Abstract

This study aims to determine the Management of Village-Owned Enterprises(BUMDes) in Meranti Bunting Meranti Islands Village, and to determine the factors thatinfluence the Management of Village-Owned Enterprises (BUMDes) in Meranti BuntingMeranti Islands Village based on Government Regulation of the Republic of IndonesiaNumber 11 Year 2021 Concerning Village-Owned EnterprisesThis research is a sociological book research because it is based on field research,namely by collecting data from observations, interviews, and literature studies that provide arelationship with the problem assisted by primary, secondary, and tertiary data. The type ofresearch data is descriptive qualitative research. This research looks at the Role of theVillage Head in the Implementation of Village Owned Enterprises in Meranti Bunting Village.The data sources are primary and secondary data, the number of informants in this study is 6informants then draws the final conclusions from the interview results.Based on the research results, it can be seen that the Management of Village-OwnedEnterprises in Meranti Bunting Meranti Islands Village has 4 aspects that affect management,namely the Planning Aspect. In the Planning Aspect, BUMDes Meranti Bunting Village hasfollowed the procedures listed in the AD/ART and planned programs to be implemented andmanaged along with the budgets to be used and managed by BUMDes Meranti BuntingVillage. Second, Organizing, Meranti Bunting Village BUMDes appoint managers who areelements of the Meranti Bunting Meranti Islands Village community and do not have duties inVillage Government and in building good work communication cooperation is needed inorder to achieve a business unitary and organizational goals Third Direction, in achievingtargets according to the planning in the management of BUMDes Meranti Banting MerantiIslands Village the manager has directed and supervised the work of members who joined andmonitored so that they can achieve success in managing BUMDes in Meranti BuntingMeranti Islands Village. Evaluation Committee, in evaluating the results of the work ofmanagers and the community continues to carry out evaluations every 3 months, every 6months and annually. At the evaluation stage BUMDes Meranti Bunting Meranti IslandsVillage continues to carry out transparency of funds so that there are no misunderstandingsand problems. Then the factors that influence the management of Meranti Bunting MerantiIslands Village are the cooperation system to full support by the Village Government, equityand procurement of BUMDes business funds, but development cannot be said to be successfulbecause the management of BUMDes is still experiencing bottlenecks in the issue of capitalparticipation funds.Keyword : The role of-village head-village owned enterprises

Abstract

The problem of internal conflicts of political parties that occur in the management ofthe democratic party in Riau province. In 2021. This conflict is seen as a conflict over powerand leadership within the democratic party in Riau Province.In this conflict the agitators areAsri Auzar and friends who are legitimate administrators of the Regional Leadership Council(DPD). In his lawsuit, the plaintiff explained the beginning of problems that occurred in themanagement of the Democratic Party.This research is a researcher of normative law. This is based on literature researchthat takes quotations from reading books, or supporting books that have something to do withthe problem to be studied. This study used Secondary data sources consisting of primary,secondary, and tertiary book materials. This study also used qualitative data analysis andproduced Descriptive data.From the results of the research and discussion conducted, there are severalconclusions obtained, namely: first, the case of political party settlement to the district courtis Article 33 paragraph (1) of Law Number 2 of 2011 which reads, "In the event that disputeresolution as referred to in Article 32 is not achieved, dispute resolution is carried out throughthe District Court". Settlement of political party disputes through district courts is an effort ifsettlement through the mechanism of political party courts cannot be achieved.Second, as well as the dismissal and implementation of regional deliberations only oneday apart violates the principle of propriety and the party does not carry out its functions asregulated by Law Number 2 of 2011 concerning Amendments to Law Number 2 of 2008concerning Political Parties, the authority in carrying out regional deliberations is the DPD,not the DPP nor the 12 DPCs of the Democratic Party, the DPP is only authorized to carryout extraordinary deliberations.The author's suggestion is that there should be strengthening of the RegionalLeadership Council of Political Parties in matters of regional deliberations without being ableto intervene in the Central Leadership Council of Political Parties as well as legalarrangements for the settlement of political party disputes in Law Number 2 of 2011concerning Amendments to Law Number 2 of 2008 concerning Political Parties.Keywords : Internal conflicts, Internal conflicts, Political Party Court

Abstract

The Proportional Election System is a system in which one electoraldistrict elects several representatives. The proportional system is also called abalanced system, there are two types of systems in the proportional system,namely the open proportional system and the closed proportional system. OpenProportional System is an electoral system in which voters directly elect theirlegislative representatives. Whereas in a closed proportional system, voters onlychoose their political party. The formulation of the problem in this study is whatare the advantages and disadvantages of open and closed proportional systemsand whether the system is most appropriate to be applied to legislative electionsin Indonesia.This study uses normative legal research methods. This study also usesthree sources of legal materials, namely, primary, secondary and tertiary legalmaterials. The purpose of this study is to determine the advantages anddisadvantages of open and closed proportional systems and to find out the mostappropriate system to be applied to legislative elections in Indonesia. Legislationwhich is the main source of this research is the 1945 Constitution, Law number 7of 2017 concerning General Elections.The results obtained from this study are that open and closed proportionalsystems have advantages and disadvantages, so the appropriate election system tobe used in Indonesia is the Open Election System because voters can choosecandidates who have the same ideas, vision and mission, reflecting the profile ofall the people, increasing public enthusiasm to participate in elections,prioritizing the unity and integrity of the Indonesian nation.Keywords: Proportional System, general elections, People.

Abstract

It can be said that the implementation of public services for patients withBPJS health insurance at RSUD Dr. RM Pratomo is good, but it has not reachedthe minimum service standards expected based on Rokan Hilir Regent RegulationNumber 35 of 2018 concerning Service Standards for the Regional GeneralHospital dr. RM Pratomo Bagansiapiapi City. The main problems in this studyare: How is the implementation of public services for BPJS patients at RSUD Dr.RM Pratomo, Bagansiapiapi City; what are the supporting and inhibiting factorsin the implementation of public services provided by the hospital to patients; andwhat efforts have been made by the hospital to improve the quality of publicservices to make it better. This type of research is a type of sociological legalresearch carried out at Dr. RM Pratomo Hospital, Bagansiapiapi City, the datasources used are primary data sources and secondary data sources. Datacollection techniques carried out in this study were observation, interviews,questionnaires and literature. Data were analyzed using qualitative methodswhich produced descriptive data and were concluded with deductive thinkingmethod.The results showed that the implementation of RSUD Dr. RM Pratomo canbe said to be good, but has not reached the expected minimum service standards.One of the supporting factors in the implementation of services is the existence ofbudgetary assistance from the government, education and training of humanresources and so on. In addition, the inhibiting factors can be in the form offacilities and infrastructure, low public knowledge regarding the BPJS flow, andthe large number of patients seeking treatment. Abstract

Filling in the position of acting regional head (Pj) which is carried out using anappointment mechanism by the president and the minister of home affairs is considered nottransparent, accountable and participatory and ignores democratic principles. The centralgovernment has a central role in appointing acting regional heads without involving theaspirations of the regions, and there is no clear and firm legal regulation regarding fillingthe positions of acting regional heads which is increasingly causing polemics in society.This study uses normative legal research methods by collecting literature andfocusing on legal principles, namely the general principle of good governance (AUPB) infilling the positions of acting regional heads in accordance with the principle ofaccountability in Indonesia.The results of the study show that, first, the dynamics of filling the vacant positions ofregional heads in Indonesia from the old order era to the reform era were carried outcentrally with power in the hands of the central government. This is reflected in severalstatutory provisions in force in Indonesia which are the government's reference in filling thevacant regional head positions. Second, filling the position of acting regional head is seen asnot being transparent, participatory and accountable and setting aside democratic values byignoring the aspirations of the region and the people. The central government is nottransparent and accountable in appointing acting regional heads so that the mechanism forappointing acting regional heads creates polemics in society. Third, the legal regulationsregarding acting regional heads should be issued immediately so that the filling of regionalhead positions has a clear and firm measurable mechanism and continues to be transparent,accountable and participatory as mandated in the Constitutional Court decision with caseNumber 67/PUU-XIX/2021 and Article 86 paragraph (6) of Law Number 23 of 2014concerning Regional Government, with contents including: a) involving the DPRD in theprocess of proposing candidates for acting regional heads b) participation of the regionalpeople in providing suggestions and input regarding the performance of the acting (Pj)regional head, c) the existence of mechanisms and prerequisites that are clearly measurableand filling the positions of acting regional heads so that they remain in accordance with thegeneral principles of good governance that are transparent, participatory and accountable.Keywords: Idea, Filling in the Position of Acting Regional Head, Accountability

Abstract

Amendments to the 1945 Constitution have resulted in several new state institutions,one of which is the Regional Representative Council (DPD). The basic idea behind theformation of the DPD is the desire to accommodate regional aspirations and at the same timegive the regions a bigger role in the process of making political decisions on matters that areprimarily directly related to the regions. With the authority possessed by the DPD manythings can be done. Now many people don't know what the DPD is, why this happenedbecause the performance of the DPD has not been optimal. Many discussions and seminarshave been held by the DPD, both with legal and political experts and with their constituentsin their respective regions, the context of these discussions always discusses the weakness ofthe authority possessed by the DPD, as if this authority is the main obstacle in carrying out itsduties and obligations. .This type of research is normative legal research. Normative legal research is legalresearch conducted by examining literature or secondary data consisting of primary legalmaterials, secondary legal materials and tertiary legal materials. Normative legal research isalso called doctrinal legal research, also referred to as library research or document study.This research examines the subject matter in accordance with the scope and identification ofproblems through a statutory approach (Statute approach). related to the legal issue understudy.The ineffectiveness of the DPD as a representative institution in carrying out its dutiesis suspected to have occurred due to several factors. First, misconceptions in applying thebicameral concept. Second, the authority of the DPD is very limited and is only related toregional matters. Third, the DPD was formed to prevent the hegemony of the executivebranch from returning, but then the balance of power did not work effectively because of thelarge amount of authority possessed by the DPR. The ideal mechanism related to theimplementation of regional community aspirations in the field of supervision carried out bythe DPD is divided into two ways in conveying aspirations, namely by formal and informalmeans. DPD members are expected by their voters to fulfill the will of the people'saspirations, provide services and provide various other forms of satisfaction even if they areonly symbolic, in carrying out their duties it is not uncommon for differences to occurbetween the representatives of the people and the people who elect them.Keywords : DPD – Authority – Settings

Abstract

This research relates to the Implementation of Internal Control Based on theRegulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the NationalDefense Agency of the Republic of Indonesia Number 16 of 2019 concerning theImplementation of the Government's Internal Control System within the Ministry of AgrarianAffairs and Spatial Planning/National Defense Agency of Pekanbaru City. In the field,internal supervision has not yet been carried out at the Pekanbaru City Land Agency, whichcan be seen from the absence of a clear flow of supervision and the absence of a report on theresults of internal supervision to the Pekanbaru City Inspectorate as well as reports submittedto Commission 1 DPRD Pekanbaru City as one of the external supervisors from thePekanbaru City National Land Agency. Therefore it is necessary to study the first stimulant,internal supervision is appropriate. with the Regulation of the Minister of Agrarian Affairsand Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number16 of 2019 at the Pekanbaru City National Land Agency. Second, the supporting andinhibiting factors in implementing the Regulation of the Minister of Agrarian Affairs andSpatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 16of 2019 at the Pekanbaru City National Land Agency.This research is a sociological law research, because it is based on field research,namely by collecting data from observation, interviews, and literature studies that have arelationship with the problems studied assisted by primary, secondary, and tertiary data. Thisstudy uses qualitative data analysis, produces descriptive data, and concludes with adeductive thinking method.From the research results there are three main things that can be concluded. Abstract

Tujuan dari penelitian ini adalah untuk mengetahui dampak dari keputusan tersebut, serta konsep ideal pengujian anggaran dasar anggaran rumah tangga (AD/ART) partai politik di Indonesia. Penelitian ini merupakan penelitian hukum normatif. Dasar penelitian ini adalah penelitian sastra yang mengambil kutipan dari buku bacaan, atau buku pendukung yang memiliki kaitannya dengan permasalahan yang akan diteliti. Penelitian ini juga menggunakan analisis data kualitatif dan menghasilkan data deskriptif. Penelitian ini menemukan bahwa Pertama, AD/ART tidak dapat disamakan dengan peraturan perundang-undangan yang ada di Indonesia karena tidak sesuai dengan unsur hierarki peraturan perundang-undangan dan bagian-bagiannya sehingga bukan wewenang Mahkamah Agung untuk melakukan  judicial review. Kedua, implikasi keluarnya putusan Mahkamah Agung Nomor 39 P/HUM/2021 dikhawatirkan akan lahirnya kepemimpinan dalam partai politik yang tidak demokratis dan tirani yang sering kali melakukan intimidasi politik terhadap anggota dan para kadernya dengan memanfaatkan otoritas dan jabatannya.

Abstract

In 2020 Indonesia was Constitutional Court Decision Number 91/PUU-XVIII/2020. Inthe decision the Job Creation Law was declared conditionally unconstitutional and gave 2years to complete the revision of the job creation law, but on December 30 2022 theGovernment postponed Government Regulation in Lieu of Law Number 2 of 2022 concerningJob Creation. Since the promulgation of this Perppu, there has been much debate in thecommunity, so there are pros and cons to the enactment of this Perppu. Therefore it isnecessary to know about the process of forming Perppu Number 2 of 2022 concerning JobCreation which is linked to the Constitutional Court Decision Number 91/PUU-XVIII/2020.The purpose of this research was to find out the background for the issuance of Perppu Number2 of 2022 concerning Job Creation by the President, as well as whether the establishment ofPerppu Number 2 of 2022 is in accordance with the Constitutional Court Decision Number91/PUU-XVIII/2020 and to find out how it should be Following up on the Constitutional CourtDecision Number 91/PUU-XVIII/2020 by the President.This research is a normative legal research. Normative legal research that examines andexamines literature or secondary data, by taking quotations from the literature that is relatedto the problem to be studied. As well as a statutory and conceptual approach, in this way thisstudy uses data sources consisting of primary, secondary and tertiary legal materials. Thisstudy also used qualitative data analysis and produced descriptive data.From the results of the discussion and research conducted, several conclusions wereobtained, namely: First, the background to the issuance of Perppu Number 2 of 2022 by thePresident is a matter of urgency that compels and as a continuation in implementing theConstitutional Court Decision 91/PUU-XVIII/2020, Second, the Establishment of PerppuNumber 2 of 2022 is not in accordance with the Constitutional Court Decision Number91/PUU-XVIII-2020. Because the subjectivity of the President which is the main reference forestablishing a Perppu is contained in the Constitutional Court Decision Number 138/PUU-VII/2009. Third, a decision of the constitutional court must be respected but must also beobeyed and maintained in its implementation. Abstract

Strengthening the function of forming Regional Regulations in the Regional People'sRepresentative Council of Kuantan Singingi Regency in the formation of which there is still alack of Regional Regulations produced by the Regional People's Representative Council in the2014-2019 period. Therefore, it is necessary to study first, the minimum number of RegionalRegulations made, Strengthening the function of forming Regional Regulations in the RegionalPeople's Representative Council of Kuantan Singingi Regency. Second, ideally the role of theRegional People's Representative Council in forming Regional Regulations in KuantanSingingi Regency.This research is classified as sociological juridical research. With the research location atthe Kuantan Singingi Regency Regional People's Representative Council.From the research results, it was concluded that, firstly, the lack of Regional Regulationsproduced by the Regional People's Representative Council was caused by an inadequatebudget, weak function and understanding of the Regional People's Representative Council, thestrong interests of Political Parties and several Regional Regulations that were cancelled.strengthening the function of forming DPRD Regional Regulations, namely allocating thebudget properly, increasing the capacity of the Regional People's Representative Council,increasing coordination between the executive and legislative parties, and strengthening theRegional Regulation Formation Agency.
