Abstract

           The Babakanmulya community's low awareness of the importance of education has led to a high dropout rate, mainly influenced by economic conditions and patriarchal culture.  This service program uses a Participatory Action Research (PAR) approach through three stages: planning (FGD), implementation (educational seminar), and impact evaluation. The partners in this program are the Babakanmulya Village Government and local community leaders.  The seminar was attended by more than 50 participants, showed high enthusiasm, and increased understanding of the importance of education and access to scholarships.  There was a change in the way the community, especially parents, viewed education. There were further initiatives from the village to support formal and non-formal education.

Abstract

Penyelesaian sengketa di sektor bisnis dan konstruksi semakin berkembang seiring meningkatnya kompleksitas kerja sama komersial, terutama dalam skala internasional. Arbitrase menjadi pilihan utama karena dinilai efisien, cepat, dan menjaga kerahasiaan para pihak. Namun, dalam praktiknya, masih terdapat permasalahan serius, seperti dalam Putusan Mahkamah Agung Nomor 126B/PDT.SUS-ARBT/2021, yang membatalkan putusan arbitrase karena terbukti adanya unsur tipu muslihat. Studi ini menganalisis pertimbangan hakim, validitas perjanjian arbitrase, dan akibat hukum dari putusan tersebut dalam konteks Undang-Undang Nomor 30 Tahun 1999. Temuan menunjukkan adanya ketidakkonsistenan penerapan hierarki hukum dan persoalan tafsir kontrak dwibahasa, yang menjadi tantangan dalam menjamin keadilan dan kepastian hukum dalam penyelesaian sengketa melalui arbitrase di Indonesia.

Abstract

This study aims to examine and analyze the active participation of the people as the holder of the highest sovereignty in the implementation of the Regional Head Election (Pilkada) in order to run with justice, with full responsibility and avoid elements of violations. This study uses the juridical normative method with the consideration that the research undertaken seeks to determine the extent to which the reality of the application of a rule. The results of this study conclude that the arrangement regarding the Election Monitoring Institution (LPP) in the Pilkada seems to be positioned as mere informants without sufficient strength, besides that there is also a real condition that if the fate of the LPP is indeed in intersection, they are encouraged to stay alive but are only given a few resources, so that strengthening the LPP is an absolute prerequisite for realizing justice in Pilkada.

Abstract

Indonesia’s electoral law established the framework to uphold democracy through free and fair elections. However, its implementation faces structural and procedural weaknesses that undermine effectiveness and public trust. This study employs a legal approach to examine these weaknesses, problems, and propose corresponding reforms. Key issues include overlapping authority among the General Elections Commission, the Election Supervisory Agency, and the Election Organizer Ethics Council; weak campaign oversight due to limited resources; unclear legal definitions; lenient sanctions for violations; and challenges in enforcing strict reporting deadlines. Additionally, systemic problems such as the open-list proportional system and the presidential threshold restrict political competition and foster transactional politics. To address these, the study recommends legal and institutional reforms: clarifying institutional roles, enhancing inter-agency coordination, strengthening campaign finance regulation with digital transparency systems, and improving enforcement mechanisms and sanctions. Further, revising the electoral system and threshold requirements, alongside introducing merit-based recruitment and whistleblower protections, are proposed to ensure inclusiveness, accountability, and democratic integrity. These measures aim to create a transparent, fair, and credible electoral process that reinforces democratic principles in Indonesia.

Abstract

The construction of religious moderation in children through dance in Babakan Mulya is a strategic initiative to strengthen moderate attitudes in a pluralistic society. Implemented by KKN Religious Moderation IV students using the Sisdamas approach, the program involved four cycles: initial socialization, social mapping, participatory planning, and program implementation and evaluation. Survey results revealed misconceptions about local arts being tied to specific religions. The program addressed this by promoting tolerance and diversity through cultural activities, such as dance group formation. Local teenagers trained the children in dance, enhancing interfaith and ethnic relations. The program ended with an evaluation showing increased understanding among children about respecting diversity and maintaining harmony. The final results indicated that children began to appreciate cultural and religious diversity, contributing to a more moderate and harmonious society in the future.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum tenaga kerja Indonesia (TKI) di Malaysia dengan fokus pada tantangan hukum dan upaya diplomatik yang dilakukan pemerintah Indonesia. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif yang melibatkan studi literatur dan analisis dokumen. Hasil penelitian menunjukkan bahwa meskipun terdapat kerangka hukum dan perjanjian bilateral, TKI di Malaysia masih menghadapi berbagai masalah, seperti pelanggaran hak kerja, eksploitasi pekerja tanpa dokumen, serta keterbatasan akses bantuan hukum. Kebaruan penelitian ini terletak pada analisis yang mengintegrasikan aspek hukum dan diplomasi, dengan penekanan pada pentingnya kerangka kerja sama bilateral yang lebih proaktif dan sistem bantuan hukum yang lebih efektif. Penelitian ini berkontribusi dengan memberikan rekomendasi kebijakan untuk meningkatkan perlindungan hukum serta memperkuat strategi diplomatik Indonesia dalam melindungi hak-hak TKI di Malaysia.

Abstract

During the 32 years of the New Order government certainly has its advantages and disadvantages, in terms of the development of infrastructure and supra-structure growing rapidly, but the journey has decreased function of government and its role even stagnant. Therefore, there was the Reform of 1998 in a variety of fields. In reply funsgi decline and the role of government under the Constitution of 1945, there was an opinion with the formation of a new organization outside the government. Gagsan ideas are realized with the establishment of committees that do not require the State budget a little, sometimes a clash of authority between committees also with government agencies. Abstract

Penelitian hukum saat ini mengalami perkembangan yang pesat seiring dengan perubahan sosial, ekonomi, teknologi dan budaya. Penelitian ini bertujuan untuk memahami dan menerapkan paradigma yang tepat sebagai upaya menghasilkan analisis hukum yang relevan dan akurat. Selain itu, tantangan utama yang dihadapi oleh peneliti hukum di antaranya kompleksitas isu hukum modern, kebutuhan akan pendekatan interdisipliner dan inovasi metodologi yang dibahas secara mendalam. Penelitian ini termasuk jenis penelitian kualitatif dengan pendekatan yuridis normatif. Teknik yang digunakan adalah studi kepustakaan (library research). Hasil penelitian ini dapat disimpulkan bahwa terdapat paradigma hukum tradisional yang bersifat dogmatis dan mengusulkan adopsi pendekatan empiris dan kritis. Sehingga dapat memberikan panduan bagi peneliti hukum dalam mengatasi berbagai tantangan metodologis dan substantif serta menawarkan saran praktis untuk meningkatkan kualitas dan relevansi penelitian hukum di era kontemporer.

Abstract

Law formation is a state function carried out by the executive, legislative and judicial bodies to form laws, both written and unwritten. By using the method of analysis, exploration, explanation, and exposure. In this context, it is important to design a scenario of national legislation politics that is oriented towards understanding the concept of a national legal system. The goal is to realize a state of law that is just, democratic, and based on justice and truth that serves the interests of the people and the nation. In addition, the formation of law is also influenced by the political configuration behind it, where law acts as a means of dominant political power. Thus, an understanding of legal politics and its relationship with legal formation is very important in the context of responsive and equitable legal development.

Abstract

This study aims to examine how war crimes are conceptualised and enforced within the framework of International Humanitarian Law (IHL) and the Rome Statute by analysing the Israel–Palestine conflict as a prolonged and politically contested armed conflict in which serious violations against civilians persist with limited accountability. Using a normative legal research design, this article applies a statutory and case-based approach through doctrinal analysis of the Geneva Conventions, Additional Protocols, and the Rome Statute, supported by qualitative examination of ICC-related documents, United Nations reports, and verified secondary data to assess the implementation of core IHL principles, particularly distinction and proportionality. The findings demonstrate that recurrent violations committed by both parties are not primarily caused by normative gaps in international law, but rather by structural enforcement barriers, including the ICC’s jurisdictional and admissibility constraints, restricted access to evidence, lack of state cooperation, political interference, and selective enforcement through international institutions, especially the UN Security Council. These obstacles contribute to an enduring enforcement deficit that weakens civilian protection and perpetuates impunity in asymmetric and protracted conflicts. The novelty of this study lies in systematically linking fundamental IHL principles—distinction, proportionality, and the prohibition of excessive force—to their qualification as war crimes under Article 8 of the Rome Statute, while critically demonstrating how political realities and institutional dependence on state cooperation undermine the effectiveness of international criminal accountability mechanisms. This research highlights the urgent need to strengthen coordination among international institutions, enhance investigative access and evidentiary reliability, and promote more consistent and impartial enforcement strategies to ensure that IHL and international criminal law operate as effective deterrents and justice-delivering instruments in contemporary armed conflicts.
