Abstract

The discourse on limiting the legislators standing to submit a constitutional review is not an entirely new issue to analyze. However, these things still need to be examined to explore the legal ratio of limitation of the legislator’s standing to submit a constitutional review by the Constitutional Court. This research specifically answers the questions: (a) how are the dynamics of the use of the legislators standing in the constitutional review? (b) what is the legal ratio for limiting legislators standing in the constitutional review? This study uses a normative legal research method by analyzing secondary data in the form of legislation, the Constitutional Court decisions, and literature related to legislators standing to submit the constitutional review. The results of this study indicate that the legal ratio limiting legislators’ standing can be traced through the legal considerations of the Constitutional Court decisions from 2003-2019.

Abstract

Abstract

Efforts to optimize existing customary institutions in the province of Gorontalo in law enforcement during society are significant. The organization of customary institutions needs to be addressed and arranged so that they can be enjoyed and utilized. This study uses a sociological juridical approach by obtaining data by interviewing figures from the Gorontalo traditional institutions. This research carries out by analysis through reduction, presentation of data, and conclusion?Gorontalo customary institution. The study results show that the position of traditional institutions in Gorontalo Province is one of the guidelines for people's lives. Customary institutions are the tools that are used and considered to be able to maintain the values of customary law itself. Imposing sanctions through traditional institutions is more effective because an adat institution grows based on values that live in society and recognize and adhered to for generations. In addition, customary institutions help prevent the accumulation of cases in court. The maximum of this research lies in the space given by the government to customary institutions both in ceremonial activities such as marriages and in law enforcement processes. In addition, community participation needs to maintain and utilize the presence of this traditional institution.

Abstract

The litigation process in court will run well if all the elements are carried out following their duties and functions. In addition, what is very important is the judicial system that applies. The objectives of this research are 1). To find out and analyze the paradigm of how judges think in the Indonesian justice system, which adheres to the Continental European justice system. 2). To find out and analyze the development of the Indonesian justice system, especially how judges think, which is currently influenced by the Anglo-Saxon system. This research method is normative, namely legal research that aims to find rules or norms. This research is also called library research. Results of discussion 1). that the paradigm of the way of thinking of judges in the Indonesian justice system, which adheres to the Continental European justice system, is more inclined to use statutory regulations as the basis for deciding cases. The principle adopted is the persuasive force precedent. 2). The development of the Indonesian justice system, especially the way of thinking of judges, is currently experiencing a shift, namely that it is no longer pure with the Continental European justice system but is starting to introduce what is the practice in the Anglo-Saxon justice system, for example, the practice of class action lawsuits which have been regulated in environmental laws.

Abstract

ABSTRAKPenyelesaian sengketa lingkungan hidup melalui mediasi merupakan hal yang penting dalam upaya penegakan hukum lingkungan hidup, terutama setelah diberlakukannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja (UUCK) yang lebih memperhatikan perlindungan keperdataan masyarakat (Pasal 91 ayat (2) huruf d Undang-Undang Nomor 11 Tahun 2020). Tujuan dari penelitian ini adalah untuk mengevaluasi eksistensi mediasi sebagai bentuk penyelesaian sengketa lingkungan hidup dan kendala yang dihadapi dalam penggunaannya setelah diberlakukannya UUCK. Penelitian ini menggunakan pendekatan yuridis normatif, dengan fokus pada analisis perundang-undangan dan konsep hukum. Dalam penelitian ini, ditemukan bahwa eksistensi mediasi dalam penyelesaian sengketa lingkungan pada prinsipnya telah menjadi budaya masyarakat Indonesia sejak dulu dan eksistensi berkembang dengan hadirnya berbagai peraturan perundang-undangan misalnya SEMA Nomor 1 Tahun 2002 tentang Pemberdayaan Lembaga Perdamaian dan Peraturan Mahkamah Agung (PERMA) Nomor 2 Tahun 2003 tentang Prosedur Mediasi di Pengadilan, Peraturan Mahkamah Agung Nomor 1 Tahun 2008 tentang Prosedur Mediasi di pengadilan dan Peraturan Mahkamah Agung (PERMA) RI Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan serta yang terbaru dalam UUCK. Meskipun mediasi seringkali tidak memuaskan, tetapi masih merupakan salah satu upaya yang penting. Namun, kendala yang dihadapi dalam penggunaan mediasi dalam penyelesaian sengketa lingkungan hidup semakin kompleks setelah putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 menyatakan bahwa UUCK inkonstitusional bersyarat, sehingga tidak mungkin untuk membuat aturan teknis tentang penyelesaian sengketa lingkungan hidup melalui mediasi. Meskipun UUCK sudah dinyatakan tidak berlaku dengan hadirnya Peraturan Pemerintah Pengganti Undang-Undang (PERPU) Nomor 2 Tahun 2022 tentang Cipta Kerja, namun Perpu masih menyisakan perdebatan dan belum menjadi Undang-Undang hingga tulisan ini diterbitkan.Kata kunci: cipta kerja; lingkungan hidup; mediasi; penyelesaian sengketa.ABSTRACTSettlement of environmental disputes through mediation is an important matter in efforts to uphold environmental law, especially after the enactment of Law No. 11 of 2020 concerning Job Creation (UUCK) which pays more attention to the protection of civil society (Article 91 paragraph (2) letter d of the -Law Number 11 of 2020). The purpose of this study is to evaluate the existence of mediation as a form of environmental dispute resolution and the obstacles encountered in its use after the enactment of UUCK. This study uses a normative juridical approach, with a focus on statutory analysis and legal concepts. In this study, it was found that the existence of mediation in resolving environmental disputes in principle has been a culture of Indonesian society for a long time and its existence has developed with the presence of various laws and regulations, for example SEMA Number 1 of 2002 concerning Empowerment of Peace Institutions and Supreme Court Regulation (PERMA) Number 2 of 2003 concerning Mediation Procedures in Courts, Supreme Court Regulation Number 1 of 2008 regarding Mediation Procedures in Courts and RI Supreme Court Regulation (PERMA) Number 1 of 2016 concerning Mediation Procedures in Courts and the latest in UUCK. Although mediation is often unsatisfactory, it is still an important endeavor. However, the obstacles encountered in using mediation in resolving environmental disputes are increasingly complex after the Constitutional Court decision Number 91/PUU-XVIII/2020 stated that UUCK is unconstitutional conditional, making it impossible to make technical rules regarding environmental dispute resolution through mediation. Even though the UUCK has been declared null and void with the presence of Government Regulation in Lieu of Law (PERPU) Number 2 of 2022 concerning Job Creation, the Perpu still remains up for debate and has not yet become a law as of the time this article was published.Keywords: job creation; environment; mediation; dispute resolution.

Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui penegakan hokum pidana terhadap tindak pidana money politic pada penyelenggaraan pemilihan umum oleh calon anggota legislatif pada pemilu 2019 di Kabupaten Gorontalo, dan untuk mengetahui apa saja yang menjadi faktor penghambat penegakan hukum pidana terhadap pelaku tindak pidana money politic oleh calon anggota legislatif pada pemilu 2019 di Kabupaten Gorontalo. Jenis Penelitian yang digunakan oleh peneliti dalam menyusun Penelitian ini adalah jenis Penelitian normatif-empiris, Adapun pendekatan yang digunakan oleh peneliti dalam menyusun penelitian ini adalah, antara lain: Pendekatan Perundang-Undangan (Statue Approach); Pendekatan kasus (case approach). Hasil penelitian ini menunjukkan bahwa Penegakan Hukum Terhadap Tindak Pidana Money Politic Oleh Calon Anggota Legislatif Pada Pemilihan Umum masih belum maksimal, hal ini dibuktikan dengan data di Bawaslu Kabupaten Gorontalomasih banyaknya pelanggaran tindak pidana money politic yang dilakukan oleh calon anggota legislatif dan masih banyak pelanggaran tindak pidana money politic yang tidak diproses sampai ketahap penyidikan karena tidak cukup bukti. Dalam menjerat para calon anggota legislatif yang melakukan tindak pidana money politic Bawaslu, dan Kepolisian, masih dihadapkan pada beberapa faktor-faktor hambatan yang melatar belakangi sehingga berpengaruh pada penerapan sistem peradilan pidana terhadap tindak pidana pelanggaran tindak pidana money politic. Kata Kunci : Penegakan Hukum; Tindak pidana; Money Politic Calon Anggota Legislatif. ABSTRACT The purpose of this study is to determine the enforcement of criminal law against money political crimes in the implementation of general elections by legislative candidates in the 2019 election in GorontaloDistrict, and to find out what are the factors inhibiting criminal law enforcement against perpetrators of money political crime by prospective members. legislative elections in 2019 in GorontaloDistrict. The type of research used by researchers in compiling this research is a type of normative-empirical research. The approaches used by researchers in compiling this research are, among others: the statutory approach (Statue Approach); The case approach (case approach). The results of this study indicate that Law Enforcement Against Money Politic Crime by Legislative Candidates in the General Election is still not maximal, this is evidenced by data in Bawaslu GorontaloRegency that there are still many violations of money political crimes committed by legislative candidates and many violations. money political crime which is not processed until the stage of investigation because there is insufficient evidence. In ensnaring candidates for legislative members who commit money political crimes, the Bawaslu and the Police, they are still faced with several background obstacle factors that affect the application of the criminal justice system to the crime of money political crime.

Big problems in Indonesian justice since independenced is justice freedom. Many sides wish to influence justice power with various reasoning of importances. Manifestly, there is politics power, economics power, member of society at law direct and or with legal advisor, or even from element of law enfurcer itself. Struggle for towards to one roof judicature as arranged in applied legislation not easy to imagined. Abstract

Peraturan daerah terhadap tata ruang di Provinsi Gorontalo sangat berarti bagi lingkungan hidup ke depan daerah ini sendiri. Keberanian dari pihak eksekutif maupun legislatif untuk mengesahkan draf rancangan peraturan daerah merupakan komitmen yang ditungu-tunggu masyarakat. Dengan kehadiran peraturan daerah tentang tata ruang, maka berbagai problem yang berkaitan dengan tata ruang terutama pemanfaatan lahan dan lingkungan hidup mendapat solusi yang terbaik.

Abstract

Tujuan penelitian ini untuk mengetahui dan menganalisa Politik Hukum Pemerintah Indonesia dalam mencegah isu Rasialisme dan Etnis, juga untuk mengetahui Politik Hukum Pemerintah Indonesia dalam mencegah isu Rasialisme dan Etnis dikaji melalui aturan Hukum Internasional. Jenis Penelitian yang digunakan peneliti adalah jenis penelitian normatif, adapun pendekatan yang digunakan dalam penelitian ini antara lain: Pendekatan Perundang-Undangan (Statue Approach) dan Pendekatan Kasus (Case Approach). Hasil penelitian menggambarkan bahwa pelaksanaan diskriminasi ras dan etnis masih kerap terjadi dalam masyarakat. Indonesia sendiri sudah mempunyai aturan yang dinilai bagus untuk menangani dan menghapus kasus diskriminasi rasial dan etnis namun masih banyak yang belum mengetahui dan mendengar tentang aturan tersebut. Maka dari itu, aturan yang ada dinilai kurang populer karena kurangnya sosialisasi sehingga implementasi terjadi hanya seputar penindakan namun masih lemah pada aspek pencegahan. Maka dari itu pemerintah harus lebih banyak memberikan edukasi terhadap rakyat tentang adanya peraturan mengenai penghapusan diskriminasi rasial dan etnis ini. Sehingga, pelanggaran berupa penghinaan suatu ras dan etnis tertentu tidak lagi dianggap biasa atau sepele dan peraturan ini juga dapat berjalan dengan baik.
