Abstract

An agreement is a legal event where one person promises another person or twopeople promise each other to do or not do something. One form of implementation of thisagreement is that which occurs between PT. IBF (PT. Intan Baruprana Finance) with PT.KAL (PT. Karya Alam Lestari). In the case of PT. IBF (PT. Intan Baruprana Finance)with PT. KAL (PT. Karya Alam Lestari), PT. IBF as lessor and PT. KAL, who then aslessee, entered into a Sale and Lease Back Agreement with the object of collateral beingtwo units of Factory Trailer Maunted Air Foam Package in 2012.This research is sociological legal research, it is based on field research whichrefers to information from interviews and observations as well as supporting documentsthat have a correlation with the background of the problem to be studied. This researchuses secondary data sources consisting of primary, secondary and tertiary legal materials.This research uses qualitative data analysis by producing a deductive method of drawingconclusions, namely drawing conclusions from general matters to specific matters.Based on the results and discussion that have been explained previously, theauthor draws the following conclusions: Implementation of the Sale and Lease BackAgreement that occurred between PT. IBF and PT. KAL is still not implemented properly.This is proven by several negligences made by the lessee during the agreement, such asnon-payment of the Financing Rent which should have been paid monthly in the amountof Rp. 388,239,248 (three hundred eighty eight million two hundred thirty nine thousandtwo hundred forty eight thousand) and the transfer of the position of 2 units of FactoryTrailer Maunted Air Foam Package without notification and confirmation to the lessor,and the financing object was found to be rusty and not well maintained . This fulfills therequirements for breach of contract in Article 13 of the Financing Lease Deed which hasbeen agreed upon by both parties.

Abstract

This article discusses the phenomenon of money politics in general elections (Pemilu) in Indonesia using a legal culture perspective. Political money has become one of the biggest challenges in Indonesia's democratic system, considering its impact on the integrity and quality of healthy elections. This research aims to analyze how money politics is viewed from the perspective of Indonesian legal culture, as well as to explore the factors that influence it, including social norms, political habits, and the role of law in preventing and overcoming this practice. The method used is a qualitative approach using literature study, document analysis, and interviews with legal experts and politicians in Indonesia. This research found that although there are clear legal regulations to overcome money politics, their implementation is still hampered by various legal cultures that have been internalized in society, such as the culture of patronage and clientelism. In addition, weak supervision and a lack of consistent law enforcement exacerbate this situation. This article suggests the need for more progressive legal culture reform to support clean, fair and democratic elections. This includes strengthening the role of the community in election supervision, increasing legal education for the community, as well as reforming the justice system which is more responsive to the practice of money politics. Thus, this research contributes to understanding the relationship between legal culture and the practice of money politics in the context of elections in Indonesia

Abstract

This research investigates the revitalization of customary law in buffalo farming practices (Jalangan) in Menaming Village, Rokan Hulu, with the aim of fostering sustainable governance and agriculture. The buffalo farming system in Menaming Village is deeply rooted in traditional practices that combine grazing and caging methods, reflecting the community’s cultural values and environmental stewardship. These practices are designed to minimize the exploitation of natural resources, positioning Rokan Hulu as a region with significant potential to support local livelihoods while contributing to national economic development. The study highlights the vital role of customary law, recognized in Indonesia's Constitution, in maintaining these traditional practices and promoting sustainable livestock management. Key strategies such as converting manure into organic fertilizer, utilizing organic materials for fuel, adopting pesticide-free animal feed, and implementing rotational grazing systems are central to the community's approach. These practices reduce environmental degradation, maintain ecological balance, and enhance livestock health and productivity, all while creating economic benefits, improving farmers’ incomes, and fostering social cohesion. The novelty of this research lies in its demonstration of how customary law can be revitalized and integrated into contemporary governance frameworks to address modern challenges in sustainable agriculture and environmental conservation. This study contributes to the discourse on law reform by proposing that customary law be formally recognized and adapted within Indonesia's legal system as a dynamic tool for promoting sustainable development, empowering local communities, and preserving cultural heritage. The research underscores the urgency of adapting these traditional frameworks to ensure long-term ecological sustainability and community resilience.

Abstract

Fenomena perkawinan janda tanpa akta cerai banyak terjadi di Jorong Dalam Koto Kenagarian Taeh Baruah, dimana seorang perempuan yang sebelumnya menikah secara sah di KUA bercerai di luar pengadilan, kemudian menikah lagi tanpa pendaftaran resmi sesuai UUP dan KHI. Penelitian ini bertujuan untuk menganalisis keabsahan dan akibat hukum dari perkawinan tersebut serta faktor penyebabnya. Metode yang digunakan adalah penelitian sosiologis dengan pengumpulan data melalui wawancara dengan pihak terkait di lokasi penelitian. Hasil penelitian menunjukkan bahwa perkawinan janda tanpa akta cerai di Jorong Dalam Koto tidak memiliki keabsahan hukum karena melanggar UUP Pasal 2 (2) dan KHI Pasal 5 (1), dan proses perceraian sebelumnya yang tidak melalui pengadilan bertentangan dengan UUP Pasal 39 (1) dan KHI Pasal 115. Selain itu, perkawinan ini dapat merugikan hak istri dan anak yang lahir. Faktor penyebabnya yaitu perceraian di luar pengadilan, rendahnya pemahaman masyarakat tentang hukum perkawinan, pengaruh lingkungan, dan kurangnya sosialisasi dari instansi terkait seperti KUA. Berdasarkan temuan tersebut, penulis memberikan saran kepada masyarakat untuk mematuhi hukum positif dalam melakukan perkawinan dan perceraian, tidak hanya mengandalkan aturan agama. Selain itu, KUA dan pihak berwenang perlu meningkatkan sosialisasi untuk mengurangi praktik perkawinan tidak terdaftar dan perceraian di luar hukum.

Abstract

Acquisition of land rights can only be obtained through registration of land rights with the BPN, as the state institution authorized to issue land rights certificates. Then based on the provisions in the UUPA, for foreign companies that have representatives in Indonesia can only have the Right of Use as a form of ownership of land rights. Thus, the research objectives of this Researcher's thesis are first how the status of land rights along Jalan Gatot Subroto Dumai City and second how the settlement of land rights disputes between the government and the community along Jalan Gatot Subroto Dumai City. The type of legal research used is sociological juridical legal research, with research locations in Bangsal Aceh Village and Mekar Sari Village. The population and samples in this study are the parties related to the problem under study. This research uses primary data sources and secondary data and data collection techniques are carried out by means of interviews and studies. From the results of the research, the status of the land/land concession of PT. CPI is still unclear because the maintenance of land registration data cannot be carried out. Therefore, whatever dispute resolution efforts the parties choose in resolving land disputes, in this case mediation, the mediator must be neutral to be able to produce fair agreements for the parties.

Abstract

The aim of this study is to analyze the implementation of credit agreements at the village-owned business entity (BUMKampung) Maju Bersama, West Perawang Village as well as efforts to resolve defaults in credit agreements between borrowers and the village-owned business entity (BUMKampung) Maju Bersama, West Perawang Village. The type of research used by the author is sociological legal research, namely examining applicable legal provisions and what happens in reality in society. The results of this research study stated that the implementation of the credit agreement at the village-owned business entity (BUMKampung) Maju Bersama, West Perawang Village, as well as efforts to resolve defaults in the credit agreement between the borrower and the village-owned business entity (BUMKampung) Maju Bersama, West Perawang Village, failed. The author in this discussion provides an explanation regarding the implementation of credit agreements at the village-owned business entity (BUMKampung) Maju Bersama, West Perawang Village as well as efforts to resolve defaults in the credit agreement between the borrower and the village-owned business entity (BUMKampung) Maju Bersama, West Perawang Village.
