Abstract

In general, Non-Bank Financial Institutions are institutions that provide various financial services, but do not have a license as a commercial bank. In its scope, LKBB includes various institutions such as finance companies, insurance companies, venture capital companies, pawnshops, and other financial entities. The problems in this thesis are: What are the legal consequences of underhand subrogation for the parties in a credit agreement? and How is the settlement of debt through subrogation at PT. BFI Finance Indonesia, Tbk Palembang Branch?. The type of research in this thesis is normative legal research supported by interview data. The conclusion obtained is the Legal Consequences of Underhand Subrogation for the Parties in the Credit Agreement at PT. BFI Finance Indonesia, Tbk Palembang Branch, BFI pays off the debtor's debt and holds or takes the BPKB from the old creditor after that makes a new contract and is notarized. with the new agreement, the previous agreement is no longer valid. Furthermore, a new agreement is made by including clauses regarding the terms, conditions and updates regarding the parties contained in the agreement. Debt Settlement Through Subrogation at PT. BFI Finance Indonesia, Tbk Palembang Branch, the procedure is simple, namely BFI simply pays off the debtor's debt and holds or takes the BPKB from the old creditor after that makes a new contract and is notarized. BFI never performs Subrogation to individual creditors, all of which are legal entities, among which are often carried out by ACC Finance and Sinar Mas Multifinance, the rest are banks because in the past there were not too many financing companies

Abstract

Work agreements in a company must comply with company regulations but company regulations come into effect after being ratified by the Minister of Manpower or an appointed official. The formulation of the problem in this study is 1) What are the legal consequences for parties bound in a work agreement that are not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera?; and 2) What is the legal settlement if a dispute arises due to a work agreement that is not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera? The research method used is normative juridical research method. The data used in this research is secondary data. Based on the results of the study, it shows that 1) The legal consequences for parties bound by a work agreement that are not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera are null and void by law and apply according to the provisions stipulated by. Legislation because the contents of the work agreement must not conflict with applicable company regulations and if there are conflicting provisions; and 2) Legal settlement if a dispute occurs due to a work agreement that is not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera, namely Mediation, Conciliation and Arbitration

Abstract

The world is currently developing rapidly along with technological advances, where existing technological advances are developing rapidly and are needed by society in everyday life. Another form of technological development is the use of social media. This research is a form of empirical method research. Empirical research is based on primary data (results of research in the field). The problem is the factors that influence the application of penal measures in the investigation of perpetrators of online gambling crimes (Case Study LP/A-05 /III / 2023 / SPKT / Satreskrim / Res Mura / South Sumatra in the Musi Rawas Police Legal Area). As a result, the factors that influence the implementation of penal legal measures are legal factors or statutory regulations, law enforcement factors, facilities and infrastructure factors and community factors

Abstract

This study analyzes the effectiveness of Community Counselors in implementing conditional release at the Prabumulih Community Guidance Center (Pos Balai Pemasyarakatan Class IIB), with a focus on factors influencing the reintegration of clients into society. Using an empirical legal approach with a sociological perspective, the research employs qualitative methods, including interviews, observations, and document analysis involving counselors, clients, and related officials. The findings show that Community Counselors play a crucial role in supervising, guiding, and supporting individuals undergoing conditional release. They act as facilitators of reintegration by providing direction, monitoring behavior, and assisting clients in adapting to social life. However, the effectiveness of their role is constrained by several challenges. These include limited human resources, high counselor-to-client ratios, inadequate infrastructure, and persistent social stigma toward former inmates. These conditions reduce the ability of counselors to provide personalized guidance and optimal supervision, which in turn affects the success of the reintegration process. In conclusion, strengthening the role of Community Counselors is essential to improving conditional release outcomes. This can be achieved by increasing the number of counselors, enhancing institutional resources, improving coordination between agencies, and addressing societal stigma to support successful reintegration and reduce recidivism.
