Abstract

Paspor merupakan dokumen identitas penting yang digunakan saat bepergian ke luar negeri. Di Indonesia, penerbitan paspor diatur oleh Kementerian Hukum dan Hak Asasi Manusia melalui Kantor Imigrasi. Penelitian ini bertujuan untuk menganalisis penerapan asas equality before the law dalam pelayanan pembuatan paspor same day service di Kantor Imigrasi Kelas I Khusus Medan. Metode penelitian yang digunakan adalah yuridis-normatif dengan pendekatan deskriptif-analitis. Data dikumpulkan melalui studi dokumen dan wawancara dengan pejabat terkait serta masyarakat pemohon paspor. Hasil penelitian menunjukkan bahwa meskipun terdapat kerangka hukum yang jelas dalam penerbitan paspor, pelaksanaan layanan same day service menimbulkan beberapa tantangan, terutama terkait ketidaksetaraan akses akibat biaya tambahan yang cukup tinggi. Rekomendasi perbaikan mencakup pemberian subsidi atau tarif berjenjang, serta peningkatan sosialisasi dan edukasi kepada masyarakat

Abstract

Correctional institutions used to be underestimated as institutions that facilitate the provision of punishments and the suspension of freedom of crime suspects. Of course, this should not happen again because it will decline the Correctional Institution as an institution that plays a role in fostering inmates and making them reborn into good and trustworthy human beings. The objectives of this research include. To find out and analyze the implementation of coaching activities for narcotics recidivist offenders in the Langsa Class IIB Correctional Institution and the obstacles of the Langsa City Class II B Correctional Institution in providing guidance to narcotics inmates who are committed recidivists. The research method used in this study is empirical normative, then the research is descriptive analytical, and uses a legislative and conceptual approach in solving problems. The data sources in this study consist of secondary data and primary data. The results of the study stated that the implementation of coaching activities for recidivist offenders in the Langsa Class IIB Correctional Institution has not been carried out optimally, this is because no special efforts have been made to narcotics inmates and the constraints of the Langsa City Class II B Correctional Institution in providing guidance to recidivist inmates lie in the facilities and infrastructure that are insufficient to carry out optimal coaching.

Abstract

This study aims to determine and analyze the urgency of the principle of equality before the law in criminal law enforcement, to determine and analyze the differences in court decisions on criminal acts of abuse and distribution of pharmaceutical drugs without a permit according to the perspective of the principle of equality before the law, to determine and analyze the enforcement of criminal law in the future by Judges against criminal acts of distribution and abuse of pharmaceutical drugs without a permit in accordance with the principle of equality before the law. The method in this study uses a normative research type and descriptive research nature, with a legislative research approach and a case approach, supported by primary, secondary and tertiary data, as well as data collection tools through literature studies or document methods, which are obtained using qualitative analysis. The results of this study are that the urgency of the principle of equality before the law is, as a basic principle for achieving justice. The difference in sentences imposed by judges is due to the Judge having used a progressive view in sentencing the defendant, which is contained in each Judge's Consideration, and is in accordance with the concept of the principle of equality before the law. Criminal law enforcement in the future by Judges in accordance with the principle of equality before the law is that Judges in court must be able to fulfill what is demanded by justice seekers by continuing to base themselves on justice, certainty and legal benefits and in accordance with the school of natural law, Positivism, Sociological Jurisprudence, American Legal Realism, and Economic Analysis Of Law. Suggestions from the results of this study to law enforcers to consistently apply the principle of equality before the law, to the POM office to be more proactive in carrying out supervision of all drug distribution optimally throughout the region.

Abstract

Tindak pidana yang dilakukan oleh anggota militer, khususnya terkait dengan penjualan amunisi dan senjata api secara ilegal, merupakan pelanggaran serius terhadap hukum nasional dan integritas institusi militer. Permasalahan ini penting untuk ditelaah secara yuridis guna memahami bagaimana kerangka hukum nasional mengatur, menangani, dan memutus kasus serupa. Penelitian ini merumuskan tiga masalah utama, yaitu: pertama, bagaimana peraturan tentang tindak pidana penjualan amunisi senjata api secara ilegal yang dilakukan oleh anggota militer di Indonesia; kedua, bagaimana proses penanganan tindak pidana tersebut; dan ketiga, bagaimana pertimbangan hakim terhadap Putusan Pengadilan Militer III-19 Jayapura Nomor 10-K/PM.III-19/AD/I/2020 dalam kasus penjualan amunisi ilegal oleh anggota Yonif 754/ENK. Metode penelitian yang digunakan adalah metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Sumber data diperoleh dari studi pustaka berupa peraturan perundang-undangan yang relevan, dokumen putusan pengadilan, serta literatur ilmiah lainnya. Penelitian ini berfokus pada analisis terhadap norma hukum positif dan penerapannya dalam kasus konkrit. Temuan dalam peneltian ini menunjukkan bahwa tindak pidana ini diatur dalam Kitab Undang-Undang Hukum Pidana Militer (KUHPM) serta Undang-Undang Darurat Nomor 12 Tahun 1951 tentang Senjata Api dan Amunisi. Proses penanganan perkara mengikuti jalur peradilan militer sebagaimana diatur dalam UndangUndang Nomor 31 Tahun 1997 tentang Peradilan Militer, melibatkan penyidikan oleh Polisi Militer, penuntutan oleh Oditurat Militer, dan pemeriksaan oleh Mahkamah Militer. Dalam pertimbangannya, Majelis Hakim tidak hanya mengkaji unsur-unsur yuridis, tetapi juga memperhatikan aspek filosofis, sosiologis, dan keamanan nasional, sehingga menjatuhkan hukuman pidana penjara seumur hidup dan pemecatan dari dinas militer kepada terdakwa sebagai bentuk penegakan supremasi hukum. Kesimpulan dari penelitian ini adalah bahwa pengaturan hukum terhadap tindak pidana penjualan amunisi secara ilegal oleh anggota militer di Indonesia telah cukup tegas, namun penerapannya masih membutuhkan pengawasan lebih ketat untuk mencegah terjadinya pelanggaran serupa. adapun Saran agar dilakukan penguatan sistem pengawasan internal di tubuh militer, pendidikan hukum yang lebih intensif kepada seluruh anggota, serta komitmen untuk menegakkan hukum secara tegas dan adil tanpa kompromi terhadap pelaku tindak pidana, demi menjaga kehormatan dan kepercayaan terhadap institusi militer.

Abstract

Article 1 point 1 of Law Number 16 of 2004 concerning the Attorney General's Office of the Republic of Indonesia stipulates that the Attorney is a functional official authorized by this law to act as a public prosecutor and implementer of court decisions that have obtained legal force and other authorities based on the law. The Attorney General's Office of the Republic of Indonesia as a state government institution that exercises state power in the field of prosecution must be free from the influence of any party's power, namely carried out independently regardless of the influence of government power and the influence of other powers. The Attorney General's Office as one of the law enforcement institutions is required to play a greater role in upholding the supremacy of law, protecting public interests, upholding human rights and eradicating corruption, collusion and nepotism (KKN).

Abstract

This study discusses the disparity of judges' decisions regarding criminal acts of defamation through social media (Study of Medan District Court Decision Number 2010 / Pid.Sus / 2022 / PN.MDN, and Medan District Court Decision Number 3563 / Pid.Sus / 2019 / PN.MDN. This study uses a normative legal research type. The results of this study are that the legal regulation of this criminal act of defamation is regulated by Law Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning ITE, which is contained in Article 27 paragraph 3 which reads: Every person intentionally and without the right to distribute and / or transmit and / or make accessible Electronic Information and / or Electronic Documents that contain insults and / or defamation. ". As for the two decisions above, there are differences in the judge's decisions where in the first decision the perpetrator of the criminal act of defamation committed through social media is subject to criminal sanctions in accordance with the ITE Law where the perpetrator is subject to a prison sentence of 3 month while the verdict of the two perpetrators of the crime of defamation through social media also but the judge said the verdict was acquitted where the reason the defendant committed his act was because the victim had no intention of paying the debt to the defendant and the victim also cut off communication with the defendant so that the defendant was forced to do his act, and the judge took into consideration in this case that no party was harmed and that comprehensive justice was created.

Abstract

Geoeducation or geoscience education is an important component in efforts to conserve nature and increase environmental awareness in geopark areas. One example of a geopark area in Indonesia is the Toba Caldera and Kenyir Geopark, the area has extraordinary geological value, as well as the potential to be used as an educational facility for school children. The main problem is that partners, especially schools, still view themselves as not being part of the geopark ecosystem. Therefore, community service activities need to be carried out to encourage partners to contribute, synergize, and benefit from the existence of the geopark. The problem statement that used are how is geo-education in the geopark area today, what is the role of schools/educational institutions in providing education in the geopark area, what steps can be taken to implement geo-education. This study uses a qualitative approach with a library research method. The type of literature study used is a narrative review. The implementation of geoeducation in geopark areas is an important strategy in environmental conservation efforts, strengthening local identity, and increasing awareness of the value of geological heritage from an early age. Schools and educational institutions play a central role in realizing contextual and enjoyable geosite-based education. For this reason, structured steps are needed, starting from identifying geosite potential, developing relevant teaching materials, teacher training, curriculum integration, to direct learning activities in the field. The success of geoeducation is also determined by the availability of adequate educational facilities and strong partnerships between geopark managers, government, schools, local communities, and higher education institutions.

Abstract

Katapiang Village faces a high risk of tsunami disaster, given its location on the Indo-Australian and Eurasian plate subduction zones. The majority of Katapiang Village residents depend on the fisheries and agriculture sectors, which makes them vulnerable to the impacts of tsunamis, especially if infrastructure and livelihoods are damaged. Although the government has attempted physical mitigation such as evacuation routes, public and official awareness of the importance of environmental conservation as part of disaster mitigation is still low. One solution offered is an ecosystem-based approach, such as planting mangroves that can function as natural protection against tsunamis. This study aims to examine tsunami disaster mitigation efforts in Katapiang Village, Padang Pariaman Regency, through an eco-action approach and community participation. This study uses a literature study method, with data sources in the form of journals, activity reports, news articles, and documents from local organizations such as JEMARI Sakato and publications from the Regional Disaster Management Agency (BPBD). Eco-action-based mitigation through planting and maintaining mangrove forests is considered potential to strengthen coastal protection against tsunamis, while increasing environmental awareness and economic empowerment of residents. The combination of ecological and participatory approaches is considered relevant and necessary as a locally based adaptive strategy in building the resilience of Nagari Katapiang to disasters.

Abstract

Blue carbon refers to the ability of coastal ecosystems such as mangroves, seagrass meadows and brackish lands to absorb and store large amounts of carbon, making them one of the most effective natural solutions in climate change mitigation. In Indonesia, which has a vast wealth of coastal ecosystems, blue carbon plays an important role not only in maintaining environmental balance, but also in supporting the lives and livelihoods of coastal communities. However, this great potential has not been fully utilized optimally due to various barriers, especially in legal and social aspects. This article aims to examine in depth the role of environmental law in supporting blue carbon management in Indonesia and its impact on coastal communities. The main focus of this study includes tenure issues (land rights and resource access), overlapping and disharmonized regulations between sectors, and low participation of local communities in the process of policy formulation and implementation. Using a normative approach and literature study, this research identifies the need for a clearer, more inclusive, and socially just legal framework for blue carbon ecosystem management. The results of this study are expected to contribute to the formation of policies that are more responsive to environmental sustainability while ensuring the protection of the rights of coastal communities as key stakeholders.

Abstract

Abstract: Payment of Replacement Money may exceed the threat of principal criminal fines, because it depends on the amount of corruption proceeds in each corruption case. This study discusses the problem, the position of additional criminal penalties of payment of replacement money against principal penalties in corruption crimes, the application of criminal penalties of payment of replacement money in the verdict of the corruption court judge No. 27 / Pid.Sus-TPK / 2018 / PN.Amb jo. No. 3 / PID.SUS-TPK / 2019 / PT AMB and No. 44 / Pid.Sus-TPK / 2018 / PN.Kdi jo. No. 9 / PID.SUS-TPK / 2018 / PT KDI and the demands for imposing replacement money are carried out by the public prosecutor in corruption cases in order to comply with the objectives of the law. This research method uses a normative legal research type with a descriptive research nature with a statute approach, a conceptual approach, and a case approach. Sources include primary, secondary and tertiary legal materials. The data collection technique is library research with a data collection tool, namely document research, then analyzed using qualitative data analysis. It is recommended that additional criminal penalties of replacement money be placed firmly as the main instrument in recovering state losses in corruption crimes, by ensuring that its implementation is in accordance with applicable provisions. Keywords: Claims, Compensation, Corruption Crimes. Abstrak: Pembayaran Uang Pengganti dapat saja melebihi ancaman pidana pokok denda, sebab hal itu secara kasuistis tergantung pada jumlah hasil korupsi pada tiap kasus korupsi. Penelitian ini membahas permasalahan, kedudukan pidana tambahan pembayaran uang pengganti terhadap pidana pokok dalam tindak pidana korupsi, penerapan pidana pembayaran uang pengganti dalam putusan hakim pengadilan tindak pidana korupsi No. 27/Pid.Sus-TPK/2018/ PN.Amb jo. No. 3/PID.SUS-TPK /2019/PT AMB dan No. 44/Pid.Sus-TPK/2018/PN.Kdi jo. No. 9/PID.SUS-TPK/2018/PT KDI dan tuntutan pembebanan uang pengganti dilakukan oleh jaksa penuntut umum dalam perkara tindak pidana korupsi agar sesuai dengan tujuan hukum. Metode Penelitian ini mengunakan jenis penelitian hukum normatif dengan sifat penelitian deskriptif dengan pendekatan penelitian perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan kasus (case approach). Sumber meliputi bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data adalah studi kepustakaan (library research) dengan alat pengumpulan data yaitu studi dokumen (documentary research), selanjutnya dianalisis menggunakan analisis data kualitatif. Disarankan agar pidana tambahan uang pengganti ditempatkan secara tegas sebagai instrumen utama dalam pemulihan kerugian negara dalam tindak pidana korupsi, dengan memastikan implementasinya sesuai dengan ketentuan yang berlaku. Kata kunci: Tuntutan, Uang Pengganti, Tindak Pidana Korupsi.
