Abstract

Waste management is a strategic issue in preserving the environment, especially amid increasing waste volumes due to urbanisation and changes in people's lifestyles. The main problem that arises is the low level of public awareness of the law in sorting, processing and disposing of waste in accordance with applicable regulations. This independent community service activity by lecturers at Puri Zahara 2, Simpang Selayang Village, Medan Tuntungan Subdistrict, aims to increase public understanding of the importance of waste management in accordance with environmental law principles, particularly those stipulated in Law No. 18 of 2008 concerning Waste Management and its derivative regulations. The methods used were legal counseling, training in 3R (Reduce, Reuse, Recycle) waste management, and assistance in forming environmental law awareness groups. The results of the activity showed an increase in community knowledge and active participation in implementing environmentally friendly and legally-minded waste management practices, through the establishment of a Waste Bank in the Puri Zahara II Complex, Simpang Selayang Village, Medan Tuntungan District. Thus, this community service not only had an impact on reducing waste volume, but also built a legal culture that supports environmental sustainability.

Abstract

Indonesia bears interest in the Malacca strait as one of its stakeholders in its effort on maritime navigational safety and environment in navigational safety and environment. Its efforts are fundamental in controlling, preventing, and recovering pollution from vessels. Referring to the United Nations Convention on Law of the Sea (UNCLOS) 1982, Indonesian contribution to controlling marine life pollution is vital. Therefore, Indonesia signed a tripartite agreement with Malaysia and Singapore (Agreement on Safety of Navigation in the Straits of Malacca and Singapore 1977). The Tripartite Agreement needs to be used as a reference in making regulations in Indonesia and implemented as a proof of Indonesia's compliance with the Tripartite Agreement. Therefore, the purpose of this research is to understand Indonesia's conformity to the mentioned agreement in controlling marine environment pollution in the Strait of Malacca. It utilizes literature and case studies such as books, notes, and previous research. The theory that we use is the compliance theory and combined theory for elaborating the obedience of Indonesia to the agreement itself. It can be concluded that Indonesia has complied with the Tripartite Agreement by putting together various laws and regulations and other regulations and forming a structure to protect the sea. However, in practice, it still requires some improvement.

Abstract

The COVID-19 pandemic is very risky and requires quick action and policy-making for the safety of all. For this reason, the government has taken a policy related to using specific budget allocations by facilitating the procurement process of goods and services to prevent and handle COVID-19. Still, in the process, many acts have occurred that are detrimental to state finances. The method used in this thesis is the normative legal research method, which refers to legal norms with data sources obtained by examining library materials to obtain secondary data in the form of primary, secondary, and tertiary materials. The study results found that in the two decisions studied, the judges had carefully considered the legal facts in the trial but still had different interpretations regarding the element of "Unlawfully" in the Corruption Law. Several factors cause the provisions of Article 2 paragraph 2 of the Corruption Law not to be applied to perpetrators of corruption during the pandemic, namely from the Public Prosecutor, Panel of Examining Judges, and the applicable regulations. Criminal policy in overcoming corruption in the relationship between business actors and procurement officials is carried out in two ways: non-penal policy by increasing supervision. In contrast, penal policy has been carried out by making changes to the Corruption Crime Law. It is hoped that the Examining Judge can have uniformity in interpreting Article 2 and Article 3 of the Corruption Crime Law so that there is no disparity in punishment for corruption convicts so that no parties feel disappointed by the decisions made.

Abstract

Cases of domestic violence that occur in Indonesia not only result in women as victims, but can also occur in children. The problem formulation in this thesis is: What is the role of the Labuhan Batu District Prosecutor's Office in providing legal protection towards child victims of domestic violence through a Restorative Justice approach; What are the obstacles for the Labuhan Batu District Prosecutor's Office in providing legal protection for child victims of domestic violence through a Restorative Justice approach? The research method used in this journal is the sociological juridical research method. The results of this research can be concluded that restorative justice can be implemented with the following requirements: the threat of a sentence of no more than 5 (five) years, the perpetrator is not a recidivist, there is the victim's consent or desire to make peace, there is good faith from the suspect to fulfill the obligations agreed between the victim and the suspect , and there must be an agreement between the victim, the suspect and other parties

Abstract

Green Procurement constitutes a strategic policy to support sustainable development; however, in practice, its implementation in Indonesia remains largely confined to the tendering stage. In fact, procurement contracts serve as a legal instrument that ensures sustainability is genuinely realized. This article examines the integration of green principles into contracts through performance clauses, life-cycle costing, incentive mechanisms, and enforceable sanctions. The study identifies existing regulatory gaps and weak implementation, while at the same time proposing a contractual framework that is more operational, measurable, and capable of generating tangible impacts on the environment, the economy, and society.

Abstract

Indonesia menerapkan dualisme pengelolaan Sovereign Wealth Fund (SWF) melalui Indonesia Investment Authority (INA) dan Danantara yang memiliki mandat serupa namun orientasi dan struktur kelembagaan berbeda. INA berfungsi sebagai katalis investasi global berbasis skema co-investment, sedangkan Danantara difokuskan pada pengelolaan dan konsolidasi aset strategis nasional. Penelitian ini menganalisis implikasi dualisme SWF di Indonesia, membandingkan tata kelolanya dengan model SWF di Singapura, Norwegia, Uni Emirat Arab, dan Malaysia, serta merumuskan strategi penguatan sinergi kelembagaan. Dengan metode kualitatif melalui studi literatur dan perbandingan kelembagaan, hasil penelitian menunjukkan bahwa dualisme SWF dapat bersifat sinergis apabila didukung pembagian mandat yang jelas, transparansi, dan independensi kelembagaan sebagaimana praktik Temasek Holdings dan GIC di Singapura. Sebaliknya, tata kelola yang lemah berpotensi menimbulkan inefisiensi dan tumpang tindih kebijakan. Oleh karena itu, penguatan prinsip good governance, integrasi nilai ESG, serta akuntabilitas publik menjadi kunci keberhasilan pengelolaan SWF di Indonesia.

praktik perjudian, dari yang awalnya perjudian konvensioal menjadi perjudian online. Indonesia telah berupaya mengatur larangan serta sanksi bagi pelaku perjudian. Akan tetapi, penegakan hukum masih menghadapi kendala, terutama karena karakter kejahatan judi online yang masuk ke kategori kejahatan cyber lintas negara. Penulisan ini menganalisis pertanggungjawaban pelaku judi online serta dampaknya terhadap ketahanan keluarga dengan memadukan pendekatan yuridis normatif dan perspektif sosiologi hukum. Temuan menunjukkan bahwa judi online tidak hanya melanggar ketentuan Hukum Pidana, tetapi bertentangan dengan Undang-Undang ITE. Adapun dampak dari perjudian online juga dapat melemahkan kondisi ekonomi, psikologis, dan sosial keluarga. Oleh karena itu, diperlukan strategi penanggulangan yang lebih komprehensif melalui penguatan pengaturan, literasi digital, dan upaya rehabilitatif bagi korban kecanduan. Kajian ini diharapkan menjadi dasar penguatan kebijakan hukum yang responsif terhadap kejahatan digital.

Abstract

Background: The fulfilment of the right to education for children with disabilities is part of human rights protection that requires an inclusive, non-discriminatory, and accessible education system. Article 24 of the Convention on the Rights of Persons with Disabilities (CRPD) obliges States Parties to guarantee inclusive education through barrier removal, reasonable accommodation, and individualized support. However, Indonesia and Malaysia still face implementation challenges, including limited accessible facilities, insufficient special education teachers, and weak policy enforcement. Methodology: This study uses normative legal research with statutory, conceptual, and comparative approaches. The analysis applies Article 24 CRPD and the AAAQ framework, namely availability, accessibility, acceptability, and adaptability. Objective:  This study aims to analyse inclusive education regulation in Indonesia and Malaysia, assess their compliance with Article 24 CRPD, and formulate legal and policy harmonization measures. Findings: Both countries have recognized the right to education for persons with disabilities, but their compliance remains partial. Indonesia faces fragmented regulation, decentralized implementation, and weak monitoring, while Malaysia still faces challenges in reasonable accommodation, individualized support, and rights-based evaluation. Originality: This study shifts the analysis from descriptive policy comparison to international legal compliance assessment.

Abstract

Frasa “kepala daerah dipilih secara demokratis” sebagaimana diatur dalam Pasal 18 ayat (4) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 telah lama menimbulkan perdebatan interpretatif mengenai desain konstitusional mekanisme pemilihan kepala daerah. Ambiguitas tersebut kembali mengemuka dalam pengujian konstitusional yang berujung pada Putusan Mahkamah Konstitusi Nomor 195/PUU-XXIV/2026, yang menegaskan kembali praktik pemilihan kepala daerah secara langsung oleh rakyat. Penelitian ini bertujuan untuk mengkaji makna konstitusional frasa tersebut serta menganalisis peran Putusan Mahkamah Konstitusi dalam memberikan arah bagi kebijakan legislasi mengenai mekanisme pemilihan kepala daerah. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statutory approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Bahan hukum yang digunakan terdiri atas bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan dan dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa frasa “dipilih secara demokratis” merupakan norma konstitusi yang bersifat terbuka (open-textured constitutional norm), sehingga memberikan ruang kebijakan (open legal policy) kepada pembentuk undang-undang dalam merancang mekanisme pemilihan kepala daerah. Namun demikian, Putusan Mahkamah Konstitusi Nomor 195/PUU-XXIV/2026 menegaskan bahwa ruang kebijakan tersebut tidak bersifat tanpa batas, melainkan harus dijalankan dalam koridor kedaulatan rakyat, demokrasi substantif, dan penafsiran konstitusi yang konsisten sebagaimana berkembang dalam yurisprudensi Mahkamah Konstitusi. Putusan tersebut tidak mengubah norma konstitusi, melainkan memperkuat arah penafsirannya dengan menegaskan bahwa dalam sistem ketatanegaraan Indonesia saat ini, prinsip demokrasi dalam pemilihan kepala daerah diwujudkan melalui mekanisme pemilihan langsung oleh rakyat. Oleh karena itu, putusan tersebut berfungsi sebagai pedoman konstitusional yang membatasi arah pembentukan kebijakan legislasi di masa mendatang mengenai mekanisme pemilihan kepala daerah.

Abstract

Waste management in North Sumatra faces complex challenges encompassing technical, legal, institutional, and community behavior aspects. The increase in waste generation, unbalanced with adequate management capacity, impacts environmental quality and public health, thus requiring a sustainable, collaboration-based approach. This research analyzes the legal framework and policy implementation of waste management in North Sumatra through Stakeholder Analysis, exploring the roles, interests, and authorities of local governments, educational institutions, the private sector, and communities in the waste management system. This normative legal research with a limited empirical approach examines national and regional regulations, provincial and district/city policies, as well as field practices. The findings indicate that the legal substance provides an adequate normative basis, but policy effectiveness is hindered by weak institutional structures, limited infrastructure, and inconsistent law enforcement, which reduce public compliance and participation. Multi-stakeholder synergy serves as the key to enhancing effectiveness through policy innovations, institutional capacity building, and changes in community behavior. Strengthening the waste management model oriented toward source reduction, reuse, and environmentally friendly final disposal requires integration of legal substance, institutional structures, and community legal culture. The success of a clean and sustainable North Sumatra depends on consistent cross-sector collaboration within a framework of shared responsibility.
