Abstract

Peraturan Pemerintah Pengganti Undang Udang (PERPU) dalam kegentingan yang memaksa sebagai salah satu bentuk peraturan perundang-undangan menurut UU No. 12 Tahun 2011 jo UU No. 15 Tahun 2019 jo UU No. 13 Tahun 2022 tentang Pembentukan Peraturan Perundang Undangan. Penelitian ini merupakan penelitian hukum juridis normatif atau yang juga dikenal sebagai penelitian hukum doctrinal. Penelitian ditujukan terhadap asas-asas hukum dalam ketentuan normatif, penerapan hukum positif atau yang bersifat ius constitutum. Sehubungan dengan hal tersebut, pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan konsep. Dalam perspektif konstitusional, baik dari segi putusan MK No. 138/PUU-VII/2009 tanggal 1 Februari 2010 maupun doktrin yang mengatur alasan-alasan konstitusional penerbitan PERPU khususnya untuk memaknai “hal ikhwal kegentingan yang memaksa”, dikaitkan dengan putusan MK No. 91/PUU-XVII/2020 tanggal 3 Nopember 2021, maka penerbitan PERPU No. 2 Tahun 2022 tentang Cipta Kerja tidak memenuhi alasan konstitusional dan terkesan dipaksakan. Hal ini telah mengakibatkan penebitan PERPU No. 2 Tahun 2022 merupakan perbuatan yang melanggar putusan Mahkamah Konsitusi dan berdampak negatif dalam sejarah ketatanegaraan Republik Indonesia

Abstract

Manusia sebagai makhluk sosial dan juga sebagai makhluk individu (pribadi) yang tidak dapat berdiri sendiri dalam hubungannya di masyarakat, dalam memenuhi kebutuhannya baik material maupun immaterial. Untuk memenuhi kebutuhan hidupnya, manusia perlu berinteraksi dengan manusia lain, agar interaksi yang terjadi tertib, maka perlu adanya pengaturan oleh hukum. Interaksi dalam pelayanan kesehatan diatur oleh hukum yang mengatur tentang kesehatan. Bentuk pengabdian kepada masyarakat dalam memberikan dukungan kepada mereka yang membutuhkan secara sukarela tanpa mengharapkan imbalan dan pengakuan, dikenal sebagai suatu kegiatan bakti sosial. Pengobatan pada masyarakat kurang mampu dapat dilaksanakan lewat pengobatan secara gratis yang dapat dilakukan lewat kegiatan bakti sosial pengobatan, agar tercapai masyarakat yang sehat, sehingga dapat melakukan kegiatan sehari-hari secara optimal, agar tercapai cita-cita bangsa. Dengan masyakat yang sehat akan tercapai pendidikan yang optimal karena memiliki otak yang cerdas. Sehingga kesejahteraan di masyarakat akan tercapai. Bakti sosial pengobatan merupakan pelayanan kesehatan yang sangat diperlukan mengingat masih banyaknya masyarakat yang memiliki ekonomi menengah ke bawah dan jauh dari sarana kesehatan.

Abstract

Law enforcement efforts against petty corruption in Indonesia are currently trapped in a serious economic inefficiency paradox, where case-handling operational costs often far exceed the value of the savings from avoided state losses. This problem is further complicated by norm disharmony between the efficiency spirit in Law Number 1 of 2023 and the rigidity of sectoral regulations effective as of January 2026. This study aims to analyze such inefficiency using the EAL approach and formulate a new Cost-Awareness-based settlement model. The research method applied is socio-legal, synthesizing doctrinal analysis of norm conflicts with secondary data evaluation regarding case cost burdens and social behavior. Research findings reveal that the conventional retributive approach creates a double loss for state finances. Fundamental juridical barriers are identified in the form of a regulatory “double lock”: Article 4 of Law Number 31 of 1999 which closes the material discretion space, and Article 82 letter c of Law Number 20 of 2025 formally excluding corruption from the restorative justice mechanism. To unravel this deadlock, the study recommends a limited double amendment to both articles, the application of financial sanctions in the form of Double Restitution accompanied by administrative sanctions of dismissal, and the strengthening of public oversight through Citizen Auditors. This model is offered as a concrete solution to ensure legal certainty and state budget efficiency.

Abstract

Intellectual property protection for public art installations presents a complex legal challenge when such works evolve into recognizable urban icons. This research aims to analyze the legal safeguards provided to creators of public artworks under the framework of Law Number 28 of 2014 and to evaluate the application of the principle of legal certainty in the "Urban Light" copyright dispute. Utilizing a normative legal research methodology with a focus on statutory and case approaches, this study examines the judicial reasoning within Decision No. 31/Pdt.Sus-Hak Cipta/2020/PN.Niaga.Jkt.Pst. The results demonstrate that public artworks are afforded automatic protection through the declarative principle, ensuring that their status as public symbols does not diminish the creator's exclusive moral and economic rights. Furthermore, the findings indicate that the Indonesian judiciary prioritized material truth by applying the "first to create" doctrine, which led to the cancellation of copyright registrations made in bad faith by unauthorized parties. The study concludes that achieving a reconciliation between legal certainty and substantive justice is vital for maintaining the integrity of the creative industry. These findings offer significant implications for the Directorate General of Intellectual Property in enhancing substantive verification protocols for works with established global reputations. Ultimately, this research serves as a crucial legal precedent for the protection of international artistic monuments within national jurisdictions against practices of plagiarism disguised as inspiration.

Abstract

Perkembangan ekonomi digital telah melahirkan kerja berbasis platform yang mengubah pola hubungan kerja konvensional. Pekerja platform digital berperan penting dalam mendukung aktivitas ekonomi, khususnya di sektor transportasi dan logistik. Namun, kontribusi tersebut belum diimbangi dengan perlindungan hukum dan jaminan sosial yang memadai. Permasalahan utama terletak pada ketidakjelasan status hukum pekerja platform digital serta kebijakan jaminan sosial yang masih berorientasi pada hubungan kerja formal. Artikel ini bertujuan untuk menganalisis implikasi hukum dan kebijakan terhadap perlindungan pekerja platform digital dalam sistem jaminan sosial di Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil kajian menunjukkan bahwa klasifikasi pekerja platform digital sebagai pekerja bukan penerima upah menyebabkan perlindungan jaminan sosial belum optimal dan tanggung jawab perusahaan platform belum diatur secara tegas. Oleh karena itu, diperlukan reformulasi kebijakan yang menegaskan peran negara dan perusahaan platform guna mewujudkan perlindungan jaminan sosial yang adil dan inklusif.

Abstract

Women Fishers’ Access to Economic Resources from the Perspectives of Gender Equality and Legal Justice discusses systemic marginalization despite women fishers’ significant contribution to fisheries through post-harvest work, small-scale industries, and even active fishing. This exclusion limits their access to economic resources, and consequently, health services, small-scale fishermen’s loan or even state protection. The objectives of the paper is to examine how patriarchal cultural norms and information asymmetries marginalize women from being recognized as fishers, restrict their access, and how exclusionary legal definitions of “fisher” systematically limit women’s economic participation.The study  uses normative legal research method (normative juridical) with statutory analysis and a sociological legal research method (sociological juridical) to seek and identify the relationship between abstract legal concepts and reality by reviewing legal products that are not gender-responsive and cultural practices that reinforce inequality and discriminatory regulations, patriarchal traditions, and poor access to information collectively hinder women’s economic participation. Achieving gender equality in coastal areas requires reforms in legal recognition, education, and policy implementation to ensure women’s rights as fishers are upheld, thereby advancing social justice and inclusive maritime development.

Abstract

The rapid development of Securities Crowdfunding (SCF) as a digital financing mechanism has transformed capital market practices by expanding access to investment and funding. However, this innovation raises critical concerns regarding investor protection, particularly in relation to information disclosure and asymmetry. This study is grounded in the theory of information asymmetry proposed by Akerlof, as well as legal protection and legal certainty theories developed by Hadjon and Mertokusumo, which emphasize the importance of transparency and clear legal standards in safeguarding investor interests. This research employs a descriptive-analytical legal method using a normative juridical approach supported by limited empirical analysis. The study examines the synchronization between Law Number 8 of 1995 on Capital Markets and Financial Services Authority Regulation Number 57/POJK.04/2021, as well as evaluates the quality of material information disclosure in SCF prospectuses, particularly in the funding of the Free Nutritious Meal Program (MBG) through the Danamart platform. The findings reveal that although SCF regulations have formally adopted the disclosure principle, the level of regulatory synchronization remains incomplete. The SCF framework lacks detailed standards for material information disclosure, creating legal uncertainty and reducing the effectiveness of investor protection. Empirical analysis further indicates that disclosure practices tend to emphasize potential returns while providing insufficient detail on risks, thereby sustaining information asymmetry and limiting informed decision-making by retail investors. In conclusion, while SCF enhances financial inclusion and investment opportunities, its effectiveness in protecting investors depends on strengthening disclosure standards, improving transparency, and ensuring regulatory alignment with broader capital market principles.

Abstract

Introduction: This article analyzes the legal protection of religious freedom regarding the licensing of houses of worship built on private land. While the Indonesian Constitution strictly guarantees the right to worship, administrative barriers often hinder this fundamental freedom. This study specifically addresses the practical challenges and discriminatory requirements faced by minority religious groups in navigating restrictive local regulations.Purposes of the Research: The purpose of this article is to evaluate the legal alignment between constitutional rights and administrative regulations regarding the establishment of places of worship. Examine the interaction between individual land ownership rights (Property Certificate) and licensing requirements. Furthermore, this study explores a more sensitive legal protection model to ensure legal certainty for minority groups in Indonesia.Methods of the Research: This study uses a normative legal method by examining legal norms, principles, and doctrines related to religious freedom. The study uses legislative, conceptual, and case approaches, focusing on Gereja Kasih Karunia Indonesia (GEKARI) in Jakarta. Data analysis is carried out qualitatively through systematic and constitutional interpretation of primary and secondary legal materials.Findings of the Research: The findings prove that restrictive administrative requirements, such as local community support, create a "social veto" that undermines constitutional religious freedom. This research offers a novel perspective by integrating agrarian law’s social function with administrative law to protect worship on private property. It concludes that shifting from a social-approval model to objective administrative verification is essential for legal certainty.
