Abstract

The Constitutional Court provides the widest possible opportunity for the entire community to make optimal use of the existence of the Constitutional Court in the constitutional system. By developing the procedural process in a better direction, which is carried out in a modern, fast, simple and cost-free manner, which is related to trial management, case time and simple procedures in submitting and examining applications. The purpose of this research is to analyze the authority of the Constitutional Court in resolving election disputes based on Indonesian positive law. The method used is normative legal research. Based on the research results, it is known that the Authority of the Constitutional Court in Resolving Election Disputes Based on Indonesian Positive Law is that the General Election Commission is one of the state institutions that is given the authority by law to form its own legal products of statutory regulations, namely in the form of General Election Commission Regulations. Seeing that its position is actually outside the hierarchy of statutory regulations, the position of the General Election Commission Regulation in the legal system in Indonesia automatically becomes very abstract because the material content contained in the General Election Commission Regulation does not fully apply to all parties and the legal force of the Commission Regulation General Elections only apply in the implementation of Regional Head Elections and General Elections so that their binding force cannot apply fully in general. The basic reasons that became the reference for why the authority for regional election disputes was finally transferred from the Supreme Court to the Constitutional Court were, firstly, seeing that the regional elections were basically included as an election regime, so that disputes over election results had to be resolved at the Constitutional Court in accordance with the 1945 Constitution. Second, this was contained in the 1945 Constitution Article 24 C paragraph 1 states that the Constitutional Court is an institution that has the authority to adjudicate at the first and last level whose decisions are final.

Abstract

Berdasarkan Pasal 169 ayat (1) Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan diatur bahwa pengemudi dan/atau perusahaan angkutan umum barang wajib mematuhi ketentuan mengenai tata cara pemuatan, daya angkut, dimensi kendaraan, dan kelas jalan. Penelitian ini bertujuan untuk menjelaskan penegakan hukum terhadap pelanggarankendaraan angkutan barang di Kota Pekanbaru berdasarkan Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. Hasil penelitian menjelaskan bahwa penegakan hukum terhadap pelanggaran kendaraan angkutan barang di Kota Pekanbaru belum berjalan optimal.Hambatan dari sisi aparatur penegak hukum adalah kurangnya koordinasi lintas sektoral antara Dinas Perhubungan Kota Pekanbaru dengan Satlantas Polresta Pekanbaru, kendaraan angkutan barang sebagian besar melintas di Kota Pekanbaru dari malam hingga dini hari, serta ringannya sanksi pidana yang diatur dalam Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Upaya yang dapat dilakukan oleh Dinas Perhubungan Kota adalah menjalin kerja sama dengan Satlantas Polresta Pekanbaru, meningkatkan pengawasan terhadap kendaraan angkutan barang, serta mengusulkan agar Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan direvisi.

Abstract

From the perspective of legal certainty, inconsistency in the regulation of the return of corruption proceeds can create uncertainty in the implementation of the law and the legal process in general. Inconsistency or inconsistency between these three regulations can create confusion in the legal process related to the return of corruption proceeds. Legal certainty is an important principle in the legal system that demands consistency and clarity in the applicable regulations. Therefore, there needs to be an effort to formulate more consistent and comprehensive regulations regarding the return of corruption proceeds to ensure better legal certainty. The purpose of this study is to analyze the legal inconsistency of the regulation of the return of corruption proceeds from the perspective of legal certainty and to analyze the legal consequences of the inconsistency of the regulation of the return of corruption proceeds from the perspective of legal certainty. The method used is normative legal research. Based on the results of the study, it is known that the Inconsistency of the Law on the Return of Corruption Proceeds from the Perspective of Legal Certainty is that the Indonesian legal system is weak in guaranteeing legal certainty. Multi-interpretable legal provisions, the absence of standard asset return mechanisms, and inconsistent judicial practices create confusion in implementation.

Abstract

This study examines the inclusion of indigenous peoples in village autonomy policies following the enactment of the Village Law (Law No. 6 of 2014). Although the law promotes decentralization and cultural recognition, its implementation remains primarily administrative, neglecting the socio-cultural realities of indigenous communities. Only a small percentage of indigenous villages are officially recognized. At the same time, structural marginalization persists due to unequal access to resources, limited political representation, and the supremacy of national law over customary law. Using a normative legal approach, this study examines the gap between legal norms and empirical practices, drawing on primary legal materials and secondary sources, including government regulations, forestry and mining laws, research findings, and case reports. The findings suggest that the Village Law's failure lies not only in bureaucratic issues but also in the absence of structural justice and legal pluralism in policy design. Procedural and uniform autonomy fails to reflect local indigenous contexts, rendering legal recognition largely symbolic. Therefore, a shift toward substantive independence is essential, grounded in recognition, subsidiarity, and legal pluralism. This approach requires harmonization of sectoral regulations, empowerment of indigenous institutions, and fiscal reform, offering a transformative path toward more just, participatory, and inclusive village governance.

Abstract

Pasal 2 ayat (1) Undang–Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang Jo. Pasal 296 Kitab Undang-Undang Hukum Pidana, mengatur adanya sanksi terhadap pelaku perdagangan orang. Tujuan penelitian ialah menganalisis penegakan hukum terhadap pelaku kejahatan seksual dalam aplikasi Michat di wilayah hukum Polda Riau berdasarkan regulasi itu; Untuk menganalisis hambatan dan upaya mengatasi hambatan dalam penegakan hukum tersebut. Metode penelitiaan yaitu penelitian hukum sosiologis, pendekatan perundang–undangan, kasus dan analitis; lokasi penelitian yaitu Polda Riau; populasi dan sampel dari narasumber–narasumber relevan; sumber data ialah primer, sekunder dan tersier; teknik pengumpulan data ialah observasi, wawancara terstruktur dan studi dokumen/kepustakaan; analisis datanya kualitatif dengan kesimpulan: induktif. Hasil penelitian yaitu penegakan hukumnya di wilayah hukum Polda Riau belum terlaksana dengan baik. Kesimpulannya yaitu Pertama, penegakan hukum terrhadap pelaku kejahatan seksual dalam aplikasi Michat di wilayah hukum Polda Riau berdasarkan regulasi itu belum terlaksana dengan baik disebabkan terhadap kasus yang terjadi tahun 2021 sampai 2023 masih terjadi hambatan penegakan hukum. Kedua, hambatan penegakan hukumnya ialah Faktor perundang-undangan, upaya mengatasi hambatan ini ialah melakukan usulan perubahan Undang–Undang Nomor 21 Tahun 2007 tentang Pemberantasan TPPO supaya juga diatur larangan dan sanksi bagi PSK dan para pengguna jasa layanannya. Faktor aparat penegak hukum, upaya mengatasi hambatan ini ialah menambah jumlah anggota Unit ini; dilaksanakan Dikjur bagi penyidik Unit TPPO Dit Reskrium Polda Riau. Faktor sarana/fasilitas upaya mengatasi hambatan ini ialah mengajukan kenaikan jumlah anggaran; pemerintah memblokir aplikasi ini. Faktor masyarakat, upaya mengatasi hambatan ini ialah Dit Reskrimum Polda Riau melakukan kerjasama dengan tempat-tempat tersebut; pelaku kooperatif, menyerahkan diri serta mengikuti proses hukum; upaya mengatasi hambatan ini ialah Polda Riau melakukan sosialisasi hukum kepada masyarakat.

Abstract

Qualified Theft refers to theft committed under certain circumstances or using specific methods that make the crime more severe, and therefore subject to harsher penalties than ordinary theft. This involves two or more individuals collaborating in the act of theft, such as jointly taking possessions. The purpose of this research is to analyze the Implementation of Law Enforcement Against the Crime of Qualified Theft in the Jurisdiction of Pekanbaru, to examine the obstacles in its enforcement, and to explore efforts to overcome those obstacles. The method used is sociological legal research. Based on the findings, law enforcement against the crime of qualified theft in Pekanbaru has not been optimally implemented. This is evident from the continued prevalence of aggravated theft cases, such as motorcycle theft, house and business burglaries, and theft from public facilities—often occurring repeatedly and in close timeframes. The high frequency of such crimes reflects a gap between legal enforcement efforts and the reality of criminal activity in the field. Obstacles to effective law enforcement include: Limited human resources compared to the volume of incoming reports each day, The socio-economic background of offenders—typically from lower-income groups with limited education, A lack of strong evidence and minimal technological support in the evidence-gathering process, Social interference from the perpetrator’s environment, including familial pressure on victims to withdraw their reports. Efforts to overcome these challenges involve: Improving the quality of investigations by strengthening human resources and applying digital technology, Enhancing police-community partnerships through initiatives like neighborhood-based police officers, legal education, and community empowerment via communication and coordination forums (FKPM), Optimizing cross-functional coordination and expediting case handling based on the principles of professionalism and proportionality, Reinforcing scientific investigation techniques such as detailed crime scene processing, forensic evidence collection, and utilizing CCTV footage and digital forensics as supporting evidence.

Abstract

The objective of this research is to analyze the Juridical Analysis of the Application of the Element of Exceeding Environmental Quality Standards in Judges’ Decisions on Land Fire Cases, and to examine the legal consequences arising from such application. The method used is normative legal research. Based on the research findings, it is known that the juridical analysis of the application of the element of exceeding environmental quality standards in judicial decisions on land fire cases shows that this element plays a central role in proving the occurrence of environmental pollution or damage. Environmental quality standards serve as objective benchmarks established through regulation to determine whether the environmental condition remains within acceptable limits or has been polluted. In land fire cases, the exceedance of air, soil, or water quality standards becomes strong evidence that an environmental law violation has occurred. However, in judicial practice, the application of this element remains suboptimal. Many court decisions have not used scientific test results related to environmental quality standards as a primary legal consideration. This is due to several factors, including the limited technical capacity of law enforcement officers, weak scientific evidence presented by investigators and prosecutors, and the lack of judges' understanding of technical aspects in environmental law. As a result, many perpetrators of land fires, particularly corporations, are not held fully accountable under the law. Legal consequences of applying the element of exceeding environmental quality standards in judicial decisions on land fire cases include criminal sanctions, the application of the strict liability principle, obligations for compensation and environmental restoration, and administrative sanctions such as revocation of business licenses or suspension of activities

Abstract

The police disciplinary code reflects a noble ideal and aspiration—namely, to uphold and maintain the image of the Indonesian National Police (Polri) as a noble profession (officium nobile). Every member of the police force is expected to preserve their dignity and honor as individuals entrusted by society to maintain public order and security, to enforce the law in times of legal conflict, and ultimately, to offer protection and guidance to the community. This study aims to analyze the enforcement of the Police Professional Code of Ethics in response to cases of desertion by police officers that result in dishonorable discharge within the jurisdiction of the Riau Regional Police (Polda Riau). Specifically, the study examines the legal enforcement process, the barriers faced, and the efforts made to overcome those obstacles. This research employs a sociological legal approach. The findings reveal that enforcement of the Police Code of Ethics in desertion cases that end in dishonorable discharge is carried out firmly in accordance with Chief of Police Regulation Number 7 of 2022 on the Police Code of Ethics. Each proven case of severe desertion leads directly to an ethics tribunal, where—if found guilty—the officer is sanctioned with dishonorable discharge. The process begins with attendance verification, clarification, and the preparation of documents for the ethics hearing. This firm stance reflects the professionalism and institutional commitment of Polri. However, it also highlights a lack of preventive and developmental approaches, particularly in the early stages before violations occur. The main barriers in enforcing the code include: (1) systemic weaknesses in attendance reporting, where desertion cases are often detected too late due to unmonitored absenteeism; (2) organizational structural issues, where the guidance and mentoring functions remain reactive rather than proactive; and (3) organizational cultural tendencies to treat violations solely as grounds for punishment, without addressing underlying causes such as psychological stress, family problems, or work fatigue. Efforts to overcome these challenges include: (1) digitalizing the attendance and reporting systems to enable real-time monitoring; (2) strengthening moral and mental development, especially for personnel in remote or high-stress areas; (3) establishing internal preventive support systems, such as communication forums, counseling services, and informal coaching activities; (4) introducing tiered sanction policies, with dishonorable discharge reserved for repeated or severely intentional desertion; and (5) reforming organizational culture to foster more open, communicative, and supportive interactions between superiors and subordinates.

Abstract

Penegakan hukum terhadap penjualan pupuk tidak terdaftar di Kabupaten Kampar berdasarkan Undang-Undang Nomor 22 Tahun 2019 tentang Sistem Budidaya Pertanian Berkelanjutan adalah belum berjalan dengan baik sesuai peraturan yang ada karena tindakan oknum penegak hukum dalam hal ini kepolisian sebagai garda terdepan dalam pelaksanaan penegakan hukum turut serta mengambil keuntungan dengan cara membeking praktek ilegal tersebut agar berjalan lancar dan tak tersentuh hukum, serta kurangnya laporan laporan dari masyarakat juga memperburuk situasi bahwa petani dan konsumen yang mengetahui praktik penjualan pupuk tidak terdaftar namun enggan untuk melaporkan hal tersebut kepada pihak berwajib.

Abstract

Tulisan ini bertujuan untuk menganalisis implementasi pemberhentian PNS terpidana kasus korupsi berdasarkan Undang - Undang Nomor 5 Tahun 2014 tentang Pegawai Negeri Sipil di Kabupaten Rokan Hilir. Tulisan ini merujuk pada Teori Negara Hukum, Teori Pertanggungjawaban Hukum dan Teori Kepastian Hukum. Populasi dan sampel berasal dari narasumber–narasumber yang relevan dengan penelitian. Sumber data yang digunakan adalah primer, sekunder dan tersier; teknik pengumpulan data: observasi, wawancara terstruktur dan studi dokumen (kepustakaan). Hasil penelitian diketahui bahwa implementasi pemberhentian PNS terpidana kasus korupsi berdasarkan Undang - Undang Nomor 5 Tahun 2014 tentang Pegawai Negeri Sipil di Kabupaten Rokan Hilir belum berjalan sebagaimana mestinya. Hal tersebut ditunjukkan dengan masih adanya 2 Pegawai Negeri Sipil di lingkungan pemerintahan daerah Kabupaten Rokan Hilir terpidana tindak pidana korupsi berdasarkan putusan Pengadilan Negeri Pekanbaru berkekuatan hukum tetap yang belum diberikan sanksi Pemberhentian Tidak Dengan Hormat
