Abstract

This study aims to review the commitments of the Riau Islands Province in enforcing the PwD rights mandated by the Convention on the Rights of Persons with Disabilities (CRPD) and Law No. 8 of 2016 concerning Persons with Disabilities (PwD Law). This study adopts normative legal research by using secondary data, and examining it based on the content analysis. The study finds and concludes that PERDA KEPRI on PwD has incorporates the principles, purposes and rights under the CRPD. However, it is different from the current PwD Law because it does not specify the rights of women and children with disabilities, yet it remains to be valid because it is permitted by Article 150 of the current PwD Law. The commitments of the Riau Islands Province are also realized by concrete actions of KEPRI local governments, NGOs and communities by providing various assistance and activities for PwD.

Abstract

Indonesia promulgated Law No. 8 of 2016 concerning Persons with Disabilities and established the National Action Plan on Human Rights (RANHAM) and Persons with Disabilities (RANPD). At international level, Indonesia ratified the Convention on the Rights of Persons with Disabilities through Law No. 19 of 2011 and it is also committed to achieve Sustainable Development Goals by 2030. The commitment is realized by the National Action Plan for SDGs which also focuses on persons with disabilities. This study aims to analyze the national legal instruments including the national action plans to ascertain their alignments and compliances with the international legal instruments. This study adopts a normative law research by using secondary data which is analyzed based on the content analysis. It finds that all national legal instruments align and comply with the obligations to respect, protect, and fulfill the rights of persons with disabilities mandated by the international legal instruments. Yet, it is unfortunate that the Optional Protocol to the Convention on the Rights of Persons with Disabilities has not been ratified by Indonesia even though it is a significant legal instrument to strengthen the implementation and monitoring of the CPRD.

Abstract

This study aims to analyze and describe the harmonization of labour law in the ASEAN region, especially Indonesia, Singapore and Vietnam in support of the ASEAN Mutual Recognition Arrangement. This research was conducted by using a normative juridical research method, with a statute approach. The study found that in welcoming the ASEAN Economic Community 2025 as a follow-up to the 2015 ASEAN Economic Community which has ended, the ASEAN member states have agreed to create a regional free market that aims to improve the living standards of the ASEAN community which has implications for the moral awareness of ASEAN member states that must unite in their territory in a free market. The reality of the implementation of the ASEAN Economic Community 2025, specifically regarding the free market for professional services in the region, the ASEAN member states have not moved seriously to implement it, each of the ASEAN member states is still using its country's positive regulations/laws which may lead to a free labour market process in the territory of their respective countries. The harmonization of regulations relating to foreign workers in each positive law of the ASEAN member states is very urgent and necessary, both formal and immaterial form in supporting ASEAN Mutual Recognition Arrangements. So that the vision and purpose of the establishment of the 2015 ASEAN Economic Community which is then followed by the 2025 ASEAN Economic Community are to create a free market and improve the competitiveness of human resources and the quality of human resources so that the creation of an integrated economic area can be achieved.

Abstract

Children are the next generation of the nation who have the right to live a decent life and achieve a bright future. However, there are still many children in Batam City who are involved in the criminal act, including of sexual intercourse with other children under mutual will, so that in the end the child perpetrators must end up in prison. This study aims to find a solution so that the Principle of Presumptio Iures de Iure for Child Offenders having sexual intercourse with persuasion can be applied effectively. The argument is based on the fact that the child perpetrators often claims that they do not know their actions were classified as a crime which regulated in Article 81 paragraph (2) of the Child Protection Act. However, our country's law adheres to the Principle of Presumptio Iures De Iure, which means that everyone is considered to know the law without exception, so that one cannot avoid the rule of law by arguing that he/she does not aware of it. The research method used this study is Sociological Empirical. The research results show, First, the principle of presumption iures de iure on Article 81 Paragraph (2) of the Child Protection Act is not implemented effectively in Batam City. Second, the obstacle that causes ineffective implementation of this principle is the public's ignorance of the existence of this article. Third, the solution in order to implement this principle effectively is to carry out socialization and legal counseling to the community by the government intensively, especially to young people in Batam City.

Abstract

Since it was ratified on October 5 2020, the Omnibus Job Creation Law has still reaped consternation among workers. Basically, the Omnibus Law on Job Creation was made with the aim of improving the welfare of employees. In fact, employees feel disadvantaged by the existence of the Omnibus Job Creation Law, especially in the work contract section. In the Omnibus Law on Job Creation, it is not possible for employees to become permanent employees when their working period ends for a certain time. However, there are also benefits for employees with this new rule, namely employees will receive severance pay/compensation when their working period ends. However, employers have a way of not incurring additional expenses by tweaking employee contracts to be short-term to avoid employees getting THR.

Abstract

Rights to well-known trademarks need legal protection. The well-known trademark case relates to the trademark dilution doctrine. This research aims to analyze and determine the legal doctrine of trademark dilution in Indonesia. The research used a normative juridical approach so that secondary data was collected by using library research methods. The conclusion of the research is that the regulation of the trademark dilution doctrine in Indonesian national law is still implied. However, provisions related to the trademark dilution doctrine in the Paris Convention for the Protection of Industrial Property Rights and the Agreement on Trade-Related Aspects of Intellectual Property Rights can be applied. The ssolution of violations of the trademark dilution doctrine in Indonesia under the Trademark Law is not optimal. The well-known trademark cases studied in this research meet the trademark dilution doctrine which contains the concept of passing off. The regulation on the trademark dilution of well-known trademark in Indonesia is still not perfect, so it is necessary to improve its legal substances.

Abstract

In the game industry itself, particularly in Indonesia, the majority of game developers and publishers are copyright holders who are not the creators themselves, often referred to as license holders. To analyze the legal protection for copyright holders of online game software in relation to the economic rights of the creator, Philipus M. Hadjon's Theory of Legal Protection can be used. The objectives of this research are to analyze the legal regulations for copyright holders of online game software, to analyze the legal protection for copyright holders of online game software in relation to the economic rights of the creator, and to analyze the role of the Government in providing legal protection for copyright holders of online game software. The research used a normative juridical approach, therefore the data used are secondary data obtained from existing literature. It employs qualitative juridical data analysis. The results of the research show that in the legal protection for copyright holders of online game software in relation to the economic rights of the creator, according to Philipus M. Hadjon, "there are two types of legal protection means, namely Preventive Legal Protection means that can be resolved through arbitration/non-litigation, such as Mediation, Negotiation, Conciliation, Arbitration.

Abstract

Penegakan HAM telah berkembang pesat pada abad ke-21 ini, namun dalam perjalanannya masih menyisakan banyak perbedaan hak antara laki-laki dengan perempuan. Stigma seksualitas perempuan yang masih kuat berakar dalam budaya masyarakat global pada akhirnya menghalangi perempuan dalam mengakses hak-haknya. Terlebih lagi ketika masyarakat maupun aparat penegak hukum menempatkan perempuan sebagai korban kejahatan. Kegiatan ini bertujuan untuk memberikan pemahaman mendalam terkait kesadaran hukum tindak pidana kekerasan seksual kepada perempuan dan anak di Kampung Pasir Merah, Kota Batam, dalam rangka pencegahan dan perlindungan korban tindak pidana kekerasan seksual. Kegiatan pengabdian ini dilaksanakan mengingat bahwa darurat kekerasan seksual yang dialami oleh perempuan dan anak di Indonesia masih tinggi, namun terkadang korban kekerasan seksual tidak ingin melaporkan kejadian yang dialami kepada pihak yang berwajib dan memilih untuk diam, terlebih lagi dikucilkan oleh masyarakat sekitar tempat tinggal sehingga hal tersebut menambah trauma yang dialami oleh para korban. Pelaksanaan pengabdian ini juga dibarengi dengan penyerahan bantuan berupa bahan pokok makanan dan pemeriksaan kesehatan secara gratis. Melalui pelaksanaan kegiatan pengabdian ini, dapat disimpulkan bahwa kesadaran hukum masyarakat terutama yang berkaitan dengan tindak pidana kekerasan seksual masih rendah, khususnya perempuan dan anak yang rentan tertimpa kekerasan seksual. Sebagian besar kekerasan seksual masih dilakukan oleh keluarga terdekat sehingga hal tersebut masih menjadi pemakluman dan faktor pemicu tindak pidana kekerasan seksual.

Abstract

Industrial Revolution 4.0 (IR 4.0) has the potential to improve the quality of life for people around the world, but it also has caused the waves of unemployment and layoffs. The Indonesian government has set 10 national priorities to deal with the IR 4.0 by “harmonization of rules and policies” (Priority 10 of Making Indonesia 4.0). In this regard, the government adopts the Omnibus Law approach by enacting the Job Creation Law. This study aims to ascertain the perspectives of Batam people regarding the Job Creation Law whose status is still conditionally valid. This study adopts empirical legal research by collecting and processing 2 types of data, namely primary data and secondary data. Both data were analyzed by using a descriptive qualitative approach. It found and concluded that based on the survey of 210 workers in Batam City, they have positive perceptions of the Job Creation Law since they consider that the Law provides more legal certainty than the former Employment Law. They are also more favorable of this Law than the former Employment Law because it abolishes the overlapping regulations and make one new effective regulation to improve the economy of people. In addition to the Central Government’s efforts to fulfil the requirements of the Constitutional Court Decision Number 91/PUU-XVIII/2020, various stakeholders in Batam City have contributed their insights and inputs to make the Job Creation Law perfect to respond many challenges in the era of RI 4.0. and it can be valid and fulfill the requirements of the Constitutional Court’s Decision.

Abstract

The enactment of Law Number 30 of 2014 concerning Government Administration, it certainly provides clear directions regarding the implementation of governance, encompassing the acquisition and exercise of authority, as well as prohibitions against the misuse of authority. The distribution of authority, finances, utilization of natural resources, and other resources are conducted fairly and harmoniously between the central government and regional governments. Similarly, the arrangement of authority distribution in the management of marine natural resources stipulates that the management of marine natural resources from the coastline up to a distance of 12 nautical miles beyond oil and natural gas falls under the jurisdiction of provincial regional governments. However, up to this point, the collection of fees for utilization remains under the control of the central government through technical implementation units in the region. This research employs a juridical-empirical method with a legislative approach, analyzing its effectiveness based on its implementation within the province of Riau Islands. The study is conducted using a qualitative method and described in a descriptive manner. The research findings indicate that the regional government does not benefit from the management of marine natural resources in the port sector, particularly concerning the collection aspects of the utilization of marine natural resources within the 0 to 12 nautical miles in the regional government's territory.
