Abstract

The study reviewed the development of the digital era in the legal field, especially The Electronic General Meeting of Shareholders (GMS), which is ruled by law. The problem formulation was how the electronic GMS, according to positive law in Indonesia, and how the impact on the notarial deed related to its implementation. The method used by the researcher was normative and library study based on the primary material (legislation), secondary material (scientific works, journals, books, documents, and other literature), and tertiary legal materials (legal dictionaries). The study results were that E-GMS is effective today, then regulated in Art 77 UUPT and PJOK Number 16/Pojk.04/2020, so that the Limited Liability Company members can carry out the GMS as usual without being physically present to break the chain of the Covid-19 pandemic. Although the e-GMS arrangements have been regulated in the legislation, the lex specialist derogat lex generalist principle cannot be ignored; article 16 paragraph (1) letter (m) and Article 18 UUJN are still prioritized so that the electronic deed of the GMS cannot be carried out or will resulting in the legal force of the proof being a private deed.

Abstract

Konteks negara hukum demokratis, Peradilan administrasi berkedudukan sebagai instrument bagi rakyat untuk melindungi dan menjamin keterpenuhan Hak Asasinya. Kendatipun secara filosofis berbeda, sebagai penganut civil law system, Belanda dan Indonesia pada asalnya memiliki konseps peradilan administrasi yang hampir sama. Perkembangan wacana dan instrument HAM universal, memungkinan adanya perubahan terhadap paradigma dan konsepsi peradilan administrasi di kedua negara. Tulisan ini mencoba menggambarkan adanya keterkaitan antara perkembangan konsep HAM dengan perubahan paradigma peradilan administrasi di Indonesia dan Belanda. Ini merupakan kajian hukum normatif, dimana bahan-bahan hukum yang ada ditelaah menggunakan pendekatan filosofis yang dipadukan dengan pendekatan perbandingan hukum. Hasil dari kajian yang kami lakukan memperlihatkan bahwa, terdapat hubungan yang erat antara perubahan paradigma dan karakteristik peradilan administrasi dengan perubahan wacana dan instrument HAM. Perkembangan konsep dan corak Peradilan administrasi kedua negara pasca lahirnya GALA (General administrative law act) di Belanda dan amandemen konstitusi di Indonesia, mengarah pada satu pola dan karakteristik yang sama, yakni lebih bersifat liberal dan individualistic. Hal itu terlihat dari pola relasi kuasa, dasar keabsahan dan lingkup tindakan administratif, serta meluasnya lingkup kompetensi peradilan administrasi, yang juga terkait dengan tindakan keperdataan dan tindakan hukum faktual.

Abstract

Criminal foreclosures and general foreclosures of bankruptcy are different. Normative juridical research with statutory and case approaches. The aim is to find out and analyze criminal enforcement and bankruptcy at the same time that there was a conflict in the execution of the Pandawa Mandiri Group Savings and Loans Cooperative case (KSP Pandawa). The results of KSP Pandawa and Nuryanto's research, the chairman of KSP Pandawa went bankrupt, the decision of the Commercial Court at the Central Jakarta District Court and all assets were publicly confiscated. Nuryanto was convicted by the Depok District Court on charges of fictitious investment and an additional crime of auctioning all economic assets for the state. The Pandawa KSP Curator Team filed a lawsuit for a criminal verdict that was strengthened by the Supreme Court's Cassation Decision Number 3 K/Pdt.Sus-Bankrupt/2019. Amar Cassation requests that the Depok District Attorney hand over all confiscated assets to the Pandawa KSP Curator Team. The cassation decision fulfills legal benefits, KSP Pandawa can register receivables with the curator for verification and will receive proportional loss returns as stipulated in Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations.

Abstract

This legal study investigates the implications of the proposed renaming of West Java Province to Tatar Sunda Province, employing the approach of intuitive semantic dualism to address issues of language, territory, ethnicity, and national identity. The research draws on data from academic journals, books, media reports, and interviews, comparing secondary data with field opinions on the languages and bordering regions of the Sundanese dialect. The findings reveal that, although the Sundanese linguistic system was expected to play a crucial role in the renaming process and promote territorial unity, it falls short due to the inclusion of regions such as Banten, pre-independence Batavia, and bilingual border areas in the east and north. This geographic and linguistic complexity means that the name "Tatar Sunda" does not accurately reflect the distinct linguistic, cultural, and territorial identities of the Sundanese people as described by J. van Baal. Legally, while there are no barriers to the renaming policy, the proposed name fails to adequately represent the region's diverse identities. Consequently, the study recommends further exploration of more representative alternatives that align with the existing legal framework, ensuring that the name change is not only legally valid but also appropriately reflects the region's identity.

Abstract

This research aims to examine and analyze the implementation of restorative justice for cases of assault in the Surakarta City Police, as well as the factors that hinder its effectiveness. The methodological approach utilized is socio-legal, with a descriptive-analytical specification. Data sources consist of both primary and secondary data, gathered through interviews and document studies. Data analysis is conducted using qualitative analysis methods. The implementation of restorative justice for assault cases in the Surakarta City Police employs the Family and Community Group Conference model, involving families and community figures to reach comprehensive agreements. This formally refers to regulations such as Article 16 paragraph (1) letter L of Law No. 2 of 2002 regarding the Indonesian National Police, Article 69 letter b of National Police Chief Regulation No. 14/2012 concerning Investigation Management, and National Police Chief Regulation No. 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice. Investigators take into consideration several aspects, including the belief that restorative justice is beneficial due to its win-win solutions principle and quick resolutions, prioritizing the principles of utility and legal fairness, as well as providing substantial understanding of law enforcement efforts that guide society. Factors hindering the implementation of restorative justice for assault cases in the Surakarta City Police include the conditions and motivations of involved parties, public unawareness of the authority of restorative justice by investigators, limited community role as social control, and cultural responses to the law. To address the challenges in implementing restorative justice, there is a need for the utilization of restorative justice within the criminal justice system through regulations governing its implementation at the investigative level.

Abstract

Abstrak : Hak kesehatan reproduksi merupakan aspek kesehatan penting, terutama bagi perempuan, dengan dampak langsung pada perkembangan sosial dan ekonomi suatu negara. Di Indonesia, masalah kesehatan reproduksi menjadi fokus utama dalam meningkatkan kualitas hidup masyarakat. Meskipun Pemerintah Indonesia telah mengeluarkan Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 untuk mengatur Standar Pelayanan Kesehatan Reproduksi, implementasinya di lapangan masih menghadapi sejumlah hambatan yang menghambat perlindungan hak-hak kesehatan reproduksi perempuan. Penelitian ini bertujuan untuk mengeksplorasi implementasi Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 dalam praktik pelayanan kesehatan di Indonesia, mengidentifikasi hambatan yang perlu diatasi, serta mengkaji peran perspektif hukum dan aspek normatif dalam meningkatkan perlindungan hak-hak kesehatan reproduksi perempuan. Penelitian ini menggunakan pendekatan kualitatif dengan pendekatan yuridis normatif dan empiris. Analisis hukum mencakup studi dokumen hukum, sementara analisis empiris melibatkan wawancara dengan pemangku kepentingan di bidang kesehatan reproduksi. Hasil penelitian menunjukan Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 mengatur berbagai aspek kesehatan reproduksi, tetapi implementasinya bervariasi. Pendidikan dan pelatihan bagi tenaga medis perlu ditingkatkan, komunikasi dengan pasien harus lebih baik, perlindungan hak-hak pasien perlu ditingkatkan, dan edukasi masyarakat tentang hak-hak kesehatan reproduksi perempuan harus lebih intensif. Perspektif hukum memberikan landasan yang kuat bagi perlindungan hak-hak kesehatan reproduksi, sementara aspek normatif membantu mengubah budaya pelayanan kesehatan reproduksi. Kesimpulanya implementasi Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 masih perlu perbaikan dalam berbagai aspek. Peningkatan pendidikan, komunikasi, perlindungan hak-hak pasien, dan edukasi masyarakat penting. Perspektif hukum dan aspek normatif berperan dalam meningkatkan perlindungan hak-hak kesehatan reproduksi perempuan dan efektivitas pelayanan kesehatan reproduksi di Indonesia. Penelitian ini memberikan rekomendasi untuk perbaikan layanan kesehatan reproduksi dan pemahaman hukum dalam konteks kesehatan reproduksi di Indonesia.Kata kunci : kesehatan reproduksi, peraturan menteri kesehatan dan hukum kesehatan reproduksi Abstract: Reproductive health rights are a crucial aspect of healthcare, particularly for women, with direct impacts on a country's social and economic development. In Indonesia, reproductive health issues are a primary focus for improving the quality of life. The Indonesian government issued Minister of Health Regulation No. 35 of 2014 to regulate Reproductive Health Service Standards, but its implementation in the field remains challenging. This research aims to explore the implementation of Minister of Health Regulation No. 35 of 2014 in healthcare practices in Indonesia, identify barriers to be addressed, and examine the role of legal perspectives and normative aspects in enhancing the protection of women's reproductive health rights. This research uses a qualitative approach with normative juridical and empirical approaches. Legal analysis involves the study of legal documents, while empirical analysis includes interviews with stakeholders in the field of reproductive health. The research results show that Minister of Health Regulation No. 35 of 2014 regulates various aspects of reproductive health, but its implementation varies. Education and training for medical personnel need improvement, communication with patients must be enhanced, patient rights protection needs strengthening, and public education on women's reproductive health rights should be intensified. Legal perspectives provide a strong foundation for safeguarding reproductive health rights, while normative aspects help transform the culture of reproductive healthcare. In conclusion, the implementation of Minister of Health Regulation No. 35 of 2014 still requires improvement in various aspects. Enhancements in education, communication, patient rights protection, and public education are essential. Legal perspectives and normative aspects play a role in enhancing the protection of women's reproductive health rights and the effectiveness of reproductive healthcare services in Indonesia. This research provides recommendations for improving reproductive health services and legal understanding in the context of reproductive health in Indonesia. Abstract

This study examines the legal challenges surrounding the smuggling of imported used clothing in Indonesia, addressing factors such as geographical complexities, resource limitations, organized crime networks, and corruption within law enforcement agencies. The manuscript aims to answer key research questions through an exploration of international legal frameworks, including the United Nations Convention against Transnational Organized Crime and World Trade Organization agreements. The findings emphasized the necessity for enhanced infrastructure, technology, inter-agency cooperation, and anti-corruption measures to improve enforcement effectiveness. Education and international collaboration are proposed as vital strategies to combat cross-border smuggling networks. Ultimately, this research contributes novel insights into legal strategies needed to address the complex challenges of smuggling imported used clothing, ensuring comprehensive and sustainable solutions to safeguard national interests and public safety.

Abstract

This study examines an important comparative legal and religious issue regarding the rights of adopted children in inheritance distribution from Islamic and Christian perspectives. While the abstract summarises key findings, there is a risk of oversimplifying the complexities of religious doctrines and national legal systems governing inheritance laws. Although adopted children's rights are limited in Islamic law, the possibility of making a will can mitigate these restrictions; however, additional nuances arise from various schools of thought and interpretations that influence the scope of inheritance. Conversely, the Christian perspective is often generalised as uniformly granting equal rights to adopted children, which may only hold across some Christian denominations or legal systems influenced by Christian principles. The abstract would benefit from a more detailed analysis of internal variations within each religion and consideration of how different national laws operationalise religious principles. Furthermore, the notion of "harmony" between these two religious traditions in addressing justice for adopted children may be overstated, as the theological foundations guiding inheritance distribution differ fundamentally. A more critical engagement with potential conflicts or limitations in achieving harmonious legal frameworks would add depth to the analysis.

Abstract

Puro Mangkunegaran is one of the fractional kingdoms of the Islamic Mataram Palace which still inherits Javanese cultural customs, one of which is dance culture. This study aims to determine the implementation of copyright protection for the classical dance of the Mangkunegaran Style based on Law Number 28 of 2014 concerning Copyright and the role of local government agencies in the preservation of the Mangkunegaran style classical dance. This research method uses an empirical juridical approach. Sources of data from primary data, namely interviews and secondary data, namely primary and secondary legal sources. Methods of data collection using literature studies and interviews with artists Puro Mangkunegaran and local government agencies. Data analysis is a qualitative approach. The results of this study are that Puro Mangkunegaran itself is quite strong in protecting the classical dance of the Mangkunegaran Style without registering copyright records.
