Abstract

Deregistration in the legal dictionary means deletion. The deletion in question is the abolishment of the mortgage right on the land title book and the certificate. If the mortgage right is removed, the Land Office shall make deregistration (Deletion/Roya) to the record of mortgage rights on the land title book and its certificates. The method used by the writer in this research was sociological juridical research, with descriptive analytical research specification, while the data analysis method used was qualitative analysis. Based on the results of the study and discussion, it can be concluded that the Deregistration Consent Agreement is as a statement from the debtor in notarial, the content is about the debtor has paid off the debt and the creditor agreed to remove the certificate of land rights burdened by the Guaranteed Right to be a clean certificate of any engagement. The Deregistration Consent Agreement does not have the executorial power as the Mortgage Right Certificate. The authority of a Notary in making the Deregistration Consent Agreement shall be based on the statement of the debtor before the Notary, so that the statement or agreement is conveyed by the Notary in an authentic agreement. This is in accordance with the provisions of Article 15 paragraph (1) of Act No.2 Of 2014 on Amendment to Act No.30 Of 2004 regarding Notary Position.Keywords: Public Notary; Agreement; Mortgage Rights.

Abstract

In this study concluded that: Implementation of agricultural land conversion to non agriculture through several stages, namely: a. The applicant submits the application permit conversion of land attached with the above requirements. b. Setting and Planning Section of Land examination whose results land noted in the minutes of technical considerations arrangement of land. c. The committee did Meetings  Land  examination, the results are set forth in the Minutes for consideration demolition permit over the land / Land Use Change Permit (IPPT) by the Head of the Land Office. d. Issuance of land conversion permits Decree (SK Land Use Change Permit). e. Delivery of the Decree of the land conversion permit (SK Land Use Change Permit). Act No.41 of 2009 on the Protection of Agricultural Land Sustainable Food, Government Regulation No. 1 of 2011 on the Establishment and Transfer Function Agricultural Land Sustainable Food has been able to balance the food sector while Act No. 26 of 2007 on Spatial Planning, has not fully balance the conversion of agricultural land to non-agricultural because there is a review of every five (years) 1 (one time. Implementation of the transformation of agricultural land to non-agricultural constrained because some of the following: a. Refusal of requests for land use only verbally. b. The term of service of technical considerations of land is 13 (thirteen) days. But in practice it can reach 3 months. c. Abstract

ABSTRAKTujuan penelitian adalah untuk menganalisis dan mengkaji peranan Notaris dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) terhadap kreditur dan debitur, untuk untuk menganalisis dan mengkaji kendala-kendala yang dihadapi Notaris dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) terhadap kreditur dan debitur, dan untuk untuk menganalisis dan mengkaji dalam notaris dalam memberi solusi yang dihadapi Notaris dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) terhadap kreditur dan debitur. Penelitian ini merupakan penelitian kualitatif dengan metode pendekatan secara yuridis normatif.Berdasarkan hasil penelitian dan pembahasan dapat diketahui bahwa peranan Notaris dalam pembuatan APHT sesuai Pasal 15 Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris terhadap kreditur dan debitur terletak pada tanggungjawabnya yaitu tanggungjawab terhadap akta yang dibuatnya serta perlindungan terhadap para pihak yang terkait di akta tersebut bila dikemudian hari terjadi sengketa di antara para pihak. Hal ini sesuai teori keadilan tindak menjadi monopoli pemikiran satu orang ahli saja dan teori kemanfaatan hukum dimana tujuan hukum semata-mata untuk memberikan kemanfaatan atau kebahagiaan.Kata kunci : peranan notaris, pembuatan APHT, perjanjian Kredit ABSTRACTThe purpose of this research is to know and explain the role of Notary in making Deed of Assignment Rights (APHT) to creditors and debtor, to know and explain constraints faced by Notary in making Deed of Assignment Rights (APHT) to creditor and debtor, and to know and explains how to overcome the constraints faced by a Notary in the creation of Deed of Assignment Rights (APHT) to the creditor and debtor. This research is a qualitative research with normative juridical approach method. The purpose of this research is to analyze and examine the role of Notary in the making of Deed of Assignment Rights (APHT) to creditors and debtors, to analyze and examine the constraints faced by Notary in making Deed of Assignment Rights (APHT) to creditor and debtor, and to analyze and review in a notary in giving solution faced by Notary in making Deed of Assignment Rights (APHT) to creditor and debtor. This research is a qualitative research with normative juridical approach method.Based on the results of research and discussion it can be seen that the role of Notary in making APHT pursuant to Article 15 of Law of the Republic of Indonesia Number 2 Year 2014 About Amendment of Law Number 30 Year 2004 About Position Notary to creditor and debtor lies on its responsibility that is responsibility to deed which he made as well as the protection of the parties concerned in the deed if in the future there is a dispute between the parties. Abstract

Research entitled "Legal Review Against the Request of Cancellation of Deed of Sale and Purchase Between PT. Wahana Wijaya Lestari Reality With Yo Swie Tjin "aims to 1) explain and provide knowledge about the terms of making the sale and purchase deed pursuant to the prevailing rules, 2) to give understanding about judge's consideration to the request for cancellation of deed of sale and purchase between PT. Wahana Wijaya Lestari Reality with Yo Swie Tjin, and 3) provide understanding and knowledge about the legal consequences of the cancellation of the deed of sale and purchase between PT. Wahana Wijaya Lestari Reality with Yo Swie Tjin.Based on the research, it can be concluded that 1) the provision of the deed of sale and purchase based on the prevailing rules by paying attention to the important matters by fulfilling the formal and material requirements, ordering the administration, running the rules of law such as Civil Code, UUPA, UUJN, PP number 24 years 1997, PP number 37 of 1998. 2) judge's consideration of the request for cancellation of deed of sale and purchase between PT. Wahana Wijaya Lestari Reality with Yo Swie Tjin is based on the non-fulfillment of Article 1320 of the Civil Code regarding the validity of a treaty, Article 1321 of the Civil Code that there is no valid agreement if it is given by mistake, or obtained by coercion or fraud, any deviations from material requirements and formal conditions. 3) the legal consequences of the cancellation of the deed of sale and purchase between PT. Wahana Wijaya Lestari Reality with Yo Swie Tjin decided by Bandung District Court that the deed of sale and purchase number 250/2012 dated June 16, 2012 and deed of sale and purchase number 251/2012 dated June 16, 2012 made before PPAT (Plaintiff) is legal defect.Keywords: Cancellation, Deed of Sale and Purchase, Parties

Abstract

The land has an important role in human life because it is completely cannot be separated from land. The issue of the disputes of land boundary may cause a difference of opinion; the value of the interest regarding the layout, borders and vast areas of land that is recognized is the most issue that appears frequently in the Office of land Bordering Counties. The method of the approach that is used in this study is the juridical sociological approach. This approach was conducted to understand the law in the context of the society is a non-doctrinal approach. Through this approach, the object of the law will be meant as part of the social subsystem between the subsystems of the social subsystem-other dispute resolution borders against the border returns object, in the form of legal protection, for misusing of the follow- the Government is due to gross negligence at the time of measurement wide plots of land for the creation of a letter, then the measurement of legal protection used is the preventive protection of the law, the role of the national land Agency Chief Rules Based BPN No. 3 Of 2011 is about the management and treatment of Cases of land. Abstract

Notary Appointment as Notary Protocol holders and storage required to accept the delegation of the protocol, because at the beginning of his run, every Notaries are required to make a statement about its willingness to accommodate the move Notary Protocol, quit, or died. As a holder of the protocol but can learn a lot there is also a consequence of the receipt of such deed is when there is a legal problem, as the holder of the protocol also participated as a defendant or summoned by investigators in order to bring that existed at the Notary deed holder protocol. However, it has become a legal obligation Notary.          The purpose of this research are: 1) To analyze and assess the extent of legal protection against protocol receiver notary deed allegedly related legal issues in the city of Semarang. 2) To analyze and assess the barriers in the legal protection of the receiving notary deed allegedly protocols about legal issues in the city of Semarang. 3) To formulate legal protection against protocol receiver notary deed was allegedly associated legal problems in the future.Notary receiver and storage protocol is not responsible for the contents of the deed of the substance or the above protocol receives. UUJN enactment, not without obstacles in its implementation. It was mainly related to the legal protection of a notary. Those barriers between them, yet the formation of the Implementing Regulation and Role Change THIS UUJN to socialize UUJN Changes in certain areas less. Abstract

ABSTRAKSuatu pekerjaan atau profesi yang dalam melaksanakan kewenangannya memerlukan etika. Kode etik yang dijadikan sebagai suatu pedoman perilaku anggota beserta sanksi yang jelas dan tegas terhadao pelanggar kode etik. Keberadaan kode etik Notaris bertujuan agar suatu profesi Notaris dapat dijalankan dengan profesional dengan motivasi dan orientasi pada ketrampilan intelektual serta beragumentasi secara rasional dan kritis serta menjujung tinggi nilai-nilai moral. Pedoman notaris dalam menjalankan tugasnya harus berpegang teguh pada kode etik Notaris yang merupakan seluruh kaedah moralnya. Dalam melaksanakan prateknya Notaris diawasi oleh Dewan Kehormatan Notaris, karena pengawasan ini sangat diperlukan agar Notaris tidak mengabaikan keluhuran dan martabat profesinya. Penelitian ini bertujuan untuk mengetahui, mengkaji dan menganalisis urgensi Dewan Kehormatan dalam penegakan kode etik, kendala, dan solusi Dewan Kehormatan Notaris dalam penegakan Kode Etik Notaris di Kabupaten Pati. Penelitian ini menggunakan pendekatan yuridis empiris. Data yang dipergunakan adalah data primer dan data sekunder. Data primer diperoleh secara langsung melalui wawancara dan data sekunder diperoleh dari bahan kepustakaan, arsip, dan dokumen-dokumen yang berhubungan dengan obyek penelitian. Hasil penelitian menunjukkan bahwa Dewan Kehormatan sangat berperan peting dalam upaya penegakan kode etik. Beberapa bentuk pelanggaran yang dilakukan oleh Notaris adalah Penandatanganan akta tidak berhadapan antara klien dan Notaris, Melakukan penetapan tarif dibawah standar , Melakukan usaha-usaha yang dapat mengarah kepada persaingan tidak sehat, Permasalahan plang nama dan pindah alamat tidak melapor. Kendala Dewan Kehormatan dalam melakukan penegakan kode etik yaitu, jumlah Notaris yang semakin banyak, Dewan Kehormatan hanya berjumlah 3 (tiga) orang anggota dan bersifat kolektif sehingga apabila ada yang berhalangan karena kesibukan atau kendala lainnya, Dewan Kehormatan tidak menjalankan tugasnya secara optimal dan ada sebagian oknum Notaris yang mau diperiksa sudah diberi tahu tetapi tidak ada di Kantor tanpa ada alasan dan wilayah kerja yang luas. Solusi Dewan Kehormatan dalam penegakan kode etik Notaris melakukan evaluasi dan perbaikan dari setiap pelanggaran kode etik agar dapat diminimalisir dan dihilangkan, merencanakan langkah yang strategis yang akan dilaksanakan Dewan Kehormatan agar sesuai dengan tujuan yang hendak dicapai.Kata Kunci : Kode Etik, Dewan Kehormatan, NotarisABSTRACTA job or profession that in carrying out its authority requires ethics. Notary guidelines in carrying out their duties must cling to the code of ethics Notary which is the entire moral method. In performing its Practice Notary is supervised by Board of Honor Notary, because this supervision is necessary so that Notary does not neglect the nobility and dignity of his profession. This study aims to know, examine and analyze the urgency of the Council of Honor in the enforcement of ethical codes, constraints, and solutions of the Notary Board of Honor in the enforcement of the Notary Code of Ethics in Pati Regency. This study uses an empirical juridical approach. The data used are primary data and secondary data. Primary data obtained directly through interviews and secondary data obtained from literature materials, archives, and documents related to the object of research. The results of the study show that the Honorary Board is very important in the effort to enforce the code of ethics. Some forms of violations committed by a Notary are the signing of not dealing dealing between the client and Notary, Conducting tariffs under the standard, Conducting business that may lead to unhealthy competition, Problems plang name and move address not report. Obstacles of the Board of Honor in enforcing the code of ethics that is, the number of Notary more and more, the Board of Honor only amounted to 3 (three) members and collective so that if there is an absence due to busyness or other obstacles, the Honor Board does not perform its duties optimally and there are some Notary person to be examined has been notified but not in the Office without any reason and wide working area. The solution of the Council of Honor in the enforcement of the code of ethics Notary conducts an evaluation and correction of any violation of the code of ethics in order to be minimized and eliminated, to plan the strategic steps that the Board of Honor will take to match the objectives to be achieved.Keywords: Code of Ethics, Council of Honor, Notary

Abstract

The purpose of the research is to find out and examine the reconstruction of terrorism prevention policies in the digitalization era that is oriented towards Pancasila justice. The approach method used a normative juridical approach. The results of the research that show that the legal reconstruction is carried out by adding special counter-terrorism efforts, namely in the form of observation, supervision and control of all forms of activities related to terrorism, both from outside and from within the country. Then added efforts in the form of early supervision of the terrorism movement through digital technology as well as conducting international cooperation related to the prevention and eradication of terrorism, for this reason it is necessary to reconstruct the Prevention of Terrorism Crimes and the Protection of Investigators, Public Prosecutors, Judges, and Correctional Officers, then reconstruction of Protection For Investigators, Public Prosecutors, Judges, and Correctional Officers, the contribution of the research is expected to reconstruct policies for handling terrorism crimes based on the value of justice so that they are expected to be able to provide a renewal of thought in the theory of preventing and handling terrorism crimes through the thought of preventing terrorism crimes.

Abstract

The purpose of this study is to analyze the factors that cause bad credit to credit agreements between creditors and debtors and to formulate a model of bad credit settlement against credit agreements between creditors and debtors. This study uses an empirical juridical approach. This study found that the factors causing the occurrence of bad credit are due to internal factors of the bank (creditors), namely ignoring bank prudential principles, especially the 5C principle, where banks are less careful in assessing potential debtors, and external factors (debtors), where the debtor's business decreases, debtors are not clever in managing their business, debtors have large debts, credit is not used properly, hidden credit and fictitious credit. The non-performing loan settlement model puts forward the principles of taawun and tawazun, with several stages, namely subpoena, credit restructuring and, / or credit settlement by selling collateral as a last resort.

Abstract

Credit risk in the context of financial institutions is a common occurrence but it has a negative impact if not insurmountable be influential on the soundness of the financial institution. Nevertheless, this risk can be managed and controlled, by way of precaution in terms of lending.1 Therefore, in the granting of credit, the bank must pay attention to the principles of lending right,2 which one of them is through the appraisal (coleteral) in the form of collateral that can be used as protection for creditors (financial institutions) in the event of default or breach of contract. Use of the mortgage institutions by financial institutions as collateral for the credit of the debtor for repayment of debt, considered more a sense of security in terms of lending, compared with provisions on the guarantee in the Civil Code in Article 1131. The weakness in terms of guarantees contained in the provisions of Article 1131 of the Civil Code is very different from the conception of the imposition of bail in the mortgage rights Act which guarantees the imposition of security rights institutions specifically tied and mutually exclusive because it applies only to one creditor only. This legal consequences on the situation in which if the debtor in default, mortgage holders creditors are entitled to sell the object as collateral through public auction in accordance with the provisions of the legislation in question with the right to precede rather than other creditors. Based the provisions of Article 6 of Law No. 4 of 1996 On Mortgage of Land And Objects Relating to Land (hereinafter referred to as UUHT). Takeover of collateral can be done by holders of mortgage without the need to seek prior authorization to the giver mortgag, and do not need to also ask for the establishment of a local court, if want to execute on mortgage as collateral the debt of the debtor in the case of debtor default.3 Mortgage holders may request to the  Head of Auction Office to the auction on the objects mortgage concerned,4 so this is a new step where before the execution of the deed grosse mortgages can only be done through the execution of the District Court.5 Execution of mortgage, this concept is known in the Code of Civil Code (hereinafter referred to as the Civil Code) is known as parate execution as referred to in Article 1178 of the Civil Code. Based these provisions, the takeover of the collateral in the form of a guarantee can be done by holders of mortgage (creditor) without the need for prior approval to the mortgage providers, when will be the execution of the mortgage which is a guarantee of debt of the debtor in which case the debtor is in default, this concept is known as parate execution which means that people refer to it as the execution is always ready at hand or parate execution.6 In practical implementation, execution parate implementation on the mortgage rights are not clear and even tend to stray far from the principles and doctrines parate execution. This is one of them can be seen in Article 14 paragraph (2) and (3) UUHT, where execution can be carried out on the certificate of mortgages in which includes irahirah with the words : “FOR THE SAKE OF JUSTICE UNDER THE ONE ALMIGHTY GOD”. Thus, the aforementioned phrase (irah-irah), indicates that the execution of the security object on the ground bound with mortgage understood as execution as grosse acte hypotheek. Other than that, on a general explanation Point 9 of the Act Mortgage stated that the concept of parate execution mortgage referred to in Article 14 paragraph (3) of the law still refers to Article 224 Herziene Indonesisch Reglement (hereinafter abbreviated as HIR). HIR provisions of Article 224 states that : The original letter from the letter of the mortgage and debt securities strengthened in front of a notary in Indonesia and whose head wear the words “On behalf of the Law”, equal magnitude with the judge’s decision, if the letter that should not be kept by peaceful means, then subject it to run held by the command and leadership from chairman of the district court which is in the jurisdiction the person who owes it silent or stay or choose a place of residence in the manner stated in the articles above in this section, but with the understanding that force the body can only be done, if it is allowed by the judge’s decision. This condition caused multiple interpretations are not contradictory between Article 6 jo. Article 20 Paragraph (1) Clause (a) of the Act Mortgage, Article 14 paragraph (3) and Point 9 General Explanation Mortgage Act.
