Abstract

This study aims to find out and analyze the effectiveness of structuring the function of the Green Open Ruan in Gorontalo City, as well as to find out the factors that hinder the availability of Green Open Space in Gorontalo City. The type of research used is empirical research where this research places a system of statutory norms when interacting with the community. Next described in the descriptive form to explain the results of the study. The research obtained by the authors in conducting this study includes the arrangement of Green Open Space in the City of Gorontalo, which provides ecological, socio-cultural, aesthetic, and economic benefits. However, it has not been maximized because the availability of Gorontalo City Green Open Space does not reach the standard compared to the overall Green Open Space area that has been set. Furthermore, based on the results of research obtained, the obstacles encountered in efforts to realize Green Open Space, namely barriers to inadequate land availability, as well as low community culture in maintaining and preserving urban Green Open Space.

Abstract

The purpose of this research is to find out the legal force of SKPT in land sale and purchase transactions in Paleleh District, Buol Regency. The research method used is empirical research, namely the author will seek and find information which will later be used as the substance of this research by means of observation or conducting field studies in the place that is used as the object of this research. this research is carried out in a planned and systematic manner to obtain answers to problem solving related to the problems that occur, especially regarding the existence of buying and selling transactions using Land Tenure Certificate (SKPT) in Paleleh District. The results of this research on the legal force of land ownership certificates in sale and purchase transactions in Paleleh Subdistrict, where many people in Paleleh Subdistrict conduct land sale and purchase transactions using only a Land Ownership Certificate.  This is due to the habits of people in rural areas who do not want to be complicated in thinking about the legal aspects of land sale and purchase transactions, for them it is enough just to provide receipts as proof that payment has been made.

Abstract

This article discusses the legal protection of clients without contracts in legal services according to Law no. 8 of 1999 concerning Consumer Protection The purpose of this article is to find out the relationship between lawyers and clients in legal service agreements and to find out legal protection for clients without contracts on legal services according to Law no. 8 of 1999 concerning Consumer Protection. The method used is a normative article using library data. The result of this article is that the relationship between advocates and clients is a relationship in the form of a symbiotic mutualism that requires each other, as regulated in the Law on Advocates No. 18 of 2003 concerning Advocates that Advocates and Clients each have rights and obligations. where the advocate is obliged to provide legal assistance to the client and is entitled to an honorarium for his services. Meanwhile, the client is obliged to provide an honorarium to the advocate and is entitled to legal assistance from the advocate. while the legal protection to clients in the legal service agreement is regulated in Law no. 8 of 1999 concerning Consumer Protection, as well as the settlement method, namely through the general judiciary, the Advocate Code of Ethics Council Session, and arbitration.

Abstract

This study aims to determine the role of the Food and Drug Supervisory Agency which (will be referred to as BPOM) in the distribution of cosmetics that include a fictitious distribution permit. The method used in this study is an empirical research methodology. This study uses a qualitative approach and sampling using purposive sampling and using descriptive analysis techniques. The results of this study show that the role of BPOM in the distribution of cosmetics that includes a fictitious distribution permit continues to carry out Supervision, Guidance, and Prosecution of every producer who violates government regulations related to the circulation of counterfeit cosmetics that include a fictitious distribution permit number and several programs are run to deceive consumers. get the right. In addition, it continues to protect consumers who experience losses by providing administrative sanctions to the perpetrators to be able to pay for the losses suffered by the consumers themselves. Protecting Consumers from the Circulation of Dangerous Cosmetics BPOM has several programs, namely the National Movement to Beware of Illegal Drugs and Food (GNWOMI), GENPOPA, BPOM Checks, Public Warnings, Educational Videos, Community Awareness Index Surveys, Implementing Teams for Quality Improvement of Community Empowerment and Consumer Protection.

Abstract

This research aims to find out the authority of the National Land Agency in the implementation of mediation on land disputes and the obstacles of the Gorontalo City National Land Agency in the implementation of mediation against land disputes. The research method used is empirical.  The results of the research obtained by the author include the Authority of the National Land Agency whose rights are attached to the Gorontalo City Land Office, is the Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 11 of 2016 concerning the Settlement of Land Cases is valid based on applicable laws and regulations. So that the Land Agency must resolve disputes that are complained about by the community without having to go through the judiciary if the parties are willing to be mediated by officers in the Land Office in question. Furthermore, the obstacles of the Gorontalo City Land Agency are still a lack of public awareness and understanding of mediation, the absence of the parties to the dispute, as well as the appointed mediator parties, still, the lack of certified mediator personnel and administrative complaints filed by complainants are incomplete.

Abstract

the purpose of this study is to determine the legal protection of personal data of bank customers according to Law No. 8 of 1999 on Consumer Protection and how the implementation of the Financial Services Authority (OJK) Regulation No. 12/PJOK.03/2021.  The method used is using sociological juridical research method, using a descriptive qualitative research approach and interactive analysis techniques. The result of this research is that it arises because the issue of data protection and customer information in Indonesia has become a new problem in the banking world. On the other hand, adequate forms of protection for a customer's privacy rights have not been implemented into legal instruments. Similarly, the existence of various laws (UU) that have the authority to manage one's data and information, are not given limits to avoid violations that result in unprotected data and information of a person.

Abstract

This study aims to determine the transfer of child custody to a father. The method used in this study is normative research methodology and uses a statutory and shirt approach as well as descriptive analysis techniques. The results of this study indicate that according to the Compilation of Islamic Law, the custody of a child to a father after a divorce is the right of the mother to take care of a child who is not yet mumayyiz or not yet 12 (twelve) years old. But if you look at the contents of decision number 448/Pdt.G/2018/PA. But where the judge imposes child custody on a father, after analysis that the judge does not only refer to the applicable laws and regulations, but the judge has the authority to assess, analyze and decide under the facts presented in court and prioritize the interests and welfare of children.

Abstract

The purpose of this study is to determine and analyze the application of criminal sanctions against illegal mining actors according to Law Number 3 of 2020 in Dengilo District, Pohuwato Regency, and to determine and analyze the impact of illegal mining in Dengilo District, Pohuwato Regency. The type of research used in this study is empirical legal research using data collection techniques through direct observation and interviews with related parties. The results of this study show that the application of criminal sanctions in Kec. Dengilo is still not optimal, because there are still many perpetrators who continue to carry out activities secretly at the mine site. The miners carried out mining activities at night using heavy equipment even though it had been prohibited by the authorities. The government of Dengilo District, Pohuwato District, has made socialization efforts to the community regarding the provisions governing mining problems and sanctions for those who violate these provisions and has collaborated with the Pohuwato Regional Police in following up perpetrators of illegal gold mining crimes by the provisions of Law Number 3 of 2020. The impact caused by illegal gold mining in Dengilo District is positive: increasing local income, accommodating labor, and increasing community income. Negative impacts: river water pollution, damage to agricultural land, destruction of forest areas, causing casualties, causing landslides, and disrupting public health. Therefore, the government should facilitate and determine community mining areas.

Abstract

Abstract: This study aims to examine the role of the Office of Religious Affairs (Kantor Urusan Agama or KUA) in reducing underage marriage rates and to identify the factors that hinder the execution of its duties. The research employs a qualitative approach with a descriptive method. Primary data were collected through in-depth interviews with KUA officials, community leaders, parents, and underage marriage participants, while secondary data were gathered from official documents, annual reports, and relevant literature. The findings reveal that KUA has implemented various measures to prevent early marriages, such as stringent administrative document verification, community outreach, and premarital counseling. However, KUA faces several challenges, including limited human resources, cultural resistance, and a lack of cross-sectoral collaboration, which hinder its effectiveness in combating underage marriages. This study recommends strengthening institutional capacity, enhancing cross-sectoral collaboration, and leveraging digital technology to support education and prevention efforts. With a holistic strategy and strong support from various stakeholders, underage marriage rates can be significantly reduced.

Abstract

The rapid development of digital technology has led to the emergence of crypto assets as a new financial instrument that is starting to be considered as collateral for banking transactions in Indonesia. Although crypto has been recognized as a digital commodity that can be traded on futures exchanges, there are currently no specific regulations explicitly governing its use as collateral for bank loans. This study aims to analyze the legal aspects, practical challenges, and risk management faced by banks in accepting crypto as collateral. The research method used is a normative legal method with a statutory and conceptual approach, supported by a literature review and comparative analysis of international practices. The results show that although crypto meets the criteria for collateral from a civil law perspective, banks still face several significant challenges, such as high price volatility, digital security risks, and the lack of standard operating procedures related to the assessment and execution of crypto collateral. Therefore, banks tend to position crypto as additional collateral, rather than primary collateral, to minimize the risk of loss. This study recommends the need to establish a more comprehensive and adaptive legal framework, strengthen technological infrastructure, and improve digital financial literacy to support the safe and effective implementation of crypto as collateral. Thus, synergy between regulators, industry players, and the public is essential to create an inclusive and sustainable digital financial ecosystem in Indonesia.
