Abstract

This research is motivated by the urgency of legal protection for Muslim consumers in Indonesia through halal certification, in line with the enactment of Law Number 33 of 2014 on Halal Product Assurance (UU JPH). The main objective of this study is to analyze the implementation of the UU JPH in halal certification practices and evaluate its effectiveness from the perspective of maqashid syariah. This research employs a normative juridical method using statute, conceptual, and maqashid-based approaches, and utilizes primary, secondary, and tertiary legal data, analyzed descriptively and analytically using content analysis techniques. The findings show that the implementation of the UU JPH is a strategic step in providing legal certainty regarding the halal status of products circulating in Indonesia. However, its execution still faces challenges, such as the low preparedness of small business actors and the limited number of halal auditors. Institutional strengthening and public education are needed to ensure more effective and equitable halal certification. Furthermore, this study affirms that the obligation of halal certification serves as a form of protection for the constitutional rights of Muslim consumers, guaranteed by national law and reinforced by administrative and criminal sanctions for violators. From the perspective of maqashid syariah, halal certification not only functions as a formal legal mechanism but also serves as an instrument to safeguard the fundamental values of human life. It ensures product compliance with sharia principles, preserves faith, health, and community welfare, and prevents moral and economic harm.

Abstract

Child marriage is still a crucial social problem in Indonesia, one of the provinces with the highest rate of underage marriage is West Java Province nationally. This practice not only violates children's rights, but also has an impact on their future, some drop out of school, ongoing poverty, and domestic violence. To respond to this problem, the West Java Provincial Government through the Women's Empowerment, Child Protection, and Family Planning Service (DP3AKB) initiated the Stop Child Marriage (STOPAN) program. This program involves cross-sector collaboration—government, academics, business, media, and communities—with a comprehensive and participatory approach to reduce the number of child marriages. This study aims to analyze the implementation of the STOPAN program in reducing the number of child marriages and evaluate its effectiveness from the perspective of Maqashid Syariah. The approach used is qualitative-descriptive with a case study method. The results of this study indicate that STOPAN is quite effective partially. The number of marriage dispensations decreased from 6,794 cases (2021) to 3,631 cases (2024), and the proportion of women aged 20–24 who married before 18 also decreased from 10.09% to 5.78%. However, the practice of unregistered marriage is still often carried out by some communities. From the perspective of Maqashid Syariah, STOPAN contributes to the protection of religion, soul, mind, descendants, and property, although it is not yet fully optimal. This study recommends strengthening the community-based approach and the integration of local religious and cultural values ​​in the implementation of STOPAN. ملخص لا يزال زواج الأطفال قضية اجتماعية بالغة الأهمية في إندونيسيا. تُعدّ مقاطعة جاوة الغربية من بين المقاطعات التي تشهد أعلى معدلات زواج القاصرات على المستوى الوطني. لا تنتهك هذه الممارسة حقوق الأطفال فحسب، بل تؤثر أيضًا على مستقبلهم، مما يؤدي إلى التسرب من المدارس، واستمرار الفقر، والعنف الأسري. ولمعالجة هذه القضية، أطلقت حكومة مقاطعة جاوة الغربية، من خلال وكالة تمكين المرأة وحماية الطفل وتنظيم الأسرة (DP3AKB)، برنامج "وقف زواج الأطفال" (STOPAN). يتضمن هذا البرنامج تعاونًا بين القطاعات المختلفة - الحكومة، والأوساط الأكاديمية، وعالم الأعمال، ووسائل الإعلام، والمجتمعات المحلية - مع اتباع نهج شامل وتشاركي للحد من معدلات زواج الأطفال. تهدف هذه الدراسة إلى تحليل تطبيق برنامج STOPAN في الحد من معدلات زواج الأطفال، وتقييم فعاليته من منظور مقاصد الشريعة الإسلامية. وقد استخدم المنهج الوصفي النوعي مع دراسة حالة. وتشير نتائج هذه الدراسة إلى أن فعالية برنامج STOPAN جزئية. انخفض عدد حالات الزواج من 6794 حالة (2021) إلى 3631 حالة (2024)، كما انخفضت نسبة النساء اللواتي تتراوح أعمارهن بين 20 و24 عامًا واللواتي تزوجن قبل سن 18 عامًا من 10.09% إلى 5.78%. ومع ذلك، لا تزال ممارسة الزواج غير المسجل شائعة في بعض المجتمعات. من منظور مقاصد الشريعة الإسلامية، يُسهم برنامج STOPAN في حماية الدين والحياة والعقل والذرية والممتلكات، على الرغم من أنه لم يصل إلى المستوى الأمثل بعد. توصي هذه الدراسة بتعزيز النهج المجتمعي ودمج القيم الدينية والثقافية المحلية في تنفيذ برنامج STOPAN. Abstrak Perkawinan anak di bawah umur masih menjadi persoalan sosial yang cukup krusial  di Indonesia, salah satu Provinsi dengan tingkat perkawinan di bawah umur tertinggi ada di Provinsi Jawa Barat secara nasional. Praktik ini tidak hanya melanggar hak anak, tetapi juga berdampak pada masa depan mereka, ada yang putus sekolah, kemiskinan berkelanjutan, dan kekerasan dalam rumah tangga. Untuk merespons persoalan ini, Pemerintah Provinsi Jawa Barat melalui Dinas Pemberdayaan Perempuan, Perlindungan Anak, dan Keluarga Berencana (DP3AKB) menginisiasi program Stop Perkawinan Anak (STOPAN). Program ini melibatkan kerja sama lintas sektor pemerintah, akademisi, dunia usaha, media, dan komunitas dengan pendekatan komprehensif dan partisipatif untuk menurunkan angka perkawinan anak. Penelitian ini bertujuan menganalisis implementasi program STOPAN dalam menurunkan angka perkawinan anak serta mengevaluasi efektivitasnya dari perspektif Maqashid Syariah. Pendekatan yang digunakan adalah kualitatif-deskriptif dengan metode studi kasus. Hasil penelitian ini menunjukkan bahwa STOPAN cukup efektif secara parsial. Jumlah dispensasi nikah menurun dari 6.794 kasus (2021) menjadi 3.631 kasus (2024), dan proporsi perempuan usia 20–24 tahun yang menikah sebelum 18 tahun juga menurun dari 10,09% menjadi 5,78%. Namun, praktik nikah siri masih kerap dilakukan beberapa masyarakat. Dalam perspektif Maqashid Syariah, STOPAN berkontribusi terhadap perlindungan agama, jiwa, akal, keturunan, dan harta, meskipun belum sepenuhnya optimal. Penelitian ini merekomendasikan penguatan pendekatan berbasis komunitas serta integrasi nilai keagamaan dan budaya lokal dalam pelaksanaan STOPAN.

Abstract

The Astrolabe as a classical astronomical instrument, holds significant historical and educational value, yet its use has become limited due to technological advancements. This study aims to develop a JavaScript-based Universal Astrolabe software to digitize the functions of a physical Astrolabe, with a focus on testing the accuracy of Qibla direction calculations. The Research and Development (RD) method was implemented through stages of needs analysis, design, implementation, and accuracy testing. Test results from three locations (Cirebon, Kuala Lumpur, Istanbul) showed minor discrepancies (0°1'56"–0°4'20") between the software's calculations and those derived from the spherical triangle formula using a calculator. These differences were attributed to the smallest rotation angle rounding of the Rete (0°15') and the 1° interval scale for altitude and azimuth. The software offers advantages in flexibility, automated Rete positioning, and ease of presentation compared to physical Astrolabes, though it does not replace the function of direct observation. The interactive simulation of the Universal Astrolabe software facilitates its use for educational purposes in Islamic astronomy (‘Ilm al-Falak).

Abstract

The Indonesian law on interfaith marriage does not explicitly prohibit it, but it also lacks clear legal clarity, leading to confusion and gaps in its implementation. This study employed a qualitative, literature-based research method based on both legislative and comparative approaches. This study compares Indonesia's legal approach with other countries, based on existing laws and community practices. The legal vacuum surrounding interfaith marriage often leads Indonesians to circumvent domestic legal limitations by marrying abroad and re-registering them in Indonesia. Another approach is to marry twice, with each bride and groom representing their respective religions. This reflects the inability of national law to accommodate increasingly pluralistic and cross-border social realities. Strong religious identities, such as Malaysia, explicitly prohibit interfaith marriage through its Islamic family law framework. Conversely, countries with high levels of religious tolerance and strong cultural ties, such as Ethiopia, the United Kingdom, and Singapore, tend to allow freedom of interfaith marriage on the basis of human rights. Indonesian legal policy needs reform to provide legal clarity and be based on community culture, so that community attempts to circumvent the law can be overcome.

Abstract

Kekerasan dalam rumah tangga (KDRT) merupakan persoalan sosial dan hukum yang bersifat struktural dan belum dapat ditangani secara efektif melalui pendekatan hukum formal semata. Di wilayah dengan masyarakat Muslim yang kuat, seperti Kabupaten Subang, konselor agama menempati posisi strategis dalam membentuk norma keluarga, menyelesaikan konflik domestik, dan memengaruhi respons masyarakat terhadap KDRT. Namun, peran konselor agama dalam pencegahan dan penanganan KDRT masih belum terkonseptualisasi secara sistematis dan kerap berada dalam ketegangan antara upaya menjaga harmoni keluarga dan kewajiban melindungi korban. Penelitian ini bertujuan untuk menganalisis secara konseptual peran pendidikan, mediasi, dan advokasi konselor agama dalam pencegahan KDRT serta menjelaskan relasinya dengan mekanisme hukum formal dalam perspektif maqashid syariah. Penelitian ini menggunakan metode kualitatif dengan pendekatan hukum Islam normatif-konseptual melalui studi kepustakaan dan analisis dokumen terhadap peraturan perundang-undangan, literatur akademik, dan kebijakan terkait KDRT dan konseling keagamaan. Hasil penelitian menunjukkan bahwa peran konselor agama bersifat ambivalen: pendidikan dan mediasi keagamaan berpotensi mencegah KDRT apabila berperspektif keadilan dan perlindungan korban, tetapi dapat menjadi kontraproduktif jika normatif dan bias patriarkal. Advokasi konselor agama terbukti efektif ketika terintegrasi dengan sistem perlindungan hukum formal melalui mekanisme rujukan yang jelas. Penelitian ini berkontribusi pada pengembangan model sinergi konselor agama dan hukum formal berbasis maqashid syariah yang menempatkan perlindungan jiwa, keadilan, dan kemaslahatan sebagai tujuan utama pencegahan dan penanganan KDRT.
