Abstract

Offering or promising something to a person with the intention of influencing them to perform or refrain from performing a duty contrary to their authority or obligation in the public interest is known as bribery. According to the Corruption Crime Act, any gift given to a state official or civil servant is considered a bribe. This research focuses on the legal liability of state officials who accept gifts and the factors considered by judges in deciding cases involving corrupt officials who receive gifts, as seen in the Central Jakarta District Court Decision Number 77/Pid.Sus-TPK/2023/PN Jkt.Pst. The findings of the study indicate that gratuities given to state officials or civil servants are deemed bribes if they are related to their position and contradict their duties or obligations. The first provision requires proof that the gratuity is not a bribe, while the second provision requires proof that the gratuity is valued at less than Rp10,000,000.00. The prosecutor provided evidence that the gifts in question constituted bribes. Failing to report the received benefits can result in fines of at least Rp200,000,000.00 (two hundred million rupiah) and up to Rp1,000,000,000.00 (one billion rupiah), as well as imprisonment for a minimum of 4 years and a maximum of 20 years or life imprisonment. The bribe giver may also face fines of at least Rp50,000,000.00 (fifty million rupiah) and up to Rp250,000,000.00 (two hundred fifty million rupiah), and imprisonment for a maximum of one to five years. Article 13 of Law No. 31 of 1999 on the Eradication of Corruption Crimes also includes additional penalties, such as fines of up to Rp150,000,000.00 (one hundred fifty million rupiah) and/or imprisonment for up to 3 years. In decision number 77/Pid.Sus-TPK/2023/PN Jkt.Pst, the judge considered the degree of culpability, the charges under Article 12(b) in conjunction with Article 18 of Law No. 31 of 1999 on the Eradication of Corruption Crimes, as amended by Law No. 20 of 2001 concerning Amendments to Law No. 31 of 1999, in conjunction with Article 55 Paragraph (1) of the Penal Code and Article 64 Paragraph (1) of the Penal Code, as well as aggravating and mitigating factors.

Abstract

Background: Traumatic brain injury (TBI) is a major cause of morbidity and mortality globally, often resulting in cognitive and functional impairment. Effective neuroprotective strategies are needed to mitigate secondary injuries following TBI. This study evaluated the neuroprotective effects of combined Centella asiatica, cinnamon, and spirulina using NeuN and neuron-specific enolase (NSE) immunohistochemical staining in a rat model of TBI. Methods: Ten male Sprague-Dawley rats (200–400 g, 10–12 weeks) were subjected to TBI using the modified Marmarou model and treated orally with a combination extract of Centella asiatica, cinnamon, and spirulina for 10 days. On day 11, brain tissues were collected for histopathological examination and immunohistochemical staining using NeuN and NSE markers to evaluate neurogenesis and neuronal survival. Results: Immunohistochemical analysis revealed a mean positive expression of 71.66% in the NeuN group, indicating increased neuronal survival and neurogenesis, while the NSE group consistently showed 0% positive staining across all samples. The NeuN staining provided a clear depiction of neuronal preservation in the brain tissue, whereas NSE did not demonstrate detectable neurogenesis or neuronal protection in this model. Conclusion: The administration of a combined extract of Centella asiatica, cinnamon, and spirulina demonstrated neuroprotective effects in a rat model of subacute traumatic brain injury, as indicated by increased NeuN immunohistochemical expression, reflecting enhanced neurogenesis and neuronal survival. NeuN staining provided a clearer and more sensitive depiction than NSE, supporting its reliability as an immunohistochemical marker for evaluating neuroprotection and neurogenesis during the subacute phase of TBI in models treated with herbal-based interventions.

Abstract

Latar Belakang: Dawet ireng merupakan minuman tradisional khas Purworejo yang menggunakan tepung oman sebagai pewarna hitam alami pada butiran cendol. Praktik penggunaan tepung oman yang bersifat tradisional serta potensi penyalahgunaan Bahan Tambahan Pangan (BTP) pewarna menimbulkan isu keamanan pangan pada produk UMKM dawet. Tujuan: Meningkatkan pengetahuan pelaku UMKM Dawet Purworejo mengenai BTP pewarna pangan dan keamanan tepung oman sebagai dasar penguatan sistem keamanan pangan. Metode: Sosialisasi meliputi survei pendahuluan, ceramah interaktif, dan diskusi terkait regulasi BTP pewarna, risiko polisiklik aromatik hidrokarbon (PAH) seperti benzo[a]pyrene pada tepung oman, serta prinsip higiene dan sanitasi pangan. Evaluasi dilakukan menggunakan kuesioner pre-test dan post-test yang dianalisis secara deskriptif. Hasil: Rata-rata skor pengetahuan meningkat dari 32% menjadi 94%, melampaui target peningkatan minimal 50%. Kesimpulan: Sosialisasi terstruktur mengenai BTP pewarna dan tepung oman efektif meningkatkan kapasitas pengetahuan pelaku UMKM dawet dan mendukung penguatan keamanan pangan pada usaha pangan tradisional.

Abstract

The presence of BUMDes is expected that the village will become more independent and the community will become more prosperous. But considering that BUMDes is still a new thing in its existence, it is inevitable that in practice, several obstacles arise precisely related to the process of its formation. the existence of BUMDes, both in terms of the role and regulation of the law and in the implementing regulations, there are still deficiencies, especially its position as a form of business entity. The problem of this research is what is the position of BUMDes in the legal system of the national economy and what is the role of BUMDes in the national economic system. The research method used is normative legal research. The conclusions obtained from research on BUMDes regulations have existed since the promulgation of Law Number 22 of 1948 concerning Principles of Regional Government, then successively regulated in Law Number 1 of 1957 concerning Principles of Regional Government, Law Number 18 of 1965 regarding Principles of Regional Government, Law Number 19 of 1965 concerning Praja Villages as a Transitional Form to Accelerate the Realization of Level III Regions throughout the Territory of the Republic of Indonesia, Law Number 5 of 1974 concerning Principles of Governance in the Regions, Law Number 5 of 1979 concerning Village Government, Law Number 22 of 1999 regarding Regional Government, Law Number 32 of 2004 regarding Regional Government. Separate arrangements are made through the promulgation of Law Number 6 of 2014 concerning Village Administration. As a business entity, BUMDes plays an important role in the development and progress of the economy at the village level as the basis for the agricultural industry. The presence of BUMDes can be a tool for social engineering in the field of welfare which will function to engineer the standard of living of stagnant rural communities towards better progress in the welfare of their people.
