Abstract

This study aims to find out and analyze how to prove the verdict of a criminal offense that results in serious injury based on the title raised in this authorship. An author is a type of writer an Emperis law or a field writer. With a Case approach. The process of collecting data from regulations and other references related to the problem being studied. The results of this author show that the proof of the Determination of the criminal act of assault resulting in serious injury is said to be incorrect but if we refer to the court decision of the defendant/convicted person is proven to have committed a criminal act of assault resulting in serious injury, but is only sentenced to imprisonment for six (6) months. The judge’s role in determining the criminal act of assault resulting in serious injury is influenced by two counts, namely the judge's estimate that lawfully and convincingly committed the crime of persecution and the legal act used in the indictment article is more than Article 351 Paragraph 2 of the Criminal Code of persecution resulting in serious injury.

Abstract

This study aims to determinea form of tackling the crime of cockfighting gambling.The method used in this research is empirical or sociological research methodology. This study uses a qualitative approach and sampling using purposive sampling and using descriptive analysis techniques. The results of this study indicate thata form of countermeasure carried out to tackle the crime of cockfighting gambling by means of preventive and repressive measures. In the preventive action stage, basically, stakeholders try to take precautions before the crime occurs. However, the most important role in preventing the occurrence of a crime is the supervision of the local community who then cooperates with law enforcement so that the crime of cockfighting gambling is easily detected.The countermeasures carried out by the authorities should be carried out with good coordination and cooperation, so as to make countermeasures that are right on target.

Abstract

The monopoly right to health protection granted to the Social Security Administration Agency (BPJS) in Law no. 24 of 2011 concerning BPJS is an attempt to organize a health insurance program effectively and efficiently. However, this monopoly right also raises several problems, first, institutional problems in the implementation of the national social security system (SJSN) and related to choosing a hospital location that is not in accordance with the wishes of BPJS participants. In this legal research, it has a normative research type with a statutory approach related to the BPJS monopoly right in health protection. The research results show that in order to ensure that the national health insurance program can run effectively, coordinated and integrated efforts are needed between the government, BPJS Health, health service providers, and the community. The government needs to increase the allocation of the health budget, ensure efficient use of funds, and find alternative sources of funding

Abstract

Artikel ini bertujuan untuk mendeskripsikan perbedaan putusan pelanggaran kode etik KPU Bone Bolango pada tahun 2020. Metode penelitian ini adalah menggunakan pendekatan hukum normatif. Hasil penelitian menunjukkan bahwa penyebab terjadinya putusan yang berbeda antara DKPP dan KPU terkait penanganan pelanggaran pemilihan kepala daerah disebabkan karena interpretasi yang berbeda terhadap kewenangan yang dimiliki masing-masing Lembaga tersebut. Selain itu multitafsir dari ketentuan yang ada disebabkan oleh ketidakpastian hukum yang mengatur secara secara lengkap terkait dengan pelanggaran kode etik dan pelanggaran perilaku.

Abstract

The purpose of writing to be achieved in this paper is to know and analyze the return of state losses in the investigation process that can eliminate criminal perpetrators of corruption.  This research is a normative legal research using  the statutory approach "statute approach", the case approach "case approach", and the  conceptual approach "conceptual approach".  This study used analytical descriptive analysis techniques. The results of this study show that the return of state financial losses in the investigation stage of corruption can stop the process of handling criminal acts through police discretion. One of the elements of corruption is the element of state loss, meaning that when it has been returned, it means that the element has been lost, meaning there is no loss as a logical consequence of the Constitutional Court decision No. 25/PUU-XIV/2016. But with the condition that it must be before the investigation stage through police discretion and if it is based on  the Lex Posterior Derogate Lege Priori, meaning that the new law overrides the old  law, meaning that the new regulation ignores or overrides the old regulation in the same respect

Abstract

Pelaksanaan dari penelitian ini untuk mengetahui dan menganalisis Isi Materi Muatan Suatu Perppu Jika Ikhwal Kegentingan Yang Memaksa Sebagai Dasar Pembentukan Perppu Berakhir dan untuk mengetahui dan menganalisis Eksistensi Ikhwal Kegentingan Yang Memaksa Ketika Perppu Ditetapkan Menjadi Undang-Undang. Implikasi pembatasan materi muatan Perppu oleh Presiden akan memberikan kepastian hukum terhadap pembatasan keberlakuan Undang-Undang yang bersumber dari Perppu. Sedangkan Eksistensi Ikhwal Kegentingan Yang Memaksa dalam Perppu Yang diidealkan sebagai instrumen hukum untuk mengatasi kearuratan negara terdapat pergeseran pemaknaan dari kegentingan yang memaksa, menjadi hal Ikhwal yang mendesak untuk diatur dengan titik tekannya pada aspek kemendesakan waktu sehingga Eksistensi Ikhwal Kegentingan Yang Memaksa yang melekat pada Perppu ketika diubah menjadi Undang-Undang tidak dapat memberikan kepastian hukum terhadap keberlakuan Undang-Undang dan tidak ada pembeda antara Perppu dan Undang-Undang dalam hal keberlakuan hukumnya dalam merespon kondisi darurat negara

Abstract

This research is made for; (1) to understand the factors that can underlie the occurrence of psychological violence perpetrated by wives in the household sphere and to find out (2) what forms of legal protection are provided for victims of psychological violence perpetrated by wives in the household sphere. The research used by the researchers namely using the type of empirical legal research. Through a statutory approach and a case approach that is actually based on the source of case analysis obtained through interviews, while the legal materials used are primary legal materials and secondary legal materials. Underlying the occurrence of psychological violence perpetrated by the wife within the scope of the household are internal factors as well as external factors. Internal factors consist of: Family factors that discriminate, in the form of physical humiliation and the victim's job so as to generate income that is only sufficient for the needs of the family but not with the wishes of the perpetrator, can encourage the perpetrator to commit the psychological violence. Whereas external factors consist of: Economic factors and social environment as for excessive acts of using social media. The form of legal protection for victims of psychological violence perpetrated by wives in the household sphere, namely the form of protection has been explained in Law Number 23 of 2004 concerning the Elimination of Domestic Violence, which has been explained in Article 7 regarding psychological violence which has been considered as According to research materials by the researchers, this article explains what is meant in Article 5 letter b, namely behavior that results in fear, loss of self-confidence, loss of ability to act, feeling of helplessness, and/or severe psychological suffering to a person.

Abstract

This article aims to determine consumer protection due to misleading cosmetic product advertisements also about influencer liability due to advertising cosmetic products that do not match the truth. The method in this study is a normative legal research method, with legal and a conceptual approach. The analysis technique is qualitative analysis technique by reviewing laws and regulations and analyzing them. The result of this study is that the state has regulated consumer protection in terms of misleading cosmetic advertisements, but the position of influencers has not been clearly regulated in Indonesian law. So in demanding accountability and to protect consumer rights, the rules are still unclear.

Abstract

This article aims to find out how the position of the standard clause in an agreement in this case refers to consumer protection regulated in Law Number 8 of 1999 concerning Consumer Protection where the inclusion of standard clauses in an agreement both retail banking transactions and others as is still very much happening in everyday life, where when this clause is agreed upon by both parties then the agreement is considered binding and applies like a law for both of them However, on the other hand, there are opinions that oppose the inclusion of standard clauses in agreements, especially based on the principles of balance and fairness in contracting. By using descriptive analytical research methods and a normative juridical approach, the author wants to answer the extent of the validity and unenforceability of standard clauses in agreements and also how standard clauses in an agreement based on Law Number 8 of 1999 concerning Consumer Protection. The result of this research is that the prohibited standard clause is a clause in a standard agreement that contains a transfer of responsibility of the business actor. the transfer of responsibility has been regulated by the prohibition of its inclusion through Article 18 Paragraph (1) of the GCPL Law.

Abstract

This article aims to find out how the disabled workers in the existing offices and enterprises in the city of Gorontalo, which are according to the rules of the Legislative Act No. 8 of 2016 on Disabled Persons and the Law No. 13 of 2003 on Employment. The protection concerned is the protection of the rights of disabled workers due to the very vulnerable circumstances of the disabled worker in their day-to-day activities. The rights studied by the researchers are more to the fulfilment of the rights of absorption of disabled workers and also the provision of facilities and accessibility for disabled employees The method used in the writing of this paper is the juris-empirical method with the fact approach and the statue approach. Primary and secondary legal data sources based on legislative regulations as well as books related to the protection of wage rights and to fill in secondary data then conducted a session of interviews with the parties concerned. With the data analysis used is qualitative data analysis. Based on the results of this study, it can be concluded that protection for disabled workers in the city of Gorontalo has not been effective because it has not provided the facilities or aids that should be available to disabled employees.
