Abstract

Child marriage remains a persistent issue in Indonesia despite the enactment of Law Number 16 of 2019, which sets the minimum marriage age at 19 years. Previous studies have predominantly focused on the legal status of unregistered marriage and child protection issues, while limited attention has been given to the role of isbat nikah in restoring the social status of families involved in underage unregistered marriages. This study aims to analyze the implications of isbat nikah on social reintegration within rural communities, particularly in Banjarsari Village. This research employs a qualitative case study approach, using interviews, observations, and documentation with families who obtained marriage ratification (isbat nikah) decisions and with village officials. The findings reveal that isbat nikah functions not only as a legal mechanism for administrative recognition but also as an instrument of social reintegration. Legal recognition through court decisions reduces social stigma, strengthens community acceptance, and improves access to civil administration and public services. The study highlights the novelty of viewing isbat nikah not merely as a formal legal procedure but as a socio-legal instrument that restores both legal and social status for families affected by child marriage practices.

Abstract

This study examines the Nyambai tradition as a form of cultural ta’āruf among the Saibatin indigenous community of Lampung through the perspective of living fiqh al-munākahāt. Nyambai is a paired traditional dance performed by muli (young women) and mekhanai (young men) that serves as a medium for social interaction, the introduction of potential marriage partners, and an essential element of customary ceremonies, particularly Nayuh wedding rituals. Beyond its aesthetic function, Nyambai embodies social norms and gender ethics that regulate interactions between men and women within the public customary sphere. This qualitative research employs a legal-ethnographic approach, drawing on participant observation, in-depth interviews with customary leaders, performers, and married couples, and documentary analysis of customary texts and fiqh literature. The findings indicate that Nyambai represents a symbolic and regulated form of ta’āruf consistent with key principles of fiqh al-munākahāt, including the protection of honor, proper social conduct, and family formation. The study also highlights ongoing negotiations between customary norms and Islamic legal interpretations.   Abstrak Penelitian ini mengkaji tradisi Nyambai sebagai bentuk budaya ta'āruf di kalangan masyarakat adat Saibatin Lampung melalui perspektif hidup fikih munakahat. Nyambai adalah tarian tradisional berpasangan yang dilakukan oleh muli (wanita muda) dan mekhanai (pria muda), yang berfungsi sebagai media interaksi sosial, pengenalan calon pasangan untuk pernikahan, serta elemen penting dalam upacara adat, terutama dalam ritual pernikahan Nayuh. Di luar fungsi estetikanya, Nyambai mewujudkan norma-norma sosial dan etika gender yang mengatur interaksi antara laki-laki dan perempuan di ranah publik adat. Penelitian kualitatif ini menggunakan pendekatan hukum-etnografi, mengacu pada pengamatan peserta, wawancara mendalam dengan pemimpin adat, pemain, dan pasangan suami istri, serta analisis dokumenter teks adat dan literatur fikih. Temuan ini menunjukkan bahwa Nyambai mewakili bentuk simbolis yang diatur oleh ta'āruf, yang konsisten dengan prinsip-prinsip utama fikih munakahat, termasuk perlindungan kehormatan, perilaku sosial yang tepat, dan pembentukan keluarga. Studi ini juga menyoroti negosiasi yang sedang berlangsung antara norma-norma adat dan interpretasi hukum Islam.

Abstract

This study aims to explain the reform of marriage registration policies in Indonesia and Malaysia. Marriage registration policies in Indonesia and Malaysia have yet to be appropriately implemented. This is proven by the fact that many unregistered marriage practices exist. This study is a literature and field research. Data was collected through documentation and interviews. This study found that the States of Indonesia and Malaysia have issued policies regarding the mandatory registration of marriages. Even so, there are still many unregistered marriages. There are many factors behind the occurrence of unregistered marriages, besides also causing problems. The government needs to reform the marriage registration policy, one of which is through digitalization. The State of Indonesia has innovated marriage registration, namely, online registration of marriages. However, this policy was implemented less effectively below. Meanwhile, the Malaysian state still needs to renew its marriage registration policy. Therefore, in this digital era, it is necessary to have a policy for registering marriages in the direction of complete digitization so that problems can be appropriately resolved.

Abstract

This study aims to analyze how a local living law intervenes with fiqh al-munākaḥāt while turning it into a living practice, either in enforcing or diminishing the ideal concept of the latter. Piil Pesenggiri, a form of local wisdom within the Lampung community, shapes and structures how local Muslim practice their religion in term of wedding and marriage. However, its position aligning with fiqh al-munākaḥāt in solving the daily family problem of local Muslim was not clear enough. This study employs a socio-legal approach using qualitative methods. Data were collected through fieldwork, in-depth interviews with purposively selected informants, customary leaders, religious figures, and married couples across Central Lampung, South Lampung, and Pringsewu. The data were analyzed using the living law framework, specifically how Piil Pesenggiri as a normative ‘inner order’ negotiates with formal fiqh doctrines, which reconstruct the daily practice of Islamic family law. The results show that when it comes to planning weddings and leading a married life, Piil Pesenggiri either upholds or downplays Islamic rule. The way Lampung people implement Islamic law in their families—from the idea of qiwāmah, or family division of labour, to family conflict resolution, to a number of wedding provisions—makes this negotiation very clear.

Abstract

This study examines the dynamics of Islamic marriage law in Indonesia and Thailand through the perspective of Living Fiqh Munakahat, emphasizing how Islamic legal norms are negotiated, adapted, and practiced within diverse socio-political contexts. Rather than framing the issue solely as a legal implementation problem, this research explores the interaction among state law, religious authority, and social practices in shaping marriage institutions. This study employs a library research method, using documentation techniques and qualitative descriptive analysis, and ensures data validity through source triangulation. The findings reveal that Islamic family law operates not merely as a formal legal system but as a living normative framework embedded in everyday social life. In Thailand, where Muslims constitute a minority, Islamic marriage law functions as a flexible and negotiated system, often serving as a mediating tool between the Buddhist-majority state and Muslim religious authorities. Its application remains optional and is geographically limited to the southern provinces of Pattani, Narathiwat, Yala, and Satun, reflecting a localized, community-based legal practice. In contrast, Indonesia institutionalizes Islamic marriage law as a binding legal framework applicable to all Muslims, supported by both formal and material legal provisions. Furthermore, differences in institutional arrangements—such as the absence of specialized Islamic courts in Thailand and the mandatory pre-marital courses enforced through social sanctions—demonstrate how legal norms are shaped by local needs and state structures. From a Living Fiqh Munakahat perspective, these variations indicate that Islamic marriage law is continuously reinterpreted and negotiated, transforming from a static body of norms into a dynamic social practice. This study highlights that the implementation of Islamic marriage law should be understood as an ongoing process of negotiation between text, context, and authority within plural legal systems. Penelitian ini mengkaji dinamika hukum perkawinan Islam di Indonesia dan Thailand melalui perspektif Living Fiqh Munakahat, dengan menekankan bagaimana norma-norma hukum Islam dinegosiasikan, disesuaikan, dan dipraktikkan dalam berbagai konteks sosial-politik yang berbeda. Penelitian ini tidak hanya melihat persoalan tersebut sebagai masalah penerapan hukum semata, tetapi juga mengkaji hubungan antara hukum negara, otoritas agama, dan praktik sosial dalam membentuk lembaga perkawinan. Penelitian ini menggunakan metode studi kepustakaan dengan teknik dokumentasi dan analisis deskriptif kualitatif, serta memastikan keabsahan data melalui triangulasi sumber. Hasil penelitian menunjukkan bahwa hukum keluarga Islam tidak hanya berfungsi sebagai sistem hukum formal, tetapi juga sebagai kerangka nilai yang hidup dan melekat dalam kehidupan sosial sehari-hari. Di Thailand, di mana umat Islam merupakan kelompok minoritas, hukum perkawinan Islam bersifat lebih fleksibel dan hasil negosiasi, serta sering menjadi jembatan antara negara yang mayoritas Buddha dan otoritas keagamaan Islam. Penerapannya bersifat terbatas dan hanya berlaku di empat provinsi selatan, yaitu Pattani, Narathiwat, Yala, dan Satun, sehingga lebih bersifat lokal dan berbasis komunitas. Sebaliknya, di Indonesia, hukum perkawinan Islam dilembagakan sebagai hukum yang mengikat bagi seluruh umat Islam, dengan dukungan aturan hukum formal dan material. Selain itu, terdapat perbedaan kelembagaan, seperti tidak adanya pengadilan agama khusus di Thailand serta adanya kursus pra-nikah yang wajib dan disertai sanksi sosial, yang menunjukkan bahwa hukum dibentuk sesuai kebutuhan lokal dan struktur negara. Dari perspektif Living Fiqh Munakahat, perbedaan ini menunjukkan bahwa hukum perkawinan Islam terus ditafsirkan dan dinegosiasikan, sehingga berubah dari sekadar aturan yang statis menjadi praktik sosial yang dinamis. Penelitian ini menegaskan bahwa pelaksanaan hukum perkawinan Islam harus dipahami sebagai proses negosiasi yang terus berlangsung antara teks, konteks, dan otoritas dalam sistem hukum yang plural.

Abstract

This study examines the development of istinbâṭ al-ahkâm related to the problems of contemporary Islamic family law contained in the Tanwirul Afkar magazine by Ma’had Aly Situbondo. This research is a qualitative research with data analysis using a content analysis approach. As a legal study, this research is included in Normative Islamic Law research by making Islamic legal norms as the object of research. Data were taken from the exploration of Tanwirul Afkar magazine. The results of this study, Ma’had Aly Situbondo carried out the development of istinbâṭ al-ahkâm in order to respond to the problems of Islamic family law so that legal decisions are relevant and in accordance with the demands of modern society today. Istinbâṭ al-ahkâm developed by Ma’had Aly Situbondo with three patterns, first; istinbâṭ al-aḥkâm al-jama’iy bi at-taqsîm, namely collective ijtihâd with division of tasks in tracing the source of legal decisions, second; carrying out scientific integration without being tied to a particular school of thought, and third; the application of ushuli reasoning which makes ushul fiqh, fiqh principles, and maqȃsid al-syarîʿah as tools in analyzing and answering problems. Based on this, Ma’had Aly Situbondo has characteristics or distinctive features in the istinbȃṭ al-aḥkȃm that is developed, namely collective-integrative ijtihâd and the application of ushuli reasoning. Penelitian ini mengkaji pengembangan istinbȃṭ al-aḥkȃm terkait problematika hukum keluarga Islam kontemporer yang terdapat dalam majalah Tanwirul Afkar karya Ma’had Aly Situbondo. Penelitian ini merupakan penelitian kualitatif dengan analisis data menggunakan pendekatan content analysis (kajian isi). Sebagai kajian hukum, penelitian ini termasuk penelitian hukum Islam normatif dengan menjadikan norma-norma hukum Islam sebagai obyek penelitian. Data-data diambil dari eksplorasi majalah Tanwirul Afkar. Hasil penelitian ini, Ma’had Aly Situbondo melakukan pengembangan istinbȃṭ al-ahkȃm dalam rangka merespon problematika hukum keluarga Islam agar putusan hukum relevan dan sesuai dengan tuntutan kehidupan masyarakat modern saat ini. Istinbȃṭ al-aḥkȃm yang dikembangkan Ma’had Aly Situbondo dengan tiga pola, pertama ; istinbȃṭ al-aḥkâm al-jama’iy bi at-taqsîm, yaitu ijtihâd kolektif dengan pembagian tugas dalam pelacakan sumber putusan hukum, kedua; melakukan integrasi keilmuan dengan tidak terikat kepada mazhab tertentu, dan ketiga; penerapan nalar ushuli dimana menjadikan ushul fikih, kaidah fikih, dan maqâsid al-syarîʿah sebagai perangkat dalam menganalisa dan menjawab permasalahan. Dari hal ini, Ma’had Aly Situbondo memiliki karakteristik atau ciri khas dalam istinbâṭ al-aḥkâm yang dikembangkan, yaitu ijtihâd kolektif-integratif dan penerapan nalar ushuli.

Abstract

Dispute resolution in indigenous communities tends to be based on family values. This is evident in the Sebambangan tradition where a man elopes with a girl and marries her as his wife. In these cases, dispute resolution is done through mediation (non-litigation) as it is considered more effective for creating harmonization, avoiding conflict, and justice. This research examines the process of non-litigation dispute resolution, namely mediation, in the tradition. This study is a qualitative study using a socio-legal approach. The study was conducted in the Mergo Sekampung indigenous community in East Lampung. Data were collected through observation and interviews with traditional leaders in five villages. The research findings show that the mediation process in the tradition begins with the male party apologizing for the mistakes made. This process is carried out in deliberation and is accompanied by traditional leaders as mediators. Mediation in Sebambangan is part of the living law that prioritizes kinship in dispute resolution. In positive law, the mediation process in the tradition of the Sekampung Marga community in East Lampung follows the material legal basis in Indonesia as in Article 1338 of the Civil Code and Articles 1851 to 1864 of the Civil Code concerning Peace. Thus, dispute resolution in the Sebambangan tradition makes it an alternative dispute resolution in a conflict carried out with family principles to achieve peace and contribute to legal reform in Indonesia and beyond.

Abstract

The sustainability of household finances has emerged as a critical issue within contemporary Muslim societies, particularly in the Asia-Pacific region, where rapid economic transformation, digital financialization, changing family structures, and increasing living costs have significantly influenced family welfare. This study aims to examine the relationship between Islamic family law and household financial sustainability by analyzing contemporary challenges faced by Muslim families in the Asia-Pacific context. The research specifically explores how Islamic legal principles governing family rights and obligations, wealth management, maintenance (nafaqah), inheritance, and marital economic responsibilities contribute to the creation of sustainable household financial systems. This study employs a qualitative normative approach based on an extensive literature review of scholarly articles, legal documents, policy reports, and contemporary studies related to Islamic family law and family economics. Data were collected from reputable academic databases and analyzed using a thematic-content analysis framework to identify major patterns, emerging challenges, and legal responses across selected Asia-Pacific countries. The findings reveal that household financial sustainability is increasingly challenged by economic uncertainty, dual-income family dynamics, digital consumerism, rising household debt, gender role transformations, and disparities in financial literacy. The study demonstrates that Islamic family law provides a comprehensive framework for promoting financial resilience through principles of justice, shared responsibility, wealth preservation (hifz al-mal), balanced consumption, and intergenerational economic protection. However, the implementation of these principles often faces institutional, socio-cultural, and regulatory constraints within contemporary societies. The analysis further indicates that integrating Islamic legal values with modern financial governance and family welfare policies can strengthen household economic stability and social well-being. This study contributes to the growing discourse on Islamic family law by connecting classical legal doctrines with contemporary household financial sustainability challenges. It offers a multidisciplinary perspective that enriches discussions on family welfare, Islamic economics, and socio-legal reform, particularly within the diverse and rapidly evolving Asia-Pacific region.
