Abstract

The government must issue a legal instrument in handling COVID-19 so that as soon as possible the budget reaches Rp.695.2 trillion. But the problem is in every budget implementation, low budget absorption is an undeniable phenomenon and almost always occurs every year both at the Ministry/Institution (K/L) and Regional Levels, including in the context of tackling the COVID-19 pandemic. Answering this problem, it is necessary to know the regulation and dynamics of performance-based budget absorption and the factors that influence it in an emergency for the response to the COVID-19 pandemic and How to Design Government Policies in Accelerating the Use of Covid-19 Countermeasures Funds Based on the Concept of Performance-Based Budgeting. Policy design, namely: (i) increasing the capacity of the financial managers of work units (satker) in preparing plans for withdrawing funds and planning for procurement; (ii) refining regulations, particularly in regards to procedures for revision of yearly budgets which give greater authority to budget users and budget users in completing budget revisions and procedures for issuing multi-year contract permits; (iii) enhancing the role of the internal control apparatus of state ministries / institutions as well as quality control units in each state ministry/institution in monitoring the implementation of activities by each work unit.

Abstract

Pengelolaan sampah dewasa ini masih menjadi problem yang belum terselesaikan. Penelitian ini bertujuan untuk mengkaji permasalahan dalam pengelolaan sampah plastik di Bengkulu guna mendukung Kawasan Wilayah Pesisir. Hasilnya terdapat beberapa peraturan perundang-undangan yang mempunyai korelasi dengan pengelolaan sampah plastik di Indonesia yaitu UU Perlindungan dan Pengelolaan Lingkungan Hidup, UU Pengelolaan Sampah dan beberapa undang-undang lainnya termasuk Jakstrada Kota Bengkulu yang bertujuan menumbuhkan kesadaran bagi masyarakat akan lingkungan hidup yang baik dan sehat di Provinsi Bengkulu. Penelitian ini juga mengemukakan Kebijakan Pengelolaan Sampah Plastik yang ideal untuk mendukung Kawasan Wisata Wilayah Pesisir Provinsi Bengkulu.

Abstract

This research aimed to provide a conceptual idea regarding legal options in resolving disputes of democratic regional head elections in Indonesia with two proposed options. The first option included revising the Election and Regional Election Law to grant authority to the Constitutional Court (MK) and Election Supervisory Agency (Bawaslu) for adjudicating disputes. The second option proposed implementing the Fifth Amendment to the 1945 Constitution to reconstruct the Constitutional Court as an election court correlating with the primary role of upholding regulations. These proposed options would grant the Constitutional Court the authority to examine and adjudicate substantial matters related to the constitutionality of elections. Furthermore, the analysis used normative legal research including statutory, comparative, and conceptual methods.

Abstract

Abstract

Bureaucracy, from a societal perspective, is often perceived as complex, slow, and inefficient. Despite these criticisms, bureaucracy remains a fundamental component of governance and plays a crucial role in societal functioning. As such, bureaucratic reform has been a prominent focus of policy discussions for several decades. A technology-driven government system, coupled with a bottom-up approach, has the potential to enhance efficiency, transparency, and accountability in public administration. However, in practice, such reforms have been largely confined to central government institutions and select agencies. This study aims to explore the integration of technology within the bureaucratic system in Indonesia, with a focus on its comprehensive implementation across government structures. Employing a normative research methodology, the study emphasizes the need for the government to take proactive steps in developing a skilled workforce in information technology. The authors also recommend strategically mapping positions that can integrate technological expertise throughout government departments. Furthermore, the study proposes a comprehensive examination of the potential for replacing executive positions with artificial intelligence (AI) to streamline and simplify bureaucratic processes.  In addition to technological advancements, bureaucratic reform must be accompanied by legal reform, particularly in the areas of data security and the protection of personal information. This includes redefining bureaucratic and personal data categories to ensure robust safeguards. The Personal Data Protection Law should play a pivotal role in integrating these data types and ensuring their protection. Moreover, the Telecommunications Act and the Personal Data Protection Act should foster collaboration between the government and technology companies to develop effective security solutions. Lastly, strengthening the Ombudsman as a public service oversight institution is essential to ensuring transparency and accountability in the implementation of bureaucratic and technological reforms.

Abstract

Researchers at state institutions were forced to leave their positions, including those at the Constitutional Court. Researchers then lose the opportunity to hold the title of research professor. These researchers were also given a new duty, which was to help courts and give Constitutional Justices substantial support. The predicate “assistance" in this rule, which receives no detailed explanation, leads to multiple interpretations and affects the productivity of assistants to expert constitutional judges. Based on this, it is interesting to discuss how the status quo regulates career paths and academic freedom of Constitutional Court researchers in personnel law and how the ideal concept of setting career paths and academic freedom for researchers at the Constitutional Court. This study uses a normative research method, in which its results implicitly suggest a return to the previous rules. The researcher also suggests that the positions of assistant judge and researcher be strictly separated and that opportunities be provided for researchers to hold the title of academic professor. Researchers think BRIN should merge research institutions with the same form and function.

Abstract

Anti-Strategic Lawsuit Against Public Participation (SLAPP) is a provision that provides legal protection to the public who fight for public interests recognisedrecognised in legislation, usually in the environmental field; however, this study examines the projection of Anti-SLAPP for consumer protection. This research is normative legal research with a legislative, case, and conceptual approach, examining legal protection for consumers when submitting reviews on social media by highlighting the freedom of opinion guaranteed by legislation. The results of this study led to a balance of rights to information, and SLAPP was implemented for the benefit of all Indonesian people to foster meaningful participation in consumer protection. This study provides suggestions to Lawmakers on issuing regulations that specifically address Anti-SLAPP. These regulations are important to protect consumers from all threats, especially criminal entanglements, and as a guide for law enforcement officers in handling SLAPP cases in Indonesia. Lawmakers can issue regulations that, in revising the Consumer Protection Law, include anti-SLAPP provisions.

Abstract

This study aims to examine the hierarchy, the meaning of urgent necessity, and the substance of Government Regulations in Lieu of Law (Perppu) from the perspective of emergency constitutional law. This study contributes to efforts to emphasise the importance of regulatory reform regarding the formulation of legislation, which is necessary to: First, clarify the hierarchy of Perppu within the legal system, as it is inappropriate to equate Perppu-as emergency legislation-with Law, which is legislation under normal conditions. Therefore, Perppu need not be included in the legislative hierarchy. Secondly, to clarify the meaning of urgent necessity as a prerequisite for the President to issue a Perppu. Thirdly, to clarify the substantive content of Perppu. This research is a normative legal study employing a juridical, historical, and conceptual approach. The findings indicate that the current regulation of Perppu does not fully reflect the concept of emergency legislation, particularly regarding hierarchy and substantive content. Legal reform is required to strengthen the position of the Perppu as an emergency legislation within Indonesia’s constitutional system, so that its use can be strictly and clearly limited and issued only when the state is in a state of emergency. The recommendations of this study are to reconstruct the hierarchy, clarify the meaning of ‘urgent need’, and define the content of the Perppu so that it meets the requirements of emergency legislation.

Abstract

Study Objective: This study examines how criminal law addresses legal evasion without eroding the principle of legality, and how such responses can protect the interests of vulnerable populations.Method/Approach: This study is a legal research that uses both statute and comparative approaches.  comparing Indonesia's fragmented sectoral regime with Hungary's functional combination of anti-tax-abuse, budget-fraud, welfare-fraud, oversight-responsibility, and asset-oriented enforcement.Novelty: This study uses vulnerability as an analytical criterion for identifying the public interests that suffer disproportionate consequences when complex economic crime diverts public resources or distorts market access.Findings: Indonesia should not criminalize all forms of formal compliance that undermine the purpose of regulation. Such a formula w7ould be uncertain and risk turning legitimate administrative disputes into criminal cases. A more defensible approach is a two-tier model. Administrative anti-abuse measures should address both artificial arrangements and tax or regulatory evasion. Hungary offers a useful comparative lesson because its budget fraud regime consolidates several forms of fiscal fraud while maintaining identifiable behavioral elements.Conclusion: Criminal liability only applies if a scheme includes fraudulent conduct, concealment of material facts, false documentation, fictitious transactions, deliberate avoidance of a predetermined public obligation, and demonstrable fiscal or public interest harm.

Abstract

This study aims to find out how the development of the Curriculum 2013 SIT (Integrated Islamic School), and the typical 8th grade curriculum at SMPIT Al Uswah Bangil. This research is qualitative descriptive field research, the data collection techniques used are interviews, observations, and documentation using Miles and Huberman data analysis techniques, namely data reduction, data presentation, and drawing conclusions. The results showed that curriculum development at SMPIT Al Uswah Bangil was developed in all school curricular activities, namely intracurricular, co-curricular and extracurricular activities. SMPIT Al Uswah Bangil also uses the concept of Islamization of science, and the implementation of evaluation is carried out in the form of curriculum supervision techniques.
