Abstract

Pengaruh perkembangan sosial dalam komunikasi masyarakat yang kemudian diatur secara hukum dan etika untuk mengantisipasi perkembangannya menjadi sebuah kejahatan, dan juga untuk memberikan kepastian hukum pada para pelaku yang benar-benar bertujuan jahat dalam penggunaan internet. Hukum pidana (KUHP) telah mengatur perbuatan hukum ancaman kekerasan dan pencemaran nama baik dalam konteks dunia nyata (konkrit), namun ketika hal tersebut digunakan menggunakan teknologi informasi dengan media elektronik (internet) maka merupakan tindak pidana relatif baru berikut dengan sanksinya. Pemerintah berusaha merespon berbagai perdebatan di masyarakat yang tampaknya belum memiliki filter dalam memilah penggunaan teknologi internet ini, dengan nenurunkan ancaman sanksi pidananya. Dua buah norma terkait delik (delict) diatas cukup menarik untuk dilakukan pembahasan, hal yang awalnya biasa terjadi dimasyarakat (interaksi sosial) seperti istilah ngerumpi, curhat, kritik dan sebagainya, saat ini menghadapi sanksi pidana khusus terkait elektronik. Perbandingan sanksi pidana dari UU ITE 2008 dan UU ITE 2016 telah tampak mewujudkan upaya pemerintah agar tidak terjadi over kriminalisasi, sekaligus tetap berupaya mengedukasi masyarakat. Beberapa pihak yang ingin agar pencemaran nama baik atau ancaman kekerasan ini dihapuskan menurut penulis adalah tidak linier dengan upaya untuk memajukan perdaban hukum dan masyarakat Indonesia

Abstract

Article 33 (3) of the 1945 Constitution of the Republic of Indonesia, is clear that the welfare of the people must be prioritized, however, the problem of mineral and coal mining, at the conceptual level, has not shown an impact on the welfare of the Indonesian people; The author appreciates this change in law. Currently, corruption related to mining has emerged again, namely a loss of IDR 271 trillion, which according to Bambang Hero S. is still an environmental loss or a loss to the country's economy. When compared to BLBI of 138 trillion and Asabri of around 22 trillion, this means that the trading system of tin as one of the mining commodities is the biggest corruption, which was unexpected by the public, but suddenly emerged after the election. Departing from the 1945 Constitution which uses the principle of managing oil and gas resources for the benefit of society and the state. So the problem formulation is how problematic occurs in changes to the regulations of Law no. 4 of 2009 until now it has become Law no. 3 of 2020. At the norm level, changes to the law have accommodated the principles of sustainability and legal certainty, even though implementing regulations do not yet exist. Returning to legal problems in Indonesia, problems often arise in the application of the law, not at the normative level.

Abstract

Criminal law is often positioned as a state instrument to maintain social order and control deviant behavior. However, its effectiveness cannot be understood solely through normative legal analysis. This study examines criminal law from a sociology of law perspective to analyze the relationship between normative legal construction and social reality, as well as the gap between the objectives of criminal law and its enforcement practices. Using normative legal research with a qualitative approach, this study analyzes legislation, legal doctrines, and relevant literature through conceptual and sociological perspectives. The findings show that criminal law operates within complex social structures influenced by power relations, cultural values, and institutional practices. A legalistic and repressive enforcement approach often leads to social injustice, stigmatization, and declining public trust in the criminal justice system. The study argues that integrating a sociology of law perspective is essential to develop a more responsive, contextual, and humane criminal law system. Criminal law reform should shift from a purely punitive orientation toward a balanced approach that emphasizes proportionality, restorative justice, and social protection. Strengthening legal awareness through civic education is also crucial to enhance the legitimacy and effectiveness of criminal law in a pluralistic society
