Abstract

Penelitian ini membahas tentang Covernote Notaris/PPAT terkait pemasangan Hak Tanggungan Agunan Bank. Penggunaan Covernote Notaris/PPAT khususnya di industri Perbankan merupakan best practice dan berlangsung sejak lama serta sudah menjadi bagian dari Hukum Kebiasaan. Penelitian ini bertujuan untuk mengetahui manfaat dari Covernote Notaris/PPAT, untuk menganalisis mengapa Covernote Notaris/PPAT tidak diatur dalam perundangan serta solusi hukum yang dapat digunakan untuk mengisi kekosongan hukum atas penggunaan Covernote Notaris/PPAT. Penelitian ini menggunakan metode penelitian yuridis normatif. Penelitian hukum ini bertujuan untuk menelaah peraturan perundangan dan regulasi yang bersangkutan dengan isu hukum yang diteliti. Hasil penelitian menunjukkan bahwa ternyata Covernote Notaris/PPAT merupakan bentuk hukum kebiasaan dan tidak diatur dalam perundangan serta bukan merupakan produk hukum Notaris/PPAT sehingga terjadi kekosongan hukum. Akibatnya Covernote Notaris/PPAT tidak mempunyai kepastian hukum sehingga sangat rentan dalam hal penegakan hukum. Penelitian ini menyarankan solusi jangka pendek dan juga solusi jangka panjang sebelum ada kejelasan perundangan yang mengatur secara tegas tentang Covernote Notaris/PPAT ini.

Abstract

The basic concept of Consumer Protection Law is to ensure legal certainty for the protection of consumer rights, as anticipation that business players are not arbitrarily violating the consumer rights. This study examines whether consumers, particularly consumers of electricity service users in Batam city have their rights protected in accordance with what has been stipulated in Law No. 8 of 1999 on Consumer Protection Law. This study aims to determine aspects of the violation of the rights of electricity service consumers in Batam which have been violated by PT PLN Batam as the only supplier of electric power for public consumption in Batam. Blackouts that often occur in Batam certainly have caused discomfort among of the community. Thus, this study further analyzes the consideration of a power outage conducted by PT PLN Batam and whether such measures can be justified legally. With this study, it is expected that the public, especially consumers of electricity service users in Batam, know how to fight for their rights that have been stipulated as consumers in accordance with Law No. 8 of 1999 on Consumer Protection. === Konsep dasar dari Hukum Perlindungan Konsumen adalah menjamin adanya kepastian hukum untuk memberi perlindungan terhadap hak-hak konsumen, memberi harapan agar pelaku usaha tidak sewenang-wenang melanggar hak-hak kosumen. Penelitian ini ingin lebih lanjut mengetahui apakah konsumen, terutama konsumen pemakai jasa listrik di Kota Batam telah terlindungi hak-haknya sesuai dengan yang telah diatur dalam UU No 8 Tahun 1999 tentang perlindungan konsumen. Penelitian ini bertujuan mengetahui aspek-aspek pelanggaran atas hak-hak konsumen pemakai jasa listrik di Kota Batam yang telah dilanggar oleh PT PLN Batam selaku pihak pemasok tenaga listrik untuk kepentingan umum di Kota Batam. Pemadaman yang kerap kali terjadi di Kota Batam tentunya telah menimbulkan keresahan di tengah-tengah masyarakat. Oleh itu, Penelitian ini juga akan menganalisis pertimbangan dari pemadaman listrik yang dilakukan oleh pihak PT PLN Batam dan apakah tindakan tersebut dapat dibenarkan secara hukum. Dengan Penelitian ini, diharapkan masyarakat, terutama konsumen pemakai jasa listrik di Kota Batam mengetahui haknya sebagai konsumen sesuai dengan UU Nomor 8 Tahun 1999 tentang perlindungan konsumen.

Abstract

Under Article 4, Section 1 of Income Tax Law No 36 of 2008 explicitly stated that income is the object of taxation. The income referred to is any additional economic ability that is obtained or received by the taxpayer with the intent to consume or improve the value of the taxpayer itself. Therefore, all income received by Youtuber or Online Shop Merchants needs to be taxed. The research has a purpose to find out which law that rules Youtuber and Online Shop Merchants especially in a field that concerns income tax. The experiment also reviews which sanction can be applied to Youtuber and Online Shop Merchant should they violate the law. This legal research is in normative form using both the legal approach and analysis approach towards legal concepts or theories. The theories used are the theory of justice and the theory of legal certainty. As for the legal substance, a secondary substance in a form of written laws and regulations as well as research results regarding the issue. Based on the result of this research, the law governing Youtubers and Online Shop Merchants are mentioned in Republic of Indonesia Ministry of Finance Regulation No 210/PMK.010/2018 about laws regarding Tax Application and Trade Transactions through e-commerce with a punishment of administrative sanction or criminal sanction should violation or breach of law occurs.

Abstract

Brand (Trademark) as an Intellectual Property Rights is a sign to identify the origin of goods and services from a company with goods and/or services of other companies. Brand is the spearhead of trade in goods and services. Through brands, entrepreneurs can maintain and guarantee the quality of goods and/or services produced and prevent dishonest acts of competition (consequences) from other entrepreneurs with the intention of aggravating brand image and reputation. Branding as a means of marketing and advertising provide a certain level of information to consumers about the goods and/or services produced by the company. The purpose of this study is to outline the legal protection for Indonesian entrepreneurs, especially in the City of Batam, who often import raw materials products, and the implementation of Law No. 15 of 2001 on Trademarks. The data is gathered through conducting interviews and field observations focusing on the case study of ‘Taman Teh Wangi’, who registered their products with the trademark 'Cha Shen‘. Based on this research, it is concluded that the protection of the Law for imported goods is similar or equivalent to Indonesian company (locally-produced goods). This is in accordance to the theory put forward by Philpus M.Hadjon. Law No. 15 of 2001 on Trademark remains ambiguous on the brands that are allowed to register under the Intellectual Property Rights. === Merek (Trademark) sebagai Hak Atas Kekayaan Intelektual pada dasarnya ialah tanda untuk mengidentifikasi asal barang dan jasa dari suatu perusahaan dengan barang dan/atau jasa perusahaan lain. Merek merupakan ujung tombak perdagangan barang dan jasa. Melalui Merek, pengusaha dapat menjaga dan memberikan jaminan akan kualitas barang dan/atau jasa yang dihasilkan dan mencegah tindakan persaingan (konsekuensi) yang tidak jujur dari pengusaha lain yang beritikad buruk yang bermaksud membonceng reputasinya. Merek sebagai sarana pemasaran dan periklana) memberikan suatu tingkat informasi tertentu kepada konsumen mengenai barang dan/atau jasa-jasa yang dihasilkan pengusaha.Tujuan penelitian ini adalah untuk menguraikan perlindungan hukum bagi pengusaha Indonesia terutama di kota Batam yang mengimpor bahan baku produknya dari Luar negeri.,serta penerapan Undang-Undang Nomor 15 Tahun 2001 Tentang Merek. Pengumpulan data dilakukan secara wawancara dan observasi lapangan dengan studi kasus Toko Taman Teh Wangi yang mendaftar produknya dengan merek cap ‘Cha Shen”. Berdasarkan hasil penelitian, perlindungan Hukum yang didapatkan oleh pegusaha indonesia setara atau sama (Produk berbahan baku lokal dan non-lokal) dan sesuai dengan Teori Pelindungan yang dikemukakan oleh Philpus M. Hadjon. Undang-Undang Nomor 15 Tahun 2001 Tentang Merek belum mengatur terlalu dalam mengenai Merek yang diperbolehkan untuk pendadtaran Hak Merek.

Abstract

This research was conducted for the purpose of ascertaining law enforcements for Small and Medium Enterprises (SMEs) business actors in Indonesia based on Law Number 55 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. It also analyzes the role of government in providing enforcements to small and Medium Enterprises. In this study, normative legal research was used. It found that the legal protection of small businesses competition in Indonesia is a manifestation of the implementation of economic democracy that contains the principles of justice and togetherness to encourage creating opportunities for every businessman in a healthy competition environment. It also found that healthy competition aims to avoid a monopoly of certain business actors only, but it could provide business opportunities for Small and Medium Enterprises business actors to enlarge their business.

Abstract

The purpose of this study is analyzing the setting of Law No. 8 of 1999 on Consumer Protection Against Expired Food Products in Kota Batam.Menganalisis application of the impact of Law No. 8 of 1999 on Consumer Protection Against Expired Food Products in Kota Batam.Menganalisis and find solutions Law No. 8 of 1999 against the negative effects of using products Food Expiration in Batam. This research is classified as qualitative research, and the kind of empirical legal research / sociological, and the object of research is the primary data Interview and observation data coupled with secondary data literature study.The results of this thesis study can be concluded as follows: Implementation of Law No. 8 of 1999 on Consumer Protection against food products expired in Batam practically found that business (shop owners) already have a sense of absolute responsibility (strick lialibility), where when consumers konplein in case the goods expired they had provide compensation in accordance with the agreement. Against the expired goods store owners take action to restore the goods to the seller, gutted and there was also selling goods at bargain prices

Abstract

Foreign investment is an important part in the country economic growth. Therefore, in order to create legal certainty and easiness for investor to boost investment growth in Indonesia, the Indonesian government enacts Law No. 25 of 2007 concerning Investment. Yet this Law has not given any significant contribution to boost investment growth in Batam City. The purpose of this study is to analyze the factors that can affect the growth of foreign investment and the solutions that can be done to increase foreign investment, especially Japanese companies in the city of Batam. Data collection is done by interviewing relevant stakeholders, namely the Badan Pengusahaan (BP) Batam, Batamindo Industrial Zone Management, Labor Unions, and the Japanese Company. Based on the research results, the legal substance of the Law is already good enough because it can provide legal certainty to foreign investment, especially Japanese companies. But there are some factors that needed to be improved to optimize the implementation of the Law. Therefore, in order to improve the implementation of the Law toward growth rate of foreign investment especially Japanese companies, there should be preventive efforts to solve this problem. The suggsted solutions are to establish a Single Authority in matters of foreign investment and LKS Tripartite, to improve infrastructure and restructure the enforcement official who are corrupt, not professional and transparent. Penanaman modal asing merupakan suatu bagian penting dalam kemajuan ekonomi suatu negara. Oleh karena itu demi menciptakan kepastian hukum dan kemudahaan yang dapat meningkatkan pertumbuhan investasi di Indonesia maka Pemerintah Indonesia mencetuskan Undang - Undang No 25 Tahun 2007 Tentang Penanaman Modal. Tetapi Undang – Undang ini masi belum memberikan dampak yang berarti dalam mendorong tingkat pertumbuhan investasi asing di Kota Batam. Oleh karena itu penelitian ini bertujuan untuk menganalisa faktor - faktor apa yang dapat mempengaruhi terhambatnya efektivitas Undang - Undang ini terhadap pertumbuhan investasi asing dan solusi yang dapat dilakukan untuk meningkatkan investasi asing terutama perusahaan Jepang di Kota Batam. Pengumpulan data dilakukan secara wawancara stakeholder yang terkait yaitu Badan Pengusahaan Batam, Pengelolah Kawasan Industrial Batamindo, Serikat buruh, dan Perusahaan Jepang. Berdasarkan hasil penelitian, secara substansi hukum Undang - Undang No 25 Tahun 2007 Tentang Penanaman Modal sudah cukup bagus karena dapat memberikan kepastian hukum kepada penanaman modal asing khususnya perusahaan Jepang. Akan tetapi ada beberapa faktor – faktor lain yang harus diperhatikan dan diperbaiki untuk meningkatkan effektivitas undang – undang penanaman modal ini. Oleh karena itu untuk dapat mendukung dan meningkatkan penerapan Undang - Undang Penanaman modal terhadap pertumbuhan investasi asing terutama perusahaan Jepang, maka harus ada usaha - usaha preventif dalam penyelesaian masalah tersebut. Beberapa - beberapa usaha yang dapat dilakukan adalah pembentukan Single Authority dalam urusan penanaman modal asing, pembentukan LKS Tripartit, perbaikan infrastruktur, dan restrukturisasi aparat yang kurang bersih, profesional dan transparan.

Abstract

This study analyzes the challenges of Indonesian MSMEs under Law No. 20 of 2008 concerning Micro, Small and Medium Enterprises in the era of AEC 2015-2020 and the readiness of MSMEs under Law No.11 of 2020 concerning Job Creation (the Omnibus Law) in facing the era of AEC 2025. It adopted a normative legal research and found that MSMEs faced many challenges in the AEC era under the MSMEs Law. However, the amendment of this Law by the Omnibus Law constitutes a better strategy to improve and develop the Indonesian MSMEs to be ready in facing the AEC 2025.

Abstract

Tanjung Pinang City of the Riau Islands Province (Provinsi Kepulauan Riau) is a transit area for the troubled Indonesian overseas workers from Singapore and Malaysia. The Indonesian National Board for the Placement and Protection of Indonesian Workers (Badan Nasional Penempatan dan Perlindungan Tenaga Kerja Indonesia/BNP2TKI) reported that 15,105 troubled Indonesian overseas workers were deported from January to November 2014 via Tanjung Pinang City. Previous research revealed that citizens of Tanjung Pinang City criticized the treatments given by the local government to the deported workers by reason that they were not the citizens of the Riau Islands Province, yet the local government has to provide shelters and funds prior to returning them to their home towns. The treatments for the deported workers in the transit area have also raised pros and cons among the stakeholders who are in charge of handling the deported workers. This circumstance may not occur if a special regional regulation of the Riau Islands Province has been issued to govern the troubled Indonesian overseas workers in the transit area. Due to this vacuum of law, this research aims to establish a mechanism in handling the deported workers in the transit area by designing an integrative-progressive model which can be adopted by the stakeholders. The model is to link the legal and non- legal issues and as well as to provide the collaborative mechanisms for the stakeholders based on the approaches of the integrative and progressive legal theory.

Abstract

The purpose of this study is to determine a model of international cooperation so that the assets recovery cross-border resulting from corruption in ASEAN can be more effective. Therefore, the questions in this study are: (1) how is the implementation of assets recovery cross-border as a result of corruption based on UNCAC in ASEAN including the obstacles faced and the success of assets recovery cross-border? (2) What is the solution for assets recovery cross-border resulting from corruption? This study using normative legal research methods with written studies using secondary data such as laws and regulations, legal theory, legal principles and scientific works of scholars (doctrine). The results of the study (1) The implementation of assets recovery cross-border resulting from Indonesian corruption in ASEAN was only successful for the first time in 2019 with a return of SGD 200,000 by the Corruption Eradication Commission (KPK) in collaboration with the Corrupt Practices Investigation Bureau (CPIB) Singapore. Obstacles in the implementation of assets recovery cross-border resulting from corruption: a. Structured abuse of power, b. the principle of sovereignty, c. national interest of a country and d. the Treaty on Mutual Legal Assistance in Criminal Matters (MLA ASEAN) as an international agreement is not sufficiently binding (soft law) and requires further processes such as ratification and adjustment to national criminal law. (2) Even though there is a legal umbrella for eradicating corruption related to the assets recovery cross-border resulting from corruption in the form of UNCAC and MLA ASEAN, in order to maximize the implementation of assets recovery cross-border in ASEAN, a special (bilateral) implementing agreement for assets recovery cross-border is needed in order to have more binding power. The implementation agreement is not enough, then it is also necessary to adjust and align the tools of Indonesian national law related to the asset recovery cross-border from corruption and the provision of appropriate authority for law enforcement.
