The Effectiveness of Law Enforcement on Illegal Logging Based on the Value of Justice Diding Rahmat

Abstract

Forests are the lungs of the earth that contribute to environmental balance. In practice, the enforcement of environmental law through various regulations, such as Forestry Law, has brought both positive and negative impacts. This study aims to find out the regulations on illegal logging and to identify the effectiveness of law enforcement on illegal logging based on the value of justice. This study was conducted in Kuningan District Regional Government, Ciremai Mountain National Park (TNGC), Kuningan District Forestry Service, Kuningan District Court, Kuningan District Police Office, and Kuningan District Prosecutors Office. This qualitative study applied an empirical juridical or socio-legal approach in order to find data relating to law enforcement on illegal logging as well as preventive and repressive actions based on justice values carried out by law enforcement officials in Kuningan District. The results showed that Illegal logging is regulated in Law No. 41 of 1999 concerning Forestry and Law No. 18 of 2013 concerning Prevention and Eradication of Forests Destruction as well as the Supreme Court Circular No. 01 of 2008 concerning Guidelines for Handling Forestry Criminal Cases. Yet, there is no Kuningan District regulation that specifically regulates illegal logging. Further, the effectiveness of law enforcement on illegal logging in Kuningan District can be seen in terms of its legal substance, structure and culture. Efektivitas Penegakan Hukum Illegal Logging Berbasis Nilai Keadilan Hutan merupakan paru paru dunia yang berkontribusi terhadap keseimbangan lingkungan. Penegakan hukum lingkungan melalui berbagi regulasi seperti undang undang kehutanan telah banyak memiliki nilai positif dalam prakteknya, akan tetapi juga ada nilai negatifnya Peneliti melakukan penelitian yang berjudul “ Efektivitas Penegakan Hukum Illegal Logging Berbasis Nilai Keadilan (Studi Di Kabupaten Kuningan) ” Lokasi penelitian dilakukan Kabupaten Kuningan yaitu pemerintah Daerah Kabupaten Kuningan, TNGC,  Dinas Kehutanan Kabupaten Kuningan, Pengadilan Negeri Kuningan, Kepolisian dan Kejaksaan Negeri Kuningan. Tujuan penelitian adalah untuk mengetahui pengaturan mengenai illegal logging  saat ini serta bagaimana penegakan hukum illeggal loging Kabupaten Kuningan. Metode yang dipakai oleh peneliti dalam penelitian ini adalah metode kualitatif dengan pendekatan yuridis empiris atau sosio legal dengan cara melakukan penelitian lapangan untuk mencari data mengenai penegakan hukum illeggal logging di Kabupaten Kuningan serta tindakan preventif dan represif yang dilakukan oleh aparat hukum berbasis nilai keadilan. Hasil Penelitian yaitu pengaturan Illegal logging diatur dalam Undang Undang Undang Undang No.41 Tahun 1999 Tentang Kehutanan dan Undang Undang No.18 Tahun 2013  Tentang Pencegahan dan Pemberantasan dan Perusakan Hutan sedangkan dalam peraturan lainya juga terdapat dalam Surat Edaran Mahkamah Agung No.01 Tahun 2008 Tentang Petunjuk Penanganan Perkara Tindak Pidana Kehutanan Sedangkan di Kabupaten Kuniningan belum ada perda tentang Illegal logging, Selanjutnya Efektivitas penegakan hukum illegal loging di Kabupaten Kuningan berdasarkan hasil penelitan dapat dilihat Dewan Perwakilan Rakyat

Abstract

Brutality motorcycle gang is due to the social phenomenon of metamorphosis and development of information technology then is not filtered and not accommodated komferhensip about how pencegahanya action , it is the analysis that the majority of gang members are children that have motors and often commit crimes and violate social norms there . As a result of the brutal and unlawful actions that ultimately the future of motorcycle gang members tend to be aged under child protection laws they are still called the future of their children because they have to face a bleak life in bars and deprived of their freedom of expression , it is different with children outside bars detainees who have the freedom to express and execute education as befits a normal child his age . Factors behind them consists of internal factors and external factors , internal factors such as for some is not healthy mental attitude of a motorcycle gang members , disharmony in the family , an outlet disappointment , the economy needs a boost , aberrant learning process , lack of attention and affection as well as low levels of education among them while external factors , namely the need for law enforcement officers to always take preventive actions in handling cases motorcycle gangs and local community participation in order to swiftly carry out preventive.measures.as.well. Abstract

This study aims to investigate the criminal sanctions on the distribution of alcoholic drinks as well as its application based on Regional Regulation. This case study was conducted in Kuningan District by applying juridical empirical research method. The results showed that Kuningan District has Regional Regulation No. 6 of 2014 concerning Supervision and Control of Alcoholic Drinks. This Regional Regulation regulates the distribution and sale of alcoholic drinks which are classified into 3 (three) groups, namely group A, group B, and group C. These three groups of alcoholic drinks can only be sold in star hotels with the Regent’s permission. Law enforcement in the application of criminal sanctions on the distribution of alcoholic drinks is carried out by holding raids in collaboration with related parties which are then followed up by carrying out investigation, search, and confiscation of alcoholic drinks. The sanctions imposed are in the form of imprisonment and/or fines.

Abstract

The Republic Indonesia has continually changed since reformation particularly regarding the institution that uphold national law. The historical process resulted in the formation of dual jurisdiction of the judiciary, namely the supreme court (MA) and the contitutional court (MK). Dual jurisdiction is interesting fact to be noticed. This model is used to analyze the problems of state administration. This article shows that the history of Indonesian governance has played significant role in Indonesian politics. Indonesian state administration is inseparable from the influence of A Model Islamic Contitution on the amendment. Hence, Indonesia is basically not an Islamic state but a country that adopts several Islamic constitutional provisions which are then adjusted to the Indonesian domain. This role has now been realized in a judicial institution namely the Constitutional Court of the Republic of Indonesia as the mandate of the 1945 amendment.

Abstract

The facts on the ground show that most mining in Indonesia is carried out using an open pit mining so that it has an impact on environmental damage. This study aims to determine the factors that cause iron sand mining conflicts and develop a concept of iron sand mining conflict resolution in Kulonprogo Regency, Yogyakarta Special Region Province. The research method used is juridical-empirical law research, with a juridical and case approach, which is then analyzed qualitatively. The results in this study are broadly classified as mining conflicts that occurred in Kulon Progo Regency, Yogyakarta Special Region, which can be divided into two, namely nuanced or legal conflicts (legal conflicts) and social conflicts (social conflicts). Then, the conflict resolution was carried out and targeted two things, namely the harmonization of laws and regulations that were related and used directly in the context of iron sand mining in the area. As well as policy making by involving all stake holders (related parties).

Abstract

AbstractThe author conducted this research with the background of the implementation of Mediation in Kuningan Religious Court in Kuningan. The purposes of writing this paper are to know how the Implementation on Divorce Settlement in Kuningan Religious Court and to know the factors that affect the success of mediation in the Kuningan Religious Court. The method used in this research is with empirical juridical approach using primary data and secondary data and data collection techniques are interviews, observation and literature study. The results of this research are the mediation arrangements set out in the Supreme Court Regulation (PERMA ) Number 1 Year 2016 about Mediation Procedures in Courts and more specifically stipulated in the Decree of the Chief Justice Number 108 / KMA / AK / VI / 2016 on Mediation Governance at the Court. Mediation is the means of dispute resolution through the negotiation process to obtain agreement of the Parties with the assistance of the Mediator. Mediator is a Judge or any other party who has a Mediator Certificate as a neutral party assisting Parties in the negotiation process to see possible dispute resolution without resorting to the disconnection or enforcement of a settlement. Its implementation has been regulated in Law Number 1 Year 1974 about concerning Marriage, Compilation of Islamic Law, and Supreme Court RegulationNumber 1 of 2016 concerning Mediation Procedure in Court. The conclusion of this thesis writing is Mediation which should be one of the alternative process of dispute settlement which can give greater access to justice to the parties in finding satisfactory dispute settlement and to fulfill the sense of justice, and become one of the effective instrument to overcome the problem of case buildup especially for the case Divorce, in the end has not been effectively implemented.Keywords: Mediation, Divorce, Marriage. AbstrakPenulis melakukan penelitian ini dengan latar belakang yaitu bagaimana pelaksanaan Mediasi pada Pengadilan Agama Kuningan. Tujuan penulisan ini untuk mengetahui bagaimana Pelaksanaan pada Penyelesaian Perceraian di Pengadilan Agama Kuningan dan untuk mengetahui bagaimana faktor-faktor yang memepengaruhi keberhasilan mediasi di Pengadilan Agama Kuningan. Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis empiris dengan menggunakan data primer dan data sekunder serta alat pengumpulan data yang digunakan melalui wawancara, observasi dan studi pustaka. Hasil penelitian ini adalah pengaturan mediasi diatur dalam Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan dan lebih spesifik diatur dalam Keputusan Ketua Mahkamah Agung Nomor : 108/KMA/AK/VI/2016 tentang Tata Kelola Mediasi di Pengadilan. Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan Para Pihak dengan dibantu oleh Mediator. Mediator adalah Hakim atau pihak lain yang memiliki Sertifikat Mediator sebagai pihak netral yang membantu Para Pihak dalam proses perundingan guna mencari berbagai kemungkinan penyelesaian sengketa tanpa menggunakan cara memutus atau memaksakan sebuah penyelesaian. Pelaksanaannya telah di atur dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkwinan, Kompilasi Hukum Islam, dan Peraturan Mahkamah Agung Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan. Kesimpulan dari penulisan skripsi ini adalah Mediasi yang seharusnya menjadi salah satu alternatif proses penyelesaian sengketa yang dapat memberikan akses keadilan yang lebbesar kepada para pihak dalam menemukan penyelesaian sengketa yang memuaskan dan mmemenuhi rasa keadilan, serta menjadi salah satu instrumen efektif mengatasi masalah penumpukan perkara khususnya untuk perkara perceraian, pada akhirnya belum efektif dilaksanakan.Kata Kunci : Mediasi, Perceraian, Perdata

Abstract

AbstractThe writer does this research with background to know the rule of diversion policy specifically for children in Kuningan Regency. The purposes of writing this paper are to know how the rule and diversion system policy in child protection at this time and to analyze how juridical diversion policy in child protection in Kuningan Regency. The method that author used in this reseach is normative juridical approach by using secondary data collected through reading, understanding, quoting, summarazing, and making some notes and analyzing the legislation. The result of this research is that the rules and policies of the current diversion are governed by few rules the legislation including laws on the child criminal justice system, supreme court rules on the guidelines implementation of diversion in the criminal justice system the child who once analyzed it still has drawbacks. Juridical analysis of diversion policy on child protection in the Kuningan Regency. Kuningan local regulations related to diversi namely Kuningan Local Regulations about organization of child protection. The conlusion of this paper is that Kuningan local regulation is still common and does not adequately support the policies and the diversion or weaknesses are found in other regulations which should be complemented by Kuningan local regulations. Analisis yuridis kebijakan diversi dalam perlindungan anak di kabupaten kuningan adanya peraturan daerah kabupaten kuningan terkait dengan diversi yakni peraturan daerah kabupaten kuningan tentang penyelenggaraan perlidungan anak. Kesimpulan dari penulisan skripsi ini adalah setelah dianalisis peraturan daerah tersebut masih bersifat umum dan tidak secara memadai dan mendukung adanya kebijakan diversi dan kekurangan atau kelemahan yang ditemukan di peraturan lain diatasnya yang seharusnya dilengkapi oleh peraturan daerah tersebut, oleh peraturan daerah tersebut tidak dilengkapi padahal telah diamanatkan oleh undang-undang dasar negara kesatuan republik indonesia untuk dilengkapi.Kata kunci : Pengaturan, Diversi, Anak.

Abstract

Pro dan kontra pemilihan gubernur langsung dalam ujud dekonsentrasi otonomi daerah di tingkatan provinsi. Otonomi pada dasarnya mempunyai wilayah, kewenangan mengurus urusan pemerintahan, dan kepentingan masyarakat setempat menurut prakarsa sendiri berdasarkan aspirasi masyarakat. Kabupaten/kota sebagai bentuk otonomi memiliki desentralisasi secara kewilayahan. Dekonsentrasi merupakan kewenangan yang dimiliki oleh pemerintah pusat kemudian dilimpahkan kepada daerah secara administratif. Kewenangan secara administratif dalam Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah, dimana kewenangan secara administratif ada pada gubernur. Gubernur sebagai wakil pemerintah pusat dan/atau kepada kepala intansi vertikal di wilayah provinsi. Dekonsentrasi, merupakan penyelenggaraan tugas yang kewajibannya dipegang oleh pemerintah pusat dan memiliki implikasi sosial kemasyarakatan dalam aplikasinya. Konsekuensi desentralisasi memposisikan gubernur sebagai wakil pusat di daerah provinisi yang membawah beberapa kabupaten/kota. Gubernur mempertanggung jawabkan segala tindakannya pada Presiden sebagai pemerintah pusat. Konsekuensinya presiden memiliki kewenangan untuk mengangkat ataupun memilih gubernur yang diajukan oleh masyarakat ataupun wakil masyarakat. Dengan menggunakan penelitian kepustakaan, mencoba mencari titi ideal teori dekonsentrasi yang ada di Indonesia. Kemudian mencoba memberikan bentuk ideal dari sebuah teori yang dianut tersebut

Abstract

The election is an election conducted by Indonesian citizens who have the right to vote to choose their representatives who sit in the House of Representatives both central and regional, or the Regional Representative Council, the President, and Vice President as a means of sovereignty people. Elections are carried out in a direct, public, free, confidential and fair manner. While election crimes are prohibited acts such as violating campaign bans, conducting campaigns outside the established schedule, providing incorrect information related to voter registration data, political money, adding, reducing and or changing votes. The purpose of this study was to determine the regulation of election criminal acts in Indonesia and how to enforce the law. Election crime regulations are regulated in Law Number 7 of 2017 Concerning Elections, namely Article 488 through Article 554. Election criminal law enforcement in Indonesia there are 116 cases consisting of 29 cases of money politics, 22 cases of acts harming election participants, 15 cases counterfeiting, 10 cases of campaigning in places of worship or educational institutions, 9 cases of campaigning outside the schedule, 17 cases of campaigning involving banned parties, 7 cases of campaigning using government facilities, 5 cases of destruction of props and 2 cases concerning the election of participants and their data still, then, in general, the implementation has run well even though at the level of implementation there are only weaknesses such as the substance of the regulation and sanctions for election crimes are multiple interpretations along with severe sanctions, from the structure in this case there are still law enforcement officers in this case GAKUMDU, Bawaslu, the police and the police The weaknesses experienced by weaknesses such as in terms of budget, human resources and facilities and infrastructure aside from the side, culture namely the culture of the community which is still low in the awareness of elections in Indonesia, makes violations of election criminal offenses still high.
