Abstract

Researchers at state institutions were forced to leave their positions, including those at the Constitutional Court. Researchers then lose the opportunity to hold the title of research professor. These researchers were also given a new duty, which was to help courts and give Constitutional Justices substantial support. The predicate “assistance" in this rule, which receives no detailed explanation, leads to multiple interpretations and affects the productivity of assistants to expert constitutional judges. Based on this, it is interesting to discuss how the status quo regulates career paths and academic freedom of Constitutional Court researchers in personnel law and how the ideal concept of setting career paths and academic freedom for researchers at the Constitutional Court. This study uses a normative research method, in which its results implicitly suggest a return to the previous rules. The researcher also suggests that the positions of assistant judge and researcher be strictly separated and that opportunities be provided for researchers to hold the title of academic professor. Researchers think BRIN should merge research institutions with the same form and function.

Abstract

Bureaucracy, from a societal perspective, is often perceived as complex, slow, and inefficient. Despite these criticisms, bureaucracy remains a fundamental component of governance and plays a crucial role in societal functioning. As such, bureaucratic reform has been a prominent focus of policy discussions for several decades. A technology-driven government system, coupled with a bottom-up approach, has the potential to enhance efficiency, transparency, and accountability in public administration. However, in practice, such reforms have been largely confined to central government institutions and select agencies. This study aims to explore the integration of technology within the bureaucratic system in Indonesia, with a focus on its comprehensive implementation across government structures. Employing a normative research methodology, the study emphasizes the need for the government to take proactive steps in developing a skilled workforce in information technology. The authors also recommend strategically mapping positions that can integrate technological expertise throughout government departments. Furthermore, the study proposes a comprehensive examination of the potential for replacing executive positions with artificial intelligence (AI) to streamline and simplify bureaucratic processes.  In addition to technological advancements, bureaucratic reform must be accompanied by legal reform, particularly in the areas of data security and the protection of personal information. This includes redefining bureaucratic and personal data categories to ensure robust safeguards. The Personal Data Protection Law should play a pivotal role in integrating these data types and ensuring their protection. Moreover, the Telecommunications Act and the Personal Data Protection Act should foster collaboration between the government and technology companies to develop effective security solutions. Lastly, strengthening the Ombudsman as a public service oversight institution is essential to ensuring transparency and accountability in the implementation of bureaucratic and technological reforms.

Abstract

Berdasarkan potret buruk pemenuhan hak atas pangan, maka penelitian ini mengusulkan penguatan norma jaminan perlindungan dan pemenuhan hak atas pangan dalam rencana Amandemen Kelima UUD 1945. Tujuan penelitian ini agar dimuatnya hak atas pangan sebagai materi muatan konstitusi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, dan konseptual. Hasil penelitian ini: UUD 1945 mengalami kelemahan, terutama pengaturan dalam jaminan, pemenuhan dan perlindungan hak atas pangan yang tidak secara eksplisit diatur. Yang diperkuat dengan fakta-fakta beberapa kasus krisis pangan di Indonesia memberikan justifikasi bahwa eksistensi hak atas pangan urgen dimuat dalam Amandemen UUD 1945 Kelima untuk memperkuat hak atas pangan dalam konstitusi dan amandemen konstitusi juga memberikan jaminan ketersediaan lahan pertanian demi mewujudkan ketahanan pangan. Dalam amandemen tersebut, Penulis menilai memberikan kepastian hukum kepada warga negara agar haknya di bidang pangan lebih terjamin. Sehingga bisa dikatakan bahwa UUD 1945 adalah Konstitusi Pangan.

Abstract

Pemilihan Umum (PEMILU) 2024 diramalkan masih akan kental dengan polarisasi politik yang tidak kunjung usai sejak Pemilihan Presiden dan Wakil Presiden tahun 2014 lalu antara masyarakat pendukung Joko Widodo (Jokowi) yang diusung Partai Demokrasi Indonesia Perjuangan (PDI-P) melawan Prabowo Subianto yang diusung oleh Partai Gerakan Indonesia Raya (GERINDRA). Tren polarisasi itu berlanjut pada pemilihan Gubernur DKI Jakarta pada tahun 2017 yakni kelompok yang pro-Joko Widodo dan pro- Basuki Cahaya Purnama dengan kelompok yang anti-Joko Widodo dan anti-Basuki Cahaya Purnama serta berlanjut dalam Pemilihan Presiden dan Wakil Presiden tahun 2019 yang pada saat itu polarisasi politik memuncak dan membelah masyarakat namun mereda sejak kontestan yang berlaga masuk dalam satu Pemerintahan dalam Kabinet Indonesia Maju, tapi memang masih menyisakan polarisasi politik yang dikhawatirkan dapat meledak kembali pada Pemilihan Umum (PEMILU) 2024. Metode penelitian yang digunakan adalah metode hukum normatif yaitu berupa penelitian kepustakaan (library research) yang dilakukan dengan mengumpulkan bahan hukum baik primer, sekunder dan atau tersier. Teknik dalam pengumpulan bahan yang dilakukan pada penelitian ini adalah studi kepustakaan. Bahan-bahan yang telah terkumpul dianalisis secara kualitatif dan untuk melakukan klasifikasi bahan-bahan hukum, penulis menggunakan analisis isi (content analysis). Hasil dari penelitian ini bahwa polarisasi politik menjelang Pemilihan Umum (PEMILU) 2024 berpeluang besar terjadi dan efeknya sangat tidak baik bagi iklim demokrasi di Indonesia. Menggunakan dan menanamkan nilai-nilai Pancasila adalah salah satu solusi yang bisa digunakan sebagai penyelesaian masalah polarisasi politik di Indonesia.

Abstract

Taḥqīq al-Manāṭ is a method of applying general legal rules to specific contextual cases. The Taḥqīq al-Manāṭ process involves determining the law based on its sharīʿah sources, then examining the case or reality to be faced before applying the law. Thus, Taḥqīq al-Manāṭ is the process of describing cases based on reality. This is because the main key in realizing the law lies in a deep understanding of reality. Therefore, this paper aims to study and introduce Taḥqīq al-Manāṭ as a method of Judicial Review in Islamic law and its potential contribution to constitutional law science. Based on the findings of this study, the Taḥqīq al-Manāṭ method can be adopted by constitutional judges to test laws against the 1945 Constitution. This research recommends applying Taḥqīq al-Manāṭ in constitutional judges' deliberation meetings to prevent decisions that undermine the public interest, and it can be implemented through constitutional conventions.
