Abstract

Moderasi beragama merupakan pendekatan yang menekankan toleransi, saling menghormati, dan dialog antar pemeluk agama untuk menciptakan harmonis sosial. Artikel ini mengeksplorasi penerapan moderasi beragama dalam konteks sosial dan budaya Kota Pontianak, dengan fokus pada peran Forum Kerukunan Umat Beragama (FKUB) dalam memfasilitasi dialog antar agama di tengah keragaman etnis dan agama yang ada. Kajian pustaka ini menunjukkan bahwa   beragama memiliki peranesensial dalam menjaga hubungan antar komunitas, menyelesaikan konflik berbasis agama,dan membangun lingkungan damai. Melalui pendidikan berbasis nilai-nilai toleransi, dialog lintas agama, serta dukungan pemerintah dan Lembaga keagamaan, moderasi beragama terbukti menjadi strategi efektif yang difasilitasi oleh FKUB untuk mengatasi tantangan keragaman. Pendidikan dan peran serta FKUB dalam program-program dialog antar agama, seperti festival budaya yang melibatkan berbagai komunitas agama, telah Memperkuat interaksilintas agama dan meminimalisir ketegangan sosial.

Abstract

Zakat has a strategic role in the Islamic economic system, not only as a religious obligation but also as an instrument of economic empowerment. This research was conducted to analyze the management of zakat by BAZNAS Pangkajene and Islands Regency, especially in empowering micro businesses as an effort to improve community welfare. The background of this research is the great potential of zakat in Indonesia, which is often not optimally utilized, especially in supporting micro businesses. This research uses a qualitative method with a phenomenological approach. Data were obtained through in-depth interviews with key informants, including BAZNAS managers, mustahik, and muzakki, as well as document analysis. The data collection process involved direct observation, structured interviews and literature study. Analysis was conducted inductively to explore patterns, meanings, and relevant experiences. The results showed that the management of zakat in BAZNAS Pangkajene and Islands Regency was carried out in a structured manner through the stages of planning, organizing, directing, coordinating, and supervising. This approach allows zakat to be distributed effectively and on target. Findings also show that well-managed zakat can help mustahiks develop micro-enterprises, thus contributing to their transformation into muzaki. However, challenges in community education, coordination, and supervision still require attention. The implication of this research is the need for innovation in zakat management to maximize its impact on micro business empowerment. Data-driven approach, cross-sector synergy, and integrated training program can strengthen the role of zakat as an instrument of sustainable economic development. This research provides an important contribution to the development of a more strategic and effective zakat policy.

Abstract

This article delves into the comprehensive examination of the dispute resolution in adultery cases within the Tolaki Tribe, specifically through the traditional practice of "Kalosara." The research also explores the relevance of Kalosara to the al-Ishlah concept in Islamic criminal law. This research uses the literature review method to establish a robust theoretical foundation. This research indicates a significant relevance between the Kalosara custom and the concept of Ishlah in the context of Islamic criminal law. The practice of Kalosara in resolving cases of adultery within the Tolaki Tribe reflects the principles of Ishlah, emphasizing reconciliation, restoration, and conflict resolution. The stages of the resolution process, from the acknowledgment of the perpetrator to the purification ceremony, mirror a holistic approach to achieving restorative justice. The research results show that the integration of Kalosara customary law in the Ishlah process reflects the aspirations of the Tolaki community for a comprehensive resolution and effective recovery at various levels, including individual, social, and broader community contexts. In the settlement through Kalosara, adulterers are expected to admit their actions, express regret, and carry out a purification process with a holistic approach to resolving conflicts and restoring social relations.

Abstract

Background: The existence of sociocultural values that are so strong and thick in the daily life of Bugis people is interesting to be associated with the conception of freedom of thought. Considering that freedom of thought is still a concept that still requires a long study. Research Objectives: This research provides an overview of the conception of freedom of thought and how Bugis socio-cultural values and norms can guide this freedom of thought. Hopefully, this research will provide a comprehensive understanding of freedom of thought from the perspective of Islamic education and Bugis socio-culture. Methods: The research method used is a library research method that collects related literature and then combines it with content analysis so as to provide results and conclusions. Results: The results show that freedom of thought is a concept that refers to individual freedom to think independently and critically without being influenced by existing opinions or authorities. However, freedom of thought must be accompanied and "supervised" by a herd of values and a set of principles so that there will be no significant problems arising when the thinking touches the corners of axiology (intersects with social society). Conclusions: Islamic education and Bugis socio-cultural values can greatly guide freedom of thought because the development of Islam itself has recognized the school of kalam science as the foundation of thinking and Bugis society contains so many values, both from the oral tradition of pappaseng and those contained in the ethical philosophy called pangadereng.

Abstract

Online gambling is a form of cybercrime that utilizes information and communication technology, especially the internet, as a medium to commit gambling crimes. Online gambling as a form of cybercrime has become an increasingly widespread phenomenon in line with the rapid development of information and communication technology. Gambling that was previously only known conventionally is now transforming into the digital realm by utilizing the internet as the main media. This research uses a theoretical study of online gambling as cybercrime. This research uses a qualitative approach with an analytical descriptive method. The types of data used are primary data in the form of laws and regulations (ITE Law, Criminal Code), online gambling case documents, official police reports, as well as academic literature and scientific articles related to cybercrime and online gambling. Meanwhile, secondary data is obtained from observation of the investigation process and law enforcement carried out by the cybercrime unit in the police. The data collection technique uses Library Research to collect secondary data relevant to cybercrime legal regulations and theories. The data analysis technique uses qualitative analysis techniques with a descriptive approach. Online gambling is expressly prohibited by Indonesian laws and regulations, especially through Law No. 11/2008 on Electronic Information and Transactions (ITE Law) and its amendments, such as Law No. 19/2016 and Law No. 1/2024. Article 27 paragraph (2) of the ITE Law prohibits any person from distributing, transmitting, or making accessible electronic information containing online gambling content, with imprisonment of up to 10 years and a maximum fine of IDR 10 billion in the latest amendment. In addition, the Criminal Code (KUHP) regulates gambling in general in Articles 303 and 303 bis, with criminal penalties that are also quite severe, although they do not specifically regulate online gambling. Law enforcement against online gambling faces various complex challenges. The existing regulations are still partial and not fully able to accommodate the cross-border and dynamic characteristics of cybercrime.Proof of online gambling cases relies heavily on electronic evidence that requires digital forensic expertise,such as imaging the perpetrator's device and server,as well as analyzing activity logs and electronic transactions

Abstract

Central Aceh is one of the Regencies located in the center of the Province of Aceh which is dubbed as the Gayo plateau region, Aceh is a province in Indonesia that applies customary law in settling cases or disputes in the community through the Sarak Opat Kampung Customary Court, as regulated in The Aceh Qanun number 9 of 2008 concerning the Development of Customs and Customs was later reinforced by Governor Regulation Number 60 of 2013 concerning the Implementation of Customary and Customary Dispute / Dispute Settlement.This study aims to describe the function and authority and find out the procedures for implementing Customary Courts by Sarak Opat in Central Aceh District, then to find out the invoices that constrain Sarak Opat in carrying out customary justice and to find formulations that are obstacles in the implementation of adat justice in Aceh District The middle.This study uses empirical juridical research methods with research sites in Central Aceh District using secondary, primary and tertiary data, then the research data is collected through literature, interviews and observations. From the results of the data are further arranged descriptively analysis.

Abstract

Aceh Province is the only one in Indonesia that is given the authority to implement Islamic law in all aspects of community life. One aspect that is of concern to the Aceh government is the enforcement of Islamic law. Where, if there is a violation of Islamic law, the perpetrator will be subject to sanctions in the form of ta'zir with a punishment of caning in accordance with the level of his/her guilt after receiving a final verdict from the Aceh Sharia Court. This study uses a qualitative approach with a literature study type of research. In this case, the researcher examines various existing literature related to the implementation of caning punishment, both from books, journals, articles, and even print and electronic media. The results of the literature study show that the implementation of caning punishment in Aceh faces various obstacles in the form of limited budget, human resources, and rejection from many parties who view the implementation of caning punishment as contrary to respect for Human Rights (HAM).
