Abstract

Hak atas tanah dapat beralih dengan cara pewarisan melalui hibah wasiat. Dalam peralihan hak atas tanah harus dilakukan pendaftaran tanah untuk menjamin kepastian hukum. Terdapat ketidaksesuaian penerapan aturan pelaksanaan pendaftaran peralihan hak atas tanah berdasarkan hibah wasiat di Kabupaten Tabanan. Berdasarkan Pasal 112 Peraturan Menteri Agraria/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 1997, dalam hal pewarisan berdasarkan hibah wasiat harus melampirkan akta PPAT mengenai hibah yang dilakukan oleh Pelaksana Wasiat, namun dalam prakteknya penulis menemukan pendaftaran peralihan hak atas tanah berdasarkan hibah wasiat tanpa akta PPAT. Adapun permasalahan yang diangkat di dalam tesis ini adalah mengenai bagaimana pelaksanaan peralihan hak atas tanah berdasarkan hibah wasiat tanpa adanya pelaksana wasiat di Kabupaten Tabanan dan kapan kepastian hukum penerima hibah wasiat dalam peralihan hak atas tanah tanpa adanya pelaksana wasiat di Kabupaten Tabanan. Jenis penelitian ini adalah penelitian hukum empiris karena terjadinya kesenjangan antara aturan yang mengatur dengan masalah-masalah yang terjadi di masyarakat. Hal ini dapat dilihat dari ruang lingkup pembahasannya yaitu mengenai apa yang tertuang dalam peraturan perundang-undangan (das sollen) dilakukan penyimpangan-penyimpangan dalam praktek peralihan hak atas tanah berdasarkan hibah wasiat. Jenis data yang dipergunakan dalam penelitian ini bersumber dari dua jenis data, yaitu data primer dan data sekunder. Teknik pengumpulan data yang digunakan dalam penelitian ini dilakukan melalui wawancara dan membaca literatur-literatur yang berkaitan dengan permasalahan. Untuk teknik analisis data, digunakan teknik deskriptif analitis, dikaitkan dengan teori-teori relevan kemudian disimpulkan untuk menjawab permasalahan. Hasil penelitian terhadap permasalahan yang dikaji yaitu pelaksanaan peralihan hak atas tanah berdasarkan hibah wasiat tanpa adanya pelaksana wasiat di Kabupaten Tabanan adalah tidak memerlukan akta PPAT mengenai hibah yang dilakukan oleh Pelaksana Wasiat karena tidak adanya penunjukan pelaksana wasiat. Jadi dasar peralihan hak atas tanah berdasarkan hibah wasiat adalah akta hibah wasiat itu sendiri. Kepastian hukum penerima hibah wasiat dalam peralihan hak atas tanah tanpa adanya pelaksana wasiat di Kabupaten Tabanan adalah didapatkan sejak dibukanya akta wasiat yang diberikan oleh pewaris kepada penerima hibah yang merupakan kehendak terakhir dari pewaris dan dengan dilakukan pendaftaran hak atas tanah sehingga diperoleh sertifikat sebagai tanda bukti haknya. Abstract

The term of corporate governance to come afer moneytary crisis in Asia particularly in East Asia. For Indonesian the concern of this term since monetary crisis moment which factually that there is a lack of good corporate governance force monetary crisis. Corporate governance has influenced greatly on companies, the board of directors, board of commissioners and shareholders in Indonesia. The stakeholders are now given wider opportunity with the adoption of corporate governance. Many sure this will add value to company sure nationalism. The existency of corporate governance was also to result in investor to invest the capital in a corporate which to comply with the principles of good corporate governance. For this, investor to have the guts to pay more the share in a corporate which to comply with the principles of good corporate governance. From management science perspective between management and good corporate governance in principe is the same, that are the process to run a corporation. But there are some different of both. Managemen just see inside of a corporation, good corporate not only see inside of a corporation but also see outside of a corporation likes supplier community buyer; environment and all of stakeholders. So the conclusion is good corporate governance more than good management.

Abstract

From political science perspective, the nature of good governance is proliferation of liberalism by moneter international institutions. Good governance is one of the requirement for a recivier state of loans from the moneter international institutions. Good governance was synergy of stakeholders (government, privat sector, and society) in the implementation of government. Good governance aims to empowering the participation of society in the process of policy formulation, and finally to create a democratic government.

Abstract

Foreign direct investment has a crucial role in accelerating economic development of a state. One of the most attractive investment sectors is tourism that has unique characters of a service industry. It has contributed jobs, tax income, and domestic value significantly. However, foreign direct investment in tourism has adverse impacts, such as environmental and anti-competitive practice. The existence of domestic laws and regulations is crucial to determine a state’s success to gain benefits from foreign direct investment in tourism. This paper aims to analyze the existing laws and regulations that regulate foreign direct investment in Indonesian tourism. This paper shows that the existence of foreign direct investment has been managed through fragmented and unclear laws and policies based on Indonesian laws of investment, tourism, environment, labor, and land. Hukum Terfragmentasi dan Aturan yang Tidak Jelas terhadap Penanaman Modal Asing dalam Pariwisata IndonesiaAbstrakPenanaman modal asing memiliki peran penting dalam meningkatkan pembangunan ekonomi di negara tuan rumah. Salah satu sektor penanaman modal asing yang paling menarik adalah pariwisata karena keunikan karakternya sebagai industri jasa. Penanaman modal asing di sector ini telah berkontribusi dalam menciptakan lapangan kerja, pajak, dan nilai tambah domestik. Namun, sector ini juga menyebabkan dampak negatif, seperti lingkungan dan praktik anti-persaingan. Memaksimalkan keuntungan dan sekaligus memitigasi dampak negatif, keberadaan hukum dan peraturan domestik sangat penting untuk menentukan sejauh mana keberhasilan suatu negara dalam memperoleh manfaat positif dari penanaman modal asing di sektor pariwisata. Tulisan ini bertujuan untuk menganalisis hukum dan peraturan terkait penanaman modal asing, khususnya pariwisata di Indonesia. Tulisan ini menunjukkan bahwa keberadaan penanaman modal asing dalam pariwisata dikelola melalui undang-undang dan kebijakan yang terfragmentasi dan cenderung mengandung ketidakjelasan dengan melihat undang-undang tentang investasi, pariwisata, lingkungan, tenaga kerja dan hak guna tanah di Indonesia.DOI: https://doi.org/10.22304/pjih.v5n3.a1

Abstract

There has been an anxiety over the rise of the spirit of national interest on the existence of World Trade Organization. This spirit that has been reflected from domestic trade policy, to some extent, has undermined trade negotiation process under the WTO as shown by the failure of the Doha Round to conclude significant trade deals. Countries also started concluding bilateral and regional trade agreements instead of the WTO. This article aimed to analyze whether the rise of the spirit of national interest has threaten the existence of the WTO agreements, putting Indonesia as a case study. This article is a normative research, analyzing the dynamics development of the national interest under the WTO, especially Indonesia, and how the judicial body has responded the rise of this spirit in its decisions. This article argues that the spirit of national interest will not threaten the existence of WTO as this spirit has been exist from the early establishment of the General Agreement on Tariffs and Trade in 1947 to the latest WTO negotiation. Moreover, the existence of the WTO judicial body will secure the existence of the WTO, especially because it has successfully controlled the overwhelming spirit of national interest of its members through its decisions. Kebangkitan Semangat Kepentingan Nasional dan Eksistensi Persetujuan World Trade Organization: Studi Kasus Indonesia AbstrakTelah timbul suatu kekhawatiran atas bangkitnya semangat kepentingan nasional terhadap eksistensi persetujuan WTO. Semangat ini yang tercermin dari kebijakan perdagangan domestik  telah menghambat proses negosiasi perdagangan di bawah WTO sebagaimana ditunjukkan oleh kegagalan Putaran Doha dalam menyetujui kesepakatan perdagangan. Negara-negara juga mulai menyetujui kesepakatan perdagangan yang lebih bersifat bilateral dan regional. Artikel ini bertujuan untuk menganalisis apakah bangkitnya semangat kepentingan nasional telah mengancam eksistensi kesepakatan WTO, dengan menjadikan Indonesia sebagai studi kasus. Artikel ini adalah penelitian normatif, menganalisis perkembangan dinamika kepentingan nasional di bawah WTO, khususnya Indonesia, dan bagaimana badan judisial merespon bangkitnya semangat ini dalam keputusannya. Artikel ini berpendapat bahwa semangat kepentingan nasional tidak akan mengancam keberadaan WTO karena semangat ini telah ada sejak awal berdirinya GATT di 1947 sampai negosiasi WTO terakhir.  Melalui keputusan-keputusan yang telah dihasilkan, keberadaan badan penyelesaian sengketa dalam WTO akan menjamin eksistensi WTO, terutama karena telah berhasil mengendalikan semangat kepentingan nasional dari anggota WTO. Kata kunci: studi kasus, Indonesia, perjanjian internasional, semangat kepentingan nasional, WTO. DOI: https://doi.org/10.22304/pjih.v4n2.a6

Abstract

There have been some cases indicating the dissatisfaction of traditional communities with regards to tourism that does not economically contribute to their cultural activities. The legal issue raised in this writing is the lack of, or maybe the abstention of, a regulation that specifically regulates indigenous culture as a tourism economic resource. This article is aimed at describing and analyzing relevant international and national instruments that regulate the issues of indigenous culture and economic activities of tourism. The cases of Indonesia, especially Bali, compared with Australia are the focus of this article. It has been found that Indonesian laws and regulations are insufficient to protect culture as a tourism economic resource. In contrast, Australia has adopted a trichotomous approach wherein economic, social and cultural factors are separate and can be managed separately, an approach that has had mixed results.

Abstract

In the modern era, Bilateral Investment Treaties (BITs) are relatively effective to attract more foreign direct investment (FDI). Many countries then eagerly concluded BITs, including Indonesia. Considering the adverse impact of FDI on the environment, most countries then start putting the environmental concern in their BITs, assisting them to prevent and mitigate any adverse impact of FDI on the environment. Indonesia, however, did not follow this measure. This paper then shows the lack of the current Indonesia’s BITs in putting the environmental concern in their provisions. The fact that Indonesia has terminated some BITs becomes a right momentum to start putting the environmental concern in the updated and modified Indonesia BITs in the future. From other countries’ practices, there is evidence to suggest that BITs can and do contain provisions aimed at ameliorating environmental damage caused as a result of FDI within host countries’ territories.

Abstract

The enactment of the Law Number 30 Year 2014 regarding Government Administration with the expansion of Administrative Court competence stimulate confusion and obstacles in norms and theoretical also practical obstacles for the justice enforcers especially Administrative Court Judges. On the other hand, this law is contrary and potentially conflict with Government Administration Law. To resolve this legal problem, Indonesia Supreme Court issuing several Supreme Court Regulation and Circular Letter of Supreme Court for each expansion of Administrative Court competence otherwise the confusion and obstacle in theoretical and practical spheres still conducted the problem for the justice enforcers. This study has aims to analyze and discuss concerning confusion and obstacles faced by enforcers especially Administrative Court Judges and the attitude or solution towards those obstacles. This study is using normative and empirical method with qualitative types as a descriptive analysis article.

Abstract

After the enactment of the Law of Government Administration, had implied to shifting paradigm concerning the regime of Administrative Decision from negative fictive became positive fictive. However, the regulation into Law of Government Administration contains several obstacles on pratical scope towards Administrative Court Judges. Meanwhile enactment of Supreme Court regulation however Adiministrative Court Judges searching the suitable method after implication of positive fictive regime in the Administrative Procedural Law System. This study aims to analyze and discuss concerning obstacles and method by the Administrative Court Judges solving the practical obstacles after enactment of the Law of Government Administration. This study results is presented in a descriptive analysis paper.
