Abstract

Nowadays, the development of science and technology such as the Internet (interconnected computer network) can practically support any profession and its work, thus allowing you to achieve your life goals in a short time. The internet can also be detrimental to the interests of others. As internet and mobile phone technology advances, so does social media. As the number of internet users increases, more and more people are using these social networks for various purposes, some for positive purposes, some for cybercrime. The ease of access to pornographic content is believed to be one of the main causes of the increase in sexual crimes against children in Indonesia. The research used is normative legal research that examines literature studies based on normative systems. The results of this research are in the form of an analysis of the legal regulations related to the responsibility of PJI in filtering pornographic content via the internet in Indonesia.

Abstract

This article aims to know the consumer protection in transactioncross border e-commerceand consumer dispute resolution due to losses experienced by consumers in the transaction. This research is a normative legal research that uses secondary data such as legislation. Legal protection of consumers in transactions e-commerceis regulated by Law No. 8 of 1999 on Consumer Protection and Law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on Electronic Information and Transactions. Zincleta settlement in cross border e-commerceinvolves various problems, especially related to standard clauses referring to foreign jurisdictions. The ITE Law provides a legal basis for e-commerce,but does not specifically regulate cross-border agreements, various methods of dispute resolution, such as mediation, arbitration, and ODR (Online Dispute Resolution) becomes relevant in this context. In conclusion, legal protection of consumers in cross-border e-commerceneeds to be strengthened. Dispute resolution involves the role of institutions such as the Consumer Dispute Resolution Agency (BPSK) and the Indonesian National Arbitration Board (BANI), but the implementation of ODR can be an innovative solution to handle disputes efficiently, especially in the international sphere.need to be strengthened.

Abstract

This research aims to understand and analyze the legal regulatory policies regarding information technology crimes in addressing cybercrime committed by virtual police in Indonesia. In the midst of technological advancements and their negative impacts, especially cybercrimes, handling cybercrime becomes a complex challenge. This study involves normative legal analysis focusing on doctrines and legal principles found in legislation and court decisions.The results indicate that the criminal legal regulations related to cybercrime in Indonesia are not yet fully adequate. Although Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions has regulated some aspects, further harmonization and adjustment are still needed in line with the development of cybercrimes. In dealing with cybercrime, the roles of virtual police and cyber police in Indonesia need to be clearly understood. Virtual police emphasize preventive efforts, while cyber police follow up on cases through law enforcement. The existence of this difference needs to be socialized so that the public understands their roles in combating cybercrime.

Abstract

Exhibitionism is the behavior of showing body parts or vital organs to others to achieve sexual satisfaction. This is done to get sexual satisfaction by masturbating while imagining. Exhibitionism itself is included in the category of sexual preference disorder (paraphilia). This research aims to analyze whether the application of mental rehabilitation sanctions can be carried out against the perpetrators of exhibitionism. The type of research used is normative research which is based on applicable laws and regulations and analyzes problems from a case perspective. The results of the research obtained by the author in conducting research on the application of mental rehabilitation sanctions have the potential to reduce the level of recurrence of exhibitionism behavior. Mental rehabilitation programs that include psychological therapy, counseling, and social support can help offenders to understand the root causes of their behavior and develop strategies to overcome these tendencies.

Abstract

This research aims to determine the position of restorative justice in the criminal justice system in Indonesia and to determine the application of restorative justice in the criminal justice system. This type of research uses empirical legal research, empirical legal research is a legal research method that functions to see the law in real terms and examine how law works in society. The position of restorative justice in the criminal justice system in Indonesia can provide justice that focuses on the needs of the victims, perpetrators of crimes, and also involves community participation, and does not merely fulfill legal provisions or merely impose criminal penalties. In this case, the victim is also involved in the process, while the perpetrator of the crime is also encouraged to take responsibility for his actions, namely by correcting the mistakes he has made. The implementation of restorative justice in the criminal justice system can be seen from various policies and laws and regulations currently in force, but in reality there are inconsistencies between enforcement officials in implementing restorative justice in a case. In fact, many cases ignore restorative justice and result in the criminal being convicted.

Abstract

Pancasila and the 1945 Constitution describe Indonesia as a welfare state. In order to cause this happen, many regulations have been formed, which to this date have not been able to bring comfort and splendor in implementing the welfare of the Indonesian people. The number of regulations has actually brought Indonesia to the brink of regulatory obesity and resulted in ineffective regulations in the welfare sector. This study aims to provide an overview of solutions to various welfare problems in Indonesia through regulatory arrangement using the omnibus law method. It represents a normative study using a legal approach and conceptual approach. The results indicate that the application of the omnibus law method can be an innovative alternative without violating the Indonesian legal system. It is because the application of the omnibus law method begins with a legal transplant, which comprises several provisions: The omnibus law approach pattern is limited per sector/theme; (2) simplification of law using the omnibus law method is carried out by measuring the relevance of a regulation with basic criteria; (3) the formation of regulations using the omnibus law method using comprehensive, multidisciplinary and multi-sector approach; (4) the application of the omnibus law method as a whole must be oriented to Pancasila, the 1945 Constitution and Law Number 12 of 2011. Regulatory arrangement with the omnibus law method can not only provide effectiveness but also overcome regulatory obesity for more satisfactory legal system and administration of welfare.

Abstract

The purpose of this research is twofold: first, to provide a conceptualization of restorative justice principles in Indonesia's criminal justice system; and second, to examine the problematic application of these concepts in that system. Normative legal research, specifically the statutory technique and the conceptual approach, are utilized in this study piece. On top of that, the processed legal materials were analyzed using a qualitative analytical method that relies on interpretation. According to this study's findings, the judicial subsystem in Indonesia, which includes the police, the prosecutor's office, and the Supreme Court, has started to implement the notion of restorative justice. Due to the lack of a legislation governing the implementation of restorative justice in Indonesia, institutional or partial rules and guidelines continue to be used when discussing its application. This brings up the issue of sub-system authority imbalance in the criminal justice system, as well as the lack of consistent guidelines for each sub-system to apply restorative justice. As a result, the various proportional institutions within each sub-system face legal uncertainty. Thus, in order to establish legal clarity on the implementation of restorative justice, Indonesia has to enact legislation that specifically addresses this concept, known as RKUHAP.

Abstract

This research is made for; (1) to understand the factors that can underlie the occurrence of psychological violence perpetrated by wives in the household sphere and to find out (2) what forms of legal protection are provided for victims of psychological violence perpetrated by wives in the household sphere. The research used by the researchers namely using the type of empirical legal research. Through a statutory approach and a case approach that is actually based on the source of case analysis obtained through interviews, while the legal materials used are primary legal materials and secondary legal materials. Underlying the occurrence of psychological violence perpetrated by the wife within the scope of the household are internal factors as well as external factors. Internal factors consist of: Family factors that discriminate, in the form of physical humiliation and the victim's job so as to generate income that is only sufficient for the needs of the family but not with the wishes of the perpetrator, can encourage the perpetrator to commit the psychological violence. Whereas external factors consist of: Economic factors and social environment as for excessive acts of using social media. The form of legal protection for victims of psychological violence perpetrated by wives in the household sphere, namely the form of protection has been explained in Law Number 23 of 2004 concerning the Elimination of Domestic Violence, which has been explained in Article 7 regarding psychological violence which has been considered as According to research materials by the researchers, this article explains what is meant in Article 5 letter b, namely behavior that results in fear, loss of self-confidence, loss of ability to act, feeling of helplessness, and/or severe psychological suffering to a person.

Abstract

The Constitutional Court's presence yields positive impacts on constitutional law, yet isn't devoid of controversies, including Judge misconduct, transgression of 'nemo judex idoneus in propria causa' principle, and potential super body transformation. This paper aims to comprehend and analyze constitutional interpretation dominance in assessing laws against the 1945 Constitution through a constitutional dialogue approach. This normative writing employs legal, historical, and conceptual methods. Findings underscore: 1) Demonstrating respect for state institutions, notably the People's Consultative Assembly of Indonesia. 2) Establishing a more democratic system to test the 1945 Constitution's compatibility in the Constitutional Court. 3) Breaking the monopoly of Constitutional Court-centric constitutional interpretation. 4) Reviving 'nemo judex idoneus in propria causa' principle is pivotal due to extensive testing of Constitutional Court Law, addressing concerns about verdict impartiality.

Abstract

The problem of land ownership in Buntulia Village is influenced by the lack of knowledge and awareness of the community about land ownership rights because of the total population of 549 families, 463 people have not registered their own land. This of course raises a fairly basic problem by the village government to be resolved. Therefore, in this downstreaming, the service team provides understanding and legal knowledge to the community about the importance of registering property rights and providing assistance to the community together with the Land Agency through the Border Marks Post Community Movement (GEMA PATAS) in order to increase community participation in installing boundary markings, making it easier for BPN officers to take measurements, as well as being able to accelerate the government program on Complete Systematic Land Registration. Thus the community could see the importance of legalizing property rights to the land in order to avoid disputes and thereby give legal certainty to the parties.
