Abstract

The system of education in pesantren becomes necessary, because it makes a set of interrelated, interdependent and strengthen one another to achieve the goals of education in pesantren, those are to form a democratic, competitive, innovative, and good society not only in science and technology (IPTEK), but also in iman and taqwa (IMTAQ), and to be responsible and have a good moral. Pesantren has a strong influence on almost all aspects of rural society life. The development of religious thought and interpretation from outside elite of pesantren did not have a significant impact on the way of life and attitudes of rural society. This fact shows that every effort aimed at society development, especially in rural area, needs to implicate pesantren. As time goes by, pesantren combines religious education and general education, which can produce the religious experts (ilmiah-amaliah-diniah) relevant to the needs and demands of the times. It makes education in pesantren as an alternative and excellent education.

Abstract

Intolerance in the name of religion is still common in this country. Excessive religious fanaticism and lack of religious knowledge are among the contributing factors. Likewise, politics wrapped in religion is still often done by some politicians, which in turn causes rifts between nations. Therefore this article will discuss the harmonization of religious communities in multi-religious and ethnic countries in the perspective of the Koran by using interdisciplinary thematic interpretation methods. The results of the study concluded that the differences in religion and ethnicity were sunnatullah. In building harmony among religious communities, the Koran encourages fair and good relations between religious communities, makes friends, does not berate each other, does not impose certain religions, carry out the teachings of each other's religion and does not interfere with other people's religions.

Abstract

This research This research is research that uses the research library method. This research The method used in this research is the descriptive method, namely research that only describes the research results that the researcher obtained in exploring the data. After that, research validates the data and then abstracts it in the form of written work. The results of this research conclude that the meaning of Amar is that there is something essential and something majestic. Amar's true meaning is only obligatory. while amar majazi has many meanings, namely Amar which means sunnah, irsyad, mubah, ta'dib, indzar and prayer. Meanwhile, the meaning of nahi is essence and majazi. The true meaning of amar is that it is only obligatory. Meanwhile, the majazi meaning of nahi is makruh, prayer, irshad, tahqir, aqibah, ta'yis, tahdid, iltimas, and syufqah. Meanwhile, the rule of Amar is that first Amar does not have to be repeated unless there is a qorinah that requires it to be repeated. Both rooms do not have to be done immediately unless there is a Korina that requires it to be done immediately. When Amar must follow the qayyid that accompanies Amar, it either includes the time to carry out Amar or the order to be carried out immediately. Meanwhile, the rule is that first nahi applies and so on unless there is a qorinah that limits it. The nullity of a prohibited law depends on the prohibition if the prohibited substance is the law. Likewise, the law is void if the prohibition is of a nature that determines what is forbidden. But when what is prohibited is due to something else, the law is not invalidated.

Abstract

Perkembangan radikalisme agama yang masuk pada sektor pendidikan melalui berbagai macam strategi dakwahnya, tentu menjadi perhatian serius bagi para pemangku kebijakan disetiap jenjang pendidikan. Tidak terkecuali pendidikan tinggi berbasis pesantren salaf. Penelitian ini membahas tentang desain pembelajaran fiqh multi madhab, kandungan nilai-nilai moderasi dalam pembelajaran tersebut, dan ragam penerapan metode pembelajaran yang digunakan. Penelitian ini menggunakan pendekatan kualitatif yang menekankan pada metode deskriptif untuk memperoleh gambaran tentang desain pembelajaran fiqh di Mahad Aly Situbondo dalam menangkal radikalisme agama. Dalam mengumpulkan data, peneliti menggunakan teknik wawancara, observasi dan studi dokumen. Hasil penelitian ini menyimpulkan bahwa konsep pembelajaran fiqh progresif digunakan untuk mencegah pemahaman radikal santri terhadap hukum Islam. Konsep pembelajaran ini diantaranya menyajikan kajian fiqh multi madhab, interkoneksi antar disiplin ilmu, dan menjadikan fiqh tekstualis menjadi kontekstual. Nilai-nilai moderasi yang ditanamkan dalam konsep pembelajaran fiqh progresif ini diantaranya adalah pandangan washatiyah, sikap nasionalisme, dan nilai keadilan. Sedangkan metode pembelajaran yang digunakan adalah ekspositori, diskusi mandiri dan bahtsul masail.

Abstract

Maqasid has the aim of realizing benefits, goodness and pleasure for humans which is called jalb al-manafi', as well as avoiding or preventing damage and evil. Maqasid shari'ah has been rerouted to the classics, but in its development, Islamic scholarship has stagnated. It was only in the contemporary era that it developed again. It is against this background that the research was conducted. The results of the study conclude that maqasid shari'ah is to realize the benefits for humans and prevent humans from mafsadah (damage), both in this world and the hereafter. Maqasid sharia is classified in aspects of human life, namely hifdhu al-Din (religious protection), hifdhu nafs (life protection), hifdhu 'aqli (protection of reason), hifdhu nasl (protection of offspring), hifdhu mal (protection of property). However, this maqasid is not partial but must be interconnected with one another. Then in terms of strong and low values, maslahah is divided into three, namely daruriyah (primary), hajiyah (needs), and tahsiniyah (secondary). There are maslahah that are amah, distinctive, and juz'i.

Abstract

Research with the title of reviving the tradition of ijtihad in the modern era uses library research methods, namely research that examines and searches for information and data that generally comes from written language that is related and relevant to the title being researched. The results of the research can be concluded that ijtihad in the contemporary era is a very significant need and cannot be separated from the problems of the people. Ijtihad is a solution to the problems of Muslims in dealing with social problems that occur in a society that is so complex and developing very rapidly. Ijtihad, which is seen by some Muslims as the door to exploring the law, of course has basic arguments from the Koran, Hadith and aqli. What needs to be underlined is that first, ijtihad is only within the scope of Sharia law, not other scientific knowledge. Second, the person who performs ijtihad is someone who is an expert in Fiqh who meets the requirements for a mujtahid. Thus, if someone is found who associates or uses the word ijtihad with his scientific endeavors which are not within the scope of Sharia law, then this is just ijtihad in language, not ijtihad as intended in the Sharia. Likewise, if someone claims to have done ijtihad but he has not fulfilled the requirements for ijtihad then his ijtihad is just a claim that he is not ijtihad in Islam, or he just wants to sweeten his language.

Abstract

The backwardness of Muslims at this time was caused by the freezing of Islamic scholarship. This happens because some people think that ijtihad has been closed. In this contemporary century, some Muslim academics are trying to revive Islamic scholarship, both from the aspect of methodology and theoretical products. One of the Islamic thinkers who is trying to develop a new methodology is Abdullah Saeed, a professor of Arabic and Islamic Studies who is active at the University of Melbourne, Australia. This research tries to explore Abdullah Saeed's thoughts in the field of contextual thematic interpretation methods. The research results are as follows: First, the contextual thematic interpretation method is an interpretation method that must consider three principles, namely 1). Pay attention to and consider various meanings, then take the relevant meaning; 2). Pay attention to and consider the socio-historical context of the revelation of the Koran to determine the food that the mufassir will take; 3). Pay attention and consider the hierarchical value of the Koran to find out which verses can be re-interpreted (dhanni) and which cannot be re-interpreted (qath'i). Second, how the contextual thematic interpretation method works is as follows: 1). Determine the theme; 2). Determine the hierarchical value of the verse text; 3). Exploring the Macro and Micro Context of the Seventh Century; 4). Analyzing Linguistics; 5). Collecting Parallel Texts of the Koran; 6). Present contextualization.

Abstract

The current radicalism and extremism became the background for the initiation of the theory of religious moderation. In the Indonesian context, religious moderation is highly emphasized and has even become a program apart from the Ministry of Religion of the Republic of Indonesia. Along with these developments, the author is interested in studying religious moderation in interpreting the Koran using thematic methods. The results of the research concluded that the Koran aims to do good to each other among fellow believers and act fairly towards them, build friendships, respect other people's religions, not incite other religions, and carry out the teachings of their respective religions and religions and not disturb them. These things can be used as principles that must be applied in building religious moderation in Indonesia.

Abstract

Intellectual Property Rights (IPR) play a crucial role in international trade and the economic development of a country. This is evidenced by the inclusion of IPR protection in the General Agreement on Tariffs and Trade (GATT), known as the Trade-Related Aspects of Intellectual Property Rights (TRIPs Agreement). This research aims to ascertain (1) the perception of lecturers and students regarding the legal protection of IPR, (2) the perception of lecturers and students regarding the IPR Center as an effort to protect IPR legally, and (3) the efforts that Polinema must undertake to enhance the perception of lecturers and students regarding the legal protection of IPR and the IPR Center. This study adopts an empirical legal research approach, with the population being students and lecturers at Politeknik Negeri Malang. Sampling is done randomly without considering strata (Simple Random Sampling). The research findings are as follows: (1) lecturer respondents have a high perception of IPR protection, while student respondents have a low perception of IPR protection; (2) lecturer and student respondents have a high perception of the IPR Center; and (3) suggested efforts include IPR socialization and education, integrating IPR courses into the curriculum, and fostering collaboration among stakeholders. Hak Kekayaan Intelektual (HKI) merupakan hal yang sangat penting di bidang perdagangan internasional dan pembangunan ekonomi suatu negara. Hal ini dapat dibuktikan dengan dimasukannya perlindungan HKI ke dalam kesepakatan GATT (General Agreement on Tariffs and Trade) yang dikenal dengan Trade Related Aspects of Intellectual Property Right (TRIPs Agreement). Penelitian ini bertujuan untuk mengetahui (1) persepsi dosen dan mahasiswa terhadapat perlindungan hukum terhadap HKI, (2) persepsi dosen dan mahasiswa terhadap Sentra HKI sebagai upaya perlindungan hukum terhadap HKI, dan (3) upaya-upaya yang harus dilakukan oleh Polinema untuk meningkatkan persepsi dosen dan mahasiswa terhadap perlindungan hukum HKI dan Sentra HKI. Jenis penelitian ini adalah penelitian hukum empiris. Populasi penelitian ini adalah mahasiswa dan dosen di lingkungan Politeknik Negeri Malang. Sampel diambil secara acak tanpa memperhatikan strata (Simple Random Sampling). Temuan penelitian ini sebagai berikut; (1) responden dosen memiliki persepsi yang tinggi terhadap perlindungan HKI, sedangkan responden mahasiswa memiliki persepsi yang rendah terhadap perlindungan HKI; (2) responden dosen dan mahsiswa memiliki persepsi yang tinggi terhadap sentra HKI; dan (3) upaya yang dapat dilakukan meliputi sosialisasi dan edukasi HKI, matakuliah HKI diajarkan kepada mahasiswa, dan sinergi antarstakeholder.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi penggunaan Artificial Intelligence (AI) dalam pengembangan perangkat pembelajaran Pendidikan Agama Islam (PAI) di SMP Negeri 22 Kota Surabaya. Pendekatan yang digunakan adalah kualitatif dengan metode field research, melibatkan wawancara mendalam dengan guru PAI untuk memahami pengalaman dan tantangan dalam menerapkan teknologi berbasis AI. Hasil penelitian menunjukkan bahwa AI berpotensi besar meningkatkan efisiensi dan kualitas pembelajaran dengan menyediakan perangkat ajar yang adaptif dan sesuai kebutuhan siswa, termasuk modul ajar, bahan ajar, serta media interaktif. Namun, penerapan AI masih menghadapi tantangan, terutama keterbatasan literasi digital guru. Untuk mengatasi kendala ini, penelitian ini merekomendasikan pelatihan terstruktur bagi guru serta pembentukan komunitas pendukung untuk berbagi pengetahuan terkait implementasi AI. Studi ini menyimpulkan bahwa integrasi AI dalam PAI dapat berperan penting dalam meningkatkan kualitas pendidikan di era digital.
