restorative justice faces obstacles, such as limited resources, community stigma towards offenders, and law enforcement skepticism towards the effectiveness of this method compared to the conventional punishment system. This research offers a new contribution by highlighting the unique sociocultural dynamics of Yogyakarta that influence the effectiveness of restorative justice in klitih cases. In addition, it provides policy recommendations, including community involvement in community-based programs and culturally sensitive training for facilitators. The conclusion of this study confirms that restorative justice has significant potential to effectively address juvenile delinquency, provided it is supported by training, adequate facilities, legal reforms, and strategies that are adaptive to the social and cultural context.

Abstract

The Madiun City Government is facing problems in resolving tax issues, which can be resolved through standard tax objection resolution. The legal basis used is Law No. 28 of 2009 concerning Regional Taxes and Regional Levies. BAPENDA Madiun City has the authority to manage land and building taxes based on these regulations. This research aims to determine legal efforts in filing objections to resolving tax disputes in the PBB-P2 field and the obstacles taxpayers face in making legal objections. The research method used is the normative legal research method. The research results state that taxpayers who feel that the NJOP value determined by Bapenda is not by the condition of their property can submit an appeal to the Tax Court Agency. The process begins with submitting an objection letter to Bapenda within a certain period after sending the tax notification. If the objection is not accepted, the taxpayer can appeal to the Tax Court Agency. However, in the case at the Madiun City Bapenda, the request for an objection to the NJOP value of land and buildings was not granted. There are several obstacles to legal action for taxpayers' objections to resolving tax disputes in the urban PBB sector in Madiun City, such as legal uncertainty and limitations of law enforcement agencies. Legal reform, increasing the capacity of law enforcement agencies, and increasing awareness of tax law among the public are needed to overcome this.

Abstract

Surakarta is one of Central Java province's cities with much development potential, which often causes traffic jams on several roads. This condition hurts the welfare of road users. This research aims to discover and analyze the urgency and implementation of the decision to approve the Traffic Impact Analysis (ANDALALIN) results to create prosperity for the road user community. This research uses an empirical juridical approach. The research results show the importance of implementing the Andalalin approval decision to realize welfare for road users based on various traffic problems in Surakarta. The implementation of the decision to approve the results of Andalalin to realize welfare for road users was issued based on the results of the considerations of the Andalalin evaluation technical team from the Class II Land Transportation Management Center of Central Java Province. The Class II Land Transportation Management Center for Central Java Province is expected to coordinate with various related agencies to implement the Andalalin results approval policy in Surakarta City effectively and efficiently.

Abstract

This research aims to examine and analyze the implementation of restorative justice for cases of assault in the Surakarta City Police, as well as the factors that hinder its effectiveness. The methodological approach utilized is socio-legal, with a descriptive-analytical specification. Data sources consist of both primary and secondary data, gathered through interviews and document studies. Data analysis is conducted using qualitative analysis methods. The implementation of restorative justice for assault cases in the Surakarta City Police employs the Family and Community Group Conference model, involving families and community figures to reach comprehensive agreements. This formally refers to regulations such as Article 16 paragraph (1) letter L of Law No. 2 of 2002 regarding the Indonesian National Police, Article 69 letter b of National Police Chief Regulation No. 14/2012 concerning Investigation Management, and National Police Chief Regulation No. 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice. Investigators take into consideration several aspects, including the belief that restorative justice is beneficial due to its win-win solutions principle and quick resolutions, prioritizing the principles of utility and legal fairness, as well as providing substantial understanding of law enforcement efforts that guide society. Factors hindering the implementation of restorative justice for assault cases in the Surakarta City Police include the conditions and motivations of involved parties, public unawareness of the authority of restorative justice by investigators, limited community role as social control, and cultural responses to the law. To address the challenges in implementing restorative justice, there is a need for the utilization of restorative justice within the criminal justice system through regulations governing its implementation at the investigative level.

Abstract

This study examines the implementation of AI in medical services in Indonesia from a medicolegal perspective, highlighting the urgent need for the development of a robust legal and ethical framework to ensure responsible and safe use of AI while protecting patients' rights and privacy. The problem of the research is to analyze how medical ethics and the positive law in Indonesia regulate the application of Artificial Intelligence (AI) as medical assistance for doctors in medical services. This research employed a combination of the normative juridical approach method and the conceptual analysis approach. Results found that AI regulations in Indonesia are still in the developmental stages and lack specificity. Thus, in cases of errors in AI usage, the legal responsibility remains with the doctors who employed this technology as a tool. This underscores the importance of stringent oversight and the development of more detailed regulations as AI adoption in the medical sector in Indonesia continues to grow.

Abstract

The potential of natural caves spread across Sanggulan Village, Sebulu District, Kutai Kartanegara Regency, East Kalimantan Province, which is a buffer zone for the capital of the Indonesian archipelago, has great potential to be developed as a tourism and educational facility. Currently, ecotourism development is widespread in the IKN area to fulfill the smart city slogan which prioritizes aspects of nature conservation, social, cultural and economic empowerment of local communities as well as learning and educational facilities. These elements significantly influence traditions, socio-economic life of the community and the empowerment of local village products. The village's identity is summarized in a slogan that highlights the richness of natural resources, preservation of cultural heritage and IKN's ecotourism priorities. By using a policy model that is Meaningful Participation, Asset Based Community Development (ABCD) and SWOT analysis of Regional Government policies in regulating or making regulations regarding cave or karst ecotourism, the aim is to increase IKN tourism by integrating cultural, geotourism and legal aspects. This model promotes participatory legal regulation, empowerment of local communities and environmental conservation to encourage sustainable regional development.

Abstract

The post-authoritarian reform era in Indonesia (starting in 1998) was characterized by a push to democratize the state system, leading to the adoption of several foreign, democratic, or "globalized" constitutional concepts. This process demonstrates legal isomorphism where Indonesia aligned its constitutional framework with prevailing international democratic standards. This article analyses the patterns of legal isomorphism in the Indonesian constitutional amendment by examining the dynamic interplay between foreign influence and national identity. For that reason, the research aims to determine a legal isomorphism that can harmonize and balance both foreign influences and the desire for a national identity in the constitutional amendment in Indonesia. To achieve these objectives, the study employed a qualitative research method with a socio-legal and comparative law approach. The research finds three distinct patterns of coercive legal isomorphism concerning the constitutional amendment process in Indonesia. Meanwhile, comparatively, a mimetic isomorphism regarding unamendable provisions of basic structure can be considered for harmonizing and making a balance between foreign influences and national identity in the constitutional amendment. The novelty of this research lies in its identification and classification of legal isomorphism patterns within Indonesia’s constitutional amendments, providing a new perspective on how external legal influences interact with national identity. This study contributes to the broader discourse on constitutional development by offering a framework for analysing the complex relationship between global legal trends and domestic constitutional transformations.

Abstract

Secara politik, DPD sebagai lembaga tinggi belum mampu menunjukkan taring politiknya untuk lebih menunjukan eksistensi dan kinerja yang efektif dalam sistem parlemen di Indonesia. Sebab, peran DPD dalam menjalankan fungsi legislasinya, tidak diikuti dengan pemberian kekuasaan dan kewenangan yang memadai. Penelitian ini bertujuan untuk menganalisis peran Dewan Perwakilan Daerah (DPD) sebagai salah satu lembaga legislasi yang mewakili kedaulatan rakyat dalam sistem ketatanegaraan di Indonesia dalam mengambil kebijakan legilasi terhadap daerah ditinjau dari aspek teori kedaulatan rakyat. Dalam hal ini, penulis menggunakan jenis penelitian, yakni inventarisasi hukum dan penemuan hukum in-concreto. Dalam penelitian ini penulis menggunakan metode penelitian yang dilakukan dengan pendekatan yuridis normatif dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Relevansi dan hambatan yang dihadapi oleh DPD dalam melaksanakan fungsi-fungsi yang ditugaskan kepadanya. Akibatnya, pertimbangan-pertimbangan ini telah menimbulkan kekhawatiran mengenai keterbatasan kekuasaan DPD, yang telah muncul sebagai titik fokusutama dalam diskusi mengenai efektivitas badan perwakilan daerah. Fundamental yang mendasar terkait fungsi dari Dewan Perwakilan Daerah sebagai manifestasi kedaulatan rakyat daerah telah tercantum pada apa yang telah dinormakan dalam Pasal 4 Ayat (2) Peraturan Dewan Perwakilan Daerah Nomor 1 Tahun 2022 Tentang Tata Tertib.
