Abstract

This research discusses two issues which are: First, (1) comparison of similarities and differences of the essence of Constitution and the amendment agreement of Constitution; Second, (2) consequence of those differences towards the current development of Constitution. Normative legal research and post-colonial theory methods are used to analyze the issues. Data are collected from legal materials through literary study and documentary study. With those methods, this research found that the difference between 1950 and 1999 agreement shows inconsistency and divergence in viewing Constitution. Besides that, the agreement on essence of Constitution is performed based on decolonialization paradigm, while the consent of People’s Consultative Assembly in 1999 was mostly based on democractization paradigm.

Abstract

The research will examine the discourse of Pancasila-based constitutional state and the relevance in Indonesia’s life after the amendments to the 1945 Constitution of Indonesia. The research uses a normative legal approach combined with a material-based analysis. The result shows that the founding fathers accepted the concept of Rechtsstaat, but they changed the basis of social-economy from liberal economic system into planned economic system. The change was made by expediting the process of social-economy decolonization and tradition reconstruction; as a result, the constitutional state of Indonesia exists on the basis of welfare state and Indonesian legal traditions. The aims are not only to ensure legal certainty for economic business but also to provide justice and welfare for all citizens. Although it was unclearly stated that the amendments to the 1945 Constitution of Indonesia rejected the free trade economic system, it has eliminated GBHN as the instrument to implement the planned economic system as regulated in Article 33 Verse (1) of the 1945 Constitution of Indonesia. Consequently, the economic system tends to move towards the free trade system, which is parallel to the concept of liberal-constitutional state and principally against the values of Pancasila that aim to grant social justice for all Indonesian citizens.

Abstract

The paper addressed to describe and to explain jihad in nation state context.Jihad is one of the pure concept comes from Islam and not related to territorial boundaries.Jihad can be found wherever Muslims live. While the nation state is a phenomenon,which emerged since the 17th century, caused by decolonization, as well as Indonesia.Contrast to the jihad, the nation state is strongly associated with territorial boundaries.In Indonesia, jihad resonated as a power struggle for independence and also to maintainindependence. However, after Indonesia became an independent nation state, there isalso jihad struggles to break away from it, Aceh with DI/TII and GAM for example.This study aims to uncover and construct the concept of jihad in the context of a nationstate based on Aceh’s case. By using the historical method of critical analysis, thispaper used method of literature research.The results showed that: 1) Jihad is an original intent concept in the defense andestablishment of Indonesia as a nation state, establish by founding fathers. 2) Strugglingin Aceh divided into three: when fighting together with Indonesia, fight for an Islamicstate with the DI/TII, and when tried to establish the State of Aceh by GAM. 3) Theconcept of jihad in the nation states could be identified from the opponent, the mainissue, the imagined community, as well as models of state formation. Aceh when joinedIndonesia together in the early days of independence, was fight to jihad, as well as theDI / TII can still called said jihad, in contrast to GAM that regardless of the jihad forthe sake of upholding the state for the people of Aceh. And for Indonesia itself shouldrefers back to the original intent in jihad conception nowadays.Key words: The concept of Jihad, Nation State, Aceh. Jihad merupakan konsep yang murni datang dari Islam dan tidak terkaitdengan batas-batas wilayah. Jihad ada dimana umat muslim hidup. Sementara negarabangsa merupakan fenomena, yang muncul sejak abad ke-17 dan salah satunyadisebabkan oleh dekolonialisasi, seperti halnya Indonesia.Berbeda dengan jihad, negarabangsa sangat terkait dengan batas teritorial. Di Indonesia, jihad menggema sebagaikekuatan perjuangan kemerdekaan dan juga mempertahankan kemerdekaan. Namunsetelah Indonesia merdeka, muncul juga perjuangan-perjuangan jihad untuk melepaskandiri dari negara bangsa, Aceh dengan DI/TII dan GAM contohnya.Penelitian inibertujuan untuk mengungkap dan mengkontruksi konsep jihad dalam konteks negarabangsa berdasarkan kasus Aceh.Penelitian ini merupakan penelitian kualitatif dan termasuk riset kepustakaan (libraryresearch).Yang menjadi bahan kajian adalah buku-buku sejarah tentang perjalananIndonesia dan Aceh yang sekaligus menjadi sumber data primer.Selain itu data jugadiperoleh dari sumber-sumber sekunder sebagai konfirmasi dan penunjangn sumberdata primer.Setelah dilakukan seleksi, data dianalisis dengan menggunakan metodehistoris analisis kritis, berupa deskripsi, pembahasan serta kritik-kritik terhadappermasalahan, sehingga bisa didapatkan penafsiran yang konfrehensip terhadap masalahyang diteliti.Hasil penelitian: 1) Konsep Jihad sudah ada sejak pembentukan dan menjelma usahapertahanan negara Indonesia. 2) Jihad di Aceh berdinamika dari berjuang bersamaIndonesia, mendirikan negara Islam dengan DI/TII, dan mendirikan negara Aceh denganGAM. 3) Konsep jihad dalam negara bangsa bisa diidentifikasi dari lawan, isu utama,komunitas terbayang yang dicita-citakan, serta model pembentukan negaranya. Acehketika bergabung berjuang bersama Indonesia di awal kemerdekaan melakukan jihad,begitu juga dengan DI/TII masih bisa dikatakan jihad, berbeda dengan GAM yangterlepas dari jihad demi menegakkan negara bagi bangsa Aceh.Kata kunci: konsep jihad, negara bangsa, Aceh.

Abstract

Objective: This article aims to find out the legal accountability of recording transparency in village fund reporting, especially in Gatak Village and Krecek Village, Delanggu District, Klaten Regency, knowing what obstacles are hamper to realizing transparency in recording and reporting village funds.Method: This type of research is empirical or sociological research. Empirical research is a type of research that is used to solve problems by examining secondary data first and then proceeding with conducting primary data research in the field and the application of law in society. The writing method used in this research is descriptive research. Findings: Transparency of Recording and Reporting of Village Funds of Gatak and Krecek Villages, to realize good governance, this has been proven by the accountability reports and the results of interviews that have been carried out by the authors in accordance with existing mechanisms based on Law No. 6 of 2014 concerning Villages, and Minister of Home Affairs number 113 of 2014. About Guidelines for Regional Financial Management. From the interviews, it was found that there were weaknesses in terms of delays in funds coming down from the center, and this would also result in a delay in activities along with existing recording and reporting, in addition to the lack of maximizing technology resources in order to fulfill transparency to the public of existing human resources, but these obstacles are still able to be resolved and do not interfere with the performance of the village government for the better.Purpose: This research is expected to be able to contribute ideas in the development of legal science, especially state administrative law, especially regarding the implementation of good governance at the village level. This research can know the recording and reporting mechanisms to achieve transparency in village fund financial reporting, and can provide the views of readers and writers who have problems with similar problems, also determine the author’s ability to apply the knowledge that has been obtained.Novelty: Different from previous research, this paper has differences that emphasize more on the role of village officials in legal responsibility in the transparency of recording and reporting village funds.

Abstract

ABSTRACTObjective: This study aims to describe the transparency of the 2019 election campaign funds based on the laws and regulations and to find out in depth the legal consequences and sanctions received by election participants in reporting campaign funds.Methodology : The type of research used is empirical juridical, namely, examining everything related to legal provisions, as they have been implemented and how they were implemented in the broader community. The research sites are at the General Election Commission (Komisi Pemilihan Umum) office of Blora Regency, the Office of the Election Supervisory Board, and the Liaison Officer of the participating political parties. In this study, the solution to the problem lies in the transparency of reporting campaign funds for 2019 election participants, which researchers emphasize on the election participants for candidates for members of the Regional People's Representative Council of Blora Regency.Results : Transparency in Law Number 7 of 2017 concerning General Elections and General Election Commission Regulation Number 24 of 2018 as amended by General Election Commission Regulation Number 34 of 2018 concerning General Election Campaign Funds and Implementation of Campaign Fund Reporting for Election Contestants to Realize The 2019 election had been held at the Blora Regency General Election Commission. The General Election Commission of Blora Regency had implemented transparency in campaign finance reports in the 2019 Election. This can be seen from the regulations governing the Blora Regency General Election Commission's strategy in applying the principle of transparency regarding campaign finance reports in the 2019 Election in Blora Regency.Applications of this study: This study is expected to produce a formulation on campaign finance reporting that will be used by the General Elections Commission to develop policies and regulations on campaign finance reporting..  Novelty/ Originality of this study: Election results have had a significant impact on Indonesia's democratic order from year to year. If a regulation is properly implemented, it will have an impact on the general election process's pattern of continuity. The goal of this study was to talk about campaign finance transparency in the 2019 elections in Blora Regency..

Abstract

Law 32 of 2004, regional autonomy, mandates the improvement of community services and regional equity by encouraging community participation. Meanwhile, Law 22 of 2009 on road traffic and transportation mandates the maintenance of traffic infrastructure, particularly The Road Traffic Signaling Devices (APILL) on National Roads, National with Provincial Roads intersection, and National with Regency/City Roads intersection to BPTD–The representative of the Ministry of Transportation. In practice, all maintenances are by Regency/City Transportation Service, including the maintenance of the Traffic Signaling Device (APILL) at National and Provincial Roads intersection with Regency/City Roads. The study aims to evaluate Law 22/2009 and its implementing regulations. Besides, This study also attempts to determine the implementation of Traffic Signaling Devices (APILL), including its procurement and maintenance. The research method was legal research. It involved investigating related regulations to the problem under study. The study concludes the maintenance implementation of traffic signaling devices (APILL) is the best fit for the Regency/City Transportation Service. In addition, it is necessary to revise the governing rules for maintaining traffic infrastructure, the traffic signaling devices (APILL).

Abstract

This study aims, (1) to find out the legal protection of the moral rights of traditional art creators on the recording of a work in Copyright Law; (2) To find out what legal steps can be taken by the Author for the recording of a work in the context of law enforcement in Indonesia. This research method is normative law. Legal approach, case approach and approach, interview research data sources and direct observations and combined with laws and regulations that are closely related to the object of research. Data analysis is descriptive analytical and qualitative withdrawal. The results of the study found a form of legal protection for the rights of the creators of traditional moral arts in the form of performing the basic motion of the Kethek Ogleng dance for recording a work in copyright law in the form of moral rights and economic rights for his creations. Meanwhile, legal steps that can be taken by the author on the recording of the work can be done by recording the change in the name of the right holder, as well as other steps, namely the deletion of the registration of the work to the Minister of Law and Human Rights of the Republic of Indonesia and then re-registering with the creator and rights holder create.

Abstract

This article aims to identify and describe problems regarding the implementation of local government in concurrent affairs of the basic services in Serang. Basic services based on Law Number 23 of 2014, include: a. education; b. Health; and c. Social. This article formulates the following problems: 1. What are the problems in Serang?, 2. What factors that influence the implementation of local government in education, health, and social affairs in Serang?. The author identifies four main problems: a. The condition and availability of regional infrastructure is not optimal; b. lack of innovation and low competitiveness of the regional economy; c. The implementation of governance is not yet optimal; and d. The implementation of local government in education, health and social affairs is not yet optimal. This research uses analytical descriptive research. Based on the four problems mentioned earlier, the local government should immediately design and reorganize priority scale programs in the Regional Development Work Plan (RKPD). It is hoped that it will have good impact toward the community and the implementation of local government based on the principles of good governance.

Abstract

Arrangements for cancellation of child adoption have not been regulated such as child adoption. This problem is the judge's consideration of examining, adjudicating, and deciding on the decision to cancel the adoption decision, there is a disparity and the judge's decision to cancel the adoption decision has fulfilled the idee des recht legal certainty, expediency, and justice. The normative juridical research method is qualitative in nature referring to laws and regulations and court decisions as well as norms that live and develop in society. There were disparities in 3 (three) civil cases, the Surabaya District Court Decision Number 155/Pdt.G/2017/PN.Sby, the Kendal District Court Decision Number 7/Pdt.G/2018/PN.Kdl and the Central Java High Court Number 389 /Pdt./2018/PT.SMG, and the Decision of the Sragen District Court Number 7/Pdt.G/2020/PN. Sby and the Sragen District Court Decision Number 7/Pdt.G/2020/PN.Sgn have fulfilled the values ??of certainty, fairness, and usefulness, but the Sragen District Court's decision is still lacking in its usefulness. While the decisions of the Kendal District Court Number 7/Pdt.G/2018/PN.Kdl and the Central Java High Court Number 389/Pdt./2018/PT.SMG did not meet the values ??of certainty, fairness, and expediency. Sby and the Sragen District Court Decision Number 7/Pdt.G/2020/PN.Sgn have fulfilled the values ??of certainty, fairness, and expediency, but the Sragen District Court's decision is still lacking in its usefulness.
