Abstract

Penelitian ini bertujuan untuk menganalisis optimalisasi Sistem Penilaian Pembinaan Narapidana (SPPN) sebagai indikator pemberian remisi serta mengidentifikasi kendala penerapan prinsip keadilan distributif di Lapas Perempuan Kelas III Mataram. Metode yang digunakan adalah normatif empiris, dengan pendekatan konseptual, perundang-undangan, kasus, dan sosiologis untuk mengkaji efektivitas hukum dan kebijakan pemasyarakatan dalam praktik lapangan.SPPN merupakan instrumen strategis dalam menilai kemajuan pembinaan narapidana secara objektif, sejalan dengan pergeseran paradigma pemasyarakatan dari pendekatan retributif ke rehabilitatif. Diterapkan berdasarkan Keputusan Dirjen Pemasyarakatan No. PAS-10.OT.02.02 Tahun 2021, SPPN di Lapas Perempuan Kelas III Mataram dijalankan oleh tim Wali Pemasyarakatan dan Asesor melalui penilaian berbasis data dan bukti. Penilaian ini mencakup observasi perilaku, wawancara, telaah dokumen, serta tes, dengan pendekatan yang terindividualisasi sesuai karakteristik masing-masing narapidana.Optimalisasi SPPN telah menunjukkan dampak positif, seperti meningkatnya transparansi, motivasi narapidana, serta efektivitas dalam pemberian remisi dan hak-hak lainnya. Namun demikian, penelitian ini menemukan sejumlah kendala signifikan yang menghambat prinsip keadilan distributif. Kendala tersebut meliputi subjektivitas petugas, keterbatasan data yang akurat dan lengkap, belum optimalnya digitalisasi, serta rendahnya kapasitas SDM. Selain itu, inkonsistensi antarunit, resistensi terhadap sistem baru, dan tantangan integrasi data dengan Balai Pemasyarakatan (Bapas) turut memperparah ketimpangan dalam penilaian.Oleh karena itu, diperlukan upaya pembenahan menyeluruh melalui penguatan infrastruktur, pelatihan petugas, standardisasi teknis, serta percepatan digitalisasi. Langkah ini penting agar SPPN dapat benar-benar menjadi alat evaluasi yang adil dan efektif dalam mendukung pemasyarakatan yang humanis dan berkeadilan.

Abstract

Kegiatan Pengabdian Kepada Masyarakat dalam bentuk Sosialisasi Perda bertujuan untuk mengetahui peran pemerintah dalam pengelolaan lahan pemakaman umum di kota Mataram. disamping berperan sebagai regulator kota Mataram dalam mengelola pemakaman umum dan juga peran sebagai fasilitator konsep penyedia lahan tidak sekedar sebagai institusi pelayanan masyarakat tetapi dalam masyarakat yang demokrasi memiliki peran pokok yaitu penyedia fasilitas dan sarana prasarana. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian kualitatif. Sifat penelitiannya bersifat deskriptif-analitik. Sumber data yang digunakan ialah sumber data primer yang diperoleh dari hasil diskusi, sumber data sekunder yang diperoleh dari buku-buku dan sumber lainnya yang berkaitan dengan pemakaman dan sumber data tersier. Dan teknik pengumpulan datanya melalui observasi, wawancara dan dokumentasi. Hasil sosialisasi ini menunjukkan semakin meningkatnya pemahaman masyarakat kota mataram tentang pengaturan pengelolaan pemakaman berdasarkan peraturan daerah.

Abstract

This study aims to analyze the practice of nominee agreements in land ownership by foreigners in Indonesia as a form of legal smuggling in a positive legal perspective. In the regulation of land law in Indonesia, based on the UUPA, land ownership with ownership rights is only by Indonesian citizens. The practice that occurs, foreigners through a name loan agreement to be able to control and own land in Indonesia with property rights. The normative legal research method with a statutory approach and a conceptual approach uses primary legal materials and secondary legal materials. Through literature studies (literature studies). The legal materials obtained were analyzed in a qualitative descriptive manner. The results of the study show that the nominee agreement is an agreement made between a person who according to the law cannot be the subject of a certain land right (property rights), in this case a foreigner with an Indonesian citizen, with the intention that the foreigner can control (own) the land owned de facto, but legally-formally (dejure) the land is owned on behalf of Indonesian citizens. The name loan agreement is clearly a form of legal smuggling to avoid regulations that stipulate that foreigners are not qualified as subjects of land title holders in Indonesia in accordance with the provisions in Article 9 paragraph (1) jo. Article 21 paragraph (1) of the UUPA clearly states that only Indonesian citizens can have a full relationship with earth, water and space, and clearly stipulates that only Indonesian citizens can have property rights

Abstract

The purpose of this study is to find out how To find out how the authority of the Regional Regulation Formation Agency of the Mataram City DPRD in the preparation of Regional Regulations in Mataram City. And To find out how the implementation of the authority of the Regional Regulation Formation Agency of the Mataram City DPRD. This type of research is normative-empirical. By using the Conceptual approach method (Conceptual Approach), Statute Approach (Statute approach) and Historical Approach (Historical Approach). Methods and techniques for collecting data through interviews, observations and documentation, using qualitative descriptive data analysis. The results of the study show that; The Legislative Function of the Mataram City Regional People's Representative Council is one of the attribution authorities inherent in the formation of regional regulations which begins at the planning, drafting, discussion and enactment stages. In carrying out its function as Legislation, it certainly requires complete tools in the DPRD structure itself, especially in the formation of Regional Regulations which in this case are carried out by Bapemperda which has the authority to harmonize, round off, and strengthen the concept of draft Regional Regulations submitted by members, commissions, or joint commissions before the draft Regional Regulation is submitted to the Leadership of the Regional People's Representative Council, Following the discussion of draft Regional Regulations submitted by the Regional People's Representative Council and the Regional Government, Providing considerations on proposals for the preparation of draft Regional Regulations submitted by the Regional People's Representative Council and the Regional Government outside the Regional Regulation formation program, Providing considerations to the Leadership of the Regional People's Representative Council regarding draft Regional Regulations originating from the Regional Government, Following developments and conducting evaluations on the discussion of the material contents of the draft Regional Regulation through coordination with the commission and/or special committee, Providing input to the Leadership of the Regional People's Representative Council on draft Regional Regulations assigned by the deliberative body, Conducting a study of Regional Regulations, Making a performance report at the end of the membership period of the Regional People's Representative Council and inventorying problems in the formation of both, the Regional Regulation Formation Agency of the Mataram City Regional People's Representative Council in implementing the authority to form The Regional Regulation has been running properly. This can be seen from how the Regional Regulation Formation Agency of the Mataram City Regional People's Representative Council has fulfilled the procedures or all applicable provisions in the process of forming regional regulations.

Abstract

Handling Post-Covid-19 Pandemic within the framework of a unitary state is not only the responsibility of the central government but also the roles and responsibilities of local governments. This is important for the government to innovate policies for handling the post-Covid-19 pandemic without overriding the policies that have been issued by the central government. This study aims to identify innovations in local government policies in handling the Post-Covid-19 pandemic from the perspective of Administrative Law. The research was conducted in a normative juridical manner with a qualitative approach to the urgency of local government policy innovation in handling the Post-Covid-19 pandemic. In this case, an analysis of Mataram City's regional policies is needed in handling the Post-Covid-19 Pandemic. This gives an understanding that local governments in making policies need synchronization with the central government, especially in analyzing a policy in accordance with state administrative law. The forms of policy innovations carried out by local governments in handling the post-Covid-19 pandemic include: 1) Strengthening the Regional Health System; 2) Strengthening the Social Protection System; and 3) Economic Recovery

Abstract

Intermarriages between Indonesian citizens and foreign nationals are becoming increasingly prevalent in Indonesia's tourist regions, along with the rise of global social and cultural connections. Despite the legal recognition and protection of mixed marriages by Law Number 1 of 1974 regarding Marriage and Law Number 12 of 2006 concerning Citizenship, their execution presents numerous legal challenges, particularly concerning citizenship status, shared property ownership, and inheritance rights. This research employs a normative legal methodology, utilizing literature review as the primary technique, and analyzes Supreme Court Decision No: XXX/Pdt.G/2020/PA.Bdg as a case study. The investigation examined pertinent legal norms, jurisprudence, and relevant legal doctrines by employing a transcendental legal method to comprehend the moral and spiritual principles underpinning these legal frameworks. The study's findings indicate that the national legal system has not adequately addressed the complexities of mixed marriages characterized by divergent legal systems and cultural origins. Restrictions on land ownership by foreign nationals present issues in mixed marriage situations about joint property. Similarly, the disparities in inheritance law systems across civil law, customary law, Islamic law, and foreign frameworks impede equitable arrangements. The transcendental legal approach provides a more inclusive and equitable perspective by grounding legal interpretation in spiritual values. This study advocates for regulatory revisions and the enhancement of international legal frameworks to achieve adaptive and compassionate legal protection that aligns with substantive justice in mixed marriages.

Abstract

This study aims to analyze the regulation and implementation of the authority of the Mataram city notary supervisory council on notary examinations based on the Minister of Law and Human Rights Regulation number 15 of 2020. Normative-empirical research with legislative, conceptual and sociological approaches in qualitative descriptive analysis, the data used are primary, secondary and literature research materials and field research. Concluded; First, the authority of the notary supervisory council in Mataram City is guidance for preventive measures and supervision of repressive actions. Second, the obstacles in carrying out notary supervision in Mataram City are; The legal factor needs to be added to the content material that regulates administrative sanctions, both in the form of verbal reprimands, written reprimands and dismissals for members and the content of the authority to determine sanctions by the Notary MPD. Meanwhile, law enforcement factors need to reschedule the schedule during the Notary examination so that all the objectives can be present so that the examination is maximized, and the role of the NTB Notary MPW to provide education and training, FGD and socialization of regulations so as to provide the same understanding in the Notary examination in Mataram City.

Abstract

This research aims to analyze the regulation and implementation of fulfilling the rights of children from mixed marriages to obtain Indonesian citizenship based on Law Number 12 of 2006. Normative-empirical research with legislative, conceptual and sociological approaches in qualitative descriptive analysis. Data used are primary, secondary and literature research materials and field research. The conclusions are; First, Law Number 12 of 2006 grants limited dual citizenship status to children born from mixed marriages after its enactment on August 1, 2006. However, to ensure legal certainty, children born from mixed marriages before the law was enacted are required to register themselves. Second, the terminology 'child with dual citizenship' in the Law implies that if another country, based on its regulations, recognizes a child from a mixed marriage as its citizen, then they fall under this category. Meanwhile, there isn't any country that explicitly, based on its provisions, does not recognize children from mixed marriages as its citizens. Third, the process of fulfilling the citizenship rights of children born from mixed marriages is burdened upon the individual concerned. Consequently, any negligence in administrative processes, requirements, and procedures can lead to the loss of Indonesian citizenship. Fourth, the implications of losing Indonesian citizenship for children from mixed marriages can have legal and sociological impacts.

Abstract

This research aims to analyze the laws and regulations on the electronic-based government system in Mataram City as an effort to improve fast, efficient and affordable public services and to describe the implementation of applications in public services in Mataram City and formulate relevant solutions. Normative-empirical research with legislative, conceptual and sociological approaches in qualitative descriptive analysis, the data used are primary, secondary and literature research materials and field research. Dto conclude; First, SPBE in the government system is needed in order to provide better service to the community, which in principle has been regulated in Presidential Regulation Number 95 of 2018 concerning Electronic-Based Government Systems. And second, the Mataram City Regional Government is committed to implementing electronic-based public services, namely with the issuance of Regional Regulation Number 3 of 2020 concerning the Implementation of Electronic-Based Government Systems and Mataram Mayor Regulation Number 20 of 2024 concerning Guidelines for the Implementation of SPBE. And through Diskominfo, it has managed 14 information technology services with each service application effectively

Abstract

The objectives of this study are to examine and analyze the application of Restorative Justice in handling minor assault crimes at the Lombok Tengah District Police Station and to analyze the legal challenges faced in applying Restorative Justice to optimize its application in minor assault cases from a progressive legal perspective at the Lombok Tengah District Police Station. The research method used in this study is normative empirical law using a legal approach, conceptual approach, sociological approach, and case approach. The legal materials used in this study include primary legal materials, secondary legal materials, and tertiary legal materials. The results of the study on the application of restorative justice in cases of minor assault within the Lombok Tengah Police Department were conducted in accordance with the mechanisms or rules outlined in Police Chief Regulation year 2021. In addition, the police offered reconciliation efforts to the victims and suspects based on cases that met the criteria for restorative justice and involved several other parties, such as religious leaders, traditional leaders, and community leaders, without any pressure, coercion, or intimidation from the Central Lombok Police, who acted as facilitators of minor assault cases. Second, the challenges faced in the implementation of restorative justice at the Lombok Tengah Police Station in resolving criminal cases of assault within the community include determining the value of compensation or restitution. Second, there are differing opinions between the victim and the victim's family regarding the peace efforts, where the victim does not wish to reconcile, while the victim's family desires reconciliation, considering long-term implications.
