Abstract

Indonesia is a constitutional state that adheres to democracy and a system ofgovernment based on people's sovereignty. The most substantial understanding of democracyis general election (election). Elections are a means to elect people's representatives who willcontrol the wheels of government. Elections are held by the General Election Commission(KPU). KPU is domiciled at the center or in the regions. The KPU at the regional level istasked with holding elections at the regional level, one of which is the Regional Head Election(Pilkada). So far, the Pilkada implementation has been inseparable from the obstacles andchallenges that have occurred. Starting from the implementation, as well as violationscommitted by the candidates themselves. So that maximum supervision and monitoring isneeded by Bawaslu. One of the Pilkada problems that occurred in Bandar Lampung City,Lampung Bawaslu stated that Candidate Pair serial number 03, Eva Dwiana-DeddyAmarullah had been proven to have violated the Structured, Systematic, MassiveAdministration (TSM) in the 2020 Bandar Lampung Pilkada, so that this pair was canceledfrom participating in the Bandar Lampung Pilkada.This research belongs to the normative juridical, namely research conducted byexamining secondary legal materials or research based on standard rules that have beenrecorded and discusses legal principles and synchronization. The data sources used areprimary data, secondary data and tertiary data with library research data collectiontechniques.The research results obtained, should The Supreme Court as the first legal remedy inmaking a decision must review the legality of letters or policies issued by KPU BandarLampung and be considered by judges in canceling election results, because they canendanger democracy and damage the morality of voters in Bandar Lampung City in thefuture. Then for the Arrangement of Bawaslu Authority in receiving violations of TSMreportsthere must be a systemreinforcement of the Bawaslu with the actions of the Bawaslu indeciding a dispute the process is final. This is done in order to maximize the implementationof authorityquasi-judicial, in the form of an adjudication function so that Bawaslu can decideon election administration violations, decide on money politics violations, and electionprocess disputes without further appeals.Keywords: Election, Bawaslu, Pilkada

Abstract

Dalam kehidupan ketatanegaraan, undang-undang dasar sebagai hukumdasar tertulis adalah merupakan norma yang sangat fundamental baginegara, karena mengatur hal-hal yang sangat mendasar dalampenyelenggaraan negara dan pemerintahan, meliputi bentuk dansusunan negara, alat-alat perlengkapaan negara yang satu dengan alatperlengkapan negara yang lain, serta jaminan perlindungan terhadaphak asasi manusia dan warga negara. Di kala rezim orde baru masihberkuasa, nilai sebuah demokrasi seakan terabaikan dengan adanyakekuasaan mutlak dari penguasa orde baru yang cenderungmengabaikan kesetraan gender, karena itu perlu dilihat politik hukumpemerintah saat ini atas kesetaraan gender. Makalah ini menyimpulkanbahwa politik hukum Indonesia dalam perspektif gender masih perluditingkatkan, karena masih banyak peraturan perundang-undangan yangbelum berperspektif gender.

Abstract

As a legal state, Indonesia has a Marriage Law which adheres to theprinciple of making divorce difficult. Divorce is regulated in Law no. 1 of 1974concerning Marriage as amended by Law no. 16 of 2019. Divorce only occurs ifcertain reasons are fulfilled in the legislation and are carried out before the court.This relates to the principle of complicating divorce in order to prevent someone fromtaking divorce steps. Even though this law has been implemented, it cannot be deniedthat currently the number of divorces that occur in society every year continues toincrease.Efforts to prevent divorce are also carried out by the government, through theBadan Penasihatan Pembinaan dan Pelestarian Perkawinan (hereinafter referred toas BP4) which is a partner organization of the Ministry of Religion which is engagedin providing advice on marriage, disputes and divorce. Then there was arevitalization of BP4 through the 14th BP4 National Conference in 2009 which wasoriginally only a consulting institution on marriage issues, through this NationalConference it expanded its duties not only as an extension institution, but also hadmore comprehensive tasks, including providing mediation assistance to parties wholitigation in the Religious Courts. However, it is unfortunate that this change does notcoincide with strengthening the legal basis of an adequate institution and tends toexperience a decline in legal authority. Previously, BP4 had a legal basis through theDecree of the Minister of Religion No. 85 of 1961, which was changed to the Decreeof the 14th BP4 National Deliberation No. 26/2-P/BP4/VI/2009 concerning theArticles of Association of BP4.This research was conducted using normative juridical research studies,namely research conducted by examining secondary legal materials that havesomething to do with the material of this thesis. From the research results there aretwo main things that can be concluded. First, a stronger BP4 institutional legal basisis needed through law. So that BP4 has greater authority in terms of carrying out itsduties and functions related to efforts to prevent divorce. Second, also in terms ofstrengthening legal substance, namely strengthening the legal basis of BP4institutions through laws, strengthening legal structures, namely regulations that alsohelp strengthen and assist performance in efforts to prevent divorce from BP4 itself.And finally strengthening the legal culture, namely people's attitudes towards the lawand the legal system, which is related to beliefs in their values, thoughts or ideas. Theimportance of a legal culture that is in harmony with society so as to createinstitutions that are in accordance with the culture of Indonesian society in efforts toprevent divorce itself.Keywords : State Law Politics, Divorce Prevention, and BP4.

Abstract

As an archipelagic country with a larger sea area than land, there are challengesin maintaining its territorial sea area. The challenge faced is in the form of efforts inenforcing the law of the sea. Currently, in law enforcement in the Indonesian seas, thereare many institutions that have the same authority and too many laws and regulationsgoverning maritime security in Indonesia. Therefore, the idea arose to simplify theinstitution of sea and coast guards in Indonesia. The purpose of this paper is to find outthe legal politics of simplifying the institutional simplification of Indonesia's sea andcoast guards and to know the implications of simplifying the sea and coast guardinstitutions in Indonesia onthe efficiency of other institutions that have authority in seaand coast guarding in Indonesia.This research is normative juridical, it is based on literature research that takesexcerpts from reading books, or supporting books that have a connection with theproblem to be studied. This study uses secondary data sources consisting of primary,secondary and tertiary legal materials. This study also used qualitative data analysisand produced descriptive data.As for the results of this study, several conclusions can be drawn, namely: First,Law Enforcement in the Indonesian Sea is running ineffectively because manyinstitutions have the same authority in law enforcement in the Indonesian sea. Second,the institutions that have existed will insist on maintaining their respective existences.So it is necessary to integrate maritime security regulations for the effectiveness of lawenforcement in Indonesia's territorial sea areas.Keywords: Simplification-Institutions-Authority

Abstract

Global Positioning System (GPS) is a system that functions to make it easier for adriver to obtain information about his position and can perform Route Tracking and find anaddress so that it is useful for fuel and travel time destinations. The problem regarding theGlobal Positioning System (GPS) stems from the Traffic and Road Transportation Law,which drives vehicles with full concentration as stipulated in Article 106 of the Road Trafficand Transportation Law (LLAJ). This is where this article implies that the use of the GlobalPositioning System (GPS) when driving can cause accidents, so that when viewed fromArticle 106 paragraph 1 of the Traffic Law there is a lack of clarity in the rules.The conclusions that can be obtained from the results of the research are: First, theinterpretation of the law regarding "doing other activities or something that results inimpaired concentration while driving in Article 283 of Law Number 22 of 2009 with the 1945Constitution as long as it is not interpreted. satellite which is usually called the GlobalPositioning System (GPS) contained in a smartphone (smartphone) is unreasonableaccording to law and the article is still considered relevant. Second, the ideal arrangement inguaranteeing legal certainty for the use of the Global Positioning System (GPS) device is thatthe norm cannot access a complete understanding of the norms contained in Article 106paragraph (1) of Law Number 22 of 2009. This norm contains the norms of command whichobliges everyone to drive their vehicle fairly and with full concentration. In the context ofcreating and passing safety against violations of the norms in question, it is necessary to givethe threat of sanctions whose formulation is placed at the end before closing.This type of research can be classified in the type of normative legal research,which discloses laws and regulations relating to legal theories that are the object ofresearch. The approach taken is using a qualitative analysis approach by searching for datain books, journals and other scientific works related to this research. Abstract

Regional Goverments manage and manage their regions inthe hope of creating community welfare in their respective areas, one of which is the policy made by local goverments to improve the welfare of the people in the area, namely by Implementing Market Arrangement Authority in Pekanbaru City. The agency authorized and responsible for managing the people’s market is the market office. The Pekanbaru City Goverments, especially the Market Service, must be able and obliged and always strive for the People’s Market (including the Main Market and Supporting Market) to become an effective and profitable trading facility for the lower middle class community. For this reason, People’s Market should get support from the Pekanbaru City Goverments, both in the form of revitalization (market rejuvenation) and the daily management of the People’s Market in the form of structuring, empowering, fostering and monitoring that is carried out strictly. The purpose of writing this thesis, namely: First, to find out the implementation of the Regional Regulation Number 9 of 2014 conceming the Management of the People’s Market. Shopping Centers and Supermarkets in Pekanbaru City. Second. To find out the inhibiting factors that affect the Regional Government in the Pekanbaru Market Arrangement. This type of research is sociological legal research, where research wants to see the correlation between law and society, so as to be able to reveal the effectiveness of law enforcement in society and identify unwritten laws that apply to people in the field or to society. The data sources used were primary data and secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection techniques in this study were observation, interview, and literature review. After the data was collected, it was analyzed to draw conclusions. From the results of the study, it was concluded that, First, the implementation of Sukaramai Trade Center Market Development Based on Article 34 paragraph (2) letter C of Pekanbaru City Regional Regulation Number 9 of 2014 has not been carried out optimally by the government. Second, the inhibiting factors that influence the Regional Government in the Implementation of Pekanbaru Market Development are the legal factor itself, official staff factors, and unclear regulatory factors. Suggestions from the author, namely, the Pekanbaru City STC Market and Market Management Office pay more attention to the rights of traders in accordance with Regional Regulations Article 34 paragraph (2) letter C Number 9 of 2014

Abstract

Discussing legislation cannot be separated from the basic concept of therule of law in a region, besides that regional autonomy as a consequence ofimplementing the principle of decentralization has provided a lot of fresh air,especially for the regions. The regional government which is an extension of thecentral government to run the wheels of government in order to achieve the goalof being a state has the responsibility to provide the best for its people. A healthyenvironment is one that must be obtained by every citizen, especially in an urbanarea. In urban planning, green open space is one of the requirements that must bemet so that the city can carry out its functions properly and pay attention to theenvironment. There are still many cities that have not been able to meet theminimum requirements for green open space, resulting in the questioning of therole of laws in the wheels of government. This study tries to answer the existingproblems by linking legal political theory and statutory regulations in making aregulation which does not conflict with the rules above it. City spatial planning isneeded to make a city able to fulfill aspects that have been mandated by law, inthis case green open spaces as a means of supporting the life of urbancommunities who still pay attention to the environment.Keywords: Regional Regulations - Political Law - Green Open Space - SpatialPlanning

Abstract

KONI filed a lawsuit through the Constitutional Court to conduct a judicial review ofthe SKN Law with constitutional case register Number 19/PUU-XII/2014, one of the objectsof testing is Article 36 paragraphs (1) and (3) of the SKN Law related to the phrase "sportscommittee" where KONI believes that the emergence of these phrases makes KONI not havestrong legitimacy to carry out its authority as a partner institution of the Government insports management so far. Therefore, the purpose of this thesis research is first, to analyzethe considerations of the Constitutional Court judges in Decision Number 19/PUU-XII/2014on the interpretation of the phrase "sports committee" in Article 36 paragraphs (1) and (3) ofthe SKN Law. Second, knowing the legal implications of the interpretation of the phrase"sports committee" in Decision Number 19/PUU-XII/2014 on the position of the nationalsports committee.This type of research can be classified into the type of normative legal research. Thisstudy used secondary data consisting of primary legal materials, secondary legal materials,tertiary legal materials and data collection techniques were carried out using the librarystudy method.From the results of the research problem there are two main things that can beconcluded. First, in the legal considerations and judges' decisions in Decision Number19/PUU-XII/2014, the Constitutional Court used several approaches to constitutionalinterpretation that had fulfilled the principles of constitutional interpretation and gave averdict, namely the Constitutional Court interpreted that the phrase "sports committee" inArticle 36 paragraphs (1) and (3) of the SKN Law did not cause multiple interpretationsbecause the formation of the SKN Law was not intended to only form one national sportsorganization. Although so, the Constitutional Court is firm in accommodating pluralinstitutions in related decisions, it can also be seen that in its legal considerations, ifinterpreted more deeply, the Constitutional Court also leads to the concept of open legalpolicy. Second, the legal implication after the enactment of Decision Number 19/PUU-XII/2014 related to the interpretation of the phrase "sports committee" is the problem ofposition in the sports development of the two main national sports institutions in Indonesia,namely KONI and KOI. The author's suggestions: First, the Constitutional Court needs todevelop an approach related to the use of constitutional interpretation and provideconfirmation of when a policy falls into the constitutional / unconstitutional category andwhen a policy falls into the concept of open legal policy. Thus, it is clear about how toproperly implement the Constitutional Court's decision. Second, there needs to be aGovernment Regulation that regulates each national sports committee as a follow-up to theConstitutional Court Decision and as a form of coordination between existing institutions bypaying attention to proportionality goals that do not harm security and public interests,especially the issue of competing rights in the future.Keywords: Sports Commitee, Constitutional Interpretation, open legal policy.

Abstract

Very high unemployment rates can cause disruption to security stability.One of the government's actions to reduce unemployment is to open job opportunitiesthrough the procurement of the state civil apparatus. Another problem that arises inaddition to the high unemployment rate is the presence of honorary workers who aremushrooming in various government agencies. The attention of the government is eagerlyawaited and is expected to be able to change their status more clearly and definitely,namely being appointed as civil servants. Law No. 5 of 2014 may also be considered agovernment action aimed at breaking the deadlock on handling unemployment and a wayout for the appointment of honorary workers to be part of civil servants. The purpose ofwriting this thesis, namely; first to find out how legal politics in appointing honoraryworkers to become government employees with work agreements based on Law Number 5of 2014 concerning civil servants. Second to find out how the Regulations for theImplementation of the Appointment of Honorary Personnel to PPPK are conformidablebased on Legal Politics. This type of research can be classified as normative legalresearch, because in this study using literature materials as the main data to analyzecases, and the author did not conduct field research. Data sources used, primary data,secondary data, and tertiary data. The collection technique uses a literature study oflegal materials.From the results of the study there are two main things that can beconcluded. First, There is legal politics in the appointment of honorary workers to PPPKbased on Law No. 5 of 2014 to overcome unemployment problems and provide legalcertainty for honorary workers to be appointed as PPPK. The appointment of honorarystaff is carried out through the stages of planning, announcement of vacancies,applications, selection, announcement of selection results, and appointment to honorarystaff and honorary staff can be appointed as PPPK candidates if they have met therequirements specified in the law. With this mechanism, it is expected that the quality ofservices provided by employees working in government agencies will be better and moreprofessional. Second, The regulations for the appointment of honorary personnel toPPPK are not fully in accordance with the legal politics above. This can be seen from thedetermination of PPPK needs that are not in accordance with the number of honorarypersonnel and various selections made that have not been able to help provide legalcertainty for honorary personnel to become part of ASN. Abstract

The attitude and behavior of people who prefer to buy imported used clothes because theyare tempted by foreign brands. Used clothing from abroad which includes goods prohibited fromimporting as regulated in the Regulation of the Minister of Trade Number 48/M-DAG/PER/7/2015.The entry of used clothes illegally imported into the domestic market has had a very bad impact onthe national economy as a whole. This is because the circulation of used clothes that are smuggledat a lower price will close the market for goods produced by domestic industries, which will resultin reduced stimulation or efforts to increase domestic production.This type of research can be classified in the type of sociological legal research (empirical),because in this study the author directly conducts research on the location or place under study inorder to provide a complete and clear picture of the problem being studied. This research wasconducted in the Tembilahan City Region, Indragiri Hilir Regency, Riau Province. The populationand samples are the Head of the Department of Trade and Industry of Indragiri Hilir Regency,Head of Trade Division of the Department of Trade and Industry of Indragiri Hilir Regency, Headof the Inspectorate General of Customs and Excise TMP C Tembilahan, Head of the Section forEnforcement and Investigation of Customs and Excise, Tembilahan Head of Health ResourcesDivision. Indragiri Hilir District Health, Secondhand Clothing Traders and the community. Sourcesof data used are primary data, and secondary data. Data collection techniques in this study wereinterviews, and literature review.The conclusions that can be obtained from the results of the research are First, theimplementation of Ministerial Regulation Number 48/M-Dag/Per/7/2015 Article 2 paragraph (2)related to the import of used goods in Tembilahan. This is what causes the used clothing business inTembilahan to still happen a lot. The sellers of used clothing there all know that what they areselling is actually not allowed to be traded and also the public's interest and dependence onimported used clothing does not make used clothing traders decrease, it just gets worse. increase.Second, the obstacles to implementing Ministerial Regulation Number 48/M-Dag/Per/7/2015Article 2 related to the import of used goods consist of Economic Factors, Inconsistency ofRegulations, and Limited resources, facilities and infrastructure. And Third, the government'sefforts in implementing the regulation of the minister of trade number 48/M-DAG/PER/7/2015article 2 paragraph 2 in Tembilahan is that it is necessary to develop a performance strategy forsocializing public understanding, supervision and also law enforcement so as to be able toovercome the implementation of Ministerial Regulation Number 48 /M-Dag/Per/7/2015 Article 2paragraph (2) regarding the import of used goods in TembilahanKeywords: Implementation, Regulation, Used Goods.
