Abstract

Cellular agriculture is a nascent manufacturing technology that holds significant potential to strengthen global food security. Globally, the number of food manufacturing companies producing food using cellular agriculture is rapidly increasing. Products of cellular agriculture are also available for consumers in the marketplace.  Hence, the objective of this study is to analyse the extent to which the food regulatory framework in Malaysia and Indonesia is ready to promote and regulate products and activities of cellular agriculture. The analysis is essential as cellular agriculture poses opportunities and regulatory challenges. Despite the benefits, it also poses potential safety and health risks to the consumers, owing to its novelty. This study adopts a doctrinal legal analysis by analysing the adequacy of the current food regulatory framework, i.e., national food policies and legislation in Malaysia and Indonesia. It is found that cellular agriculture is not part of the national food policy and food regulatory framework in Malaysia and Indonesia. Both jurisdictions are lacking regulatory preparedness to embrace the presence of products of cellular agriculture in the marketplace. Hence, there is a need to reform the current food regulatory framework. Such reform includes the formulation of national policy for cellular agriculture to promote the adoption of cellular agriculture in food manufacturing. The current food safety legislation also needs to be amended to incorporate the provisions to regulate the safety aspects.

Abstract

Abstract: Payment of Replacement Money may exceed the threat of principal criminal fines, because it depends on the amount of corruption proceeds in each corruption case. This study discusses the problem, the position of additional criminal penalties of payment of replacement money against principal penalties in corruption crimes, the application of criminal penalties of payment of replacement money in the verdict of the corruption court judge No. 27 / Pid.Sus-TPK / 2018 / PN.Amb jo. No. 3 / PID.SUS-TPK / 2019 / PT AMB and No. 44 / Pid.Sus-TPK / 2018 / PN.Kdi jo. No. 9 / PID.SUS-TPK / 2018 / PT KDI and the demands for imposing replacement money are carried out by the public prosecutor in corruption cases in order to comply with the objectives of the law. This research method uses a normative legal research type with a descriptive research nature with a statute approach, a conceptual approach, and a case approach. Sources include primary, secondary and tertiary legal materials. The data collection technique is library research with a data collection tool, namely document research, then analyzed using qualitative data analysis. It is recommended that additional criminal penalties of replacement money be placed firmly as the main instrument in recovering state losses in corruption crimes, by ensuring that its implementation is in accordance with applicable provisions. Keywords: Claims, Compensation, Corruption Crimes. Abstrak: Pembayaran Uang Pengganti dapat saja melebihi ancaman pidana pokok denda, sebab hal itu secara kasuistis tergantung pada jumlah hasil korupsi pada tiap kasus korupsi. Penelitian ini membahas permasalahan, kedudukan pidana tambahan pembayaran uang pengganti terhadap pidana pokok dalam tindak pidana korupsi, penerapan pidana pembayaran uang pengganti dalam putusan hakim pengadilan tindak pidana korupsi No. 27/Pid.Sus-TPK/2018/ PN.Amb jo. No. 3/PID.SUS-TPK /2019/PT AMB dan No. 44/Pid.Sus-TPK/2018/PN.Kdi jo. No. 9/PID.SUS-TPK/2018/PT KDI dan tuntutan pembebanan uang pengganti dilakukan oleh jaksa penuntut umum dalam perkara tindak pidana korupsi agar sesuai dengan tujuan hukum. Metode Penelitian ini mengunakan jenis penelitian hukum normatif dengan sifat penelitian deskriptif dengan pendekatan penelitian perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan kasus (case approach). Sumber meliputi bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data adalah studi kepustakaan (library research) dengan alat pengumpulan data yaitu studi dokumen (documentary research), selanjutnya dianalisis menggunakan analisis data kualitatif. Disarankan agar pidana tambahan uang pengganti ditempatkan secara tegas sebagai instrumen utama dalam pemulihan kerugian negara dalam tindak pidana korupsi, dengan memastikan implementasinya sesuai dengan ketentuan yang berlaku. Kata kunci: Tuntutan, Uang Pengganti, Tindak Pidana Korupsi.

Abstract

Abstract: Illegal, Unreported, and Unregulated Fishing (IUU Fishing) is one of the fisheries-related crimes that threatens the sustainability of marine resources, causes significant economic losses to the state, and undermines Indonesia's maritime sovereignty. The North Natuna Sea Exclusive Economic Zone (EEZ) is particularly vulnerable to such practices due to its abundant fishery resources and strategic geographical location. This study aims to analyze the national legal framework governing the prevention and eradication of IUU Fishing in the North Natuna Sea EEZ, identify the challenges faced by Indonesia in combating such activities, and examine the role of national and international law in promoting marine environmental sustainability. This research employs a normative juridical method with a descriptive-analytical approach. The data used consist of secondary data obtained through library research on primary, secondary, and tertiary legal materials related to international maritime law and national fisheries law. The data were analyzed qualitatively through the examination of legislation and relevant legal literature. The results indicate that Indonesia has established a relatively comprehensive legal framework for combating IUU Fishing through various laws and regulations that incorporate principles of international law. The synergy between national legal instruments and the provisions of UNCLOS 1982 plays a crucial role in strengthening law enforcement, protecting fishery resources, safeguarding national sovereignty, and supporting the sustainability of the marine environment. Keywords: IUU Fishing, Exclusive Economic Zone, Marine Environmental Sustainability   Abstrak: Illegal, Unreported, and Unregulated Fishing (IUU Fishing) merupakan salah satu bentuk kejahatan perikanan yang mengancam keberlanjutan sumber daya laut, menimbulkan kerugian ekonomi negara, serta mengganggu kedaulatan wilayah perairan Indonesia. Zona Ekonomi Eksklusif (ZEE) Laut Natuna Utara menjadi kawasan yang rentan terhadap praktik tersebut karena memiliki potensi sumber daya perikanan yang besar dan posisi strategis. Penelitian ini bertujuan untuk menganalisis pengaturan hukum nasional terkait penanggulangan IUU Fishing di ZEE Laut Natuna Utara, mengidentifikasi kendala yang dihadapi Indonesia, serta mengkaji peran hukum nasional dan internasional dalam mewujudkan keberlanjutan lingkungan laut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif analitis. Data yang digunakan berupa data sekunder yang diperoleh melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier yang berkaitan dengan hukum laut internasional dan hukum perikanan nasional. Analisis dilakukan secara kualitatif melalui penelaahan peraturan perundang-undangan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa Indonesia telah memiliki landasan hukum yang cukup komprehensif dalam penanggulangan IUU Fishing melalui berbagai peraturan perundang-undangan yang mengadopsi prinsip-prinsip hukum internasional. Sinergi antara hukum nasional dan ketentuan UNCLOS 1982 berperan penting dalam memperkuat penegakan hukum, melindungi sumber daya perikanan, menjaga kedaulatan negara, serta mendukung keberlanjutan lingkungan laut. Abstract

The formation of a holdingholding to restructure the state-owned plantation industry cannot be separated from the government's ability to control the country's economic engine. Government Regulations Number 72 of 2014 and Number 72 of 2016 which were passed as legalizing the formation of BUMN holdingholding s have sparked controversy and public debate. The fundamental issue of this procedure is the Parent Company's legal obligation to manage the Parent Company. In the relationship between parent companies and subsidiaries, the concept of limited liability presents its own problems. In addition, there is uncertainty regarding legal obligations to third parties. The research methodology is normative law which is supported and obtained from literature data. The findings of this study indicate that the use of the BUMN Law and Limited Liability Company Law as guidelines for managing Plantation BUMNs does not provide the business confidence that Plantation BUMNs need to grow and stay healthy. Considering that the business world continues to develop and the high need for group company management among business actors who carry out business development and expansion, adjustments to these two regulations are very important. The modern business paradigm has resulted in the consolidation of centralized operations in a way that drives growth. As a result, the formation of a holding companyholding company by the government is inappropriate if it is not preceded by changes to the Limited Liability Company Law which provides business certainty for established Plantation BUMNs.
